C . -Itinerant & Non-Itinerant Vendors (Casual) Itinerant Vendors--Definition: A. Itinerant Vendors shall be defined as individual Transient Merchants collectively participating as part of a consolidated retail sales effort offering related items and/or products (ie. hand crafted articles or collectibles, etc . ) for immediate sale during a specified period of time at a designated or assigned space on the Ithaca Commons and/or peripheral areas indicated. B. Non-Itinerant Vendors Definition: Non-Itinerant Vendors shall be defined as individual merchants (whose 1 place of business is considered a retail store by virtue of being an established place of business at a permanent address) collectively participating as part of a consolidated retail sales effort (ie. an exhibit or show) offering related items and/or products (ie . Cars, boats, campers, etc. ) for the purpose of stimulating and activating current and/or future sales during a specified period of time at a designated or assignedSR* e on the Ithaca Commons and/or peripheral areas indicated. C . Itinerant & Non-Itinerant. Vendors : Definition Casual itinerant & non-itinerant vendors `shall be defined as those individuals desiring occasional (one time only) use of the Ithaca Commons for the purpose of cash sales of items during a specified period of time not to exceed 4 consecutive days in a calendar year. The items for sale shall not be in direct competition with merchandise offered by Central Business District Merchants . Permits shall not be granted if either merchandise or activity is deemed inappropriate or inprudent by the C . A. B. or the D. I . B. A. Permits may be revoked subject to subsequent infractions of conditions set forth. • FEES SCHEDULE A. Itinerant Vendors (Groups) 1 . Space units are 4'X8' (tables, stands, booths , etc. ) 2 , Minimum units allowed 26--Maximum 100 Unit Rate Schedule 1-Day rate $5.00 2-Day rate $7.50 3-Day rate $10 .00 Over 3 days add $5.00 per day 1-day Maximum per 100 units $500 .00 2-day Maximum per 100 units $750 .00 3-day Maximum per 100 units $1 ,000.00 ` over 3 days add $500 per day 3. FLAT Rate Schedule Maximum units allowed =-25 --no minimum 1-day rate $250 .00 2-day rate $500 .00 3-day rate $750 .00 Over 3 days add $250.00 per day B. Non-Itinerant Vendors (Groups) 1 . Space units are 8'X20 ' (cars, boats , campers , etc . ) 2 . Maximum units allowed 50--minimum 26 Unit Rate Schedule 1-day rate $5.00 2-day rate $7.50 3-day rate $10.00 over 3 days add $5.00 per day 1-day maximum per 50 units $250 .00 2-day maximum per 50 units $375.00 3-day maximum per 50 units $500.00 over 3 days add $200 .00 per day a 3. Flat Rate Schedule Maximum units allowed 25--no minimum 1-day rate $200.00 2-day rate $300.00 3-day rate $400.00 over 3 days add $150 .00 per day. C . Refunds Policy In the event rain cancels the engagement without a rain date,fee refunds for that day only will be remitted. 1 E. Special Rates Special rates will be in effect Monday thru Wednesday (Holidays excepted) . The rate for activities during .these days will be 75% of standard fees . F. Fees Payments All fees will be paid one (1) week prior to commencement of events. G. "No Shows" Failure to perform as agreedwill constitute a "No Show" thereby causing forfeit of fees unless the Vendors involved can show cause to prevent this action, in which case a hearing will be held. H. Air Space Air space per unit shall not exceed 7' in height without written authorization by city officials . J. Availability All requests for the use of the Ithaca Commons are subject to availability on a first come-first serve bases and cannot interfere with promotions or activities previously established. K. Vendors shall be subject to the overall jurisdiction of the Ithaca Commons Promotion Director. L. No individual , Itinerant or non-itinerant vendor shall occupy more than one (1 ) space per day. ITHACA COMMONS Fees Committee Third Draft May 1, 1975 FEES APPLYING TO CLASS E PERMITS (VENDING, SOLICITING AND FUND RAISING) NO MERCHANDISE SHALL BE DISPLAYED ON THE COMMONS WITHOUT SPECIFIC PERMIT. I. Non Profit Organization Vending or Sale for Profit: A. $5.00 fee for project use permit B. Time and space use shall be set by I.C.A.B. subject to space available in conjunction with other activities scheduled. C. Merchandise shall be quietly displayed (no hawking) . D. Small sign identifying organization would be helpful. E. Keep permits visable. II. Individual Sales: - Pavilions (I) may be rented by individuals and by individual merchants for $25 per day, per pavilion, OMMOIftwiag. This rental shall be subject to 30 day advance scheduling by the I.C.A.B. and availability of each pavilion. Users shall provide a Certificate of Liability Insurance in the following amounts: a. bodily injury $300,000 b. property damage $50,000 c. product coverage $25,000. III. Organized Group Promotions and Sales: c • A fee of llaki per event will be charged for all organized and planned promotions or sales sponsored by the D.I.B.A.. MAJOR MOTIONS MADE AND PASSED BY THE COMMONS 'd,TSORY BOARD RESOLUTION No. 1 Date: January 14, 1975 MOVED by: Nancy Meyer SECOND by: Gerry Schickel MOVED THAT the Advisory Board recommend to Common Council that the Commons Advisory Board (CAB) be the final Appeals Board for matters pertaining to the Commons within the general policy guidelines adopted by Council. VOTE: Carried unanimously. RESOLUTION No. 2 Date: January 14, 1975 MOVED by: Gerry Schickel SECOND by: Agda Osborn MOVED THAT all organizations or individuals applying for permits should submit their plans to the Commons Advisory Board for approval. VOTE: There was no vote recorded in the minutes on this motion. RESOLUTION No. 3 Date: January 14, 1975 MOVED by: Nancy Meyer • SECOND by: Peggy Underwood MOVED THAT all activities on the Commons should come to the CAB for approval or denial and, upon the approval of such applications, the CAB would authorize the Superintendent of Public Works to issue a permit. Brown MOVED THAT the report from the Operations Committee be approved with the understanding that additional operating procedures could be established as necessary. Brown MOVED THAT the CAB is in strong support of a proposal by the Johnson museum for a City Spirit program for the Commons involving demonstrations of printmaking, pottery, and other arts and crafts in the summer of 1975. Brown MOVED THAT a Use Permit be granted by the Superintendent of Public Works without review of the Commons Advisory Board unless the Super- intendent of Public Works asks for approval from the Commons Advisory Board for the following actions: A. Police, fire, ambulance, and City owned vehicles. B. Repair construction or service vehicles needed by buildings on the Commons. C. Special delivery vehicles needed on the Commons. D. Educational recruiting by Tompkins Cortland Community College, BOCES, Cornell University and Ithaca College. VOTE: Passed unanimously. RESOLUTION No. 9 Date: January 30, 1975 MOVED by: Peggy Underwood SECOND by: Agda Osborn MOVED THAT a Use Permit be granted by the Superintendent of Public Works after review, approval and scheduling by the Commons Advisory Board or its designee of the following activities. A. Entertainment B. Educational C. Cultural D. Special E. Religious F. Other nonprofit use. AND BE IT FURTHER MOVED that this procedure shall be followed for a six month trial basis. "Experimental Use Permit" shall be defined as a permit for use on an experimental basis but with an indefinite time limit unless otherwise specified by the Commons Advisory Board. If the user of the permit proves to be unsatisfactory the permit may be withdrawn by the Advisory Board. In addition: A. Commons use fee shall be established by the CAB and or waived at their discretion. B. Priority for Vending Permits shall be given to businesses in the tax district. VOTE: Passed unanimously. VOTE: Passed unanimously. 4 RESOLUTION No. 13 Date: February 14, 1975 MOVED by: Peggy Underwood SECOND by: Nancy Meyer MOVED THAT the overall sales and promotion calendar of the Downtown Ithaca Business Association be referred to the Commons Advisory Board for approval and scheduling. BE IT FURTHER RESOLVED that each individual activity in such overall sales and promotion schedule be approved by the Commons Advisory Board prior to the time that such activity takes place. VOTE: Passed unanimously. RESOLUTION No. 14 Date: February 21, 1975 MOVED by: Nancy Meyer SECOND by: Gerry Schickel MOVED THAT the Commons Advisory Board feels that an administrative secretary, other than the promotion and advertising director hired by the DIBA, be engaged to assist the CAB with administrative and secretarial duties in accordance with the job description submitted by the subcommittee and attached hereto. RESOLUTION No. 15 Date: February 28, 1975 MOVED by: Agda Osborn SECOND by: Nancy Meyer MOVED THAT the planning department be requested to review the current sign ordinance as it applies to the Central Business District and the Ithaca Commons and to make recommendations for any modifications which might be necessary to meet the aesthetic objectives established for the Ithaca Commons. BE IT FURTHER RESOLVED that the planning department be requested to consider a street graphics system for the Commons area and its surroundings and, further, that if it is possible for the planning board to do so, a system of street graphics including letter style, color, materials, and location be prepared and submitted to the CAB for review. Brown SECOND by: Nancy Meyer MOVED THAT the Commons