HomeMy WebLinkAbout1974-04-08 • TOWN OF DANBY TOWN BOARD MINUTES April 8 , 1974 A special meeting immediately proceeding the regular Town Board meeting was called to order at 7 : 30 P . M . The purpose of this meeting was to open bids for a new ten wheel truck and snow frame . Supervisor A . Francis Wright called the meeting to order and asked that the clerk open and read the bids . Only one bid was received . This bid was from the Brockway Motor Truck Company . The bid was in the amount of $$38 , 600 . with a delivery date of 45 days after purchase . Supervisor Wright read the specifications . The board decided to table the matter until Highway Superintendent , Joseph Hulbert , can check the specifications . III The regular meeting of the Danby Town Board was called to order at 8 : 10 P . M . at the Danby Elementary School , April 8 , 1974 . Board Members present : Supervisor A . Francis Wright Councilman Ralph Wilbur Councilman Clyde Carrier Justice Floyd Dorn Board members absent : Justice Milton Todd Others present : Edward Slights , Gladys Hulbert , Joseph Hulbert , Dick Watts , Erie Miller , Ernest Cole , Moses Peter , Mr . & Mrs . Newman , Gordon Roberts , Roy and Mary Casterline , Rhoda Larsen , Ralph Sager , and Emily Wiggins . Councilman Ralph Wilbur made the motion to approve the minutes of the March meeting as presented . Justice Floyd Dorn seconded the motion which was carried by a vote of four ayes and no noes . COMMUNICATIONS : 1 : The minutes of the West Danby Water Commissioners meeting of April 5 , 1974 were read . 2 . A letter from the New York State Temporary Commission of State and Local Finances giving dates of public hearings . 3 . The minutes of the Danby Planning Boards meeting of March 20th , 1974 were read. 4 . Agenda of the Tompkins County Board of Representatives meeting of Monday April 8 , 1974 . 5 . A letter from Tallmadge Tire Service advising the town that they have contracted with the County for tires and the towns may buy at this contract price . 6 . A letter from the Danby Community Council expressing concern about the condition of certain properties along 96B . 7 . A letter from the Danby Fire District expressing the wish to meet with the Danby Planning Board concerning an office • building attached to the fire station . 8 , Notice of Public hearing of the Town Board of the Town of Ithaca to be held April 8 , 1974 . 9 . A letter from Attorney Asco M . Peterson concerning a petition of Crispell Charter Service , Inc . PRIVILEGE OF THE FLOOR : Ralph Sager representing the senior citizens in Danby said that he has made a list of people in the town that are 65 or over . There are 42 people to the best of his knowledge and possibly eleven of these would never be eligible to receive tax exemption due to their age . Mr . Sager asked that the board raise the amount of annual income a person can receive and still be eligible for the tax exemption . The amount allowable now is $ 5 , 000 . annual income . The state allows $$6 , 000 . 1 Town Board Minutes - April 8 , 1974 - Page 2 Privilege of the Floor continued : Mrs . Evelien asked about zoning rules and boundary lines . A lengthy discussion on this matter followed . Tompkins County Representative Erie J . Miller said that he would be willing to talk with people about cleaning up their property . Currently the Board of Representatives is involved with Pyramid project in Lansing and a public hearing will be held to talk over the possibility of making the District Attorney ' s job part time instead of full time as it is at the present time . Justice Floyd Dorn commented that the service from the District Attorney ' s Office is the poorest now than it ever has been . • Moses Peter asked Erie Miller who he represented in the Town Hall Vote . He feels that Mr . Miller is responsible for the defeat of the Town Hall referendum . He is disappointed in the lack of communication between the board and representative Miller . Mr . Peter stated that he has new applications for the flood insurance . Gladys Hulbert stated that garbage is being dumped on private property in West Danby and is causing a major clean up problem . Ralph Sager said that the Town Hall should be sold to the Historical Society' and the property next door to the Town Hall should not be purchased . The town should buy a new lot for a Town Hall . Clyde Carrier feels that the Zoning Officer , Gordon Roberts , needs help in cleaning up the town . More people should take advantage of Danby Clean- up Day . More advertising should be done to see that the people are aware of the clean up day. COMMITTEE REPORTS : A . Highway - The snow plowing is continuing . Tires for the new truck can be purchased for a better price if it is done separately . Councilman Ralph Wilbur was very satisfied with the bid for the truck and plow. Supervisor A . Francis Wright made the motion that the question of rebuilding or repairing Eastman Hill Road be tabled . Councilman Ralph Wilbur seconded the motion which was carried by a vote of four ayes and no noes . The Danby Highway Department has been helping the County who is short a driver . B. West Danby Water District - Everything is running well . In May a name for a replacement of a commissioner will be presented to the Board . One commissioner has resigned . C . Insurance - Councilman Ralph Wilbur stated that he met with Frank Liguori who will help Moses Peter with the application for flood insurance . Flood insurance was discussed at length . D . Refuse Collection and Disposal - Councilman Clyde Carrier said there is no discontent . The carriers are doing their jobs . The only complaint is that dogs get into the garbage . People ask about junk cars . Perhaps to clarify the definition of a junk car the state law definition of a junk car should be publicized . It was suggested that the collectors be notified and asked to advise people of late collections: E . Youth - No report. F . Zoning and Planning - No report . G . Fire - No report . H . Cemetaries - No report. Town Board Minutes - April 8 , 1974 - Page 3 OLD BUSINESS : Report of the Highway Superintendent - Joseph Hulbert had nothing to add to the Highway Report already given . Zoning Officer - A written report was submitted for the board to read . ' Gordon Roberts explained the procedure to be followed in applying for a building permit. Planning Board Chairman - The minutes of the March 20th meeting were read . The planning board approved the charging of fees for appeals . The Town Board made the suggestion that the survey made up bar the planning board be presented by Ernest Cole for publication • in the Danby Area News . Appeals Board Chairman - An appeal will be heard before the board on April 10 , 1974. Any opinions of the public concerning the appeal will be welcome . Would like to hear from interested parties before the hearing . NEW BUSINESS : Supervisor A . Francis Wright made the motion to modify the Highway' Budget by transferring $3 , 000 . from Item #4 DS5142 . 1 to D35142 . 4 contractural expense . The motion was seconded by Councilman Ralph Wilbur . RESOLUTION #5 TRANSFER OF HIGHWAY FUNDS Roll Call Vote : Wright - aye Wilbur - aye Carrier - aye Dorn - aye Carried four ayes and no noes . Councilman Ralph Wilbur made the motion that the town advertise for bids on a new voting machine . Councilman Clyde Carrier seconded the motion which was carried by a vote of four ayes and no noes . Supervisor A . Francis Wright read a letter concerning Employees Retirement Systems . Justice Floyd Dorn made the motion that the Town of Danby apply for membership in the New York State Employees Retirement System . Money has been budgeted for this purpose . Councilman Clyde Carrier seconded the motion . RESOLUTION #6 APPLY FOR MEMBERSHIP IN THE NEW YORK STATE EMPLOYEES RETIREMENT SYSTEM Roll Call Vote : Wright - aye Wilbur - aye Carrier - aye Dorn - aye • Carried four ayes and no noes . Councilman Ralph Wilbur stated that the Town of Danby has no representative in the Enviromental Management Council . This matter was tabled until the May meeting . The petition of Crispell Charter Service , Inc . to operate a bus line running through the Town of Danby was discussed . Justice Floyd Dorn made the motion that Crispell Charter Service , Inc . be granted permission to operate their bus line running through the Town of Danby. The motion was seconded by Councilman Ralph Wilbur . Town Board Minutes - April 8 , 1974 - Page 4 New Business continued : RESOLUTION #7 CRISPELL CHARTER SERVICE , INC . , GRANTED PERMISSION TO OPERATE A BUS LINE RUNNING THROUGH THE TOWN OF DANBY Roll Call Vote : Wright - aye Wilbur - aye Carrier - aye Dorn - aye Carried four ayes and no noes . Councilman Ralph Wilbur made the motion that the tax exemption on property taxes for senior citizens in the Town of Danby be based on • income of $6000 . per year which is an increase from $5 , 000 . Justice Floyd Dorn seconded the motion`. RESOLUTION #8 INCREASE THE ANNUAL INCOME ALLOWABLE FOR PERSONS ( 65 ) OR OLDER TO RECEIVE PARTIAL TAX EXEMPTION OF REAL PROPERTY FROM $5 , 000. to $ 6 , 000 . Roll Call Vote : Wright - aye Wilbur - aye Carrier - aye Dorn - aye Carried four ayes and no noes'. There was a lengthy discussion of boundary lines shown on the Danby Zoning Ordinance' . The question was what is the exact line between - residential and business ? It was recommended that a fee of $ 15 . 00 be charged to persons wishing to make an appeal before the Danby Board of Appeals . This was tabled until the May meeting . General Fund Warrant #4 in the amount of $318 . 50 was approved to be paid . The motion was made by Councilman Ralph Wilbur and seconded by Justice Floyd Dorn and carried by a vote of four ayes and no noes . Highway Fund -Warrant #4 in the amount of $1 , 900 . 13 was approved to be paid'. The motion was made by Councilman Ralph Wilbur and seconded by Justice Floyd Dorn and carried by a vote of four ayes and no noes . West Danby Water District Warrant #4 in the amount - , of $43 . 86 was approved to be paid . The motion was made by Justice Floyd Dorn and seconded by Councilman Clyde Carrier and carried by a vote of four ayes and no noes . Justice Floyd Dorn made the motion to accept the Supervisor ' s reports . Councilman Ralph Wilbur seconded the motion which was carried by a vote of three ayes and no noes . Supervisor A .
