M . at the Danby Elementary School , August 12 , 1974 . Board members present : Supervisor A . Francis Wright Councilman Ralph Wilbur Councilman Clyde Carrier Justice Floyd Dorn Justice Milton Todd • Others present : Gordon Roberts , Mrs . Clyde Carrier , Erie J . Miller , Attorney Richard Thaler , Ernest Cole , Joseph Hulbert , Edward Slights , Mark Silverman , Floyd Hoover , Mrs . Hoover , Dr . Neffer , Mr . Badger and The Ithaca Journal reporter . Justice Floyd Dorn made the motion that the minutes of the July 8 , 1974 meeting be approved as presented . Justice milton Todd seconded the motion which was carried by a vote of five ayes and no noes . COMMUNICATIONS : 1 . A letter from the employees retirement system advising the board of the Monday , August 19th meeting of the town employees with representative Mr . Rosenbaum . 2 . A letter from the United States Department of Agriculture concerning the culvert size needed for the bridge to the Ithaca Speech Clinic . 3 . A letter from Richard E . Murdock , Drug Programming Coordinator , asking how to apply for Town of Danby Revenue Sharing Funds . 4 . A letter from Gary E . Lee concerning the appointment of a member to the Bicentennial Committee from the Town of Danby . 5 . Minutes of the Danby Town Planning Board meeting of July 17 , 1974 . PRIVILEGE OF THE FLOOR : Floyd Dorn stated that Justice Court has been busy . There were thirty cases heard in July and already several scheduled for August . Flood Hoover reported that the condition of Travor Road is very poor . Mr . Hoover and the other people living along this three quarters of mile of road would like some work done to improve the condition of the road . There are five families involved . Another resident Mr . Silverman said that he will have a son attending school this fall and repairing the road would be a help in getting bus transportation . At the present time mail delivery is made only as far as the South Danby Road even though Travor • Road is part of the mail route . There was some discussion as to whether this section of road was a public road . It was decided that the Highway Committee make a study of this matter . Erie J . Miller stated that the work has been light at the County Board of Representatives this summer . He said he would be glad to answer any questions that anyone might have pertaining to County business . Dr . Neffer Vice- president of the Ithaca Speech Clinic stated that the speech clinic is a private non- profit organization for the deaf and hard of hearing . They have been operating for over thirty- six years . They have never asked for help before but now feel that special consideration be given to the repairing of the bridge leading to the speech clinic . They are concerned about the fire hazard and with the water situation . There are youngsters at the clinic from all over the v TOWN OF LANEY PLANNING BOARD MINUTES The regular meeting of the planning Board was held at the Danby Town Hall , July 17 , 1974 at 8 ; 00 P . M . Planning Board members present : Chairman Ernest Cole Sec , Alberta Wilbur Edgar Oltz Stanley Kirk Board members absent : Vice - Chairman Clifford Hill William Best Town Board members present : Supervisor A . Francis Wright 5 Councilman : None Justice Floyd Dorn Others present : Ithaca Journal Reporter , John Teeter , Gordon Roberts , James Miller , EDward Slights , Edward Roberts , Mr , & Mrs . Weber ( Here to report to the Dryden newspaper . ) Purpose of this meeting is for the towns people that are interested in a new town hall . Ernest Cole ( Chairman ) declard minutes from June approved as presented . ti. PRIVIT ,FGE OF THE FLOOR : Justice Floyd Dorn said he was surprised there was so much interest in remodeling this Town Hall and not much interest 5� in this meeting for a new Town Offices . A . Francis Wright , this is a personal feeling , he is not A speaking for the town board , he feels the town is not progressing , we do have an obligation to this building we should come up with a compromise . The Town does have Federal revenue sharing funds to work with and spend wisely .:. To get those who want to volunteer help to remodel this Town hall , tear off back of building and build all new x. Offices on , using the services of an architect . d `! Mrs . Dotson , just here because she was interested in what went on at this meeting . The Planning . . Board now has three options : The Architect has drawn- up plans in conjunction with the Danby Firehouses, just i. offices , using