RESOLUTION FOR ISSUANCE OF SERIAL BOND .
TOWN OF DANBY
WHEREAS- , The ' Town. .Board of the Town of Danby , New York , by
Resolution No . 10 , duly adopted on the 13th day of May , 1974 ,
authorized the . Supervisor ; of the Town of Danby • to. purchase a
Brockway truck for $ 37 , 800 . 00 , including $ 900 . 00 for the tires
o n said vehicle , to be paid as follows : . $ 10 , 450 . 00 out of cur -
✓ ently appropriated capital funds in the Highway Department and
the balance , of $ 27 , 350 . 00 by borrowing from the Tompkins County
Trust Company on a 5 year serial bond , and . . •
WHEREAS , it is necessary to have said truck for the . mainten-
ance of the highways of said Town ,
NOW ; THEREFORE , BE IT RESOLVED :
1 . That the specific object . . or purpose for which said obliga -
t ion. is to be issued pursuant to . this Resolution , is to permit the
financing of the cost of said truck for the maintenance and construe -
d on of roads in the Town of Danby .
2 . That said equipment , when purchased , is to be used by said
Town of. Danby .
3 . That the following determinations are hereby made :
(a ) : That the period of probable usefulness of such
machinery and equipment is seven years ; ,
(b ) That the subdivision of Paragraphs a . of Section
11 . 00 of the Local Finance Law ,. which ' is ° applicable . in the cir-
cumstances is 28 . ;
(c ): That the proposed maturity of the obligation authorized
by this Resolution will not exceed; five (5 ) years .
4i 4 : . That the Supervisor is hereby delegated the power to prepare
said Bond and to sell said obligation . at private sale at not less
than par and accrued interest and the rate of interest to be borne
by said obligation shall not be more than 61/2% per annum . That the

Supervisor shall deliver said obligation to the purchaser thereof
for cash , certified or bank check . That the proceeds of the sale

of said obligation shall be used to pay for said truck , as here -
inabove mentioned . That the powers . delegated to the Supervisor
by this Resolution shall be exercised in conformity with the
provisions of the Local Finance Law .
5 . That this Resolution shall take effect immediately .
Upon the question of adoption of the foregoing resolution ,
with at least 2 / 3 vote of the members of the Town Board voting
in the affirmative , the resolution was declared duly adopted by
the Supervisor .

corporation in the . County of Tompkins , State of New York , do
hereby . CERTIFY . that the foregoing is a true and complete copy
of a resolution duly adopted by the Town Board of said Town and
recorded in the minutes of a meeting of said Board duly held on
the 13th day of May , 1974 , and not subsequently rescinded or
modified .

TOWN BOARD MINUTES
May 13 , 1974
The regular meeting of the Danby Town Board was called to order at
8 : 10 P . M . at the Danby Elementary School , May 13 , 1974 .
Board members present : Supervisor A . Francis Wright
Councilman Ralph Wilbur
Justice Milton Todd
Justice Floyd Dorn
Board member absent : Councilman Clyde Carrier
Others present : Joseph Hulbert , Erie J . Miller , Joseph Short , Moses
Peter , Roy Casterline , Mary Casterline , Gould Coleman , Edward Slights
Ernest Cole , Jeromey Alderson , Bradley Corbitt
There were two corrections made to the minutes of the April Board
Meeting . Under privilege of thefloor remarks of Ralph Sager the word
" age " should be changed to " income " in the second sentence . Under
committee reports paragraph A the last sentence sheen should be deleted
and " The Danby Highway Department has helped the County by renting them a
shovel with an operator " added . Justice Floyd Dorn made the motion
that the minutes be approved as corrected . Justice Milton Todd
seconded the motion which was carried by a vote of four ayes and no noes .
COMMUNICATIONS :
1 . The minutes of the Town of Danby Planning Board meeting of
April 17 , 1974 were read .
2 . Minutes of the West Danby Water District Board meeting of
May 1 , 1974 were read .
3 . A letter from Carol Sisler concerning the future plans for the
Town Hall and _ inclosing a suggested floor plan .
4 . A letter from Arch Dobson concerning the removal of trees
from the right of way on Updike Road .
5 . A letter from Hugh Hulbert concerning the Fair Labor Standards
Act signed into law by President Nixon April 8 , 1974 which
will be effective May 1 , 1974 . .
6 . A letter from New York State Executive Department Office for
the Aging asking towns to proclaim May Senior Citizens Month .
7 . A letter concerning N . Y . S . Retirement System resolution forms
and calculation of initial payment.
8 . A letter from State Comptroller , Arthur Levitt , with
resolution forms and calculations of initial payment for
employees retirement system .

