TOWN BOARD MINUTES
June 9 , 1975
The regular meeting of the Danby Town Board was called to order at
8 : 05 P . M . at the Danby Elementary School , Town of Danby , Tompkins
County , New York on June 9 , 1975 .
Board Members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
Justice Floyd Dorn
Justice Milton Todd
Due to the death of Clyde Carrier only four board members were present .
Others present : Edward Slights , Joseph ?'ulbert , Mr . Westmiller ,
Gordon Roberts , Mary Casterline , Roy Casterline , Jimmie Miller , Gail
Seldin , Wendell Bryce , Ernest Cole and Moses Peter .
Justice Milton Todd made the motion to approve the minutes of the May
12 , 1975 meeting . The motion was seconded by Justice °L' l 'oyd Dorn and
and carried by a vote of four ayes and no noes .
COMMUNICATIONS :
1 . Notice of filing of tenative assessment roll for 1975 .
2 . A letter from the Assembly of the State of New York concerned
with the Donovan Plan .
3 . Agenda of the Tompkins County Board of Representatives
meeting of June 9 , 1975 .
4 . A letter from the Tompkins County Division of Assessment
asking the board to appoint a person to serve on the Local
Advisory Board of Review .
5 . A letter from " The Danby Teens " saying thanks for the use of
the Danby Town Hall for their dance .
6 . A note from Emily Wiggins thanking the board for the real
estate deduction for senior citizen taxpayers .
7 . Public Notice on increased fares proposed by Greyhound Lines , Int
8 . Notice of quarterly meeting of Tompkins County Municipal
Officials .
9 . Minutes of the meeting of the Danby Planning Board of May 15 , 1975,
10 . Minutes of meeting of Board of Zoning Appeals of May 21 , 1975 .
PRIVILEGE OF THE FLOOR :
• Moses Peter asked if Jimmie Miller could make major county budgetary
figures more clear to the public .
Mr . Westmiller paid taxes on his property that were not his but it
was necessary to pay them to get a clear title to sell the property .
He asked the help of the Town Board in getting this matter corrected .
Supervisor A . Francis Wright appointed a committee of Milton Todd ,
Floyd Dorn , and Roy Casterline to check into this matter and make '
recommendations to the board .
Wendell Bryce , Chairman of the Republican Committee in Danby that due
to the unfortunate loss of Councilman Clyde Carrier as a member of the
board the committee has been looking for a replacement . They recommend
Paul Smith be nominated to fill Mr . Carrierts unexpired term of office .

Privielge of the Floor continued :
A resolution for the Clyde Carrier family was read by Supervisor
A . Francis Wright . Supervisor Wright made the motion to make
this resolution a part of the minutes of the town board meeting .
The motion was seconded by Justice Milton Todd .
RESOLUTION #11 RESOLUTION OF APPRECIATION
CLYDE CARRIER
Roll Call Vote : Wright - aye

Todd - aye
Carried by a vote of four ayes and no noes .
Justice Milton Todd made the motion that Paul Smith be appointed
as Town Councilman to replace Clyde Carrier . His appointment
would be for now until December 31 , 1975 . Ralph Wilbur seconded
the motion which was carried by a vote of four ayes and no noes .
COMMITTEE REPORTS :
A . Highway Report - Work has been done on Michigan Hollow Road and
the people living there seem to be satisfied . Work is being
done on Miller Road . There have been some equipment problems .
B . West Danby Water District - A pump needs to be replaced . A
survey has been requested to be done by the Gas and Electric
for three phase service to the pump house .
C . Insurance - Nothing .
D . Refuse Collection and Disposal - No report .
E . Youth - It was reporteq that Jack baker has resigned as
president of the Danby Community Council .
F . Zoning and Planning - Justice Milton Todd reported that a
meeting was held at the Town Hall with the Town Board and the
Town Attorney to discuss a referendum on the Town Hall . There
will be three propositions on the referendum . The supervisor
read the resolution as it was set up by the attorney .
G . Fire - Councilman Ralph Wilbur stated that he has tried to
negotiate a contract with the south part of Ithaca for fire
protection . He feels that some of the commissioners have
negative feels towards this .
H . Cemetaries - Justice Floyd Dorn says that everything is under
control . The grass has been mowed . Holders are needed for the
flags on the veterans graves .
OLD BUSINESS :
H ighway Superintendent - No report .
Appeals Board Chairman - Moses Peter stated that there has been
lots of activity . The board has decided to have one night a month
to hear all appeals with no more than three appeals scheduled per
night . The hearings will be held the second Wednesday of each
month . There are already four to be scheduled . Fred Lee ' s term
will expire at the end of june . Mrs . Seldin offered to fill the
vacancy on the appeals board .

