TOWN BOARD MINUTES
October 13 , 1975
The regular meeting of the Danby Town Board was called to order at
8 : 00P . M . at the Danby Elementary School , Gunderman Road , Town of
Danby , Tompkins County , New York on October 13 , 1975 .
Board members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
Councilman Paul Smith
Justice Floyd Porn
• Justice Milton Todd
Others present : Peter Goodman , Joe Short , Edward Slights , Mary
Casterline , Roy Casterline , Joseph Hulbert , Ernest Cole , Albert
Sebesta , WTKO - Bob Lynch and Ithaca Journal reporter Rick Jenson .
Supervisor A . Francis Wright made the motion to approve the minutes
of the September 8 , 1975 meeting as presented . The motion was
seconded by Councilman Paul Smith and carried by a vote of five
ayes and no noes .
COMMUNICATIONS :
1 . A letter from the State Senate and Assembly Committee on
Local Governments advising of public hearings .
2 . A notice of a Fall Planning Conference focusing on the
nuclear energy plant issue .
3 . Agenda of the Tompkins County Board of Representatives
meeting of September 22 , 1975
4 . A summary of the County Sewer Agency meeting of September
25 , 1975 .
5 . A letter from Harold Bernhardt submitting his resignation
as town constable for the Town of Danby .
6 . A letter from the Attorney General State of New York
advising of new enviromental legislation and its
affect on towns.
7 . A letter from the Ad Hoc Committee on Youth and Recreational
Services asking for decisions on recommendations .
8 . A letter from the Tompkins County Board of Representatives
inviting the town to attend an open meeting October 15 , 1975 .
9 . A letter from Harris Dates of the Tompkins County Board of
Representatives concerning the Draft Comprehensive Sewerage
Study .
. 10 . A copy of the testimony of Congressman Matthew McHugh on
the extension of revenue sharing .
11 . Agenda of the Tompkins County Board of Representatives
meeting of October 13 , 1975 .

PRIVILEGE OF THE FLOOR :
Peter Goodman , an employee from the office for the aging , attended
the meeting to make people aware that his office exists and told
of their objectives . Information about the office was mailed to
the town board members .
Alfred Sebesta mentioned that he would like to see the 45MPH
speed limit through Danby extended one -half mile further south
on Route 96B .
COMMITTEE REPORTS :
A . Highway Report - Councilman Ralph Wilbur reported that there
was an accident with one of the town trucks . No one else
rt was involved . Fenders and some sheet metal were bent but no
one was hurt . Highway Superintendent Joseph Hulbert reported
that the road crew has been cleaning ditches and patching .
B . West Danby Water District - Roy Casterline asked that the
meeting with Gary Lee be set up . October 21 , 1975 there
will be a meeting at the supervisor ' s home to discuss
figures .
C . Insurance - No report .
D . Refuse Collection & Disposal - No report .
E . Youth - Councilman Paul Smith reported that he the town attorney
and the Finger Lakes Parks people went over the contract for the
pond permit . Changes have been made by the attorney and he will
send the revised contract to the Town Board for their approval .
. F . Zoning and Planning - Justice Floyd Dorn mentioned that the
D ' Ambrose case will be heard in Justice Court . It has been
postponed several times but is now scheduled for the 21st of
October . Justice Milton Todd reported that the Bell violations
in West Danby are being taken care of . Bids will be accepted
to clean up the property and the cost will be added to the
property taxes .
G . Fire - The budget has not been received yet .
H . Cemetaries - All cleaned up ready for winter .
I . Building Committee Report - The committee held a meeting
October 1 , 1975 with architect Robert Boehlecke . The committee
went over the schematics drawn up by the architect and agreed
on one . that Robert Boechlecke will show the board tonight .
The Floor plan is settled and they are now starting on the
final drawings . A set of the approved drawings were given to
the town board for the record . Probably go out for bid in
November .
J . Bicentenial Committee - Justice Floyd Dorn reported that they •
are working to get people and get the committee organized .
OLD BUSINESS :
Supervisor A . Francis Wright said that he would like to meet with
the Town Board as a whole and go over the highway budget which is
in a bad situation now . Temporarily a transfer of funds is in
order . He recommended that $ 3 , 000 . 00 be transferred from Item lA
code DE5150 . 1 to Item 1 code DR5110 . 1 . Justice Milton Todd made the
motion that this transfer of funds be made . Justice Floyd Dorn
seconded the motion .

Carried by a vote of five ayes and no noes .
The fiscal officer has filed the tenative budget with the town
• clerk . A budget meeting will be held to establish a preliminary
budget . The date for this meeting will be Wednesday October 22 ,
1975 at 8 : 00 P . M . at Supervisor Wright ' s home .
Zoning Officer - submitted a written report .
Appeals Board Chairman - Absent .
Planning Board Chairman - Mr . Ernest Cole asked the board if. there
was any objection or opinions in reference to publishing articles
in the Danby Area News about the progress in planning . The Planning
Board passed a resolution approving in general concept the town
park proposal and encouraged the community council to go ahead with
this with the understanding that no town funds are available for the
study . The Town Board was in favor .
The problem with taxes in West Danby Water District is being worked on .
Albert Sebesta reported for the committee working to get TV cable
service extended in the Town of Danby . He told the board where the
additional lines would run and said that approximately 100 new
customers would be added . He said that it will take some time to
get the service and people should not expect to get this until
sometime in the spring . This should be ready o go to bid in
November .
The Town Attorney , at this time , is trying to resolve the Town Board ' s
position and that of CSEA .
NEW BUSINESS :
Enviromental impact statement and how it affects the town needs
clarification . The board will check with Frank Liguori and
possibly the town attorney .
The Town Board felt that a meeting with the Zoning Officer to discuss
appeals that have come before the appeals board would do no good at
this time . The planning board is working to revise the Zoning
Ordinance which will take care of many problems . 'lhe letter from the
appeals board will be answered .
• Justice Floyd Dorn is working on a dog ordinance for the Town of
Danby using Caroline ' s ordinance as a guide . The town attorney
will be asked to draw up the ordinance . A lengthy discussion
followed .
Harry Hatfield and Percy Button have both resigned as voting machine
custodians .
General Fund Warrant 10 in the amount of $ 2 , 983 . 41 was approved to
be paid . The motion was made by Justice Milton Todd and seconded
by Justice Floyd Dorn and carried by a vote of five ayes and no noes .
Highway Fund Warrant #10 in the amount of $ 2 , 983 . 41 was approved to
be paid . Councilman Ralph Wilbur made the motion which was seconded
by Councilman Paul Smith and carried by a vote of five ayes and no noes .

New Business continued :
West Danby Water District Warrant #8 in the amount of $ 266 . 44 was
approved to be paid . The motion was made by Justice Milton Todd
and seconded by Justice Floyd Dorn and carried by a vote of five
ayes and no noes .
Councilman Ralph Wilbur made the motion to accept the Supervisor ' s
reports as presented . The motion was seconded by Justice Floyd
Dorn and carried by a vote of four ayes and no noes .
Justice Floyd Dorn made the motion to adjourn which was seconded
by Supervisor A . Francis Wright and carried by a vote of five
ayes and no noes .