Communications Continued :

Training Session for Town Receivers of taxes and Collectors
and Town Clerk Collectors of taxes on June 19 , 1974 .
15 A letter from the Ithaca Journal announcing rate adjustments
effective June 1 , 1974 .
16 . The minutes of the meeting of the T . V . Cable Planning
Committee were read .
• 17 . A thank you letter from the Danby Senior Citizens to the
Danby Town Board .
18 . The minutes of the meeting of the Danby Board of Zoning
Appeals held April 10 , 1974 were read .
PRIVILEGE OF THE FLOOR :
Justice Fioyd ,:,DornTmentioned the increase in correspondence in
connection with his office .
Supervisor A . Francis Wright said that possibly a second board meeting
should be held each month to give board members more time for
committee business and more time to handle the increased correspondence .
The town clerk asked the board to consider another file for her office
to handle the records that would normally be put in the vault .
Erie J . Miller reported that the Board of Representatives meeting
was one of the longest on record . There were 18 resolutions on the
agenda for consideration . Establishing an office for the aging was
discussed and also emergency medical service for the . county . Mr .
Miller said that he is still working on the Rick Dobson and Maycumber
situation but has had little sucess . Mr . Miller then had a personal
request. He would like the board to at least consider giving him
authorization to put up a sign at the South end of Nelson Road
designating that road as Steam Mill Road . This would make it more
convenient for visitors that are not familiar with the area . A
lengthy discussion : followed .
Mr : stated that he is pleased with the progress of the Planning
Board in their efforts to change the image of Danby by cleaning up
the center of the town .
Jeromey Alderson asked if the Black Rose Band could rent the Town Hall
as a place to hold band rehearsals .

Ernest Cole urged people to turn/their questionaires concerning the
Town Hall.
Gould Coleman said that there were problems understanding the
• guestionaire the second question in particular. He stated that the
Town Board should consider restoration of the Town Hall and that
already costs have changed .
Moses Peter said that many problems of the town are causes by a lack
of communication. He suggested that an outline of the minutes of the
Town Board meetings be published in the Danby Area News and possibly
the agenda of the upcoming meetings also be published .
COMMITTEE REPORTS :
A. Highway - Councilman Ralph Wilbur reported that the bridge leading
to the Spewah Clinic is in need of repair. Councilman Ralph Wilbur
made the motion that Joseph Hulbert be authorized to buy pipe
at a cost of $2 , 700 . to repair the Ithaca Speech Clinic Bridge .
This pipe to be purchased on a state contract . Justice Milton Todd
seconded the motion that was carried by a vote of four ayes and
no noes . The LaRue Road bridge needs to be repaired also . A new
man has been hired by the Highway Superintendent . It was noted

Committee Reports Continued :
that the Town Board should make their annual tour of the town roads
in the near future . Ralph Wilbur and Joseph Hulbert will set a date
for the tour . . A date should also be set for discussion of the
Updike Road problem .
B . West Danby Water District - The painter has been called and will
paint the water tank in June . The insurance will be updated .
C . Insurance - A meeting will be held Thursday night .
• D . Refuse Collection & Disposal - No report .
E ; Youth Committee - Bradley Corbitt who is chairman of the Pond
Committee and responsible for hiring of the water front personnel
said that hiring of the life guards and caretaker has been
completed . Further news of the program will be posted in the
Danby Area News. .
F . Zoning and Planning - No report .
G . Fire - No report .
H . Cemetaries - The annual tour of the town cemetaries has been
completed . All looks good although a few headstones have been
tipped over .
OLD . BUSINESS :
Report of the Highway Superintendent - Joe Hulbert had nothing to add
to the report already given .
Zoning Officer - A written report was submitted .
Planning Board Chairman - 50 people have responded to the
questionaire but as yet they have not been tabulated . . The Planning
Board will meet with the fire oommissioners and Mr . Cole invited the
Town Board to attend also`. Frank Liguori will attend the next
regular meeting of the Planning Board to be held Wednesday , May 150 1974 .
Appeals Board Chairman - An appeal is scheduled to be heard before the
board May 15 , 1974 . Gary Vincent is resigning from the Appeals Board .
Justice Floyd Dorn made the motion that the supervisor be authorized
to fill out the proper forms to inact Resolution #6 passed in April
of this year . Councilman Ralph Wilbur seconded the motion which was
carried by a vote of four ayes and no noes .
NEW BUSINESS :
Councilman Ralph Wilbur made the motion that the town purchase a
Brockway Truck for the bid submitted less $1 , 700 . 00 for tire
• allowance . Tires will be purchases for $900 . 00 . This will make
the total cost of the truck $36 , 700 . 00 . The motion was seconded by
Justice Floyd Dorn.

