Request for 213 Mitchell Street The property owner has requested the ability to purchase a residential parking permit because his property does not have off-street parking and on -street parking is not allowed. In order for this property to be sold, an encroachment agreement must be in place with the City. Authorization to Execute Public Works Contracts to Lowest gualifled Bidder Resolution e�!-Section G -58A of the City Charter states that "No contract involving the zxpenditure of moneys shall be made except by vote of a majority of the members of the Board of Public Works" and WHEREAS, it is often necessary to execute construction, material supply, and professional services contracts on a timely basis, and execution of such contracts is sometimes delayed for several weeks until the next Board of Public Works meeting occurs, and scneaulea orrr meeting often results in the lack of a quorum present at the meeting, further delaying t authorization to execute contracts, and i ine lourest qualmea Diacer, and Ine Board of Public Works has consistently agreed with staffs recommendation to award contracts to the lowest qualified bidder, and RESOLVED, That the Board of Public Works does hereby authorize the Superintendent of Public Works and/or Mayor to execute construction, material supply, and professional services contracts related to the operations of the Department of Public Works without prior approval of the Board, provided that the contract is awarded to the lowest qualified bidder, the contract does not exceed budgeted amounts established by Common Council, and that City procurement policies are followed, and be it further RESOLVED, That award of contracts to any bidder other than the lowest qualified bidder be brought to the Board of Public Works for discussion and authorization by the Board of Public Works. 8A. A Resolution to Establish Guidelines for the Repair or Reconstruction of Pedestrian Connections between the Sidewalk and the Street WHEREAS, around the City in many locations are pedestrian connections in the public right of way between the public sidewalk, which runs generally parallel with the street, and the street itself, these connections 'usually take the form of concrete slabs, steps, a staircase, or a ramp; and RESOLVED, That it is not the intention of the Board of Public Works to commit the City to future maintenance of such pedestrian connections should they be approved for one time funding and that it is the expectation of the Board that maintenance of the pedestrian connections will still be the responsibility of the abutting property owners in accordance wit[,., the City Code. ?B. Board of Public Works Concurrence that the Planning Board be Lead Agency in Environmental Review for the Proposed Residential P[o ect at 323 Taughannock j Blvd. - Resolution WHEREAS, 6 NYCRR Part 617 of the State Environmental Quality Review Law and Chapter 176.6 of the City Code, Environmental Quality Review, require that a lead agency be established for conducting environmental review of projects in accordance with local and state zmvironmental law; and WHEREAS, State Law specifies that, for actions governed by local environmental review, the lead agency shall be that local agency which has primary responsibility for approving and funding or carrying out the action; and 11,'AEREAS, the City of Ithaca Planning and Development Board has one pending application for site plan approval for proposed residential project at 323 Taughannock Blvd the City of f Ithaca, by Noah Demarest for Rampart Real LLC.; and WHEREAS, the project involves approvals for a Planned Unit Development (PUD), subdivision, work on City property, and potentially disturbance to the banks and/or water of the Old Cayuga Inlet; and WHEREAS, the applicant is proposing construction of 8 attached townhomes on Inlet Island, on a 0.242 acre lot. The townhomes will contain up to 2 dwelling units each for a maximum total of 16 units with up to 24 bedrooms. The applicant is proposing zoning for the site that is identical to the City's adopted WF -2 zoning ordinance. The applicant proposes to subdivide the parcel such that each unit is on a unique parcel. The project includes an 8 space parking area that is accessed through the adjacent City -owned parking lot. The project includes some improvements to the city -owned parking lot- which will require approval by the Board of Public Works. The project also includes an asphalt walkway along the Old Cayuga Inlet, landscaping and lighting; and WHEREAS, the BPW and Common Council, the Canal Corporation, NYS DEC and #` t. of Health have all been identified as potentially involved agencies in the environmental review of this project; and i# t. 771�M i review of this project; now, therefore be it WHEREAS, three Bids were opened on April 25, 2017, for the Construction Contract for the Replacement of the Maintenance Building Roof, and WHEREAS, the Common Council established a budget for Stewart Park Roofs, Capital Project 800, and I TIM; r-1 RESOLVED, That the City of Ithaca Board of Public Works hereby awards the Construction Contract for the Replacement of the Stewart Park Maintenance Building Roof - Capital Project 800, to ...... Award of Contract Construction Materials Testing Services for 2017 Construction Program — Resolution WHEREAS, three Proposals were received on Friday