Seconded by Commissioner Perko. Motion carried. NEW BUSINESS ADOPTION OF AMENDMENTS TO CIVIL SERVICE RULES Commissioner Cooper made a motion to accept the following Resolution. Seconded by Commissioner Perko. Motion Carried. WHEREAS, the City of Ithaca Civil Service Commission duly advertised and held a Public Hearing on April 9, 1990, for the purpose of amending Rule I Definitions of the City of Ithaca Civil Service Rules to redefine part-time employment and, WHEREAS, the Ithaca Civil Service Commission supports the proposed amendment, and no persons spoke against the proposed amendment, NOW, THEREFORE, BE IT RESOLVED, that Section 6 of Rule I = Definitions be amended to read as follows: "Part-time Employment" means any employment or a combination of one or more employments in a civil division in which an individual works less than fifty percent of the time prescribed as the normal work week by the appropriate governing body or other appropriate authority of the civil division or wherein the employee earns less than one-half (1/2) of the rate assigned to the position if the position has been allocated to a graded salary schedule. Commissioner Cooper made a motion to accept the following Resolution. Seconded by Commissioner Perko. Motion carried. WHEREAS, the City of Ithaca Civil Service Commission duly advertised and held a Public Hearing on April 9, 1990, for the purpose of amending Rule VII Recruitment of Personnel of the City of Ithaca Civil Service Rules to establish residency requirements governing the inclusion of a candidate in a certification which gives preference to municipal residents and, . 1 Civil Service Commission Meeting May 14, 1990 Page 2 WHEREAS, the Ithaca Civil Service Commission supports the proposed amendment, and no persons spoke against the proposed amendment, NOW, THEREFORE, BE IT RESOLVED, that Rule, VII - Recruitment of Personnel be amended by adding a new Section 1(a) to read as follows: When preference in certification is given to residents of a municipality pursuant to subdivision 4-a of Section 23 of the Civil Service Law, an eligible must have been a resident of such municipality for at least one month prior to the date of certification in order to be included in a certification as a resident of such municipality and must be a resident of such municipality at the time of certification and appointment. Commissioner Cooper made a motion to accept the following Resolution. Seconded by Commissioner Perko. Motion carried. WHEREAS, the City of Ithaca Civil Service Commission duly advertised and held a Public Hearing on April 9, 1990, for the purpose of amending Rule XII Certification of the City of Ithaca Civil Service Rules to extend the validity of a certification from thirty (30) days to sixty (60) days and, WHEREAS, the Ithaca Civil Service Commission supports the proposed amendment, and no persons spoke against the proposed amendment, NOW THEREFORE, BE IT RESOLVED, that Section 2 of Rule XII = Certification be amended to read as follows: A certification issued by the Commission to an appointing officer shall be valid for. 'a period of 60 days from the date of its issuance. After the expiration of such 60 day period, no appointment shall be made except from a new certification. Commissioner Cooper made a motion to accept the following Resolution. Seconded by Commissioner Perko. Motion carried. WHEREAS, the City of Ithaca Civil Service Commission duly advertised and held a Public Hearing on April 9, 1990, for the purpose of amending Rule XIII = Promotions of the City of Ithaca Civil Service Rules to allow persons appointed on a contingent permanent basis to compete in promotional examinations and, WHEREAS, the Ithaca Civil Service Commission supports the proposed amendment, and no persons spoke against the proposed amendment, NOW, THEREFORE, BE IT RESOLVED, that Section I of Rule XIII = Promotions be amended to read as follows: Civil Service Commission Meeting May 14, 1990 Page 3 In no case shall any person be eligible to participate in a promotion examination until he has served at least six months on a permanent or contingent permanent basis in a lower grade position. Commissioner Perko made a motion to accept the following Resolution. Seconded by Commissioner Cooper. Motion carried. WHEREAS, the City of Ithaca Civil Service Commission duly advertised and held a Public Hearing on April 9, 1990, for the purpose of amending Rule XIV - probationary Term of the City of Ithaca Civil Service Rules to update existing job titles and clarify the existing probationary period for Police Officers and Firefighters, and WHEREAS, the Ithaca Civil Service Commission supports the proposed