their meeting room , price for around $ 35 , 000 ! not including buying land from Fireman . d Another plan to be drawn up of offices on back of present Town Hall . Build a new Town Offices on present lot , buying land next to Town Hall . The plans drawn up of offices joining Firehouse were :shown at this meeting . Town Board Minutes - August 12 , 1974 - Page 2 Privilege of the floor continued : country and some from other countries . There are from 125 to 150 children at the clinic at one time . They are concerned about the saftey and welfare of the children . A lengthy discussion followed . Attorney Richard Thaler stated that Section 230 of the Highway Law says the procedure to follow concerning bridge repair is to first notify the County Highway Supervisor and then wait for his recommendations . The highway Committee was asked to follow these instructions and get back to the town board . COMMITTEE REPORTS : • A . Highway REport - The road work is proceeding as usual . The new truck still has not been received but the tires for the truck have been purchased . B . WestDanby Water District - No report . C . Refuse Collection and Disposal - There seem to be no problems . D . Insurance - Justice Milton Todd reported that after talking to two insurance agents representing two different insurance companies he finds that neither could compete with Blue Cross and Blue Shield . A proposal should be made to the board according to the supervisor . E . Youth - Mary Oltz reported that the summer program at the school is over and seemed to be a good one . The swim program at the pond is still in progress . F . Zoning and Planning - Justice Floyd Dorn stated that the main concern right now seems to be offices for the town officials . The planning Board is working on this . G . Fire - Ralph Wilbur says that a new $49 , 000 . 00 fire truck has been purchased . H . Cemetaries - All in good order according to Justice Floyd Dorn . OLD BUSINESS : Report of Highway Superintendent - Joseph Hulbert reported that prices are going up all the time on everything it is necessary for him to purchase for road work and also to keep the trucks in good repair . Report of Zoning Officer - A written report was submitted and Gordon Roberts added that a hearing is coming up before Judge Dorn tomarrow . The Maycumber case was discussed . Report of the Appeals Board Chairman - Chairman absent . The secretary reported that two appeals have been heard ; one July 24 , 1974 and the other August 7 , 1974 . There are two more appeals yet to be scheduled . Planning Board Chairman - Still working on the office space . A • recommendation will be made to the Town Board at the September meeting . The board is still short one member . The three proposed resolutions to be adopted by the board in order to apply for flood insurance were read . Justice Milton Todd made the motion that the Town Board assure the Federal Insurance Administration that it will enact as necessary and inforce the provisions as set forth in Section 1910 of the National Flood Insurance Program Regulations . The motion was seconded by Justice Floyd Dorn . RESOLUTION #15 DANBY TOWN BOARD ASSURES THE FEDERAL INSURANCE ADMINISTRATION IT WILL ENACT AND INFORCE THE PROVISIONS OF THE NATIONAL FLOOD INSURANCE REGULATIONS . Justice Milton Todd made the motion that the Zoning Officer review all building permit applications for new construction or improvements to determine whether proposed building sites will be reasonably safe from flooding . Councilman Ralph Wilbur seconded the motion . RESOLUTION #16 ZONING OFFICER TO REVIEW ALL BUILDING PERMIT APPLICATIONS TO DETERMINE IF REASONABLY SAFE FROM FLOODING Roll Call Vote : Wright - aye Carrier - aye Wilbur - aye Dorn - aye Todd - aye Carried five ayes and no noes . Justice Milton Todd made the motion that the Zoning Officer require the issuance of a permit for any excavations , grading , fill , or construction in the community . The motion was seconded by Councilman Clyde Carrier . RESOLUTION #17 ZONING OFFICER REQUIRE THE ISSUANCE OF A PERMIT FOR ANY EXCAVATION , GRADING , FILL , OR CONSTRUCTION IN THE COMMUNITY Roll Call Vote : Wright - aye Wilbur - aye Carrier - aye Dorn - aye Todd - aye Carried five ayes and no noes . Repairs to the bridge on La Rue Road leading to the Ithaca Speech Clinic was discussed at length . It was decided that the County Highway Superintendent should be notified in writing and when the Town Highway Superintendent gets the evaluation from him the problem