CITY OF ITHACA CIVIL SERVICE COMMISSION
November 10, 1987
Present: Commissioner Bantuvanis, Commissioner Cooper, Executive Secretary Pezdek,
J. Dougherty, Superintendent of Public Works, David Livingstone,
President of CSEA Labor Unit, W. Baker, Vice President CSEA Administrative
Unit, W. Baker, Personnel Administrator, Arthur Santora, Senior
Engineering Aide, Jodi Lee, Trainee.
The public hearing on amending Rule XVIII was not held since the Commission
could not meet on the regularly scheduled day. It will be held December 14, 1987.
NEW BUSINESS
APPROVAL OF MINUTES
Commissioner Bantuvanis moved that the Minutes of Public Hearing and regular meeting
for October be approved. Seconded by Commissioner Cooper. Motion carried.
MR. WILLIAM R. BAKER VICE PRESIDENT C.S.E.A. ADMINISTRATIVE UNIT - ENGINEERING
TECHNICIANS
Commissioner Bantuvanis asked Mr. Baker to address the Commission.
Mr. Baker said that he was here to find out why there was confusion regarding
the Senior Engineering Aides and the Engineering Technician positions. He stated
that he had followed the re-classification survey of the Department of Public
Works from the beginning and that he wanted to know why Mr. Santora received
a letter notifying him that his position would be changed from Senior Engineering .
Aide to Engineering Technician, and then it didn't happen.
He said he had a copy of hte letter from Mr. Ciprioni of the Municipal Service
Division stating that the Senior Engineering Aides could become Engineering
Technicians without examination and that all five of the Senior Engineering
Aides received a final notification that their positions would remain as Senior
Engineering Aides.

•,- Mr. Baker stated further that the problem began July first when the City hired a
non-city employee to become an Engineering Technician.
' j He also stated that the City, meaning the Commission, did not follow the recommendat-
ion from Albany and now a test must be given to the two Senior Engineering Aides
who have been promoted to Engineering Technician.
Commissioner Bantuvanis asked: "A test is now required for Mr. Santora?"
Mr. Baker replied: " A test is now required for all Senior Engineering Aides
who have been promoted. "
Mr. Baker went on to say that the whole problem could be eliminated if the original
recommendation were followed. The problem is that there are still three classed
as Senior Enginrreing Aides and that all of them have been with the City for
many years. As a result of what has happened the union has filed grievances.
Commissioner Cooper asked: "When were the grievances filed?"
Mr. Baker replied: "The first was filed on August 21, 1987 when the whole deal
with Bouchard came about, and the second grievance was filed on October 21, 1987.
He also said that he had some other things that he would like to add which is
that he called Mr. Ciprioni and talked with him about the whole business and that
Mr. Ciprioni said that he should a freedom of information request, and further
; '.___ that he was being stonewalled by the City Attorney on the request.
ICommissioner Bantuvanis asked Mr. Pezdek what has happened:
Mr. Pezdek told the Commission the history of the freedom of information
request including what has happened today namely that City Attorney Nash
had called and asked if .I had released any documents to Mr. Baker. I told
Mr. Nash. that I had not because there was no time to do so yesterday. Mr.
Nash said that I was not to release any documents and that he would be down
from his office to see me.
Mr. Nash came to the office shortly after 3:00P.M. and I explained to him that
I had not released any documents.. Mr. Nash called Mr. Ciprioni who advised him
to contact the Freedom of Information Office in Albany for advise.
Mr. Nash then called the office and after the phone called stated that he would
have to review each document from the re-class survey and then took the documents
back to his office, and that this was the second time. Mr. Nash wrote two memos.
Mr. Baker then said: " That's all I have to say. I wanted to bring the matter to
your attention. "
Commissioner Cooper asked Mr. Baker: "Were you notified about the meeting where
the Senior Engineering Aides were left as aides?"
Mr. Baker replies: "No. I wasn't. "
Commissioner Cooper then asked: "If all five were promoted then there would be no
examination?"
Mr. Pezdek replied: "Yes. That's correct."