Carried four ayes and no noes .
Supervisor A . Francis Wright informed the board that the financing
of part of the cost of the Brockway Truck will be necessary . This
will be done by issuing Serial Bonds . Justice Milton Todd made the
motion that five year serial bonds be issued in the amount of $27 , 350 •
to the Tompkins County Trust Company . The motion was seconded by
Justice Floyd Dorn .

RESOLUTION #10 PARTIALLY FINANCE THE PURCHASE OF THE
BROCKWAY TRUCK BY ISSUING FIVE YEAR
SERIAL BONDS IN THE AMOUNT OF $27 , 350 . 00
TO THE TOMPKINS COUNTY TRUST COMPANY .

• Carried four ayes and no noes.
Ernest Cole recommended that Bob Snedden be contacted as a possible
representative to the Enviromental Management Council from the Town
of Danby. Mr . Cole will contact Bob and report to the board in June .
The voting machine bid will be opened Tuesday May 28 , 19 74 at a special
meeting immediately following Justice Court . Possibly the Highway
Committee meeting can be held the same evening.
Supervisor A. Francis Wright made . the motion that May be proclaimed
Senior Citizens Month in the Town of Danby . Justice Milton Todd
seconded the motion .
RESOLUTION #11 PROCLAIM MAY AS SENIOR CITIZENS
MONTH IN THE TOWN OF DANBY
Roll Call Vote : Wright - aye
Wilbur - aye
Dorn - aye
Todd - aye
Carried four ayes and no noes.
Supervisor A. Francis Wright informed . the board that they must decide
how they are going to use Federal Revenue Sharing funds . There is a
possibility that they can get an extension of time in which to spend
this money'. This matter will be discussed in an executive session of
the board before definite steps are taken .
The condition of the town vault was discussed briefly . Damage by rain
continues to be a problem. Possibly a temporary storage place can be
found:
The Town Hall was broken into by vandals`: This was reported to the
Sheriff ' s department and they are investigating the break in .
The charts have not been received for the Enviromental Needs Survey .
This matter will be handled by the supervisor .
Justice Milton Todd made the motion that Supervisor A. Francis Wright
411 and Mary Oltz , clerk, be authorized to attend the school for Collectors
and receivers of taxes to be held June 19 ' `° 1974 . Justice Floyd Dorn
seconded the motion which was carried by a vote of four ayes and no
noes":
The matter of a filing cabinet for the clerk was tabled for . further
study
The change of the Nelson Road sign to read Steam Mill Road was
discussed but no action was taken.
The rental of the Town Hall by the Black Rose Band was discussed . The
request was withdrawn because the building cannot be secured .
Supervisor A. Francis Wright stated that he thought the board should
set up rules and regulations as to the renting of the Town Hall .
Insurance coverage if the building is rented should be checked into .
The matter was tabled .

New Business Continued :
The Town Historian ," Mrs . Cortright will be contacted for an annual
report for. the June board meeting .
General Fund Warrant #5 in the amount of $456&. 52 was approved to be
paid. The motion was made by Justice Milton Todd and seconded by
Justice Floyd Dorn and carried by a vote of four ayes and no noes .
Highway Fund Warrant #5 in the amount of $2 , 186 . 31 was approved to be
paid: The motion was made by Councilman Ralph Wilbur and seconded by
Justice Milton Todd and carried by a vote of four ayes and no noes .
West Danby Water District Warrant #5 in the amount of $144 . 76 was
approved to be paid . The motion was made by Justice Milton Todd and
seconded by Justice Floyd Dorn and carried by a vote of four ayes and
no noes'.
Justice Floyd Dorn made the motion to accept the Supervisor ' s reports.
Justice Milton Todd seconded the motion which was carried by a vote of
three ayes and no noes.
The meeting was declared adjourned by Supervisor A . Francis Wright .
