HomeMy WebLinkAbout1975-03-10 TOWN OF DANBY TOWN BOARD MINUTES March 10 , 1975 The regular meeting of the Danby Town Board was called to order at 8 : 00 P . M . at the Danby Elementary School , Town of Danby , Tompkins County , New York , on March 10 , 1975 . Board members present : Supervisor A . Francis Wright Councilman Ralph Wilbur Councilman Clyde Carrier Justice Floyd Dorn • Board member absent : Justice Milton Todd Others present : Louise Carrier , Gould Colman , E . J . Miller , Edward Slughts , Joseph Hulbert , Gordon Roberts , Joyce Stafford , Moses Peter , Beverly Hogben , Elizabeth Croft , John Cobb , Journal Reporter and Dan Hoffman . It was noted that the special meeting minutes of February 17 , 1975 state that Richard Wells:. was present at the meeting it should have been Richard Walker . In the regular meeting minutes for February it was noted on page two that the statment reading all the snowmobile signs have disappeared should have read some of the signs have disappeared . Councilman Clyde Carrier made the motion to approve the minutes as corrected . Councilman Ralph Wilbur seconded the motion which was carried by a vote of four ayes and no noes . COMMUNICATIONS : 1 . Minutes of the meeting of the Planning Board meeting of February 20 , 1975 . 2 . A letter from the New York State Board of Equalization and Assessment concerning payments made to the for damages done `by ' huricane agues . 3 . A letter from Gould Colman stating that he was resigning as the representative from Danby to the Tompkins County Bicentennial Commission . 4 . A memorandum from the County of Tompkins New York Division of Assessment concerned with income limitations - Age exemption for tax purposes . 5 . A note from Robert A . Boehlecke Jr . , Architect with a map showing the new location of his office . 6 . Notice of a public forum on the Fall Creek Recreational River proposal to be held March 20 , 1975 at the New York State Electric and Gas Auditorium . 7 . A meeting notice from The Susquehanna River Basin to be held • March 13 , 1975 . 8 . A letter from the Tompkins County Municipal Officials Association giving notice of quarterly meeting to be held March 19 , 1975 at the Holiday Inn . 9 . A letter from Danby teenagers asking for the use of the Town Hall for a recreation center and money to get this started . PRIVILEGE OF THE FLOOR : Justice Floyd Dorn said the Justice Court received some unfavorable publicity recently . It was a planned and staged act to discredit the Danby Justice Court . No justice was obtained from this act . O Town Board Minutes - March 10 , 1975 - Page 2 Privilege of the Floor Continued : Tompkins County Representive , Erie J . Miller stated that there had been a busy day at the board meeting held March 10 , 1975 . The request for increased rates for the hospital were turned down . The youth situation is in the hands of a study committee . A resolution was passed to file application for grant assistance in airport improvements . Mr . Miller tried to get Gould Colman to stay on as a member of the Bicentennial Committee . He also asked about the junk car situation in the Town of Danby at the present time . He referred specifically to the situation next to the town hall . A lengthy discussion followed . • John Cobb spoke for the teenagers in Danby . He said that a petition • had been circulated and signed by teenagers interested in using the town hall as a recreational center . Beverly Hogben added that the teenagers in Danby have no place to meet in Danby . Gould Colman stated that he attended the meeting as a follow up of the meeting of the group interested in preservation of the town hall and the Danby Town Board . He asked what is to be done about ; the town hall . A pitition was circulated and signed by people interested in restoring the town hall , preserving it ' s historical value and providing the necessary office space needed now . Over 200 people signed the petition . The Town Board mentioned that a study was made of the several options available . Possibly these figures should be published again . The cost of renovation of the town hall would be prohibitive at this . The matter was tabled for six months at a previous meeting of the town board . A lengthy discussion followed . Moses Peter mentioned that as the town has applies for Flood Insurance and they have not been notified of approval as yet perhaps this should be followed up . He stated that the town board should not allow road signs to be changed by the townspeople . COMMITTEE REPORTS : A . Highway Report - Councilman Ralph Wilbur reported that stone is being hauled to West Danby for the West Danby black topping project this summer . It. . is being put on the Water District property . Work has been . started on King ' Road which is a Donavan project . The highway barns must be updated . This matter was discussed at length . B . West Danby Water District - No report . C . Insurance - No report . D . Refuse Collection and Disposal - No report . E . Youth - The teenagers again asked that the town board consider the use of the town hall for a youth center . A meeting will be set up with the Town Board and the Danby Community Council to discuss the matter further . F . Zoning and Planning - No report . • G . Fire - Councilman Ralph Wilbur stated that the new fire truck has been delivered . It is a much larger truck than the town has had before . No problems are for seen as far as weight on the bridges in the town is concerned . H . Cemetaries - No report . OLD BUSINESS Report of Highway Superintendent - No report . honing Officers report - A written report was submitted and Gordon Roberts reported that Mr MayCumber is asking that the Town Board apply for funds for a fence so that he can fence in his operation . He also asked if their would be a Danby Cleanup Day this year ? If there are plans for one he strongly advised that it be well advertised . As far as a fence for Mr . MayCumber is concerned Councilman Ralph Wilbur stated that the Town Board has already been over this matter and previously decided that Town Board Minutes - March 10 , 1975 - Page 3 Old Business Continued : Mr . MayCumber should be responsible for his own fence . He also stated that perhaps another attorney should be consulted as nothing seems to be happening . Councilman Clyde Carrier stated that we should have some positive action by the next town board meeting on the MayCumber situation . If Mr . Thaler doesn ' t help us let ' s get someone else even if we go out of town . As was previously stated the board keeps repeating this matter . We are being given the run around by the attorney . Gordon Roberts stated that too many people apply for a building permit only after he has approached them and their building is already started . Possibly they should be fined to put a stop to • this . Possibly the pertinent Section of the Zoning Ordinance could be printed in the Danb5*, Area News . The clerk was asked to mail a copy of the Board Meeting minutes to Richard Thaler . Report of the appeals board chairman - Moses Peter reported that the attendance at the appeals board hearings is not good . Roland Neefe does not attend regularly . He asked that the supervisor write and ask what his intentions are . Report of Planning Board Chairman - No report . Report of committee on Freedom of Information Law - The committee working on this has received a copy of the regulations and they were discussed at length . NEW BUSINESS : Councilman Ralph Wilbur recommended the purchase of a used Gradall from Cayuga Leasing for $ 13 , 960 . 00 and asked that a letter of rejection be sent to Roger Beck for the bid he submitted . The reason is that Mr . Beck ' s machine did not meet specifications or condition qualifications . Ralph Wilbur then made the motion to purchase a used gradall from Cayuga Leasing for the price of $ 13 , 960 . 00 . The motion was seconded by Councilman Clyde Carrier . RESOLUTION # 5 ACCEPT BID FOR USED GRADALL Roll Call Vote : Wright - aye W ilbur - aye Carrier - aye D orn - aye Carried by a vote of four ayes and no noes . Councilman Ralph Wilbur made the motion that $ 7 , 574 . 00 be transferred from the Federal Revenue Sharing Account and $ 6 , 386 . 00 be transferred from the Machinery Fund Account DM5130 . 2 and $ 13 , 960 . 00 added to the Capital Fund Account H3591 to make funds available to pay for the used gradall . The motion was seconded by Councilman Clyde Carrier . RESOLUTION #6 TRANSFER OF NECESSARY FUNDS FOR THE PURCHASE OF A USED GRADALL • Roll Call Vote : Wright - aye W ilbur - aye Carrier - aye D orn - aye Carried by a vote of four ayes and no noes Justice Floyd Dorn made the motion to table the matter of Gould Colman ' s resignation as a member of the Tompkins County Bicentenial Committee . Councilman Ralph Wilbur seconded the motion which was carried by a vote of four ayes and no noes . 9G Town Board Minutes - March 10 , 1975 - Page 4 New business continued : The Town Board discussed the changing of the income limit for persons over 65 from $ 6 , 000 . 00 to $ 6 , 500 . 00 for tax purposes . Councilman Ralph Wilbur made the motion to make this change . Justice Floyd Dorn seconded the motion . RESOLUTION #7 INCREASE THE INCOME LIMIT FROM $ 6 , 000 . 00 to $ 6 , 500 . 00 FOR PERSONS OVER 65 YEARS FOR TAX PURPOSES • Roll Call Vote : Wright - aye Wilbur aye Carrier - aye Dorn - aye Carried by a vote of four ayes and no noes . The Town Hall business was discussed at length as to the back ground work done by the Town Board and why the matter was tabled for six months . A petition was received from Coddington Road people concerning the Town Hall . Town Board members want to make people aware of the work that has been done . They discussed how this might be accomplished . There will be an executive meeting of the Town Board to be held March 20 , 1975 at the Danby Elementary School . The purpose of the meeting will be to discuss the Youth Program and also Highway Programs . The board will meet with the Planning Board at 8 : 00P . M . at their regular meeting . The clerk was asked to make reservations for town officials who wished to attend the municipal officials dinner meeting Wednesday March19 , 1975 . General Fund Warrant #3 in the amount of $ 827 . 21 was approved to be paid . The motion was made by Justice Floyd Dorn and seconded by Councilman Clyde Carrier and carried by a vote of four ayes and no noes . Highway Fund Warrant #3 in the amount of $ 3 , 122 . 95 was approved to be paid . The motion was made by Councilman Clyde Carrier and seconded by Justice Floyd Dorn and carried by a vote of four ayes and no noes . West Danby Water District Warrant #3 in the amount of $ 24 . 30 was approved to be paid . The motion was made by Councilman Ralph Wilbur and seconded by Councilman Clyde Carrier and carried by a vote of four ayes and no noes . The motion was made by Justice Floyd Dorn to accept the supervisor ' s reports as presented . Councilman Ralph Wilbur seconded the motion which was carried by a vote of three ayes and no noes . The motion was made at 11 : 00 to adjourn the meeting . Councilman Ralph Wilbur made the motion which was seconded by Supervisor A .