Advisory Board feels that the Farmers' Market is an appropriate and desirable activity in the Central Business area and that space be made available in Parking Lot D on Tuesday afternoons and Saturday mornings for the operation of such Farmers' Market. BE IT FURTHER RESOLVED that the Commons Advisory Board recommend to the Board of Public Works that such space be made available for the Farmers' Market beginning on or about May 13, 1975. Brown MOVED THAT the draft of the Ithaca Commons Advisory Board Operations Manual, as modified and approved on March 14, 1975, be submitted to Common Council as a recommended guideline for the continuing operation of the Ithaca Commons and the Ithaca Commons Advisory Board. Brown SECOND by: Jim Rothschild MOVED THAT the proposal of the Tompkins County Automobile Dealers for an auto show on the Ithaca Commons be endorsed and approved in principle as an appropriate activity for the Commons, and that the dates of May 16, 17, and 18 be approved for this event, and that this resolution be transmitted to the Superintendent of Public Works for issuance of a permit subject to conditions of safety and any construction limitations imposed by the contractor. VOTE: Carried unanimously. RESOLTUION No. 21 Date: March 24, 1975 MOVED by: Nancy Meyer SECOND by: Agda Osborn MOVED THAT a proposal from Jane Rice, Chairman of the Food Day in Tompkins County committee, to conduct an educational event in conjunction with National Food Day on the Ithaca Commons be endorsed and approved in principle as an appropriate activity for the Commons, and that the date of April 17th from 10 a.m. until 6 p.m. be approved, and that this resolution be transmitted to the Superintendent of Public Works for issuance of the permit subject to conditions of safety and any construction limitations imposed by the contractor. VOTE: Carried unanimously. RESOLUTION No. 22 Date: March 28, 1975 MOVED by: Gerry Schickel SECOND by: H. S. Brown MOVED THAT the planning board be requested to assist in the preparation of alternate designs for a logo for the Ithaca Commons and, further, that John Taylor be requested to check with the school of Design and Environmental Analysis at Cornell University to determine whether or not design suggestions for a logo can be obtained. Brown MOVED THAT the request from Charles Decker of Alpha House to use the Commons for Friday March 28th and Saturday March 29th for the sale of cheesecake be endorsed and approved as an appropriate activity on the Commons and that this resolution be transmitted to the Superintendent of Public Works for issuance of a permit subject to any conditions that he might impose. VOTE: 3 Yes 1 No Motion carried. RESOLUTION No. 24 Date: March 28, 1975 MOVED by: Stuart Lewis SECOND by: H. S. Brown MOVED THAT the proposal of Mr. Philip Johnson and Mrs. Gloria Weeks, representing the Tompkins County Senior Citizens' Council, to use - the Commons for a Senior Citizens' event, be endorsed and approved in principle as an appropriate activity on the Commons, and that the date of Thursday, May 8th from noon to 4 p.m. be approved, and that this resolution be transmitted to the Superintendent of Public Works for issuance of a permit subject to conditions of safety and any construction limitations imposed by the contractor. VOTE: Carried unanimously. RESOLUTION No. 25 Date: March 28, 1975 MOVED by: H. S. Brown SECOND by: Stuart Lewis MOVED THAT the proposal by Gerald Schickel of the Iron Shop to conduct a sale of wrought iron outdoor furniture on the Ithaca Commons be endorsed and approved in principle as an appropriate activity on the Commons, and that the date of May 7th through the 10th, from 9 a.m. to 9 p.m. , be approved, and that this resolution be transmitted to the Superintendent of Public Works for issuance of the permit subject to conditions of safety and any construction limitations imposed by the contractor. VOTE: Carried unanimously with Mr. Schickel abstaining. 8 RESOLUTION No. 26 Date: March 28, 1975 MOVED by: Gerry Schickel SECOND by: Jim Atsedes MOVED THAT the proposal by Peter Ciferri to conduct a Craft Fair on the Ithaca Commons be endorsed and improved in principle as an appropriate activity on the Commons, and that the dates of May 10th and 11th be approved, and that the following condition be attached to this recommendation; Any craftsman selling items at wholesale to merchants in the Commons tax district shall not sell such items at a lower price in the Craft Fair than the retail price charged by said merchants. BE IT FURTHER RESOLVED that this resolution be transmitted to the Superintendent of Public Works for issuance of a permit subject to conditions of safety and any construction limitations imposed by the contractor. VOTE: Carried unanimously. RESOLUTION No. 