TOWN BOARD MINUTES
September 8 , 1975
The regular meeting of the Danby Town Board was called to order at
8 : 00 P . M . at the Danby Town Hall , Town of Danby , Tompkins County ,
New York on September 8 , 1975 .
Board members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
• Justice Floyd Dorn
Justice Milton Todd
Board member absent : Councilman Paul Smith
Others present : Joseph Hulbert , Ed Slights , Mr . Westmiller , Mary
and Roy Casterline , Jimmie Miller , Dan Hoffman , Moses Peter ,
Bonnie and Wayne Palmer , Ernest Cole , Elfred Sebesta , Joseph
Short , Gordon Roberts , Steven Zimmerman , and Jack Miller .
Councilman Ralph Wilbur made the motion to approve the minutes of
the August 11 , 1975 board meeting as presented . The motion was
seconded by Justice Floyd Dorn and carried by a vote of four ayes
and no noes .
COMMUNICATIONS :
1 . Minutes of the meeting of the West Danby Water Commissioners
of August 3 , 1975 .
2 . Notice of the meeting of September 17 , 1975 of the
Tompkins County Municipal Officials .
1. Minutes of the Board of Zoning Appeals hearing of August
13 , 1975 .
4 . A letter from Richard Thaler to the Supervisor concerning
CSEA .
PRIVILEGE OF THE FLOOR :
Steve Zimmerman and other people from the Dawes Hill Community were
upset by the decision of the Board of Zoning Appeals in the James
Steinman hearing and also disputed the legality of the executive
session of the board in making their decision . The people from
the Dawes Hill Community would likepto help draw up the new Zoning
Ordinance so that communal living will be provided for . Moses
Peter answered by stating that the town attorney advised the board that
• an executive session was proper in the decision making of the
Board of Zoning Appeals .

Moses Peter urged the Town Board to pass a resolution to control the
budget for the coming year .
Mr . . Westmiller asked about the outcome of the tax problem he
brought to the board several months ago . Jimmie Miller reported that
this is being worked on but has not been resolved yet .
Jimmie Miller , Danby '; s Representative on the County Board of
Representatives , reported that the county cannot help the town in
the Michigan Hollow Road problem . He then informed the board of
the work being done on the County budget .

Privilege of the Floor continued :
Douglas Gillogly , chairman of the committee working to extend TV
cable service in Danby could not be present . Alfred Sebesta
attended in his place and asked the board to name Joe Short as
a member of this committee . This matter is being worked on and
a meeting will be set up in the near future .
COMMITTEE REPORTS :
A . Highway report - No report .
B . West Danby Water District - The budget was submitted .
C . Insurance - No report .
D . Refuse Collection and Disposal - Garbage is still being
dumped along Bald Hill Road . Possibly the early closing of
the dump is an inconvenience to some people .
E . Youth - The 1976 budget has been made up and will be presented
to the town board . The swim program and recreation program
run by the Community Council were very sumessful this year .
F . Zoning and Planning - The Town Board and the Planning Board
held a meeting to discuss planned development in the Town
of Danby . .
G . Fire - The budget was discussed and will be submitted .
H . Cemetaries - All in good order .
I . Report of Building Committee - This committee held a meeting
at Paul Smith ' s home . The people on the committee are the
architect , Bob Boehlecke , Gould Colman , Francis Wright , John
Myers , and Fred Thayer . Paul Smith is the chairman of the
committee . The purpose of the committee is to work with the
architect to make recommendations to the Town Board on the
restoration of the Town Hall . The next meeting will be
Wednesday , September 10 , 1975 .
J . Bicentenial Committee - Nothing has been done yet .
OLD BUSINESS :
Highway Superintendents Report - Joseph Hulbert said that patching
and gravel work is being done as usual and there lots of ditches
that need to be dug . The budget is in very poor shape .

