M . at the Danby Elementary School , September 9 , 1974 . Board members present : Supervisor - A . Francis Wright Councilman Ralph Wilbur Councilman Clyde Carrier Justice Floyd Dorn Justice Milton Todd. • Others present : Mrs . Makaranen , Edward Slights , Mary Casterline , Roy Casterline , Joseph Hulbert , Mrs . Carrier , Betty Melchen , Robert Maycumber , Jr . and Robert Maycumber , Sr . , Ernest Cole , Gordon Roberts , Gould Colman , Arch Dotson , Mrs . Evelien and the Ithaca Journal reporter . Justice Milton Todd made the motion that the minutes of the August 12 , 1974 meeting be approved as presented . Councilman Clyde Carrier seconded the motion which was carried by a vote of five ayes and no noes . COMMUNICATIONS : 1 . A letter from the New York State Temporary State Commission of State and. Local Finances advising the board of public hearings to be held throughout the state . 2 . A notice of the reschedualingci. f the public hearings to be heard before the State of New York Public Service Commission . 3 . A letter from Douglas Gillogly stating the procedure to follow to inact the legal notice for T . V . Cable service in Danby . 4 . Agenda of the Tompkins County Board of Representatives meeting of Monday , September 9 , 1974 . 5 . A letter from the Tompkins County Municipal Officials ' Association advising of the quarterly meeting September 18 , 1974 . 6 . A letter from the State of New York Department of Audit and Control concerning highway aid to towns 1975 payment . 7 . A proclamation from Governor Wilson setting aside September 17 , 1974 as Citizenship Day in New York State . 8 . A letter from the Ithaca Speech Clinic concerning the bridge on LaRue Road . 9 . A copy of a letter to the Commissioner of Health in Albany concerning the reguiring of rabies vaccination before dogs may be licensed . 11 . Town Board Minutes - September 9 , 1974 m Page 2 PRIVILEGE OF THE FLOOR : Robert Maycumber , Sr . asked the help of the Town Board in getting state aid to pay for putting a fence around his salvage yard . He has been advised that money is available and as soon as he can get estimates he will give them to the town board and is asking them to file an application with the state . Perhaps this could be done for others as well . He feels that a salvage yard is a very necessary thing . He also stated that he maintains a 24 hour wrecker service in the town . COMMITTEE REPORTS : • A . Highway Report - Howard Stevenson and Bill Mobbs have checked the LaRue Road Bridge . They have recommended to Joe Hulbert that he pour a concrete slab at the bottom of the creek and build a bridge over this and not use pipe at all . The board asked Joe to get this in writing . Work has been done on Travor Road although there is no indication that this is a public road . The truck has been delivered and has been licensed and is in operation . Ralph Wilbur complimented Joe on a good job done . B . West Danby Water District - No report . C . Insurance - Nothing new . D . Refuse Collection and Disposal - Mr . Turk has changed his pick up date from Tuesday to Saturday . People were dissatisfied because they were not notified but now they know and things are alright . E . Youth - No report F . Zoning and Planning - No report . G . Fire - N9 Report . H . Cemetaries - All in good shape . OLD BUSINESS : Report of Highway Superintendent - No report . Report of Zoning Officer - Written report submitted . Two cases are to be heard in Justice Court September 10 , 1974 . Appeals Board Chairman - Absent , No report . Planning Board Chairman - Ernest Cole recommended Donald Graham be considered by the Town Board to fill the vacancy on the Planning Board . Mr . Cole then presented the results of the study made by the Planning Board for new town offices . After due consideration and many meetings the board came up with five options . The first was to demolish the present town hall and build a new building plus buying the adjoining property for parking space . The second option was to take the back part • off the present town hall , leave the front = part ': as a meeting room and build an L shaped office in the back . The third option was almost the same as the second except that the office space would be built in the shape of a square . The fourth option was to build an office building adjacent to the fire station . This would involve buying the land from the fire commissioners and using the meeting room , restrooms and the kitchen in the fire station . The fifth option would be to completely remodel the town hall . The Planning Board recommended that the town board accept either option two or option four . The voters of the town should be given the opportunity to choose between these two by a referendum vote . Mr . Cole noted that options two , three and five would also include buying the property next door for parking space . He also stated that the Planning Board will continue to assist the town board in any way they can . Cost estimates were discussed and Mr . Cole answered questions presented by the public and town board about the town hall office space study . The clerk was asked to compose a lettere thanks to the Planning Board in appreciation of all the time spent in getting this study together . L Town Board Minutes - September 9 , 1974 - Page 3 Old Business continued : The flood insurance report has been mailed . Nothing further has been heard from this at the present time . The Town Board stated that as soon as Joseph Hulbert receives a letter from Howard Stevenson instructing him on the repair of the LaRue Road Bridge he should proceed . Supervisor A . Francis Wright made the motion that Donald Graham be appointed to serve as a member of the Planning Board . He will replace Louis Ackerman whose term expired June 30 , 1974 . Mr . Graham ' s term will expire in 1981 . Justice Milton Todd seconded the motion which was carried by a vote of five ayes and no noes . Councilman Ralph Wilbur made the motion that Harry Hatfield be appointed as voting machine custodian . The motion was seconded by Justice Milton Todd and carried by a vote of five ayes and no noes . Supervisor A . Francis Wright stated that a resolution was needed on the retirement fund for the town . It was recommended that the town take the non- contributory plan the records to be kept by the supervisor . The motion was made by Ralph Wilbur that the town sign up for the non- contributory plan for retirement for town employees . The motion was seconded by Justice Milton Todd . RESOLUTION #19 PROVISION FOR A 1 /60TH PENSION BENEFIT UNDER A NON- CONTRIBUTORY PLAN C Roll Call Vote : Wright - aye Carrier - aye Wilbur - aye Dorn - aye Todd - aye Carried five ayes and no noes . Justice Floyd Dorn made the motion that Bob Barnhardt be appointed dog enumerator for the town for 1974 . Justice Milton Todd seconded the motion which was carried by a vote of five ayes and no noes . It was noted that Gould Colman has accepted the appointment as Danby ' s representative to serve as a member of the bicentenial committee . A report was received from Douglas Gillogly concerning the cable television franchise in Danby . He states that a legal notice must now be placed in the Ithaca Journal , Broadcasting in Washington D . C . and C . A . T . V . in Englewood Colorado . The motion was made by Councilman Clyde Carrier to authorize the supervisor to place the legal notice in the above mentioned places . Justice Milton Todd seconded the motion . RESOLUTION #20 AUTHORIZE SUPERVISOR TO POST LEGAL NOTICES AS NECESSARY FOR TV CABLE • TELEVISION FRANCHISE IN THE TOWN OF DANBY Roll Call Vote : Wright - aye Wilbur - aye Carrier - aye Dorn - aye Todd - aye Carried five ayes and no noes . The motion was made by Councilman Ralph Wilbur that September 17 , 1974 be proclaimed " Citizenship Day " at the suggestion of Governor Wilson . The governor proclaimed this date as " Citizenship Day " in New York State . The motion was seconded by Justice Floyd Dorn and carried by a vote of five ayes and no noes . Town Board Minutes e September 9 , 1974 ® Page 4 Old Business Continued : The town board discussed the new law called the Freedom of Information Law that has been in affect since September 1 , 1974 . The law requires that the public have free access to public records . The New York State Commission on Public Access to Records will advise municipalities of guidelines and regulations that may be used . A . Francis Wright stated that the town board should act as a committee to go over the rules and regulations so veryone will understand what the law is all about . The budget meeting set for Monday September 16 , 1974 will be held at • the home of the supervisor at 7 : 30 P . M . instead of 7 : 00 P . M . as originally scheduled . Tompkins County Representative , Erie J . Miller , reported that the County has passed a resolution that will help keep Justice Court in the towns . General Fund Warrant #9 in the amount of $433 . 94 was approved to be paid . The motion was made by Councilman Ralph Wilbur and seconded by Justice Milton Todd and carried by a vote of five ayes and no noes . Highway Fund Warrant #9 in the amount of $ 15 , 724 . 55 was approved to be paid . The motion was made by Justice Milton Todd and seconded by Justice Floyd -Dorn and carried by a vote of five ayes and no noes . West Danby Water District Warrant #7 in the amount of $491 . 20 was approved to be paid . The motion was made by Justice Floyd Dorn and seconded by Councilman Clyde Carrier and carried by a vote of five ayes and no noes . Councilman Clyde Carrier made the motion to accept the Supervisor ' s reports . Councilman Ralph Wilbur seconded the motion which was carried by a vote of five ayes and no noes .
