N . at the Danby Town Hall , Town of Danby , Tompkins County , N ew York on July 14 , 1975 . B oard members present : Supervisor A . Francis Wright Councilman Ralph Wilbur Councilman Paul Smith Justice Floyd Dorn Justice Milton Todd 411 Others present : Mary Casterline , Roy Casterline , Robert Boothroyd , Rick Jenson - Journal Reporter , Elizabeth Croft , Beverly Hogben , B eatrice Hogben , Gordon Roberts , Ernest Cole , Jimmie Miller , Don Baker and wife , Edward Slights , Moses Peter , Gladys Hulbert , Joseph Hulbert , Shirley Wright , Danny Wright . Justice Floyd Dorn made the motion to approve the minutes of the June 9 , 1975 meeting as presented . The motion was seconded by Justice Milton Todd and carried by a vote of five ayes and no noes . COMMUNICATIONS : 1 . A letter from the State Board of Equalization and Assessment n otifying the town of the final state equalization rate for the 1974 assessment roll . 2 . A note of resignation from James Fowler from the Danby Board o f Zoning Appeals . 3 . State of New York Department of Transportation designating ✓ ight turn lanes for right turns only on Route 96B . 4 . A letter from the New York State Electric and Gas Corp . concerning electric rate increases . 5 . Minutes of the West Danby Water Commissioners meeting of July 9 , 1975 . 6 . Minutes of the Planning Board Meeting of June 19 , 1975 , 7 . Minutes of the Board of Zoning Appeals Hearing of June . 11 , 1975 . PRIVTILEGE OF THE FLOOR : B ob Boothroyd asked the board to officially declare an old road crossing his property abandoned if they have not already done so . B everly Hogben asked if the " Darby Teens " could use the Town Hall for a record hop on August 2 , 1975 . Also they would like to use the Town Hall during the week as a meeting place :; They would use it one or two evenings . Mr . Baker also asked the Town Board if the old road crossing the Boothroyd property was abandoned by the town. or if it was still officially a town road . Shirley Wright asked why the Bell Property was still not cleaned out and also the overflow on her property . It was promised that this would be done some time ago . The property is rented again . It was noted that this matter is in the hands of the attorney . Mrs . Bell cannot be located . Jimmie Miller said that he hopes the town moves on abandoned roads ° . This mornings meeting at the County Board of Representative was a three hour session . There were 22 resolutions to act on He read through to give the Tom_ Board an idea of what was being done at the county level . He said he would be glad to answer questions . Town Board Minutes - July 14 , 1975 - Page 2 Privilege of the Floor continued : Moses Peter commented that he urges people to vote in the special election tomarrow for a new building not renovation of the old one . Ralph Wilbur talked about the Ag District that may be set up in Danby . It was discussed at length . COMMITTEE REPORTS : . A . Highway Report - The people . have had a week and a day of vacation . Their have been calls about the bad condition of Troy Road , More discussion is needed on the Donovan Plan . B . West Danby Water District - Roy Casterline said that the New York State Electric and Gas Corp . will install a three phase hook up on a surcharge basis . They have a contract that must be signed before this is done . He asked if the Town Board would approach the New York State Electric and Gas Corporation . A lengthy discussion followed . Milton Todd , Ralph Wilbur and A . Francis Wright will form a committee to work on this . The contract will not be signed yet . C . Insurance - Nothing D . Refuse Collection and Disposal - Paul Smith will chair this committee . E . Youth - Paul Smith and Milton Todd will review the contract for the use od Jennings Pond for a recreation area in Danby . They will report on this at the next town board meeting . I F . Zoning & Planning - Justice Floyd Dorn stated that the informational meetings on the town hall referendum were poorly attended . G . Fire - Nothing H . Cemetaries - All in order . OLD BUSINESS : H ighway Superintendents Report - The town will feel the affects o f the cut in state aide for Donovan Projects . The matter was d iscussed at length . Ralph Wilbur made the motion to close up t he Donovan Projects that are being worked on now and try to draw partial payment and enter again next year in the hopes that there will be funding then , Take the balance of the money that would be spent on the improvement program and do the work that n eeds to be done around town . Milton Todd seconded the motion