PUBLIC HEARING Barry & Karen Shaw, Applicants/Reputed Owners - 774 Peru Road - TM #36.-1-10 - Proposed Antique Shop Chairman Ed Neuhauser opened the Public Hearing at 7:30 p.m. The Board Secretary read aloud the Public Hearing Notice as published on 10 May 2011 in the Groton Independent Proof of Publication has been placed on file for the record. Chairman Neuhauser recognized the applicants who explained that would like to convert a portion of their existing barn into a seasonal retail shop selling antiques and collectibles, as shown on the drawings accompanying their application. The Shaws had appeared before the April meeting of this Board; reference is made to those Minutes for further details about their plans. Chair Neuhauser then asked if there was anyone present who would like to make any comments regarding this application; there was no one who wished to comment. With everyone being heard who wished to be heard, Chairman Neuhauser closed the Public Hearing at 7:35 p.m. REGULAR MEETING The Regular Meeting of the Town of Groton Planning Board was called to order at 7:36 p.m. by Chairman Ed Neuhauser. APPROVAL OF MINUTES — 21 APRIL 2011 A motion was then made by Member Jim Morey to approve the Minutes of the 17 March 2011 Planning Board meeting, as submitted. The motion was seconded by Member Mark Baxendell, with the vote recorded as follows: Ayes: Chair Neuhauser Nays: None Member Carey Member Baxendell Absent: Member Clark Member Morey Member Gloster Motion carried. This becomes Action #20 of 2011. Page 1 of 3 (T)Groton Planning Board Minutes of Public Hearing&Regular Meeting 19 May 2011 OLD BUSINESS Barry & Karen Shaw, Applicants/Reputed Owners - 774 Peru Road - TM #36.-1-10 - Proposed Antique Shop Chair Neuhauser acknowledged that "in accordance with the State Environmental Quality Review Law, the proposed action is a Type II action and is determined not to have a significant impact on the environment, or is otherwise precluded from environmental review under the Environmental Conservation Law, Article 8." With no further discussion, a motion was made by Member Monica Carey to approve the Final Site Plan for the proposed antique shop, as submitted, pending NYSDOT approval. The motion was seconded by Member Baxendell, with the vote recorded as follows: Ayes: Chair Neuhauser Nays: None Member Carey Member Baxendell Absent: Member Clark Member Morey Member Gloster Motion carried. This becomes Action #21 of 2011. NEW BUSINESS Joan Foote, Applicant/Reputed Owner - 185 LaFayette Road - TM #29.-1-14.3 - Proposed Flag Lot Chairman Neuhauser recognized the applicant who explained that she owns this 14.3± acre parcel and is giving two acres to her son, as shown on a portion of the tax map accompanying the application. Their mortgage encumbers approximately 360 feet of their 503± feet of road frontage. Therefore, as explained to the Board, she is requesting a 50-foot flag pole for access to the son's lot, also shown on the tax map which accompanied the application. CEO Coats explained that the maximum width for the pole is 50 feet. Once the parent's mortgage is satisfied, the flag pole will be eliminated. With no further discussion, a motion was made by Member Baxendell to approve the Flag Lot as requested. This becomes Action #22 of 2011. OTHER MATTERS • CEO Coats commented Beck litigation; the case has been filed, but the information was incomplete. Case re-filed and Mr. Beck has 20 days to respond. He is acting as his own attorney. • CEO Coats reported that the Town has a suit against someone on Lick Street regarding a mobile home. Page 2 of 3 (T)Groton Planning Board Minutes of Public Hearing&Regular Meeting 19 May 2011 • CEO Coats stated that Jeff Barney (?) will be getting a letter saying that his approval has expired. • CEO Coats reported that the filing of the new Code will be at least the end of June. • CEO Coats advised that when this Board overrides Tompkins County Planning, it should be responded to by a resolution made by the Town Board. • CEO Coats reported on the changes that need to be made in the SEQRA process. • CEO Coats stated that there will be a cell tower application forthcoming (Sears Road). ADJOURNMENT At 8:15 p.m., a motion was made by Member Morey to adjourn the meeting. The motion was seconded by Member Carey, with all members present voting in favor. j•'n E.