amendment, and no persons spoke against the proposed amendment, NOW, THEREFORE, BE IT RESOLVED, that Section 1(a) of Rule XIV = Probationary Term be amended by replacing the title of "Patrolmen" with "Police Officer" , and by replacing the title of "Assistant to the Superintendent of Public Works" with "Assistant Superintendent of Public Works" , and be if further RESOLVED, that the last clause of paragraph 1 of Section 1(a) of Rule XIV - Probationary Term be amended to read "except the probationary period for Police Officer and Firefighter shall be not less than eight (8) nor more than fifty-two (52) weeks" . Commissioner Perko made a motion to accept the following Resolution. Seconded by Commissioner Bantuvanis. Motion Carried. WHEREAS, the City of Ithaca Civil Service Commission duly advertised and held a Public Hearing on April 9, 1990, for the purpose of amending Rule XIV m Probationary Term of the City of Ithaca Civil Service Rules to establish a twelve (12) week probationary period for all appointments from promotional eligible lists and, WHEREAS, the Ithaca Civil Service Commission supports the proposed amendment, and no persons spoke against the proposed amendment, NOW, THEREFORE, BE IT RESOLVED, that Section 1(c) of Rule XIV = Probationary Term be amended to read as follows: Every permanent appointment from a promotion list shall be for a probationary period of twelve weeks. Commissioner Bantuvanis made a motion to accept the following Resolution. Seconded by Commissioner Cooper. Motion carried. Civil Service Commission Meeting May 14, 1990 Page 4 WHEREAS, the City of Ithaca Civil Service Commission duly advertised and held a Public Hearing on April 9, 1990, for the purpose of amending Rule XVI = Effect of Temporary_ or Provisional Appointment 2n Status of Appointee of the City of Ithaca Civil Service Rules to provide that no permanent appointee may be reclassified out of his/her position without first being afforded the opportunity to compete in an examination for permanent appointment to the reclassified title and, WHEREAS, the Ithaca Civil Service Commission supports the proposed amendment, and no persons spoke against the proposed amendment, NOW, THEREFORE, BE IT RESOLVED, that Rule XVI = Effect of Temporary or Provisional Appointment on Status of appointee be amended by adding a new Section 4 to read as follows: Reclassification of permanently encumbered competitive class position. An open-competitive, promotion or preferred eligible list shall not be certified for filling a permanent competitive class vacancy created by reclassification of a permanently encumbered competitive class position if appointment or promotion from such list would require the lay off of a permanent competitive class employee; but this provision shall not apply if the incumbent whose position was reclassified, following such reclassification, either refused to take an examination for such reclassified position or failed to qualify for appointment, examination or promotion to the reclassified position. Commissioner Bantuvanis made a motion to accept the following Resolution. Seconded by Commissioner Cooper. Motion carried. WHEREAS, the City of Ithaca Civil Service Commission duly advertised and held a Public Hearing on April 9, 1990, for the purpose of amending Rule XVI Effect of Temporary or Provisional Appointment on Status of Appointee of the City of Ithaca Civil Service Rules to allow for contingent permanent appointments and establish rules and conditions governing said appointments and, WHEREAS, the Ithaca Civil Service Commission supports the proposed amendment, and no persons spoke against the proposed amendment, NOW, THEREFORE, BE IT RESOLVED, that Rule XVI - Effective of Temporary or Provisional Appointment 2n Status of Appointee be amended by adding a new Section 5 to read as follows: Contingent permanent appointments. a. A position left temporarily vacant by the leave of absence or promotion of the permanent incumbent may be filled, at the Civil Service Commission Meeting May 14, 1990 Page 5 discretion of the appointing authority, by a contingent permanent appointment through the use of an open-competitive or promotional Civil Service eligible list. Any person appointed on a contingent permanent basis shall have all the rights and benefits of a permanent competitive class employee subject to the following limitations: 1. Probationary Period: All appointments under the Rule shall be required to complete the probationary period for original appointment or promotion as prescribed in these Rules. 2. Preferred List: In the event the permanent incumbent returns from leave of absence the contingent permanent appointee shall have his/her name placed on a preferred list for the title. 