TOWN BOARD MINUTES
August 11 , 1975
The regular meeting of the Danby Town Board was called to order at
8 : 00 P . M . at the Danby Town . Hall , Town of Danby , Tompkins County ,
New York on August 11 , 1975 .
Board members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
Councilman Paul Smith
Justice Floyd Dorn
Board member absent : Justice Milton Todd
Others present : Mr . & Mrs . Griffin , Jimmie Miller , Craig Boniface ,
Joseph Hulbert , Gladys Hulbert , Mr . & Mrs . Steele , Gordon Roberts ,
Grace and Douglas Gillogly , Fred Thayer , Ernest Cole , Mr . & Mrs .
Rustak , Roy Casterline and Mary Casterline , Betty Melchin , Louise
Carrier , Joyce Stafford , Mr . & Mrs . Reeves , Gould Colman , Glen Kline ,

A correction was made on page 3 of the minutes of the regular
board meeting of July . Ralph Wilbur made the motion to accept James
Fowlers resignation from the Zoning Board of Appeals and the
motion was seconded by Councilman Paul Smith not ‘ by Ralph Wilbur as
recorded in the minutes . The motion to accept the minutes as
corrected was made by Justice Floyd Dorn and seconded by Supervisor
A . Francis Wright and carried by a vote of four ayes and no noes .
COMMUNICATIONS :
1 . A message was read by the clerk from Mrs . Steele of
Michigan Hollow Road stating that the dust problem on
the road is getting much worse .
2 . A petition signed by 15 people on Nelson Road and near
Nelson Road formerly Steam Mill Road asking that the name
of the road be changed back to Steam Mill Road .
3 . A note from Peter Kahn aMY Ruth .- Kahn with a check to be
used in the renovation of the Town Hall .
4 . A note from Governor Carey ' s office acknowledging receipt
of a copy of resolution #14 adopted on June 30th by the
Danby Town Board .
5 . A notice from the State of New York Public Service Commission
concerned with the recording of telephone conversations .
6 . A copy of a letter to Mr . Toomey of New York State Public
Employgent Relations Board concerned with the Danby Highway
Department election .
• 7 . A letter from Tompkins County Youth Court reminding people
that the Youth Court is operating and awaiting referrals .
8 . Agenda of the meeting of the Tompkins County Board of
Representatives of August 11 , 1975 .
9 . Resolution #132 from the Tompkins County Board of
Representatives intitled - Establishment of the Tompkins
County Intergovernmental Relations Study Committee .
10 . A letter from the Local Government Program at Cornell
University concerned with updating the Town Legislative
Guide published last year .
11 . Notice of Quarterly Meeting of the Tompkins County Municipal
Officials ' Association .

14 . News Release from the Tompkins County Division of
Assessment 1975 study by State Board of Equalization and
Assessment .
PRIVILEGE OF THE FLOOR :
Councilman Paul Smith has heard a complaint about houses being rented 0
to a number of students and questioned the septic system as to
efficiency and also the contamination of the water supply when used
by large numbers of people . Cars being parked on the roadway are c;
causing a traffic problem . Who should look into this situation ?
Gordon Roberts answered using the Zoning Ordinance .
Mr . & Mrs . Steele , Mr & Mrs . Reeves , Mrs . Griffin , Fred Thayer ,
Mr . & Mrs . Gillogly all are unhappy about the condition of Michigan
Hollow which runs in front of their homes . It is very dusty and
the oil helps only for a short time . These people would like a
permanent solution to this problem .
Joyce Stafford told of a road in bad condition next to the Tioga
County line .
Gould Colman attended the meeting in response to the letter from the
Town Board asking him to get a group together to clean out the Town
Hall and head a committee to advise the architect . He is still
interested in the restoration of the building but would like to work
with Vicki Romanoff but not with the present architect . A lengthy
discussion followed .
Jimmie Miller stated that he and Milton Todd have discussed the
assessment problem in West Danby .
COMMITTEE REPORTS :
A . Highway Report - No report .
B . West Danby Water District - There has been no meeting of the
commissioners due to vacations .
C . Insurance - Nothing
D . Refuse Collection and Disposal - No problems
E . Youth - The application for Jennings Pond license is being worked
on . The attorney will be asked to check this over . After a
lengthy discussion Councilman Ralph Wilbur made the motion that
the supervisor be authorized to execute this license on the
approval by the attorney . Justice Floyd Dorn seconded the
motion which was carried by a vote of four ayes and no noes .