which was carried by a vote of five ayes and no noes . Ralph Wilbur made the motion that Joseph Hulbert be authorized to attend the Highway Superintendents convention . Floyd Dorn seconded the motion which was carried by a vote of five ayes and no noes . Abandonded roads were discussed . The old road that is considered abandoned at the intersection of Durfee Hill Road and Nelson Road was discussed . Bob Boothroyd stated that according to Section 205 o f New York State Law any road that has not been used for six years is considered abandoned . Gordon Roberts submitted a letter and Survey Map pertaining to this situation . The matter will be ✓ eferred to the town attorney for his opinion . The motion was made by Milton Todd to turn this matter offer to the town attorney . Councilman Ralph Wilbur seconded the motion which was carried by a vote of five ayes and no noes . Town Board Minutes - July 14 , 1975 - Page 3 O ld Business continued : Zoning Officer ' s Report - A written report was submitted . He stated that in the matter of abandoned roads it should be made more clear which ones have been abandoned to save time . There should be a list of abandonedroads and zoning map should reflect this . A long d iscussion followed . Mr . Roberts has asked Attorney Thaler to attend the rehearing of the Steinman case before the board of Zoning Appeals . Moses Peter stated the the Town Attorney had met with the Board of Zoning Appeals and said that he would provide them with a format of procedure but to his knowledge this has not been done yet . He also stated that the attorney said the Appeals Board should have a copy of the Town Law . As a member of the appeals board has resigned a n ew member will have to be appointed by the Town Board . The Appeals B oard cannot act until this vacancy is filled . Possibly Ronlad Elia might serve as a member of the board . He feels the town attorney is dragging his feet . He needs to be prodded or get another attorney . Councilman Paul Smith and Justice Floyd Born were asked to study the attorneys that might be available . Find out what their fees are and what they would charge the town annually and if they would be able to attend meetings . Justice Flod Dorn and. Justice Milton. Todd will form a committee to look for a replacement for James Fowler who ✓ esigned from the Appeals Board . They will brinF suggestions to e xecutive session of Town Board to be held Thursday July 17 , 1975 at the Danby Fire Station at 8 : 00 P . M . P lanning Board Chairman Ernest Cole stated that a vacancy needs to be filled on the Planning; Board . gtanley Kirk ' s name was submitted for reappointment for another term . Mr . Cole stated that the board is working on the zoning ordinance . The next meeting of the Planning Board will be Thursday Night , July 17 , 1975 at the Danby Town Hall , Councilman Paul Smith made the motion to reappoint Stanley Kirk to serve as a member of the Planning Board_ . His term will run from July 1 , 1975 to June 30 , 1982 . The motion was seconded by Justice Milton Todd and carried by a vote of five ayes and no noes . The highway employees had an election . They voted to designate C .SEA as their bargaining agent over no union at all . Councilman Paul Smith noted that there was no CSFA representative present at the election . Councilman Ralph Wilbur made the motion that James Fowler ' s resignation as a member of the Board of Zoning Appeals be accepted . The motion was seconded by Councilman Ralph Wilbur and carried by a vote of five ayes and no noes . Justice Milton Todd made the motion for the " Danby Teens " to use the Town Hall for a record hop on August 2 , 1975 . Justice Floyd Dorn seconded the motion which was carried by a vote of five ayes and no noes . General Fund Warrant #7 in the amount of $ 648 . 78 was approved to be paid . The motion was made by CouncilmanRitalph Wilbur and seconded by Justice Milton Todd and carried by a vote of five ayes and no noes . H ighway Fund Warrant -17 in the amount of $ 8 , 0C4087 was approved to be paid . The motion was made by Councilman Ralph Wilbur and seconded by Justice Milton Todd and carried by a vote of five ayes and no noes . W est Danby Water District Warrant - 6 in the amount of. 1296 . 94 was approved to be paid . The motion was made by Justice Milton Todd and seconded by Justice Floyd Dorn and carried by a vote of five ayes and no noes . Councilman Ralph Wilbur made the motion to accept the Supervisor ' s reports as presented . The motion was seconded by Justice Milton Todd and carried by a vote of five ayes and no noes .