March 13, 2017 for the contract for the 2017 professional services for construction materials testing services; and WHEREAS, the lowest price proposed that met the terms of our request for proposals was provided by SJB Services, INC. located at 60 Miller St, Cortland, NY, with a proposal not to exceed $25,000.00 for testing and inspection services; and WHEREAS, funding for the contract for professional services for construction materials testing services for the 2017 construction program shall be provided through operating budgets and capital programs; and WHEREAS, it is the recommendation of the City's Engineering Department that the contract be awarded to, SJB Services, Inc.; now, therefore be it RESOLVED, That the Board of Public Works award the contract for professional services for construction materials testing services for the 2017 construction program to SJ1B Services, Inc. located at 60 Miller St, Cortland, NY, for the amount not to exceed $25,000.00; and, be it further RESOLVED, That the Superintendent of Public Works be authorized to enter into al -2dminister this contract. 9C. A Resolution to Declare Lead Agency Status for the Environmental Review of the West State/Martin Luther King Jr. Street Corridor Enhancements R[Wect WHEREAS, the State Environmental Quality Review Act (SEQR) and the City of Ithaca Environmental Quality Review Ordinance (CEQR), Section 176 of the City Code, require that a lead agency be established for conducting environmental review of projects in accordance with local and state environmental law; and WHEREAS, State Law specifies that for actions governed by local environmental review, the lead agency shall be that local agency which has primary responsibility for approving and funding or carrying out the action; and WHEREAS, SEQR and CEQR both provide for an uncoordinated review for "Unlisted" projects that involve more than one agency; and WHEREAS, the proposed construction of the West State/Martin Luther King Jr. Street Corridor Enhancements project (PIN 395050, Capital Project # 790) is a "Unlisted" action under SEQR and is an "Unlisted" action under CEQR; now, therefore be it RESOLVED, That the City of Ithaca Board of Public Works does hereby declare itself lead agency for the environmental review of the proposed construction of the West State/Martin Luther King Jr. Street Corridor Enhancements project. 913. Authorization of the Reguest for Encroachment Agreement/License at 308 East Seneca - Resolution WHEREAS, Josh Giblin, on behalf of the Sciencenter Discovery Museum located at 601 First Street (Tax Map Parcel No. 25.-2-1.1), in the City of Ithaca, has requested an encroachment agreement/license from the City to install certain signage to direct bus and car traffic to the Sciencenter; and WHEREAS, the encroachment consists of installation and maintenance of three signs as �lepicted in document entitled "Sign Placement Request to the City of Ithaca by the Sciencenter", attached and hereby incorporated as Exhibit A, and WHEREAS, it appears that the proposed signs will not interfere with the sidewalk or right of way as currently constituted, and in fact two signs will replace existing Sciencenter signs in th�; proposed locations; and Tr Mi works uses or needs; and WHEREAS, the 2017-18 schedule of fees for use of City -owned property requires an initial application fee of $100 for new licenses, but stipulates that the annual use fee shall be waived for minor encroachments, now therefore be it RESOLVED, That the Board of Public Works hereby grants the request for an encroachme as proposed, contingent upon the execution of a license/agreement and submission of the required application form and fee (and renewal fees for any subsequent terms) and proof o required insurance, and be it further I MI 9 e usu terms an con i ions, inc u specified in Chapter 170 of the City's Municipal Code. AGREEMENT / REVOCABLE LICENSE FOR USE OF CITY REAL PROPERTY 'THIS AGREEMENT, made this _ day of 2017, by and between: 0- Sciencenter Discovery Museum, an education corporation duly chartered and validly existi pursuant to the laws of the State of New York, with offices at 601 First Street, Ithaca, New Yo 14850, (hereinafter referred to as "LICENSEE"), �1 =49 10The CITY OF ITHACA, NEW YORK, a municipal corporation having offices at 108 E. Green Stre Ithaca, New York (hereafter referred to as "CITY"), i WHEREAS, LICENSEE is the owner of a parcel of land with improvements thereon in the City of Ithaca, County of Tompkins, State of New York, commonly known and designated as 601 First Street, Ithaca, New York, and as Tax Map Parcel No. 25.