TOWN BOARD MINUTES •
October 14 , 1974
The regular meeting of the Danby Town board was called to order at
8 : 00 P . M . at the Danby Elementary School , October 14 , 1974 .
Board members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
Councilman Clyde Carrier
Justice Floyd Dorn

Others present : Mildred Miller , Jane Fowler , Clyde Carrier , Mrs . Sisler ,
Jimmie Miller , Gordon Roberts , Joseph Hulbert , Ernest Cole , Gould Colman ,
Arch Dotson , Esther Dotson , Edward Slights , John Kern , Mrs . John Kern ,
Walter Reimers , Betty Melchen , John Novarr , Mr . Sebesta , Helen McDougall ,
David Warrner , Margaret Corbitt and the Ithaca Journal reporter .
Justice Milton Todd made the motion that the minutes of the September
9 , 1974 meeting be approved as presented . Councilman Clyde Carrier
seconded the motion which was carried by a vote of five ayes and no noes .
COMMUNICATIONS :
1 . A letter from the New York State Office for Local Government
advising of a management conference to be held Thursday
October 24 , 1974 at the Treadway Inn in Binghamton , New York ,
2 . A memorandum from State of New York Committee on Public access
to public records with a questionaire attached .
II 3 . A letter from John Miller , County Fire and Disaster
Coordinator asking for a list of official names for the
roads in the Town of Danby .
4 . A note from Anna Covert saying that she is resigning as
alternate election inspector in District II .
5 . Minutes of the meeting of the Danby Board. of Zoning Appeals
meeting held October 9 , 1974 .
6 . Minutes df the Planning Board meeting of September 18 , 1974 .
7 . Minutes of the meeting of the Danby Board of Zoning Appeals
of August 28 , 1974 .
8 . A letter from the New York State Department of Enviromental
• Conservation concerning Flood Insurance .
9 . Minutes of the September 25th meeting of the Danby Board of
Zoning Appeals .
PRIVILEGE OF THE FLOOR :

Erie J . Miller reported that the board of representatives meeting held
today was concerned with the office of District Attorney . The county
will have a part time District Attorney instead of a full time one .
Disposal of sewage in the county was discussed and the question of
Boardman House was put off for two more weeks .
Mr . Gould Coleman stated that he felt that the historical value of the
town hall could be preserved and also the towns need for office space met
by remodelling the town hall . He felt this could be done at a much lower
cost than the figure presented by the planning board with their plans .
There have been several meetings of the people that are interested in
preserving the old town hall . The plan presented to the town board
would provide for volunteer help . The Town Board asked for floor plans .
These were given to them . A lengthy discussion followed .

Privilege of the Floor continued :
Mr . Sebesta commented that the town should consider the longrange needs
of the town . Possibly an inexpensive building now would give the board
time to come up with more substantial plans for the future .
Helen McDougall from the State Division of Historical Preservation
remarked that there is a possible 50% funding available from the state .
An application would have to be filed . The town , if eligible , would
be able to get these funds in 1976 . She said she would mail an application
to the town .
411 Arch Dotson stated that the Town Board has plans for remodelling the
town hall . When will they hold a referendum so the people can vote on
this matter . Are there any estimates as to when it might be , October ,
November , 1976 ? Supervisor A . Francis Wright state that the board is
not ready to hold a referendum yet . They want to move affectively and
correctly and must go to the town attorney for the legality of the
referendum .
Ralph Wilbur stated that the request for a definite time now is
unreasonable . Many more questions need to be asked . He stated that
he is willing to listen to a proposal .
The motion was made by Councilman Ralph Wilbur that the Town Board
meet with a committee from the historical preservation group from the
Town of Danby to discuss the plans they have for restoration of the
town hall . The motion was seconded by Justice Milton Todd and carried
by a vote of five ayes and no noes . Attorney Richard Thaler and the
Planning Board chairman , Ernest Cole , will be invited to this meeting .
Walter Reimers submitted reports on the summer program that was set up
and run by the Danby Community Council and partially funded by the
town . The clerk read the reports .
The State Youth Director will meet with the Town Board and any members
of the Community Council that are able to attend . This meeting will
take place October 30 , 1974 at the home of the supervisor at 7 : 00 P . M .
Mrs . Sisler reported that Historic Ithaca is taking a survey of the
buildings in the County that were constructed in the 18001s . She is
currently working in the Town of Danby collecting information . She
then commented on the restoration of the town hall and the addition of
office space .
David Warrner who lives on John Hill Road asked that some road work be
done to mke the road passable . He doesn ' t need much just a little
gravel . The highway committee will meet and then get in touch with Mr .
Warrner as to what action will be taken .
COMMITTEE REPORTS :
A . Highway Report - The Brown Road has been completed for inspections
III This was a Donovan project . Hill Road has been repaired as requested .
People all seem satisfied . The LaRue Road Bridge is still to be
completed . The creek has been cleaned out to lower the level of the
water in preparation for further work . The snow plowing equipment is
being made ready for winter . People wishing to cut wood should go
to Joseph Hulbert and he will direct them .
B . West Danby Water District - Supervisor A . Francis Wright stated that
the West Danby Water District Budget must be modifiedsin the amount
of $813 . 50 . Councilman Clyde Carrier made the motion that $400 . 00 be
taken from SW8320 . 4 and $ 300 . 00 from SW8310 . 1 and 0113 . 50 be taken
SW8310 . 4 and these three amounts transferred to Sw8340 . 4 . The motion
was seconded by Justice Milton Todd .

