The Regular Meeting of the Town of Groton Planning Board was called to order at 7:30 p.m. by Chairperson Barbara Clark. APPROVAL OF MINUTES — 14 MAY 2009 A motion was made by Member Ed Neuhauser to approve the Minutes of the 14 May 2009 meeting of the Town of Groton Planning Board, as submitted. The motion was seconded by Member Janice Haines, with the vote recorded as follows: Ayes: Chair Clark Nays: None Member Baxendell Member Carey Absent: Member Donlick Member Gloster Member Haines Member Neuhauser Motion carried. This becomes Action #12 of 2009. OLD BUSINESS - None NEW BUSINESS Rod Howe, Applicant/Reputed Owner- 47 Cobb Street -TM # 34.-1-25.2 - Minor Subdivision Chair Clark recognized the applicant's rep, Tiffany Howe, who explained that her uncle was seeking approval to subdivide the subject 12.97± acre parcel into three lots, as shown on the portion of the tax map attached to the application. Ms. Howe stated that she would be purchasing the house which sits on about 1.8± acres. The applicant plans to retain the acreage with the barn. The CEO Gary Coats advised that all setbacks will be adhered to. It is noted that there was some confusion as to tax map parcel numbers, but this was because it had been less than a month since the property was previously subdivided and the new tax map parcel had not yet been received from the County. Chair Clark acknowledged that "under 6 NYCRR Part 617.5(c)(10), (12) or (13) of the State Environmental Quality Review Law, the proposed action is a Type II action and is determined not to have a significant impact on the environment, or is otherwise precluded from environmental review under the Environmental Conservation Law, Article 8." The motion was seconded by Member Monica Carey, with the vote recorded as follows: Ayes: Chair Clark Nays: None Member Baxendell Member Carey Member Gloster Absent: Member Donlick Member Haines Member Neuhauser Motion carried. This becomes Action #13 of 2009. Stanley Tucker, Applicant/Reputed Owner - 39 Townline Road - TM # 24.-1-1.1 - Site Plan Review for Proposed Gun Shop Chair Clark recognized the applicant who explained to the Board that he was seeking approval to put a gun shop in the basement of his existing house. The shop, he stated, was "more of a hobby at this point." He commented that it would be part-time, that he might buy and sell, there would be no target range, and no shooting. The closest neighbor would be across the street. He also advised there would be no sign at all, and he would depend on word-of-mouth. Mr. Tucker stated he would obtain all required licenses, and there would be a separate entrance to the basement level. CEO Coats advised he had inspected the proposed shop, which had 8-foot ceilings, escape windows, two exits, a concrete floor, and conforms to the Code for this use. At the conclusion of the discussion, a motion was made by Member Neuhauser, to set a Public Hearing for the proposed gun shop for 16 July 2009 at 7:30 p.m. The motion was seconded by Member Mark Baxendell, with the vote recorded as follows: Ayes: Chair Clark Nays: None Member Baxendell Member Carey Member Gloster Absent: Member Donlick Member Haines Member Neuhauser Motion carried. This becomes Action #14 of 2009. A motion was then made by Member Carey, to approve the Preliminary Site Plan for the proposed gun shop, as submitted. The motion was seconded by Member Gloster, with the vote recorded as follows: Ayes: Chair Clark Nays: None Member Baxendell Member Carey Member Gloster Absent: Member Donlick Member Haines Member Neuhauser Motion carried. This becomes Action #15 of 2009. Page 2 of 4 (T)Groton Planning Board Minutes of Regular Meeting 18 June 2009 Tyloer & Hannah VanOstrand, Applicants/Reputed Owners - 577 Pleasant Valley Road - TM # 35.-1-1.32 - Minor Subdivision Chair Clark recognized the applicant's representative Frankie Nolan, who allowed CEO Coats to give a brief history of this parcel, which was explained in the 6/10/09 narrative from CEO Coats to the Planning Board, a copy of which has been placed on file for the record. The applicants would now like to subdivide this 11± acre lot into three lots, as shown on a portion of the tax map accompanying the application. Two of the lots would be flag lots, with access from Pleasant Valley Road, as shown on the map. Parcel 1, as shown on the map, contains a small portion of a wetland; Mr. VanOstrand had indicated to CEO Coats that he planned to keep this parcel "forever wild." CEO Coats advised that the lot sizes meet the requirements. At the request of the Chair, Board Secretary Fitch read aloud Part II of the Short Environmental Assessment Form. Negative responses were obtained to all questions in Part II. A motion was then made by Member Carey that the proposed action, based on the information submitted, will not cause any significant adverse environmental impact, resulting in a Negative Declaration under SEQRA. The motion was seconded by Member Baxendell, with the vote recorded as follows: Ayes: Chair Clark Nays: None Member Baxendell Member Carey Member Gloster Absent: Member Donlick Member Haines Member Neuhauser Motion carried. This becomes Action #16 of 2009. A motion was then made by Member Haines, to approve the Minor Subdivision, as requested. The motion was seconded by Member Gloster, with the vote recorded as follows: Ayes: Chair Clark Nays: None Member Baxendell Member Carey Member Gloster Absent: Member Donlick Member Haines Member Neuhauser Motion carried. This becomes Action #17 of 2009. OTHER MATTERS • Town Supervisor Glenn Morey advised the Board that there will be a second Public Hearing held July 14th on the proposed Code regulations. He'd heard comments that the Committee who worked on the revised regulations had wasted their time, and he assured everyone that this was definitely not the case. Approximately 90% of the original Code remains, but it now gives everyone a clear understanding of what's allowed and not allowed. He also mentioned that they will start reviewing the Comprehensive Plan again, since it's been about five years since this was done.