Zoning Officer r Gordon Roberts urged the Town Board to seek a
replacement for the Town Constable , Harold Bernhardt who is
moving .
Planning Board Chairman - Ernest Cole reported that the revision
of the zoning ordinance is still being worked on . The Town. of
Danby Planning Board recommends that the Danby Town Board in
considering land use settlement pattern alternatives suggested by
the County Planning Department approve the selective community
pattern in concept allowing for some modifications . The Planning
Board also suggests that growth in the town be governed by the
Zoning Ordinance requirements and intensive development be

Old Business continued :
only as such time and in such places as water and sewer facilities
become available . They further suggest that such facilities be
provided for only in this long range . Councilman Ralph Wilbur
made the motion that the Danby Town Board approve the
recommendations of the Danby Planning Board which recommends
approval of the selective community pattern in concept with
modifications . The motion was seconded by Justice Milton Todd .
• RESOLUTION # 17 APPROVE THE SELECTIVE
COMMUNITY PATTERN IN
CONCEPT

Carried by a vote of four ayes and no noes .
The matter of recognizing the CSEA as a representative of the Town
Highway Employees was discussed at length . A meeting was set for
Wednesday , September 10 , 1975 at the Town Hall with the Town Board ,
town attorney and Mr . Toomey and Mr . Miller to further discuss this
matter .
NEW BUSINESS :
Councilman Ralph Wilbur made the motion to authorize the supervisor
to spend an amount not to exceed $ 250 . 00 for minimal repairs to
t he Town Hall roof . The motion was seconded by Justice Floyd Dorn
and carried by a vote of four ayes and no noes . If more money
is needed Supervisor Wright will again come to the board for
t heir approval .
Moses Peter suggested a resolution to be directed to the Tompkins
County Board of Representatives asking them to hold the County
budget in line by curtailing certain services if necessary to
prevent financial hardship for taxpayers . Justice Floyd Dorn
moved the resolution as presented and Councilman Ralph Wilbur
seconded the motion .

Carried by a vote of four ayes and no noes .
Councilman Ralph Wilbur made the motion to appoint Alfred Sebesta
and Joe Short as members of the TV Cable committee and also Mary
O ltz . Justice Milton Todd seconded the motion which was carried
by a vote of four ayes and no noes .
A budget meeting was set for Monday September 22 , 1975 at the
h ome of the Supervisor at 8 : 00 P . M .

New Business continued :
Mary Bone was suggested as a possible candidate for voting
machine custodian . '

Steven Zimmerman knows of a person that may be interested in taking
the dog census . Harold ( Bob ) Bernhardt is moving to Oregon and
will no longer be able to be the enumerator .
Supervisor A . Francis Wright moved a resolution of thanks to
Bob Bernhardt for his services to the town as Constable and
Dog Enumerator . Councilman Ralph Wilbur seconded the motion .

Carried by a vote of four ayes and no noes .
General Fund Warrant # 9 in the amount of $ 441 . 39 was approved to
be paid . The motion was made by Councilman ' Ralph Wilbur and `
seconded by Justice Milton Todd and carried by a vote of four
ayes and no noes .
Highway Fund Warrants #9 in the amount of $ 1 , 311 . 03 was approved
to be paid . The ,motion was made by Councilman Ralph Wilbur and
seconded by Justice Floyd Dorn and carried by a vote of four ayes
and no noes .
West Danby Water District Warrant # 7 in the amount of was
approved to be paid . The motion was made by Justice Milton Todd
and seconded by Justice Floyd Dorn and carried by a vote of four
ayes and no noes .
Councilman Ralph Wilbur made the motion to accept the Supervisor ' s
reports as presented . The motion was seconded by Justice Milton
Todd and carried by a vote of three ayes and no noes .
Justice Milton Todd made the motion to adjourn the meeting at
10 : 20 P . M . The motion was seconded by Councilman Ralph Wilbur
and carried by a vote of four ayes and no noes .