C . Insurance - No report .
D . Refuse Collection and Disposal - No report .
E . Youth - Report submitted and read by the clerk .
F . Zoning and Planning - Written reports submitted and read . Councilman
Ralph Wilbur commented that the appeals Board has granted a variance
on a garage being built to close to the road and at the same time
another case is being taken to court for a very similar violation .
Gordon Roberts stated that the appeals board can only act on the
cases brought before them and each case is judged on its own merits .
In the above mentioned cases one person followed the correct procedure
in filing an appeal and the second person failed to do anything except
continue to build his garage without a permit . A lengthy discussion
followed .
G . Fire - Ralph Wilbur stated that the fire company is concerned about
their new pumper- tanker . The chassis is ready for delivery but there
is no equipment and the time allowed for delivery in the contract is
almost up .
H . Cemetaries - No more work will be done this season .
OLD BUSINESS :
Report of Highway Superintendent - No report .
Report of Zoning Officer - A written report was submitted . Gordon
Roberts also discussed the Maycumber situation . The town attorney has
written to Mr . Maycumber three times and has had no reply to his
letters . The next step will be up to the town board . Supervisor A .
Francis Wright said he would write a letter to Mr . Maycumber and advise
the town attorney that he has done so . A discussion then followed
concerned with people coming before the appeals board for a hearing and
being unprepared .
Report of Appeals Board Chairman - No report .
Report of Planning Board Chairman - The Planning Board will start work
• on the zoning ordinance at their next meeting . Mr . Cole thought the
joint meeting suggested by the appeals board would be a good thing .
After checking with Moses Peter chairman for the Appeals Board a time
to hold the meeting will be set .
Flood Insurance Report - No Report .
The supervisor stated that the meeting of the Association of Towns will
be held in New York City the 10th , 11th , and 12th of February 1975 . He
would like all who are able to attend this meeting . The date of the
Town Board meeting which falls on the 10th of February that month will be
changed .
A special committee will be set up to handle the freedom of information
business .

NEW BUSINESS :
As a matter of information it was noted that a group has met to create
an Ag District in the County . Farmers do not automaticly come under
this but must apply and if they are qualified they can become part of
the Ag District . There is no advantage to this in Danby . A long
discussion followed .
II Supervisor A . Francis Wright asked that he be authorized to attend the
meeting in Binghamton the 24th of October . Councilman Ralph Wilbur made
the motion that the expenses of the supervisor be paid to the management
0 conference . The motion was seconded by Councilman Clyde Carrier and
carried by a vote of five ayes and no noes .
The date for the public hearing on the budget was set for November 11th
at 7 : 00 P . M . at the Danby Elementary School . The motion was made by
Justice Milton Todd and seconded by Councilman Clyde Carrier and
carried by a vote of five ayes and nonnoes .
The motion was made by Supervisor A . Francis Wright that Gordon Roberts
be authorized to attend a school pertinent to his job as zoning officer .
The motion was seconded by Councilman Ralph Wilbur and carried by a vote
of five ayes and no noes .
General Fund Warrant #10 in the amount of $ 3 ,, , 493 . 64 was approved to be
Paid . The motion was made by Justice Floyd orn and seconded by
Councilman Clyde Carrier and carried by a vote of five ayes and no noes .
Highway Fund Warrant #10 in the amount of $ 7 , 179 . 75 was approved to be
paid . The motion was made by Councilman Ralph Wilbur and seconded by
Justice Milton Todd and carried by a vote of five ayes and no noes .
West Danby Water District Warrant # 8 in the amount of $ 121 . 12 was approved
to be paid . The motion was made by Justice Milton Todd and seconded by
Councilman Ralph Wilbur and carried by a vote of five ayes and no noes .
Councilman Ralph Wilbur made the motion to accept the Supervisor ' s
reports . Justice Floyd Dorn seconded the motion which was carried by a
vote of four ayes and no noes .
Councilman Ralph Wilbur made the motion to adjourn the meeting which was
seconded by Councilman Clyde Carrier and carried by a vote of five ayes
and no noes .