Mr. Baker then stated: "If you would look at your October 13th minutes beginning
on page 211 paragraph four beginning with Mr. Doyle."
Everyone referred to the Commission minutes and read them.
Commissioner Bantuvanis then asked: "Do you have other comments you wish to
add."
Mr. Baker replied: "I think the big this is that Common Council only approved
two positions in July. At the time Bouchard was promoted only two positions
existed and not three in the 1987 perfonnel roster for the department. "
Mr. Pezdek then asked Personnel Administrator Baker is Council had approved the
third position for Engineering Technician-at their meeting on the fourth.
Superintendent of Public Works Dougherty replied: "Yes. "
Mr. Baker the Vice President of the C.S.E.A. Adminsitrative Unit stated
that he would like to add that the letter from Ciprioni read that all five
Senior Engineering Aides were working out of title. "
Commissioner Cooper asked Mr. Pezdek how people were notified of the Commission's
meetings.
Mr. Pezdek replied that mostly department heads were notified as well as the Mayor,
and the City Clerk's Office.
Commissioner Cooper then asked: "Is the union notified?"
Mr. Pezdek said that the union was not notified and suggested that the union
be placed on the mailing list.
Commissioner Cooper then asked Mr. Baker if he would like to receive agendas.
Mr. Baker replied that he would.
Commissioner Cooper with the agreement of Commissioner Bantuvanis so directed.
Commissioner Bantuvanis asked Commissioner Cooper what should be done. The
Commission discussed the matter and decided to take the matter under advisement
for further consideration.
RPSTERS OF CANDIDATES
Commissioner Cooper moved that the Roster of Candidates for the Principal Account
Clerk examination No. 60-673 be approved. Seconded by Commissioner Bantuvanis.
The Commission reviewed the candidates on the Roster then voted. Motion carried.
ESTABLISHMENT OF ELIGIBLE LISTS
Commissioner Cooper moved that the eligible list for Typist No. 1987-10
be established effective November 10, 1987 and that it be in existence for
four years unless exhausted sooner. Seconded by Commissioner Bantuvanis.
The Commission reviewed the list then voted. Motion carried.

Commissioner Cooper moved that the eligible list for Building Inspector III No.68-935
= be :established'effective November-10:,1987 and that it be in effect for four

The Commission reviewed the eligible list then voted. Motion carried.
Commissioner Cooper moved that the eligible list for Stenographer No. 1987-11 be
established effective November 10, 1987 and that it be in effect for four years.
Seconded by Commissioner Bantuvanis.
The Commission reviewed the list then voted. Motion carried.
Commissioner Cooper moved that the eligible list for Youth Worker No. 66-756 be
established effective November 10, 1987 and that it be in effect for four years.

The Commission reviewed the list then voted. Motion carried.
Commissioner Bantuvanis moved that the eligible list for Account Clerk, No. 1987-9
be established effective November 10, 1987 and that the list be in existence
for four years unless exhausted sooner. Seconded by Commissioner Cooper.
The Commission reviewed the list then voted. Motion carried.
Commissioner Cooper moved that the eligible list for Account Clerk-Typist, No.
19.87-8 be established effective November 10, 1987 and that it be in existence for
four years unless exhausted sooner. Seconded by Commissioner Bantuvanis.
The Commission reviewed the list then voted. Motion carried.
Commissioner Bantuvanis moved that the eligible list for Offset Printing Machine
Operator No. 60-366 be established effective November 10, 1987 and that it be
in effect for four years unless exhausted sooner. Seconded by Commissioner Cooper.
The Commission reviewed the list then voted. Motion carried.
Commissioner Cooper moved that the eligible list for Modernization Program
Coordinator No. 67-121 be established effective November 10, 1987 and that
it be in effect for four years unless exhausted sooner. Seconded by Commissioner
Bantuvanis.
The Commission reviewed the list then voted. Motion carried.
NEW POSITION DUTIES STATEMENT - SENIOR TYPIST - HIGH SCHOOL VICE PRINCIPAL'S OFFICE
Commissioner Bantuvanis presented to the Commission a New Position Duties Statement
for the position of Senior Typist in the Ithaca High School Vice Principal 's Office
and moved that it be approved. Seconded by Commissioner Cooper
The Commission reviewed the Statement and the accompanying documents. It
also discussed the request following which it voted. Motion carried.
STOREKEEPER POSITION SPECIFICATION - AMENDMENT
Commissioner Cooper presented to the Commission a request to change/delete the
words Parts Manager and insert Parts and Supply Manager in the special note
section of the Storekeeper position specification. This change was overlooked
in the recent re-classification survey when the Parts Manager title was changed
to Parts and Supply Manager. Seconded by Commissioner Bantuvanis.