3. Layoff: In the event of a layoff, contingent permanent appointees shall be treated in the manner prescribed in these Rules. Provided, however, that when a contingent permanent appointment matures into a permanent appointment the date of the permanent service shall begin on the date of the original contingent permanent appointment. 4. Promotion: , a permanent competitive class employee accepts a., ontingent permanent appointment, the position vacated by that employee shall be filled only on a temporary or contingent permanent basis until such time as the contingent permanent appointment matures into a permanent appointment. B. All appointments under this Rule shall be "permanent-contingent permanent" . A copy of this Rule must be included with the canvass letter. C. Appointments to contingent permanent positions shall be made by selection of one of the top three candidates on an appropriate eligible list willing to accept a contingent permanent appointment. There will be no recanvassing of the eligible list in the event the contingent permanent position becomes unencumbered. Acceptance of a contingent permanent appointment will remove the eligible's name from the eligible list for any future contingent permanent or permanent vacancies. D. If a permanent vacancy becomes available in the same title in the department or agency in which a contingent permanent appointment has been made, contingent permanent appointees may be offered reassignment prior to canvassing for a permanent appointment from an appropriate eligible list or prior to appointing a temporary or provisional to the position. When a position filled by a contingent permanent appointee becomes unencumbered, the contingent permanent appointee in that position shall gain permanent competitive class status in the class if they have completed the required probationary period as prescribed in this Rule. WHEREAS, the City of Ithaca Civil Service Commission duly advertised and held a Public Hearing on April 9, 1990, for the purpose of amending Rule XXIV Grading of Positions of the City of Ithaca Civil Service Rules by deleting the Rule and, WHEREAS, the Ithaca Civil Service Commission supports the proposed amendment, and no persons spoke against the proposed amendment, NOW THEREFORE, BE IT RESOLVED, that Rule XXIV = Grading of Positions be deleted. Commissioner Perko made a motion to accept the following Resolution. Seconded by Commissioner Bantuvanis. Motion carried. WHEREAS, the City of Ithaca Civil Service Commission duly advertised and held a Public Hearing on April 9, 1990, for the purpose of amending Rule XXIV - Trainee Appointments of the City of Ithaca Civil Service Rules to establish the rules and conditions governing Trainee Appointments and, WHEREAS, the Ithaca Civil Service Commission supports the proposed amendment, and no persons spoke against the proposed amendment, NOW, THEREFORE, BE IT RESOLVED, that a new Rule XXIV = Trainee Appointments be adopted and read as follows: The Civil Service Commission may require that permanent appointment or promotions to designated positions shall be conditioned upon the satisfactory completion of a term of service as a trainee in such a position or in an appropriate, lower training title or the completion of specified training or academic courses, or both. The period of such term of training service shall be prescribed by the Civil Service Commission. Upon the satisfactory completion of such training term, and of specified courses if required, an appointee shall be entitled to full permanent status in the position for which appointment was made. Any appointment hereunder shall be subject to such probationary period as is prescribed in these rules. Also, the employment of such person may be discontinued if his/her conduct, capacity or fitness is not satisfactory, or at any time if he/she fails to pursue or continue satisfactorily such training or academic courses as may be required. WHEREAS, the City of Ithaca Civil Service Commission duly advertised and held a Public Hearing on April 9, 1990, for the purpose of amending Appendix A = Exempt Class of the City of Ithaca Civil Service Rules by adding the positions of "Confidential Secretary to the City Attorney" and "Confidential Secretary to the Police Chief" and, WHEREAS, the Ithaca Civil Service Commission supports the proposed amendment, and no persons spoke against the proposed amendment, NOW, THEREFORE, BE IT RESOLVED, that the following positions be added to Appendix A = Exempt Class: Confidential Secretary to the City Attorney Confidential Secretary to the Police Chief Commissioner