PUBLIC HEARING Keith Lattin, Applicant/Reputed Owner - 823 Old Stage Rd. - TM #19.-1-4.11 - Proposed Motor Vehicle Repair Shop (Note: Reference is made to the Planning Board Minutes of 15 April 2010 for details of this proposed business.) Chairman Ed Neuhauser opened the Public Hearing at 7:37 p.m. The Board Secretary read aloud the Public Hearing Notice as published in The Shopper on 10 May 2010; Proof of Publication has been placed on file for the record. Chair Neuhauser recognized the applicant who explained to everyone present that he would like to open an auto repair shop at this location. Chair Neuhauser then asked if there was anyone present who would like to make any comments regarding this application; there was no one who wished to comment. With everyone being heard who wished to be heard, Chairman Neuhauser closed the Public Hearing at 7:38 p.m. REGULAR MEETING The Regular Meeting of the Town of Groton Planning Board was called to order at 7:39 p.m. by Chairman Ed Neuhauser. APPROVAL OF MINUTES — 15 APRIL 2010 A motion was made by Member Monica Carey to approve the Minutes of the 15 April 2010 Planning Board meeting, as submitted. The motion was seconded by Member Mark Baxendell, with the vote recorded as follows: Ayes: Chair Neuhauser Nays: None Member Baxendell Member Carey Absent: Member Donlick Member Clark Member Gloster Member Haines Motion carried. This becomes Action #22 of 2010. Page 1 of 3 (T)Groton Planning Board Minutes of Public Hearing&Regular Meeting 20 May 2010 OLD BUSINESS Keith Lattin, Applicant/Reputed Owner - 823 Old Stage Rd. - TM #19.-1-4.11 - Final Site Plan Review- Proposed MVR Shop The Board members recalled from the April meeting that the applicant was asking for a maximum of 12 vehicles to be displayed, operating hours from 8 a.m. thru 7 p.m., Monday thru Saturday. They also stated that the vehicles were to be kept parked in a neat/orderly fashion. Chairman Neuhauser then read aloud Part II of the Short Environmental Assessment Form. Negative responses were obtained to all questions in Part II. A motion was then made by Member Baxendell that the proposed action, based on the information submitted, will not have a significant adverse environmental impact, resulting in a Negative Declaration. The motion was seconded by Member Monica Carey, with the vote recorded as follows: Ayes: Chair Neuhauser Nays: None Member Baxendell Member Carey Absent: Member Gloster Member Clark Member Donlick Member Haines Motion carried. This becomes Action #23 of 2010. With no further discussion, a motion was made by Member Barb Clark to approve the Final Site Plan for the proposed Motor Vehicle Repair Shop with hours of operation to be from 8 a.m. to 7 p.m., Monday thru Saturday, with up to 12 roadworthy vehicles on the premises to be placed in an orderly fashion. The motion was seconded by Member Mark Baxendell, with the vote recorded as follows: Ayes: Chair Neuhauser Nays: None Member Baxendell Member Carey Absent: Member Gloster Member Clark Member Donlick Member Haines Motion carried. This becomes Action #24 of 2010. OTHER BUSINESS Review of Draft Land Use & Development Code Town Supervisor Glenn Morey remarked that everyone had received a copy of the proposed Code. He stated that the public hearing had brought out some issues; map was corrected by the Town Board. The other changes that were made were explained to everyone present by Town Clerk April Scheffler, one of which afforded the Planning Board the opportunity to waive a public hearing (441.7). Town Supervisor Morey stated that the Board will be dealing with the mass gathering issue. Once the draft is reworked, it will be submitted to everyone and another public hearing will be held in August. Regarding subdivisions, CEO Gary Coats had asked (through Town Clerk Scheffler) about enforcing the three-year period. He suggested rewording the appropriate statement to be once a third parcel is created, it will be treated as a minor subdivision, but the original parcel sold would not be a part of that review. Member Carey was concerned that if the first parcel was not a part of the review then the subdivision could end up with non-conforming lots, e.g. a landlocked parcel. This was discussed further, and Member Clark suggested changing the wording so that if the first lot sold is then resold to Page 2 of 3 (T)Groton Planning Board Minutes of Public Hearing&Regular Meeting 20 May 2010 another owner, it is not subject to review. Town Clerk Scheffler agreed that the Planning Board has, over the years, "made it work," but perhaps it should be made more clear in the Code. Town Attorney Fran Casullo commented that the last thing the Town wanted to do was create non- conforming lots with a brand new Code, so maybe the Town should look at that issue so it doesn't happen. The Board acknowledged that they had received a letter from the Town of Dryden, and also from the County Planning Board. Town Clerk Scheffler concluded her remarks by asking the Planning Board to communicate with the Town any concerns or suggestions they would like to see covered in the new Code. Member Clark asked if "farming concerns" were covered, such as liquid manure. Member Carey stated she thought that this was covered by the NYSDEC and/or Ag 86 Markets Law. ADJOURNMENT At 8:12 p.m., a motion was made by Member Clark to adjourn the meeting. The motion was seconded by Member Janice Haines, with all members present voting in favor. Joan E.