should then be worked on . The motion was made by Justice Milton Todd that Percy Button from West Danby be appointed voting machine custodian to replace Reverand Huth who has moved from the area . The motion was seconded by Justice Floyd Dorn and carried by a vote of five ayes and no noes . • Justice Milton Todd made the motion the voting machine custodians go to the Jamestown School for instruction the cost to be paid by the town . Justice Floyd Dorn seconded the motion which was carried by a vote of five ayes and no noes . Justice Milton Todd made the motion to transfer the necesaary funds for this school . The motion was seconded by Councilman Clyde Carrier . RESOLUTION #18 MODIFY THE BUDGET BY TRANSFERRING $300 . 00 FROM THE EQUIPMENT ACCOUNT UNDER ELECTIONS A1450 . 2 TO A1450 . 4 Roll Call Vote : Wright - aye Carrier - aye Wilbur - aye Dorn - aye Todd - aye Carried five ayes and no noes . Town Board Minutes - August 12 , 1974 ® Page 4 NEW BUSINESS : An information meeting to implement the employees pension plan will be held August 19 , 1974 at 7 : 00 P . M . at the Town Supervisor ' s house and 8 : 00 P . M . A budget meeting was set for Monday , September 16 , 1974 at the home of the Town Supervisor at 7 : 00 P . M . The clerk was asked to call Gould Colman and ask if he would serve on the Bicentenial Committee as Danby ' s representative . If he cannot serve Esther Dotson will be called . Gary Lee should be notified . • General Fund Warrant #8 in the amount of $363 . 87 was approved to be paid . The motion was made by Justice Floyd Dorn and seconded by Councilman Clyde Carrier and carried by a vote of five ayes and no noes . Highway Fund Warrant #8 in the amount of $6 , 349 . 17 was approved to be paid . The motion was made by Councilman Ralph Wilbur and seconded by Justice Floyd Dorn and carried by a vote of five ayes and no noes . Councilman Ralph Wilbur made the motion to accept the Supervisor ' s Reports . Councilman Clyde Carrier seconded the motion which was carried by a vote of four ayes and no noes . The supervisor declared the meeting adjourned . Respectfully submitted , Maryaltz , erk • RESOLUTION #17 TOWN OF DANBY TOMPKINS COUNTY , NEW YORK At a regular meeting of the Town Board held in and for the Town of DAnby , Tompkins County , New York , on the 12th day of August 1974 the following resolution was duly adopted indicating the Zoning Officers duties as applicable to the enforcement of the Zoning Ordinance as it applies to mudslide prone areas : WHEREAS , the Town Board of the Town of Dpnby has adopted and is enforcing a zoning ordinance , and WHEREAS , Section 1001. of the aforesaid prohibits any person , firm , _oz ._c_orporation from erecting , constructing , enlarging , altering , repairing , improving , moving or demolishing any -building Cr structure without-first obtaining -a separate - building- - permit- -_for_ _each_ _building or structure from the Zoning Officer , and WHEREAS , the zoning officer must examine all plans and specifications for the proposed construction when application is made to him for a building permit . NOW THEREFORE , BE IT RESOLVED as follows : 1 . That the zoning officer shall require the issuance of a permit for any excavation , grading , fill , or construction in the community ; and 2 . That the zoning officer shall require review of each permit application to determine whether the proposed site and improvements will be reasonably safe from mudslides . If a proposed site and improvements are in a location that may have mudslide hazards , a further review must be made by persons qualified in geology and soils engineering ; and the proposed new construction , substantial improvement , or grading ( i ) be adequately protected against mudslide damage and ( ii ) not aggravate the existing hazard . Adopted August 12 , 197t RESOLUTION #18 MODIFY THE BUDGET BY TRANSFERRING $ 300 . 00 FROM THE EQUIPMENT ACCOUNT A1450 . 2 TO A1450 . 4 WHEREAS , at the regular meeting of the Danby Town Board , at the w Danby Elementary School , Gunderman Road , Town of Danby , Tompkins County , New York , on August 12 , 1974 , and , WHEREAS , the town board decided by unamious vote to pay the expenses of the voting • machine custodians for the school in Jamestown , New York , it was , . RESOLVED , that the - money needed for travel to and from the school and the motel bill should not exceed $ 300 . 00 . This amount to be transferred from the equipment account under elections A1450 . 2 to account A1450 . 4 .