F . Zoning and Planning - One zoning violation brought to court .
G . Fire - Nothing .
H . Cemetaries - All in order .
OLD BUSINESS :
Highway Superintendent ' s report - Some work was done last spring on
John Hill Road the Road Mrs . Stafford is talking about is over the
line in Tioga County .

Old Business continued :
Zoning Officers Report = - Gordon Roberts stated that he has a request
for application for a part of a planned development district to be
excluded from a planned development already established . This matter
was turned over to committee who will work with Mr . Roberts to research
the matter and make recommendations .
Appeals Board Chairman - No report .
Planning Board Chairman - Ernest Cole reported that they are working
on two things the land use and settlement plan and the zoning
ordinance . They would like a meeting with the town board in executive
• session . The date for the meeting was set for Monday August 25 , 1975
at 8 : 00 P . M . at the Danby Town Hall .
Report on Referendum - The vote was two to one , approximately, in favor
of the restoration of the old town hall .
Craig Boniface gave a report on what is happening at county level to
prepare for the bicentenial celebration and also what is being done
in other areas . Mr . Boniface said that the town should have
co -chairmen of their committee . He will work with someone . Jimmie
Miller and Floyd Dorn were asked to find another person .
Mr . Glen Kline attended the meeting to answer questions pertinent to
the proposed Ag District in the Town . He showed maps and discussed
procedurein setting up such a district . Councilman Ralph Wilbur
made the motion to approve the Ag District with one exception that
there be a set back line of 500 feet from the main road on a portion
of Rick Dobson ' s property which borders 96B north of the hamlet of
Danby . A letter is to be sent to the board of representatives with
a copy to Jimmie Miller informing them of this change . Councilman
Paul Smith seconded the motion which was carried by a vote of four
ayes and no noes .
NEW BUSINESS :
The Michigan Hollow Road was discussed at length . It was decided that
oiling the road was not the answer to the problem but will serve as
some immediate relief . At budget time paving three tenths of a mile
in front of the houses will be considered .
The question of Nelson Road also known as Steam Mill Road was
discussed . Changing the name from Steam Mill Road to Nelson Road
has caused many problems and the residents would like the name
changed back to Steam Mill Road . A resolution will have to be passed
to make this change and the County notified . Supervisor A . Francis
Wright made the motion which was seconded by Councilman Raul Smith .

Carried by a vote of four ayes and no noes .
Supervisor A . Francis Wright made the motion to set up a special fund
for receiving donations for the town hall . These donations will be
accepted for furnishing the town hall or for historical renovation .
Councilman Paul Smith will work and help develope a committee to
work as a building committee in connection with the town hall
renovation . Possibly Jimmie Miller will work with him .
Suggestions are needed for aweltstodian of the voting machine . This
person must be of the Democratic party as we have a Republican now .
A retired person would be most fesible .

New Business continued :
General Fund Warrant #8 in the amount of $ 517 . 92 was approved to be
paid . The motion was made by Councilman Ralph Wilbur and seconded
by Councilman Paul Smith and carried by a vote of four ayes and no
noes .
Highway Fund Warrant 08 in the amount of $ 10 , 915 . 69 was approved to
be paid . The motion was made by Justice Floyd Dorn and seconded by
Councilman Paul Smith and carried by a vote of four ayes and no noes .
Councilman Ralph Wilbur made the motion to accept the Supervisor ' s
reports as presented . The motion was seconded by Justice Floyd
Dorn and carried by a vote of three ayes and no noes . 411
The meeting was adjourned at 10 : 55 P . M .