-2-1.1; and WHEREAS, LICENSEE wishes to use, occupy and/or encroach upon certain land in the City of Ithaca owned by CITY, for the benefit of the above -referenced parcel of LICENSEE, as set forth in the document entitled "Sign Placement Request to the City of Ithaca by the Sciencenter", attached and hereby incorporated into this License Agreement as Exhibit A and a curved monument sign, as proposed to the Board of Zoning Appeals on August 5, 2014, constructed of Llenroc stones laid to a height of three feet, approximately one foot in width, and commencing at a distance of J foot from the inner edge of the curb approximately 12 feet northwest of the comer of the existing grassy area within the City right of way, adjacent to the intersection of First and Franklin Streets, and running southeast approximately 12 feet, and rounding the comer approximately 26.5 inches from an existing utility pole, and then continuing northeast toward Franklin Street for a total length of approximately 20.5 linear feet on the outside curve, thereby encompassing an encroachment into the right of way by approximately 21 square feet, which is shown on a drawing stamped March 7, 2014 and entitled "New Front Entrance Comer Sign Sciencenter"; and WHEREAS, Chapter 170 of the Municipal Code of the City of Ithaca establishes the process and the terms and conditions by which the CITY may license the use of and/or encroachment upon its real property to a person or persons; and WHEREAS, the CITY's Board of Public Works has authorized the Mayor to execute an agreement containing a revocable license that allows the above-described use or encroachment, subject to certain conditions; NOW, THEREFORE, in consideration of the mutual covenants and agreements herein containe including receipt by CITY from LICENSEE of the fees described herein (either in full, or pursuant to installment payment agreement), the parties hereto, for themselves, their heirs, executors, administratol successors and assigns, do hereby covenant and agree as follows: 1. In the event of such early termination, LICENSEE shall be entitled to a pro -rated refund of the use fee, for the unused portion of the term, provided that LICENSEE is in compliance with the provisions of Paragraph 8, below. Such early termination shall not relieve LICENSEE of its duty to restore and deliver up the licensed premises as described below. 5. Notwithstanding any other provisions herein, the License contained herein may be revoked or modified by CITY (a) upon such notice as is practical, in the event of an emergency that threatens property or t�h � W U -mi -1, I "•-f if 6. This Agreement/License shall not take effect until fully executed and until the application and use fees set forth below have been received by the City. Application Fee: An Application Fee in the amount of $100.00 (in the form of a check payable to the City of Ithaca) must accompany submission of the application for this license to the City Chamberlain's office. The purpose of this fee is to cover the amount of City staff time typically associated with the processing of such applications. Annual Use Fee: The Use Fee for the initial year of this license (April 1, 2017, until March 31, 2018) is $0.00. This Use Fee is waived because the described use is a minor encroachment. In the event that this License is renewed, the Use Fee for subsequent years may be adjusted by CITY (a) by an amount up to the rate of any increase in the consumer price index since the previous year, or (b) to corres-Nond with information from dated Ltsivraisal rLvacort f t` 'i to occur evetv 5 i.,,-tarsli. If the CIT intends such adjustment, LICENSEE shall be so notified by February 1 " prior to the expiration of the current term. Notwithstanding any other provisions herein, the CITY hereby reserves the right to correct the amount of the Use Fee at any time, if the square footage of land occupied by LICENSEE is found to be different from the amount stated above. LICENSEE hereby agrees to install the signs as indicated in Exhibit A in accordance with the in Exhibit B, and maintain the licensed premises in a safe, sound, clean and serviceable condition, in accordance with all applicable ordinances of the CITY and such that no hazard is posed to the public from the public's use of or proximity to said premises, and to repair or remove any unsafe or improper structure or thing thereupon, as directed by the CITY. In the event of LICENSEE's failure to effect such repair or removal, after notice from CITY to do so, CITY may cany out the same and charge LICENSEE and its benefited property for such cost (plus a 25% administrative charge), 8. LICENSEE hereby agrees that it is LICENSEE's duty, at the end of the term (in the absence of timely renewal thereof) or in the event of other termination of the License, to deliver up the licensed premises in as good order and condition as they were at the commencement of the License (reasonable use and wear excepted), unless the CITY agrees in writinq6��s-r--�, 0 otherwise agreed to by the CITY, such delivery shall include restoration of grade and original ground cover, if applicable, and removal of any debris and any structures installed by LICENSEE. Any damage to the premises or any debris remaining thereupon at such time shall be presumed to have been caused by LICENSEE. In the event of the failure of LICENSEE to effect the required restoration, within ten (10) days of the date of written notice from the CITY, the CITY may thereafter cause the restoration to occur and may subtract the cost thereof from any pro -rated refund due to LICENSEE and/or may assess the cost thereof (plus 25%) against LICENSEE and its benefited property. 9. LICENSEE hereby agrees to indemnify and save the City and its officers and employees harmless from any loss, injury or damage arising out of the occupancy or use of the encroached -upon City property, by LICENSEE or its servant or agent, or by any member of the public, or from any negligence or awfault of said 119000061&30��Ulft# Gavill lint if 1M -W-W WVLY IN sl- 611 and -court costs.
