HomeMy WebLinkAbout1973-04-09 19 TOWN OF DANBY TOWN BOARD MINUTES , April 9 , 1973 The regular meeting of the Danby Town Board was held in the Danby Elementary School , April 9 , 1973 , at 8 : 00 P . M . Board members present : Supervisor A . Francis Wright Councilman Ralph Wilbur Councilman Gerald Crance Justice Floyd Dorn Justice Milton Todd Others present : Roy Casterline , Mary Casterline , Gordon Roberts , Erie Miller , Joseph Hulbert , Gladys Hulbert , Mike Wiese , Dean • Westmiller , Gary Vincent , Richard Seymour , Edward Slights . The minutes of the regular meeting of March 12 , 1973 were mailed to board members for reading and correction . The minutes were approved as presented . COMMUNICATIONS : 1 . The minutes of the March 21 , 1973 meeting of the Danby Town Planning Board . 2 . The minutes of meeting of the Danby Board of Zoning Appeals meeting of March 28 , 1973 . PRIVILEGE OF THE FLOOR : Gary Vincent said that the clean up sponsored by the Danby Community Council will be May 5th . In case of rain it will be May 12th . He has been in contact with the State Parks Commissioner about developing the Danby Pond Area over a period of five years . The state will provide the grass seed and the shrubs and do the landscaping but the town would have to do the planing and maintain the area . He feels that many people use this areasand it warrants more extended development . A recreation committee has been formed to hire life guards and set up the summer program . He also stated that they have been working on the budget for next year and will have it ready to submit when the board needs it . A . Francis Wright reported that he attended a meeting at the County level where youth recreation funds from the state were discussed .. The idea was that perhaps the towns and cities should get together and have one program rather than several smaller programs . No decision was made . Mr . Shepardson asked the board why a trailer that was approved for the use of a mother to be near her family was not being rented to other people . The mother is no longer there and two families have been in and out . Gordon Roberts will check into this matter . Tompkins County Representative , Erie J . Miller , reported that many n ew projects are being worked on . One in particular is the • extended care program at the hospital . Requests have been made to rejuvenate the County Fair and time has been spent on historic Ithaca , Ralph Wilbur stated that the Environmental Council has been asked to make a recommendation to the board of representatives concerning the proposed Bell Station . Mr . Wilbur felt opinions o f towns people should be made known to the town board and the board will come up with a recommendation to give to the Tompkins County Board of Representatives . He feels this should be a written ✓ eport . COMMITTEE REPORTS : A . Highway Report - Joseph Hulbert has been busy cleaning up trees cut by the electric company . The flood projects are being finished Sr the final inspection in June . Patching and working on the town roads is a constant thing . He would like to start on his Donovan Projects in May . 11 Danby Town Board Minutes - April 9 , 1973 - Page 2 Committee Reports continued : B . West Danby Water District - Two letters have been ' sent to contractors on the painting of the water tank . He has had no reply yet but will report next month . C . Insurance - The insurance committee has met with Bill Scott and discussed the insurance converage that the town carries . Milton Todd questioned the Insurance on the Town Hail of $ 17 , 000 . 00 . There has been no estimate of the contents of the West Danby Water tank . Gerald Crance will contact the installer and get this information to the May Town Board meeting . Councilman Ralph Wilbur said that as long as the insurance premium for the Town Hall is only $ 200 . 00 the board should let it ride for a year and see if something has been 41/ 6 settled as to building at that time . All board members agree with this . D . Refuse Collection & Disposal - Letters were sent to Robert Hiney and Richard Seymour asking that they attend the town board meeting . Mr . Seymour was present . Councilman .. . Gerald Crance stated that the garbage collection in the town was a problem and that unless the garbage is picked up as scheduled the town is prepared to issue licenses to the collectors . If the license is violated it will be taken away . Mr . Seymour stated that equipment break down is a problem in the garbage collection business . If the truck is not operating obviously the garbage pick up is late . He is trying to build his own shop which will relieve this problem for him . A lengthy discussion of land fill sites and the dropping of garbage along the road followed . E . Youth - This was well covered by Gary Vincent ' s report . F . Zoning and Planning - Justice Floyd Dorn read from a survey taken in 1964 by the Danby Community Council . One of the questions asked was what the residents of the town thought of their town . Junk cars was mentioned most often as a problem then too . Councilman Ralph Wilbur stated that if we are to get the junk car problem cleared up Gordon Roberts will need some help . Gordon Roberts reported that he has met with the town attorney several times . Trailers were discussed at length . He stated that the information given to the news media made him look as if he wasn ' t doing his job . In doing his