Mary Cornell Town Clerk; Town Supervisor Stephanie Redmond; Town Councilperson Robert Lynch; Code Enforcement Officer Alan Teeter. Call to order: Dan Walker called the meeting to order at 7:04 pm Review of Minutes: Minutes are postponed until the February Meeting. Site Plan Review, tax parcel 2.-3-12 for adding an additional house on a tax parcel. PB resolution No. 2023-01: SEQR, Melvin Site Plan Approval additional residence, Aiken Road, Enfield Tax Parcel No. 2.-3-12 Moved By- Carpenter Second By – Chaffee WHEREAS: 1. This action is Consideration of Site Plan Approval for construction of a third residence on a tax parcel located at Aikin Road and 864 Hayts Road in the Town of Enfield. Barbara Melvin owner; and 2. This is an Unlisted Action for which the Town of Enfield Planning Board is acting in an uncoordinated environmental review with respect to the Melvin third residence project; and 3. The Planning Board, on January 4, 2023, has reviewed and accepted as adequate a Short Environmental Assessment form part 1, prepared and submitted by the Applicant; and a site plan application and sketch; and 4. The Planning Board on January 4, 2023, has prepared a Short Environmental Assessment Form Parts 2 and 3; NOW, THEREFORE BE IT RESOLVED: That the town of Enfield Planning Board hereby makes a negative determination of environmental significance in accordance with article 8 of the Environmental Conservation Law and 6 NYCRR Part 617 New York State Environmental Quality Review for the above-referenced action as proposed, based on the information in the SEAF Part 1 and for the reasons set forth in the SEAF Parts 2 and 3, and, therefore, an Environmental Impact Statement will not be required. Vote: Dan Walker, Aye; Mike Carpenter, Aye; Ann Chaffee, Aye; Henry Hansteen, Aye; Rich Teeter, Aye; Carried. PB resolution No. 2023-2: Site Plan Approval, Melvin additional residence, Aiken Road, Enfield Tax Parcel No2.-3-12 Moved By- Carpenter Second By – Hansteen WHEREAS: 1. This action is Consideration of Final Site Plan Approval for an Additional residence on the Aiken Road portion of a parcel located at 864 Hayts Road in the Town of Enfield. The applicant is proposing to build a third house for a family member on a large parcel that currently has two existing homes; and 2. This is an Unlisted Action for which the Town of Enfield Planning Board, acting in an uncoordinated environmental review with respect to the proposal, made a negative determination of environmental significance after having reviewed and accepted as adequate a Short Environmental Assessment form part 1, prepared and submitted by the Applicant; and prepared a Short Environmental Assessment Form Parts 2 and 3; and 2 3. The Planning Board, has reviewed and accepted the site plan drawings sketch provided by the applicant, and other application materials; NOW, THEREFORE BE IT RESOLVED: That the town of Enfield Planning Board hereby grants site plan approval for the above-referenced action as proposed. Vote: Dan Walker, Aye; Mike Carpenter, Aye; Ann Chaffee, Aye; Henry Hansteen, Aye; Rich Teeter, Aye; Carried. Property owners may subdivide in the future and the request will be able to go through the Code Office. Breezy Meadows subdivision Sketch Plan: Dan shared that at the last meeting they had a sketch plan review and comments were sent to Breezy Meadows for consideration and review. Breezy Meadows – Alan Lord. Some of his takeaways were wells and water questions and other property questions. He has not done a phase one investigation before. He has obtained quotes from multiple companies to complete the phase one investigation and he will be able to report back when he has more information. Dan shared that phase one is literature research and property review. They have contracted with an engineering firm to complete phase one. Water seems to be an issue that needs to be investigated, the DEC only started recording well locations ~20 years ago. He reached out to the former property owners and they shared that they had never run out of water in the 20 years that they had lived there. If water was used in the barns then they would have used a lot of water, they are researching where wells are located as they have been told wells exist, however, they have been unable to locate them. Breezy Meadows – Alan Lord. Tucker Rd seems to be a rough road as it is not paved. Dan shared that the dimensions of the road meet a road determination. The road needs work as it was not designed as a heavy-use road. The Highway Department has been doing sub-maintenance on the road. BM went over to his project that they did in Dryden. They sold 42 lots in 2019. Only four homes have been built on the lots. Many of the properties were being used for agriculture, hay, and gardens. The 42 lots were a combined total of over 900 acres. It will not be a high-traffic area. He shared that individuals may purchase multiple lots. Most of the fields were marginal out there, what was offered for leases was not even half of the cost of the taxes on the parcels. Alan L. shared that for the Tucker Road project, most of the fields are less than 10 acres, so without taking out hedgerows the largest consecutive acreage is 27 acres. He has not come up with a good plan as of yet for plot creation. There any many different agricultural usage options. Two small parcels are listed on the Tompkins County maps as wet spots. Alan L. asked if the board have any questions, Dan shared that it is all open space and there is brushland to the north. There are some large ponds near Iradell rd. There is a lot of deer in the area and he does not think that people may want to build on the hills, they may consider restricting some of this land as habitat areas. There are 4 lots where the barns are located. These lots may be best used for commercial purposed. Dan shared that the town does not currently have many restrictions in place and if individuals would like to use this land then they would need to complete a site plan review. And the best use may be to demolish the buildings. When phase one is complete then they will do an inventory of the buildings. The planning board went through covenants that were presented that Mike and other board members had questions about. Mike shared that there are several covenants involved, who will enforce them? Alan L. shared that 90% of the time people abide by them, in his experience only in one instance has an attorney been involved. When the land is purchased the restrictions will be included when filing the deed. Mike asked if when someone applies for a subdivision with Alan Teeter look up the deed and enforce the restrictions. Mike is iffy about doing partial zoning in the town itself as were are coming in the back door, is this something that we want to do as a town? Supervisor Redmond asked if it was possible to enforce a local law that would require an applicant to disclose deed restrictions. Alan L. there is no government authority to oversee them and if they want to then how can you enforce it (Civil litigation). A neighboring 3 property owner attending the meeting commented that they would like some deed restrictions to be included as someone who lives close by is concerned about what the property may be used for. Dan asked if a swift was required (Ray Burg – Dryden). Keystone Engineering from Binghamton completed the SWIPP for the Town of Dryden project. Dan was going to check to see if a SWIPP is required. Dan shared it would be hard to do a swift if you do not know what you are going to be building on the lots. Dan shared a basic swift will be required. Dan would like BM to put together covenants which will include who has the authority to enforce them and he would like to get the board’s impression on the bigger lots and undisturbed open lots. Breezy Meadows will plan on providing an update at the March 2023 meeting. Review Applications for Planning Board Vacancies: Dan shared that the open position is for a 5-year term. Henry Hansteen was last year’s appointment. Greg Hutnik – 598 Bostwick Rd. He is a planner by profession in Cayuga County. He was on the Planning Board for the Village of Trumansburg and wanted to throw his name in the hat. He is available on Wednesdays and at additional times as needed. Greg grew up in the Town of Ithaca and went to school in Colorado and returned to Ithaca ~3 years ago. Mike shared that he agrees that Greg’s experience would be a great asset to the Planning Board. There is an alternate position available as well. Dan shared that the alternate position member would be expected to attend the meetings as much as the current planning board members. Ann shared that she thinks that we should keep Rich as the current board member and she is willing to consider Greg as an alternate board member. Mike Carpenter moved and Ann Chaffee seconded to appoint Rich Teeter as the full Planning Board Member and Greg Hutnik as the alternate Planning Board Member. Discussion of the Site Plan Review Law and Subdivision Regulation modifications to address land use concerns.