Old Business Continued :
Planning Board Chairman - Ernest Cole stated that the meeting on the
Town Hall Referendum was attended . The Zoning Ordinance will be worked
o n at the next meeting of the Planning Board and also the park proposal
will be considered .
Zoning Officer Gordon Roberts read the write up in the Newfield
Newspaper on the appeal of James Steinman of Dawes Hill . He felt
that the decision of the Zoning Board of Appeals should be appealed .
A lengthy discussion followed .
• NEW BUSINESS :
Mr . Paul Smith joined the board and Mr . Wright introduced him as the
n ew Councilman appointed to fill the unexpired term of Clyde Carrier .
Two informational meetings to discuss the town hall referendum will
be held by the Town Board . The first will be held June 25 , 1975 at
8 : OOP . M . at the Town Hall ; the second will be held June 30th at the
West Danby Fire Station at 8 : OOP . M . These meetings will be advertised .
Supervisor A . Francis Wright made the motion to hold a special election
o n the three propositions pertaining to the Town Hall . The motion was
seconded by Councilman Ralph Wilbur .

ELECTION ON PROPOSITION PURSUANT
TO SECTION 82 OF THE TOWN LAW •

Carried by a vote of five ayes and no noes .
Justice Milton Todd made the motion to hold the Special Election on
the referendum on July 15 , 1975 . The motion was seconded by Justice
Floyd Dorn and carried by a vote of five ayes and no noes . The advice
o f the attorney will be needed as to what voters will be able to vote .
The Town Board felt that the Appeals Board plan to hear appeals once
a math was a good idea . Supervisor A . Francis Wright made the motion
to appoint Gail Seldin to fill the vacancy on the appeals board .
Justice Milton Todd seconded the motion which was carried by a vote
of five ayes and no noes .
Justice Milton Todd made the motion to appoint Lawrence Cortwright to
serve on the Local Advisory Board of Review . Justice Floyd Dorn
seconded the motion which was carried by a vote of five ayes and no
noes .
• The following people were recommended for appointment as Election
Inspectors for a one year term . Their term will start July 1 , 1975
and end June 30 , 1976 :

New Business Continued :
Justice Milton Todd made the motion to appoint the election
inspectors as recommended for a one year term . Justice Floyd
Dorn seconded the motion which was carried . by a vote of five ayes
and no noes .
Justice Floyd Dorn made the motion that the town officials wishing
to attend the Municipal Officials meeting be authorized to do so .
Justice Milton Todd seconded the motion which was carried by -= a
vote of five ayes and no noes .
General Fund Warrant #6 in the amount of $ 409 . 02 was approved to
be paid . The motion was made by Justice Floyd Dorn and seconded
by Justice Milton Todd and carried by a vote of five ayes and no
noes .
Highway Fund Warrant #6 in the amount of 51 , 098 . 91 was approved to
be paid . The motion was made by Justice Milton Todd and seconded
by Councilman Ralph Wilbur and carried by a vote of five ayes and
no noes .
Councilman Ralph Wilbur made the motion to accept the Supervisor ' s
reports as presented . The motion was seconded by Justice Floyd
Dorn and carried by a vote of five ayes and no noes .
Justice Milton Todd made the motion that the meeting be adjourned
at 10 : 35P . M . The motion was seconded by Justice Floyd Dorn and
carried by a vote of five ayes and no noes .
