HomeMy WebLinkAboutMN-CIV-1987-09-24 189 REGULAR MEETING CITY OF ITHACA CIVIL SERVICE COMMISSION September 24, 1987 Present: Commissioner Bantuvanis, Commissioner Cooper, Executive Secretary Pezdek William Baker, Personnel Administrator, John Dougherty, Superintendent of Public Works, Debra Parsons, City Chamberlain, Jodi Lee, Trainee The meeting was called to order at 3:53P.M. by Commissioner Cooper APPROVAL OF MINUTES Executive Secretary Pezdek stated that there was a correction to the Minutes of the July meeting. Mr. Ronald Denmark, Chief Sewage Treatment Plant Operator was incorrectly listed under Seasonal Appointments. This should be listed under Temporary Appointments. Commissioner Cooper moved that the Minutes of the July meeting be approved with the above correction and that the Minutes of the special meeting on September 15th be approved. Seconded by Commissioner Bantuvanis. Motion carried unanimously. SENIOR CLERK - NEW POSITION DUTIES STATEMENT - CHAMBERLAIN'S OFFICE The Commission requested City Chamberlain Parsons to address the Commission on the above topic. Ms. Parsons gave background of the request saying that she was planning to have all payments for any bills done only at two windows, and that two people would be required to man these windows. At the present time the Account Clerk- Typist only handles water and sewer bills with limited involvement in other types of bill payment and record keeping. At the present time the Account Clerk-Typist is learning other duties and that in the future she will be spending one half a day doing the work that a senior clerk is now doing. There was more discussion and more background information provided by Ms. Parsons. Following this Commissioner Cooper moved that the New Position Duties Statement for Senior Clerk be approved and that it be placed in the competitive class. Seconded by Commissioner Bantuvanis. Motion carried unanimously. NEW COPY MACHINE REQUEST Executive Secretary Pezdek asked the Commission to support Superintendent Dougherty's budget request for a new copy machine for the second floor. He explained that Personnel, Civil Service, the Engineering Division and the Superintendent's Office all use the present machine but that it was producing bad copies and had frequent breakdowns. Commissioner Bantuvanis asked Superintendent Dougherty if the Commission should mention a dollar amount. Mr. Dougherty said that that would not be necessary but a resolution of support would be. Commissioner Bantuvanis moved that: The Civil Service Commission wholeheartily supports the Superintendent of Public Works request for a new copy machine for the use of the departments on the second floor of city hall . Seconded by Commissioner Cooper. Motion carried uninamously. O Commissioner Cooper requested that the items on the agenda be moved around in order not to have individuals waiting overly long. Commissioner Bantuvanis agreeded. - DISQUALIFICATION OF CANDIDATE ON THE CHIEF SEWAGE TREATMENT PLANT OPERATOR ELIGIBLE LIST No. 66-572. Superintendent Dougherty requested that Mr. Ronald Denmark be removed from the eligible list for Chief Sewage Treatment Plant Operator - which is really the Chiew Wastewater Treatment Plant Operator Type I A Plant - since the DPW Re-Classification survey completion. He stated that Mr. Denmark did not have the required license to operate a I A plant. Mr. Pezdek agreeded stating that in order Mr. Denmark to get such a license he would have to work for a year in a one a plant and that that was the only way to get this type of license. Also that our present sewage plant is a II B plant. Mr. Dougherty stated that Mr. Denmark does not have the required experience. Commissioner Bantuvanis moved that Mr. Ronald Denmark be removed from the eligible list for Chief Sewage Treatment Plant Operator No. 66-572 due to the fact that he did not meet minimum qualifications. Seconded by Commissioner Cooper. Motion carried unanimously. ASSISTANT SUPERINTENDENT OF PUBLIC WORKS ELIGIBLE LIST No.67-249 - PASSING OVER A CANDIDATE Commissioner Cooper asked Superintendent Doughterty to address the Commission on why he wished it to consider passing over the number one candidate on the eligible list for Assistant Superintendent of Public Works No. 67-249. Superintendent Dougherty stated that he had received the Certification of Eligibles from the Executive Secretary for Assistant Superintendent of Public Works. In addition, he also received a copy of the letter the candidate Mr. Dunn had written in which he says that if he were offered the position by mid October that he would not be available until January of 1988 due to a teaching commitmentat the State University of New York at Plattsburgh. The letter from Mr. Dunn goes on to state that if offered the position after mid October that he would not be able to come to work until mid May of 1988. The Commission reviewed the letter from Mr. Dunn and Superintendent Dougherty's Memorandum on his request. The Superintendent said that he wished to fill the position now and that any delay would be disastrous for the