Cooper made a motion to accept the following Resolution. Seconded by Commissioner Perko. Motion carried. WHEREAS, the City of Ithaca Civil Service Commission duly advertised and held a Public Hearing on April 9, 1990, for the purpose of amending Appendix B - Non-Competitive Class of the City of Ithaca Civil Service Rules by adding the positions of "Parking Lot Attendants" and "Police Dispatchers (P/T)" and, WHEREAS, the Ithaca Civil Service Commission supports the proposed amendment, and no persons spoke against the proposed amendment, NOW, THEREFORE, BE IT RESOLVED, that the following positions be added to Appendix B = Non- Competitive Class: Parking Lot Attendants Police Dispatcher (P/T) Commissioner Bantuvanis made a motion to accept the following Resolution. Seconded by Commissioner Cooper. Motion carried. WHEREAS, the City of Ithaca Civil Service Commission duly advertised and held a Public Hearing on April 9, 1990, for the purpose of amending Appendix B = Non-Competitive Class of the City of Ithaca Civil Service Rules to designate the position of Personnel Administrator as requiring the performance of functions influencing policy and, WHEREAS, the Ithaca Civil Service Commission supports the proposed amendment, and no persons spoke against the proposed amendment, NOW, THEREFORE, BE IT RESOLVED, that pursuant to Section 42(2) (a) of the New York State Civil Service Law, the position of Personnel Administrator be designated as a position which requires the performance of functions influencing policy. Civil Service Commission Meeting May 14, 1990 Page 8 NEW POSITION DUTIES STATEMENT: DEPARTMENT OF PUBLIC WORKS - CITY FORESTER Personnel Administrator Walker explained to the Commission that the Shade Tree Ordinance which was passed last year authorized a position of City Forester. The position was originally filled on a contractual basis, but has developed into a full-time position. Consequently, it should be a classified Civil Service position. Commissioner Cooper wanted to note for the record that the City does have a commitment to Affirmative Action, and recommended that the Affirmative Action procedure be followed when recruiting for the City Forester. Commissioner Perko made a motion to classify the City Forester position. Seconded by Commissioner Bantuvanis. Motion carried. DISCUSSION OF PROPOSED CIVIL SERVICE LEGISLATION - AMENDMENT TO RULE OF 3 Personnel Administrator Walker explained to the Commission that the Affirmative Action Committee has been discussing a Proposed Legislative bill which would increase the Rule of 3 to a Rule of 10. The Affirmative Action Committee would like to see the Rule of 3 expanded. Instead of having to make an appointment from the top three scores, they would like to see it changed to the top ten scores. Commissioner Cooper felt that the Rule of 3 should be changed to Rule of 10 because it would give provisional employees who do not score in the top three a better chance. Commissioner Perko felt that the Rule of 3 should stay the same since it has worked well in the past. RECLASSIFICATION REQUEST - ITHACA CITY SCHOOL DISTRICT Personnel Associate Patz explained to the Commission that Maureen Stoneman of the Ithaca City School District had requested a reclassification in her position. Personnel Associate Patz stated that she conducted a job audit and felt that although Maureen's position is diversified, her job duties still fall within the job specification of Senior Stenographer; therefore, she would recommend that her position remain classified as Senior Stenographer. The Commission reviewed Ms. Stoneman's reclassification request and felt that she was performing job responsibilities which probably really belonged to the Principal. The Commission also felt that a letter should be sent to Ms. Stoneman and the School District stating that her reclassification request was going to be denied, and that the duties belonging to the Principal should be performed by the Principal. Commissioner Cooper made a motion to deny the reclassification request. Seconded by Commissioner Perko. Motion carried. RECLASSIFICATION REQUEST - PERSONNEL DEPARTMENT: SENIOR STENOGRAPHER - ADMINISTRATIVE SECRETARY i Civil Service Commission Meeting May 14, 1990 Page 9 The Commission reviewed the reclassification request from Personnel Administrator Walker to reclassify the current Senior Stenographer position in the Personnel Department to Administrative Secretary. Commissioner Cooper made a motion to reclassify the Senior Stenographer position to Administrative Secretary. Seconded by Commissioner Perko. Motion carried. Commissioner Bantuvanis made a motion to go into Executive Session. Motion carried.
