Ithaca Commons Fee Ordinances

Itinerant Vendors--Definition:
A. Itinerant Vendors shall be defined as individual Transient Merchants
collectively participating as part of a consolidated retail sales effort
offering related items and/or products (ie. hand crafted articles or
collectibles, etc . ) for immediate sale during a specified period of time
at a designated or assigned space on the Ithaca Commons and/or peripheral
areas indicated.
B. Non-Itinerant Vendors Definition:
Non-Itinerant Vendors shall be defined as individual merchants (whose
1 place of business is considered a retail store by virtue of being an
established place of business at a permanent address) collectively
participating as part of a consolidated retail sales effort (ie. an
exhibit or show) offering related items and/or products (ie . Cars, boats,
campers, etc. ) for the purpose of stimulating and activating current
and/or future sales during a specified period of time at a designated or
assignedSR* e on the Ithaca Commons and/or peripheral areas indicated.
C . Itinerant & Non-Itinerant. Vendors : Definition
Casual itinerant & non-itinerant vendors `shall be defined as those
individuals desiring occasional (one time only) use of the Ithaca Commons
for the purpose of cash sales of items during a specified period of time
not to exceed 4 consecutive days in a calendar year. The items for sale
shall not be in direct competition with merchandise offered by Central
Business District Merchants . Permits shall not be granted if either
merchandise or activity is deemed inappropriate or inprudent by the C . A. B.
or the D. I . B. A. Permits may be revoked subject to subsequent infractions
of conditions set forth.

D. Refunds Policy
In the event rain cancels the engagement without a rain date,fee refunds
for that day only will be remitted.
1 E. Special Rates
Special rates will be in effect Monday thru Wednesday (Holidays excepted) .
The rate for activities during .these days will be 75% of standard fees .
F. Fees Payments
All fees will be paid one (1) week prior to commencement of events.
G. "No Shows"
Failure to perform as agreedwill constitute a "No Show" thereby causing
forfeit of fees unless the Vendors involved can show cause to prevent
this action, in which case a hearing will be held.
H. Air Space
Air space per unit shall not exceed 7' in height without written authorization
by city officials .
J. Availability
All requests for the use of the Ithaca Commons are subject to availability
on a first come-first serve bases and cannot interfere with promotions
or activities previously established.
K. Vendors shall be subject to the overall jurisdiction of the Ithaca
Commons Promotion Director.
L. No individual , Itinerant or non-itinerant vendor shall occupy more
than one (1 ) space per day.

FEES APPLYING TO CLASS E PERMITS (VENDING, SOLICITING AND FUND RAISING)
NO MERCHANDISE SHALL BE DISPLAYED ON THE COMMONS WITHOUT SPECIFIC PERMIT.
I. Non Profit Organization Vending or Sale for Profit:
A. $5.00 fee for project use permit
B. Time and space use shall be set by I.C.A.B. subject to space
available in conjunction with other activities scheduled.
C. Merchandise shall be quietly displayed (no hawking) .
D. Small sign identifying organization would be helpful.
E. Keep permits visable.
II. Individual Sales:

Pavilions (I) may be rented by individuals and by individual
merchants for $25 per day, per pavilion,

shall be subject to 30 day advance scheduling by the I.C.A.B.
and availability of each pavilion. Users shall provide a
Certificate of Liability Insurance in the following amounts:
a. bodily injury $300,000 b. property damage $50,000 c. product
coverage $25,000.
III. Organized Group Promotions and Sales:

• A fee of llaki per event will be charged for all organized and
planned promotions or sales sponsored by the D.I.B.A.. An
exception to this shall be the scheduled sidewalk days (2 days) ,
and paid attractions where this charge shall be waived.

MOVED THAT the Advisory Board recommend to Common Council that the
Commons Advisory Board (CAB) be the final Appeals Board for matters
pertaining to the Commons within the general policy guidelines adopted

Commons.
C. Special delivery vehicles needed on the Commons.
D. Educational recruiting by Tompkins Cortland Community College, BOCES,
Cornell University and Ithaca College.

MOVED THAT Experimental Use permits bt granted by the Superintendent
of Public Works after individual review and approval by the Commons
Advisory Board for all applications for all profit sales or vending
use of the Commons. "Experimental Use Permit" shall be defined as a
permit for use on an experimental basis but with an indefinite time
limit unless otherwise specified by the Commons Advisory Board. If
the user of the permit proves to be unsatisfactory the permit may be
withdrawn by the Advisory Board. In addition:
A. Commons use fee shall be established by the CAB and or waived
at their discretion.
B. Priority for Vending Permits shall be given to businesses in the
tax district.

prior to the time that such activity takes place.

