P ez d Executive Secretary PUBLIC HEARING CITY OF ITHACA CIVIL SERVICE COMMISSION February 14, 1984 Present: Chairperson Wilcox, Commissioner Slaght, Executive Secretary Pezdek, Barbara J. Lund Chairperson Wilcox called the Public Hearing to order at 7:37 P. M. Chairperson Wilcox requested Executive Secretary Pezdek to read the Notice of the Public Hearing. Mr. Pezdek read the notice as follows: "Please take note that pursuant to Section 20 of the Civil Service Law of the State of New York, the City of Ithaca Civil Service Commission will hold a Public Hearing on February 14, 1984, at 7:30 P. M. , in the Conference Room, Third Floor, City Hall , 108 East Green Street, Ithaca, New York, to amend its Rules as follows: To include in Rule XIV, Probationary Term in Section 1 (a) the sentence: The probationary term for the City Engineer will be one year. All interested parties and citizens for or against the adoption of the proposed change are invited to attend and be heard." RESOLUTION TO OPEN THE PUBLIC HEARING: Commissioner Slaght Resolved that the public hearing be open. Seconded by Chairperson Wilcox. Motion carried. Chairperson Wilcox invited Ms. Barbara J. Lund to address the Commission. Ms. Lund stated that she was the former City Engineer. She asked what the present rule on the probationary term was for the City Engineer's position. Mr. Pezdek replied that it was isriDc Months. 190 Ms. Lund then proceeded to give background information to the Commission on her accepting the position of City Engineer. She stated that she had left a $43,000.00 job in Northern California to accept the position, she had received a negative reaction on a higher salary than she was earning in the negotiations with Mr. Kenneth Walker of the Board of Public Works and with Mr. Kinsella the Superintendent of Public Works due to the salary structure here. It would be impossible to pay her more that the Assistant to the Superintendent of Public Works, Mr. Dougherty was earning. Ms. Lund then stated: " I found out that I had no protection in December in my appointment as City Engineer because I was provisional . " Ms. Lund then stated: "In private industry you receive a performance review. I received no performance review from the Superintendent. Furthermore, I • received on filing and secretarial services as of June of 1983. " Ms. Lund then described the scope of responsibilities of her former position position to the Commission. Ms. Lund then Stated that: "In September, I requested an executive session with Don Kinsella and the Board of Public Works, to review my position and work. Don Kinsella cancelled the executive session. I was busy with Floral Avenue - and the West Clinton Street construction jobs and I let the matter drop. I routinely updated Don Kinsella on my division. Don Kinsella repeatedly told the Board of Public Works that thid did not happen. I was repeatedly denied tools in the secretarial area. As a result, I had to work ten, eleven, twelve hours a day repeatedly doing secretarial duties. " Ms. Lund then said she had received a report of her breaking into the Civil Service Office. She said " Bob Pezdek discussed it with Jack Clynes and others. " She further stated that she was " required to be ethical as a person and as a professional engineer. Professional engineers have a code of ethics and I must follow them. When I have problems I am bound to rectify them. Problems such as people working under forty hours and over forty hours without being paid." Chairperson Wilcox asked Ms. Lund: "How does this relate to the public hearing?" Ms. Lund replied: " These is no way that the City Engineer can please the Board of Public Works with the problems in the areas of my former responsibility. I recommend that the probationary period be one year. The Civil Service Commission should recommend that the City Engineer serving at the pleasure of the Board of Public Works be deleted from the Charter. Further more Civil Service should sit in on the negotiations with a new City Engineer. " Chairperson Wilcox asked Ms. Lund: " Do you have knowledge of how civil service works in that area?" Ms. Lund replied: "Yes. " She then proceeded to give background information on her position in San Diego. In that position, she stated that she received review during the entire probationary period, and that while here she received no review of her performance. Chairperson Wilcox Ms. Lund: "Anything further?" Ms. Lund replied: "No. " f Chairperson Wilcox asked Commissioner Slaght if she had any questions. Commissioner Slaght replied: "No, I don't think so. " Chairperson Wilcox thanked Ms. Lund for her comments. There were no other persons present to address the Commission either for or against the extension of the probationary period. RESOLUTION TO CLOSE THE PUBLIC HEARING - Commissioner Slaght Resolved that the public hearing be closed. Seconded by Chairperson Wilcox. Motion carried. Pezdek, Executive Secretary REGULAR MEETING CITY OF ITHACA CIVIL SERVICE COMMISSION February 14, 1984 Present: Chairperson Wilcox, Commissioner Slaght, Executive Secretary Pezdek Chairperson Wilcox called the meeting to order at 3:02 P. M. NEW BUSINESS APPROVAL OF MINUTES Chairperson Wilcox moved that the minutes of the January meeting be approved. Seconded by Commissioner Slaght. Motion carried. PROBATIONARY TERM FOR CITY ENGINEER Resolution to change the Rules of the City of Ithaca Civil Service Commission by amending Rule XIV, Probationary Term, Section 1 a - Commissioner Slaght. WHEREAS, a public hearing was held on February 14, 1984 at 7:37 P. M. in the Conference Room, Third Floor, City Hall , 108 East Green Street, Ithaca, New York, concerning the Rules change noted above and at which one person appeared in favor of the proposed change and none against: NOW, THEREFORE BE IT RESOLVED, THAT the following sentence be inserted at the end of Section 1 (a) in Rule XIV Probationary Term: The probationary term for the City Engineer shall be one year. " Seconded by Chairperson Wilcox. Motion carried. ELIBIBLE LISTS Chairperson Wilcox moved that the following eligible lists be established effective February 14, 1984 and that they be in existence for one year unless exhausted 192 sooner: Account Clerk - Typist, No. 1984-1; School Secretary No. 78-316; Senior Typist, No. 78-049; Senior Stenographer, No. 66-903; Senior Stenographer, No. 78-097, NCP; and Senior Stenographer, No. 78-098. Seconded by Commissioner Slaght. The Commission reviewed the eligible lists then voted. Motion carried: ROSTERS OF CANDIDATES Chairperson Wilcox presented to the Commission the following Rosters of Candidates for examination and moved that they be approved: School Bus Dispatcher, No. 67- 326; School Bus Route Coordinator, No. 78-612, Prom. ; and Library Clerk, No. 1984-2. The Commission reviewed the rosters then voted. Motion carried. PROBATIONARY TERM FOR PERSONNEL ADMINISTRATOR The Commission discussed the Mayor's request to extend the probationary term of the Personnel Administrator from six months to one year. Following the discussion the Commission voted to table the request and directed the Executive Secretary to write to the Mayor requesting his attendance at the Commission's meeting in March.
