The Notice of Public Hearing was read by Chairperson Wilcox. "Please take note that pursuant to Section 20 of the Civil Service Law of the State of New York that the City of Ithaca Civil Service Commission will hold a public hearing at 7:30 P. M. in the Conference Room, City Hall , 108 E. Green Street, to amend its Rules by adding to Appendix B to Rule IV Non-Competitive Class the position of Parking Meter Checkers - Part-time. All citizens either for or against the change are invited to attend and be heard. " Resolution to Open the Public Hearing - Commissioner Slaght Resolved that the public hearing be opened. Seconded by Commissioner Schickel . The Commission voted. Motion carried. There were no persons present to address the Commission on the above matter. Resolution to Close the Public Hearing - Commissioner Schickel Resolved that the Public Hearing be closed. Seconded by Commissioner Slaght. The Commission voted. Motion carried. Pezdek, Executive Secretary REGULAR MEETING CITY OF ITHACA CIVIL SERVICE COMMISSION May 14, 1985 Present: Chairperson Wilcox, Commissioner Slaght, Commissioner Schickel , Executive Secretary Pezdek. NEW BUSINESS APPROVAL OF MINUTES Commissioner Slaght moved that the Minutes of the April meeting be approved. Seconded by Commissioner Schickel . Motion carried unanimously. ESTABLISHMENT OF ELIGIBLE LISTS Commissioner Slaght presented to the Commission the following eligible lists and moved that they`be established effective May 14, 1985 and that they be in existence for one year unless exhausted sooner: Assistant Engineer, No. 60-061 ; School Bus Route Coordinator No. 70-676 and Administrative Assistant, No. 60-370. Seconded by Commissioner Schickel . The Commission reviewed the eligible lists then voted. Motion carried unanimously. RULES CHANGE - PARKING METER CHECKERS - PART-TIME Commissioner Schickel moved: "WHEREAS, The City of Ithaca Sivil Service Commission has held a Public Hearing on May 14, 1985 at 7:41 P. M. in the Conference Room, City Hall , 108 E. Green Street, Ithaca, New York concerning the amendment of its Rules for the Classified Civil Service of the City of Ithaca by adding Parking Meter Checkers - Part-time to Appendix B to Rule IV, Non-Competitive Class : NOW, THEREFORE BE IT RESOLVED, That Parking Meter Checkers - Part-time be added to Appendix B to Rule IV Non-Competitive Class. Seconded by Commissioner Slaght. The Commission voted. Motion carried unanimously. ROSTERS OF CANDIDATES Commissioner Slaght moved that the following Rosters of Candidates for the following examinations be approved: Supervisor of Custodians, No. 71-055 and Youth Worker, No. 61-432. Seconded by Commissioner Schickel . The Commission reviewed the Rosters then voted. Motion carried unanimously. At this point of the meeting the following individuals entered. Mr. J. Douglas Hart, Personnel Director, Ithaca City School District, Mr. David Bacharach, Mr. Charles Fletcher, Mrs. Mary Hubbell representing the Ithaca City School District Employees Association. LAYOFFS AT THE ITHACA CITY SCHOOL DISTRICT Following the introductions Chairperson Wilcox asked Mr. Hart to address the Commission on the layoff situation in the school district caused by the cuts proposed by the Board of Education and those caused by individuals not passing their promotional examinations. Mr. Hart thanked the Commission for its time and stated: " We have a problem and would like to share it with you. Three people have failed their promotional tests - two are School Secretaries and one is a Senior Typist. In addition we are in the process of the cuts with the result that two stenographers will have to go in addition to three others for a total of five. Their present jobs are in jeopardy but they have a second area of classification to which they can bump down. We feel that the performance of the individuals is good in their present positions. What we need to know is can you give us flexability? Is there any other recourse? Can we retain them? Can they take a third open competitive test rather than be cut off? Is there a possibility of reclassifying the positions downward? Would you consider this? Are there any other options so beople on the bottom won' t go on to a preferred eligible list. " ' • Mr. Hart then asked if any of the union representatives had any comments. Mr. Fletcher stated that the employees involved had been there a long time. Mr. Bacharach said that they - the employees don't know of this yet. Two of the people have been in positions many years with the district. They have letters of recommendation from various administrators. They don't take tests well , They weren't aware that the