MOVED THAT the Commons Advisory Board feels that an administrative
secretary, other than the promotion and advertising director hired
by the DIBA, be engaged to assist the CAB with administrative and

sign ordinance as it applies to the Central Business District and the
Ithaca Commons and to make recommendations for any modifications which
might be necessary to meet the aesthetic objectives established for
the Ithaca Commons.
BE IT FURTHER RESOLVED that the planning department be requested to
consider a street graphics system for the Commons area and its
surroundings and, further, that if it is possible for the planning board
to do so, a system of street graphics including letter style, color,
materials, and location be prepared and submitted to the CAB for review.

is an appropriate and desirable activity in the Central Business area
and that space be made available in Parking Lot D on Tuesday afternoons

BE IT FURTHER RESOLVED that the Commons Advisory Board recommend to
the Board of Public Works that such space be made available for the
Farmers' Market beginning on or about May 13, 1975.

Works for issuance of a permit subject to conditions of safety and any
construction limitations imposed by the contractor.

in Tompkins County committee, to conduct an educational event in
conjunction with National Food Day on the Ithaca Commons be endorsed

and that the date of April 17th from 10 a.m. until 6 p.m. be approved,
and that this resolution be transmitted to the Superintendent of
Public Works for issuance of the permit subject to conditions of
safety and any construction limitations imposed by the contractor.

subject to any conditions that he might impose.

the date of Thursday, May 8th from noon to 4 p.m. be approved, and
that this resolution be transmitted to the Superintendent of Public
Works for issuance of a permit subject to conditions of safety and
any construction limitations imposed by the contractor.

to 9 p.m. , be approved, and that this resolution be transmitted to the

MOVED THAT the proposal by Peter Ciferri to conduct a Craft Fair on
the Ithaca Commons be endorsed and improved in principle as an
appropriate activity on the Commons, and that the dates of May 10th
and 11th be approved, and that the following condition be attached
to this recommendation;
Any craftsman selling items at wholesale to merchants
in the Commons tax district shall not sell such items
at a lower price in the Craft Fair than the retail
price charged by said merchants.
BE IT FURTHER RESOLVED that this resolution be transmitted to the
Superintendent of Public Works for issuance of a permit subject
to conditions of safety and any construction limitations imposed
by the contractor.

of the American Cancer Society, to offer daffodils for sale as

Commons and that this resolution be transmitted to the Superintendent
of Public Works for issuance of any permit required.

this resolution be transmitted to the Mayor for issuance of a permit
subject to conditions of safety imposed by the Superintendent of Public
Works and to a satisfactory solution to the problem of phone and
electrical hookup.

Ithaca High School Drama Club, to present a short segment of the
Drama Club Spring Production be endorsed and approved in principle
as an appropriate activity on the Commons and that the date of
April 10th starting at 4 p.m. , with a rain date of April 14th,
be approved, and that this resolution be transmitted to the
Superintendent of Public Works for issuance of a permit subject to
conditions of safety and any construction limitations imposed by the
contractor.

ticular activity.

MOVED THAT the proposal from Charlie Chatfield and Jack Kiely to
conduct an event on the Ithaca Commons as a salute to the Bicentennial
observance and as a kickoff to the United Way campaign be endorsed
and approved in principle as an appropriate activity on the Commons,
and that the dates of October 1st and 2nd be approved and that this
resolution be transmitted to the Superintendent of Public Works for
scheduling and issuance of a permit subject to conditions of safety.

MOVED THAT the Commons Advisory Board accept the offer of the Glidden
Paint Company and specifically Mr. Lauren Cooper and Mr. William
Frick, General Manager of Bishops of Ithaca, Inc., to develop a
color analysis for building facades on the Commons.

MOVED THAT the Commons Advisory Board has determined that the proposal
of Mary Kelsey to conduct an artists studio open house on Saturday,
April 26th does not require a permit.
BE IT FURTHER RESOLVED that the Chairman be directed to inform Ms. Kelsey
that the placing of freestanding signs, advertising bills, and posters
on the Commons in conjunction with this activity is not permitted unless
such signs are affixed to private property with the owner's consent.
BE IT FURTHER RESOLVED that the Chairman be directed to inform Ms.
Kelsey that the Commons Advisory Board is not a sponsoring organization
and does not normally sponsor activities and events on the Commons
and that our name should not be used as such.

MOVED THAT the proposal of Jim Atsedes for an outdoor cafe in con-
junction with the College Spa restaurant be approved in concept
as an appropriate activity on the Ithaca Commons subject to further
development of plans and necessary local, and Alcoholic Beverage
Control Board approval.
VOTE: Carried unanimously with Mr. Atsedes abstaining.
