TOWN BOARD MINUTES
May 12 , 1975
The regular meeting of the Danby Town Board was called to order at 8 : 00
P . M . at the Danby Elementary School , Town of Danby , Tompkins County ,
N ew, York on May 12 , 1975 .

Knuutila , Roy & Mary Casterline , Ernest Cole , Mr . & Mrs . Steele , Lynn

Journal reporter .
The motion was made by Councilman Ralph Wilbur to approve the April
14 , 1975 meeting minutes as presented . Justice Milton Todd seconded the
motion which was carried by a vote of five ayes and no noes .
COMMUNICATIONS :
1 . A letter from assemblyman Gary A . Lee of the State of New
York concerning the Donovan Road Program .
2 . Agenda of the Tompkins County Board of Representatives
meeting of May 12 , 1975 .
3 . A summary of the County Planning Board Meeting of April 9 , 1975 .
4 . A letter from the Finger Lakes State Parks and Recreation
Commission concerning liability insurance for Jennings Pond .
5 . The minutes of the West Danby Water Commissioners meeting of
May 7 , 1975 .
6 . A letter from the Tompkins County New York Division of
assessment concerned with comparision of Equalization Rates
for Assessment Rolls .
7 . A notice of a Public Hearing in the Town of Newfield to
consider the advisability of a Town Ordinance creating a flood
plain district in that town .
8 . A letter from the Association of Towns of the State of New
York advising of siminars to be held at Cornell University
June 4-6 , 1975 .
9 . Resolution No . 91 - Apportionment of Mortgage Tax adopted by
the Tompkins County Board of Representatives April 28 , 1975 .
• 10 . Minutes of the Danby Planning Board meeting of April 17 , 1975 .
11 . Minutes of the meeting of the Danby Board of Zoning Appeals
held April 30 , 1975 .
PRIVILEGE OF THE FLOOR :
Residents of Michigan Hollow Road ; Joyce Knuutila , Mr . & Mrs . Griffin ,
Gertrude Reeves , Mr . & Mrs . Steele and Lynn Deuschle attended the meeting
to ask what is to be done about the poor condition of Michigan Hollow
Road where they live . Mr . Fred Thayer and Mr . Rustyak who live on Danby
Road but near the intersection of Michigan Hollow were there for the
same reason . The traffic is heavy and the dust is unbearable plus the
general condition of the road is bad . Councilman Ralph Wilbur stated
that there is no easy solution to this problem . Something will be done
temporarily . The Tompkins County Highway Department will be contacted
to see if they can help . A lengthy discussion followed .

Privilege of the Floor continued :
E . J . Miller representative of the Tompkins County Board of
Representatives reported that a study was done and it was found
that the increase in rates for the hospital were necessary and
the board approved this . The hospital is a big problem and much
of the Board of Representatives time is spent on this subject .
Mr . Miller felt that the Michigan Hollow Road problem could be
taken back to the County Committee with good grounds . This
situation was discussed at length .
COMMITTEE REPORTS :
A . Highway report - No report .
B . West Danby Water District - Everthing is fine . •
C . Insurances - The insurance for Jennings Pond will be renewed .
D . Refuse Collection and Disposal - No report . •
E . Youth - No report .
F . Zoning & Planning - Justice Floyd Dorn stated that a meeting was
held in Danby concerning the formation of agricultural districts .
Councilman Ralph Wilbur feels that the Town Board should get
involved in this business of setting up Agricultural Districts .
A , lengthy discussion followed .
G . Fire - Councilman Ralph Wilbur is working on a contract with the
Town of Ithaca because the Town of Danby so often helps with the fires
in the south section of the Town of Ithaca .
H . Cemetaries - Justice Floyd Dorn has visited the cemetaries in the
Town to see what condition they are in . He found they need to
be mowed and need some work .
OLD BUSINESS :
Highway Superintendent - Absent , no report .
Zoning Officer - A written report was submitted .
Appeals Board Chairman - Absent , no report other than the minutes of
the last hearing before the board .
Planning Board Chairman - Mr . Cole stated that the next meeting will
deal with the proposed airstrip in Danby and he is checking with
Frank Liguori for assistance .
Supervisor A . Francis Wright stated that Mr . Maycumber has "been served
a summons . . This case will be heard in County Court . Justice Milton
Todd reported that the Bell property in West Danby is being foreclosed
on . There is a bad problem of garbage on that property . Milton Todd
made the motion that Gordon Roberts be given the authority to check
into this garbage problem and with the advice of the attorney handle
the situation as he sees fit . Justice Floyd Dorn seconded the motion
which was carried by a vote of five ayes and no noes .
NEW BUSINESS :
Supervisor A . Francis Wright stated that there will be a meeting of
the Town Board , Planning Board , Attorney Thaler , and Mr . Boehlecke
to talk about the town hall referendum . The meeting will be held at
the Town Hall on Tuesday May 27 , 1975 at 8 : 00 P . M .
The motion was made by Justice Milton Todd that the supervisor be
authorized to renew the permit with the Finger Lakes Parks
commission for the use of Jennings Pond for the recreation program .
The motion was seconded by Councilman Clyde Carrier and carried by
a vote of five ayes and no noes .

New Business Continued :
Supervisor A . Francis Wright made the motion that the Planning Board
and Appeals Board members be invited to attend the seminar held June
5th at Cornell University . The motion was seconded by Justice Milton
Todd and carried by a vote of five ayes and no noes .
Rural Community Development funds through HUD have been appropriated .
Attorney Thaler will file application for a share of these funds for
The Town of Danby .
Freedom of information law has been taken to the clerk for typing .
Application must be made to take gravel from Buttermilk Creek and
• there should be no problem in getting a permit .
General Fund Warrant #5 in the amount of $ 1 , 473 . 43 was approved to be
paid . The motion was made by Councilman Ralph Wilbur and seconded by
Councilman Clyde Carrier and carried by a vote of five ayes and no
noes .
Highway Fund Warrant # 5 in the amount of $ 2 , 745 , 55 was approved to
be paid . The motion was made by Councilman Ralph Wilbur and seconded
by Justice Floyd Dorn and carried by a vote of five ayes and no noes .
West Danby Water District Warrant # 5 in the amount of $ 225 . 77 was
approved to be paid . The motion was made by Justice Milton Todd and
seconded by Justice Floyd Dorn and carried by a vote of five ayes
and no noes .
Councilman Ralph Wilbur made the motion to accept the Supervisor ' s
reports as presented . The motion was seconded by Justice Floyd Dorn
and carried by a vote of five ayes and no noes .
Justice Milton Todd made the motion that the meeting be adjourned at
10 : 15 P . M . The motion was seconded by Councilman Clyde Carrier and
carried by a vote of five ayes and no noes .