results of the tests were that critical . We have been putting them off because we don't know what will finally happen. We are looking for another route to hurt as few as possible. Chairperson Wilcox stated that she had a question on Mrs. Haring the item that was on the Commission's agenda. Was Mrs. Haring's position one of those being considered at this time. Mr. Hart replied that it was not. Dave Bacharach stated: "Mrs. Haring consciously refused to take the test. There was general discussion. The Commission reviewed the position classification questionnaire prepared on Mrs. Haring's present job and asked for comments from those present. Mr. Bacharach stated that it was Gary's, meaning Mr. Lindenbaum's, position that it is generally typing. I know she types a lot but I have no specific knowledge. Mrs. Hubbel remarked that Mrs. Haring works with bids, purchase orders organizing bids, filing etc. Chairperson Wilcox stated: "The same question was -raised in the re-classification study and it still appears to be so. At the moment as for other ideas nothing occurs to me. We will look at your two pptions. Who are the three individuals?" Mr. Hart replied Mrs. Meeker, Ms. Cornish and Mrs. Fischer. Commissioner Slaght said in your first recommendation are you asking for an open competitive examination. Mr. Hart replied Yes. Mr. Flecther remarked that where the examinations are given at GIAC it is noisey and that this bothers the candidates. Mr. Hart remarked that the Commission could have a free room at the district for testing. Mr. Pezdek stated that he would be very happy with this arrangement, and would follow up on it. There was general discussion. Mr. Hart described what the district personnel and Bob Pezdek had been doing to try and resolve the situation. He stated that he was very appreciative of Bob's coming down to the district for three meetingsof over two hours each to lend assistance. Chairperson Wilcox stated that the Commission was appreciative of your coming here to Mr. Hart and the others. In addition I am wondering about time. Is there a schedule? r 1 Mr. Hart replied: You gave it to us already - July 12th. Chairperson Wilcox: That's correct. Mr. Hart then said: "We have to get the people affected together for a meeting. I will have to inform the school board and the individuals involved what the cuts will be. " Mrs. Hubbell asked: "What's the purpose of Civil Service. I thought it was to protect the people. " Chairperson Wilcox: "The bumping system is part of the system of protection. " She then asked Mr. Pezdek for comments on this point. He agreeded with the Chairpersons statement and pointed out that the system protected the long term employee and did not provide for terminating or letting them go to a preferred list. Mrs. Hubbel Stated that:" You are taking people off an eligible list hiring them and letting others go to a preferred list, and that her people could not understand why a present employee had to go and another one be hired. Mr. Pezdek replied that the civil service law and the State Constitution provided that an employee obtain their job based on merit and fitness as determined by competitive examination, and that we have no choice other than to follow what is set forth in the law in this matter. Commissioner Slaght asked if the three individuals were aware of the situation. Mr. Hart replied that Mr. Pezdek has sent them letters. There was general discussion. In conclusion, Chairperson Wilcox stated that the system is not as exact as we try to make it. and it is not as flexable as in the past. Mr. Hart stated: "I assume you will be in touch with us. Chairperson Wilcox assured him that the Commission would be. Mr. Hart and the union representative departed. The Commission went into executive session where it discussed its options. Following the discussion the Commission the Commission instructed Mr. Pezdek to contact Mr. Ciprioni of MSD to ascertain what assistance he could render in the matter and to advise Mr. Hart that the Commission would give its decision sometime between May 29th and June 11th. EXTENSION OF SERVICE FOR MRS. TIRING Commissioner Schickel moved to confirm Executive Secretary Pezdek 's decision to grant an extension per Section 65. 3 of the civil service law to the school district in the case of Mrs. Margaret Haring, Senior Typist. Thus Mrs. Haring must vacate her position no later than July 12, 1985. Seconded by Commissioner Slaght. Motion carried unanimously. OLD BUSINESS None r ANNOUNCEMENTS 1. The New York State Association of County Personnel and Civil Service Officers is holding their annual meeting/training session on June 24-27.