job he will first travel the Danby Road , route 96B , then West Danby and lastly Coddington Road . He will take notes and contact people and see what cooperation he gets . He will wait for the advice of the town board before taking people to Justice Court but the next time he goes to court he will have an attorney . A lengthy discussion followed concerning the definition of a junk car and junk cars as a problem in the town . G . Fire - No report . H . Cemeteties - Ed Slights in prepared to begin work as soon 411 as it is warranted . OLD BUSINESS : H ighway Superintendents Report - Joe Hulbert said that a resolution is needed to create three jobs . These three jobs are motor equipment operator , laborer , and part time laborer . RESOLUTION # 10 THREE JOBS WERE CREATED IN THE HIGHWAY DEPARTMENT Motion made by Ralph Wilbur and seconded by Justice Milton Todd . Roll Call Vote : Wright - aye Wilbur - aye Crance - aye Dorn - aye Todd - aye Carried five ayes and no noes . FF 23 Danby Town Board Minutes - April 9 , 1973 - Page 3 Old Business continued : Councilman Ralph Wilbur made the recommendation that the town highway employees be given sick leave . The first 90 days of employment , no time given ; the first year of employment after the first 90 days , 5 days sick leave should be given ; up to 30 days sick time can be accumulated , but no more . If an employee is sick for 3 consecutive days or more he must have a doctors certificate to come back to work . A lengthy discussion of sick leave for town employees followed . Councilman Ralph Wilbur made the motion that the town board adopt the sick leave schedule as he outlined it . Justice Milton Todd seconded the motion which was carried by a vote of four ayes and one no . • The zoning officer submitted a report for the board members to read . Report of Planning Board Chairman - In the absence of the chair - man the minutes of the last meeting were read . Report of the Appeals Board Chairman - The minutes of the last appeals board public hearing were submitted in the absence of a report from the chairman . . . . , Councilman Ralph Wilbur reported that the pension plan is being worked on The state asked for more information which was sent . No reply has been received yet . Insurance . - A report was submitted for board members to look over . Councilman Ralph Wilbur made the motion that we accept the low bid of Cayuga Motors for a F100 four wheel drive pickup truck with power steering and automatic transmission . The total cost of the truck is $ 3 , 418 . 00 . Justice Floyd Dorn seconded the motion . RESOLUTION # 11 BID ACCEPTED FOR A FOUR 3 WHEEL DRIVE PICKUP TRUCK Roll Call Vote : Wright - aye Wilbur - aye Crance - aye Dorn - aye Todd - aye Carried five ayes and no noes . Only one bid was received for an automatic voting machine from the Automatic Voting Machine Division of AVM Corporation of Jamestown , New York . The price of the machine is $1 , 960 . 00 . Councilman Gerald Crance made the motion that the bid be accepted . The motion was seconded by Justice Milton Todd . RESOLUTION # 12 BID ACCEPTED FOR AN AUTOMATIC VOTING MACHINE Roll Call Vote : Wright - aye Wilbur - aye Crance - aye Dorn - aye Todd - aye Carried five ayes and no noes . NEW BUSINESS : A letter was read from the CSEA and turned over to the board for discussion . Justice Floyd Dorn made the motion that this matter be tabled until May . The motion was seconded by Justice Milton Todd and carried by a vote of five ayes and no noes . D anby Town Board Minutes - April 9 , 1973 - Page 4 New Business Continued : H ighway Superintendent Joseph Hulbert recommended that three equipment operators and one laborer be given a $ . 15 per hour wage increase . After some discussion Councilman Ralph Wilbur made the motion that a $ . 15 per hour wage increase be given to four highway employees to be received next payroll period . The motion was seconded by Gerald Crance and carried by a vote of f±ve ayes and no noes . B efore deciding what to do about the Danby Pond area the town board decided to wait and hear from the study made by the State Park ' s Commissioner . After the study is made and they have gone over it they will come to some conclusion . Also the insurance • company will be contacted as to 1 day coverage with Danby Clean up in mind . Councilman Ralph Wilbur requested some member of the Highway Committee have a copy of the payroll . Possibly this person should be the town supervisor . The board requested the clerk write letters to Steven Turk , Robert Hiney and Mr . Collins concerning the licensing of refuse collectors in Danby . General Fund Warrant # 4 in the amount of $ 4 , 788 . 14 was approved to be paid . The motion was made by Justice Floyd Dorn and seconded by Justice Milton Todd and carried by a vote of five ayes and no noes . The Highway Warrant # 4 in the amount of $ 1 , 485 . 57 was approved to be paid . Councilman Ralph Wilbur made the motion which was seconded by Justice Milton Todd and carried by a vote of five ayes and no noes . West Danby Water District Warrant # 3 was approved to be paid . This warrant is in the amount of $ 24 . 44 . The motion was made by Councilman Gerald Crance and seconded by Justice Milton Todd and carried by a vote of five ayes and no noes . The motion to accept the supervisor ' s report was made by. Justice Floyd Dorn and seconded by Justice Milton Todd and carried by a vote of four ayes and no noes .