27 Date: March 28, 1975 MOVED by: Gerry Schickel SECOND by: H. S. Brown MOVED THAT the request of Mrs. Craig Boniface, Executive Director of the American Cancer Society, to offer daffodils for sale as a fund raising measure on Friday, April 11th and Saturday, April 12th be endorsed and approved as an appropriate activity on the Commons and that this resolution be transmitted to the Superintendent of Public Works for issuance of any permit required. VOTE: Carried unanimously. RESOLUTION No. 28 Date: April 4, 1975 MOVED by: Gerry Schickel SECOND by: Peggy Underwood MOVED THAT the proposal from Radio Station WICB, and specifically Mr. Gary B. Duglin to conduct a Sock Hop dance be endorsed and approved in principle as an appropriate activity on the Commons, and that the date of May 4th from 7 to 11 p.m. be approved and that this resolution be transmitted to the Mayor for issuance of a permit subject to conditions of safety imposed by the Superintendent of Public Works and to a satisfactory solution to the problem of phone and electrical hookup. VOTE: Carried unanimously. 9 RESOLUTION No. 29 Date: April 4, 1975 MOVED by: Peggy Underwood SECOND by: Agda Osborn MOVED THAT the proposal by Daniel Rift, Publicity Director of the Ithaca High School Drama Club, to present a short segment of the Drama Club Spring Production be endorsed and approved in principle as an appropriate activity on the Commons and that the date of April 10th starting at 4 p.m. , with a rain date of April 14th, be approved, and that this resolution be transmitted to the Superintendent of Public Works for issuance of a permit subject to conditions of safety and any construction limitations imposed by the contractor. VOTE: Carried unanimously. RESOLUTION No. 30 Date: April 11, 1975 MOVED by: H. S. Brown SECOND by: Peggy Underwood MOVED THAT the request from Steve Walters an Ithaca College student to conduct a classroom survey on the Commons be endorsed and approved in principle as an appropriate activity, and that the dates of April 11th and 12th be approved for this activity, and that the Superintendent of Public Works be informed that no permit is needed for this par- ticular activity. VOTE: Carried unanimously. RESOLUTION No. 31 Date: April 11, 1975 MOVED by: H. S. Brown • SECOND by: Peggy Underwood • MOVED THAT the request of Mrs. Lempi H. Parsons to conduct an antique show on the Ithaca Commons in August, 1975 be denied due to the absence of suitable guidelines and to a lack of experience by the Commons Advisory Board on what might be involved in such a show. • VOTE: Carried unanimously. 10 RESOLUTION No. 32 Date: April 18, 1975 MOVED by: Agda Osborn SECOND by: Gerry Schickel MOVED THAT the proposal from Charlie Chatfield and Jack Kiely to conduct an event on the Ithaca Commons as a salute to the Bicentennial observance and as a kickoff to the United Way campaign be endorsed and approved in principle as an appropriate activity on the Commons, and that the dates of October 1st and 2nd be approved and that this resolution be transmitted to the Superintendent of Public Works for scheduling and issuance of a permit subject to conditions of safety. RESOLUTION No. 33 Date: April 18, 1975 MOVED by: H. S. Brown SECOND by: Gerry Schickel MOVED THAT the Commons Advisory Board accept the offer of the Glidden Paint Company and specifically Mr. Lauren Cooper and Mr. William Frick, General Manager of Bishops of Ithaca, Inc., to develop a color analysis for building facades on the Commons. VOTE: Carried unanimously. RESOLUTION No. 34 Date: April 18, 1975 MOVED by: Peggy Underwood SECOND by: H. S. Brown MOVED THAT the Commons Advisory Board has determined that the proposal of Mary Kelsey to conduct an artists studio open house on Saturday, April 26th does not require a permit. BE IT FURTHER RESOLVED that the Chairman be directed to inform Ms. Kelsey that the placing of freestanding signs, advertising bills, and posters on the Commons in conjunction with this activity is not permitted unless such signs are affixed to private property with the owner's consent. BE IT FURTHER RESOLVED that the Chairman be directed to inform Ms. Kelsey that the Commons Advisory Board is not a sponsoring organization and does not normally sponsor activities and events on the Commons and that our name should not be used as such. VOTE: Carried unanimously. 11 . RESOLTUION No. 35 Date: April 18, 1975 MOVED by: Gerry Schickel SECOND by: H. S. Brown MOVED THAT the proposal of Jim Atsedes for an outdoor cafe in con- junction with the College Spa restaurant be approved in concept as an appropriate activity on the Ithaca Commons subject to further development of plans and necessary local, and Alcoholic Beverage Control Board approval. VOTE: Carried unanimously with Mr. Atsedes abstaining. 12