The Commission voted. Motion carried.
PROBATIONARY TERM FOR PARKING LOT ATTENDANTS AND SENIOR LABORERS
Commissioner Cooper aksed Superintendent of Public Works Dougherty
to address the Commission on the above matter.
Superintendnet Dougherty stated that what he had to say was basically
covered in his memorandum to the Commission on this subject.
He stated that these people were long term employees and that he did not
wish to subject them to a probationary period again because they served
one when they were first employed. He also said that he felt it was unfair
or re-subject them to another probationary period. He asked if the
probationary period could be waived.
Commissioner Cooper asked Mr. Pezdek if the probationary period could be
waived.
Mr. Pezdek replied that he had never heard of a probationary period being
waived.
Commissioner Bantuvanis asked Commissioner Cooper: " How do you feel about
waiving?: She replied I agree.
Commissioner Cooper asked Mr. Pezdek to check with Albany on the possibility
of waiving the probationary period.
ABOLITION OF POSITION SPECIFICATIONS NO LONGER USED
Commissioner Bantuvanis presented to the Commission a list of Position
Specifications no longer used and moved that they be abolished from
the Commissions list of position specifications. The specifications
to be abolished are as follows: 052 Assistant Controller, 122 Building
Inspector II, 380 Drafter; 536 Educational Instructor-Computers, 446 Fire
Equipment Mechanic, 410 General Maintenance Supervisor; 425 Grounds Foreman;
400 Maintenance Apprentice; 406 Maintenance Supervisor; 538 Nutrition Program
Supervisor; 546 Outreach Worker; 430 Buildings, Parks and Grounds Supervisor;
099 Research Assistant (Pupil Personnel Services), 342 Sewer Maintenance
Supervisor, 098 Special Porjects Coordinator, 314 Streets and Sanitation Fore-
man; 424 Tree Trimmer Foreman, 336 Water and Sewer Supervisor and 351 Chief
Sewage. Treatment Plant Operator Type B Plant. Seconded by Commissioner
Cooper
The Commission discussed the listing and noted that appointing authorities
were appraised of this action and had a month to react to it. Only Mr.
Cohen of the Youth Bureau replied wishing to retain three specifications
which were Educational Instructor No. 534, Recreation Therapist No. 510
and Volunteer Coordinator No. 520.
The Commission then voted. Motion carried.

JOINT CITY/COUNTY AFFIRMATIVE ACTION COMMITTEE MEETING
The Commission discussed the upcoming joint City/County affirmative action
-:: meeting due to take place on Thursday November 12, 1987.
The County has expressed an interest in some type of joint application form
for candidates.
The Commission discussed the county proposal and decided that more information
was needed. Commissioner Cooper said she would be attending the meeting
and would report back to the Commission.
Commissioner Cooper moved to table this matter until next month when more
information would be available. Seconded by Commissioner Bantuvanis.
The Commission voted. Motion carried.
OLD BUSINESS
LIFTING FROM TABLE OF NEW POSITION DUTIES STATEMENT FOR ENGINEERING TECHNICIAN
Commissioner Bantuvanis moved to lift from the table the New Position Duties
Statement for Engineering Technician. Seconded by Commissioner Cooper.
The Commission discussed this matter. Following the discussion, the Commission
agreeded to a Special Meeting to be held on Tuesday November 17th to consider
this matter as well as the classifying of the remaining three Senior Engineering
Aide positions to Engineering Technician.
Superintendent Dougherty stated that he would be present for the meeting together
with, the Staff and the Union represented by Mr. William Baker said that he and
his staff and members would also be present.
Commissioner Cooper then moved to table the New Position Duties Statement
for Engineering Technician. Seconded by Commissioner Bantuvanis.
The Commission voted. Motion carried.
LIFTING FROM TABLE OF VARIOUS ITEMS
Commissioner Bantuvanis moved to lift from the table the following matters:
First the Minimum Qualifications for Deputy Police Chief; Second, the
Reinstatement of Mr. Brina Wilbur as Deputy Fire Chief and third, the Personnel
Associate position specification, and to retable these matters. Seconded
by Commissioner Cooper. The Commission voted. Motion carried.
ANNOUNCEMENTS
1. Copies of a judicial decision on zone scoring McGowan v. Burnstein were
distributed to the Commissioners. This decision involves zone scoring and
and declared this practice to be unconstitutional . Mr. Pezdek reminded the
the Commission that it presently had a list for Police Officer which was zone
scored but that the decision would not effect the list since it was established
prior to the decision.
2. Copies of the NYPE Reporter were distributed to the Commissioners.

3. The following examinations have been announced: Administrative Secretary No.
68-394, Senior Engineering Aide, No. 61-150, Engineering Technician, No.
61-083 and Assistant Activities Center Coordinator, No. 77-243.

November 9, 1987 the regular meeting date because the Commission was unable to
meet on that date and the the Authorization on the Roster Cards be listed as