operation of his department. The Commission then asked Mr. Dougherty some questions and discussed the request. Commissioner Cooper then moved that Mr. Terry A Dunn be removed from the eligible list for Assistant Superintendent of Public Works, No. 67-249 until such time as he indicates that he is available for appointment within a reasonable time period. Seconded by Commissioner Bantuvanis., Motion carried unanimously. CANVASS LETTERS FOR YOUTH DEVELOPMENT PROGRAM LEADER. ELIGIBLE LIST No. 67-077 1 Executive Secretary Pezdek has written a memorandum to the Commission on the late return of two canvass letters on the eligible list for Youth Development Program Leader No. 67-077. Basically one candidate out of three returned the canvass letter on time. One, No. 1, did not and it was received on July 22, 1987, two days late, the third.candidate No. 3, was on active duty with the Army reserve and did not come in with his canvass letter until after he returned home from the training. He explained that in the past that the Commission had accepted late canvass letters from individuals who where on active duty and who through no fault of their own could not return the canvass letters on time. Commissioner Cooper asked if Mr. Pezdek had any idea of when a eligible list would arrive back from Albany - actually the grades. He said that he never knew when the grades would arrive until he picked up the mail at the post office and opened the envelopes. Thus,there is no way of knowing ahead of time exactly when the grades for the eligible list will arrive. He asked that the Commission consider accepting both canvass letters. The Commission reviewed his memorandum on the subject and the copies of the canvass letters from candidates numbers 1 and three. f Commissioner Cooper pointed out that candidate one did not give any explanation of why he signed his canvass letter one day after it was due back. Candidate number three who was in the army at the time explained where he was and why he could not reply in a timely manner to the canvass letter. Commissioner Bantuvanis then moved that the canvass letter of Mr. Myers the third candidate on the eligible list for Youth Development Program Leader No. 67-077 be accepted. Seconded by Commissioner Cooper. Motion passed unanimously. PERSONNEL ASSOCIATE NEW POSITION DUTIES STATEMENT AND POSITION SPECIFICATION Commissioner Cooper began by stating that she had reservations on what has been going on and about not being notified by Common Council of what they did. She further that she was clear in what I presented to Common Council : "It is in the Rules and law how we operate. Our Field Representative says that Common Council action is illegal . I really feel torn. My understanding is if Common Council wants us to do this it is illegal . We appoint our own. " Commissioner Bantuvanis stated: "Something is wrong." Mr. Baker said that "You have to listen to Ted Doyle to Tom Pillsworth. One of the things here is basically it is a new position. We contract out labor relations at tremendous costs. It costs $20,000.00 per year. The position involves costing out labor relations contracts. I will do the negotiations and this position will train, counsel on discipline. Civil Service is alive and well here. . It will provide 1 me with support. " Commissioner Bantuvanis asked: " Will this position be Secretary to the Commission. " Mr. Baker replied: "You have to delegate it to someone." 192 Commissioner Bantuvanis: "This person would handle civil service matters. She then read from the position specification: 'Specific responsibilities include applying Civil Service Law for all positions under the jurisdiction r - , of the Civil Service Commission. '" Mr. Baker replied: "Is that under Distinguishing Features of the Class? I make sure Department Heads do things according to Civil Service. " Commissioner Bantuvanis: "Civil Service matters have to come through the Commission ." Mr. Baker: No one is saying Civil Service is by the wayside." Commissioner Cooper: "I have heard that as of January 1, 1988 Common Council is taking away the Executive Secretary and that the Personnel Associate is taking over the duties. I would not like to act on anything until the issue is cleared up. " Commissioner Bantuvanis asked: "Can Common Council delete the Executive Secretary?" Commissioner Cooper replied: "No, they can't. " She then stated that she wanted a meeting with the Field Representative to get this cleared up. Commissioner Bantuvanis asked: "Should we table this. You want to do it?" Commissioner Cooper: "I could go for a Personnel Associate. You could interview but not for civil service duties. " Mr. Baker: "Obviously I need help. " =' Commissioner Bantuvanis then said: "Let me ask you a question. 1i'our position as Personnel Administrator is not Civil Service is it? By that I mean, competitive. Mr. Baker replied: "It is in the non-competitive class; the Personnel Associate is in the competitive class." Mr. Baker continued: You have responsibility to classify the position. I need to move forward. " Commissioner Bantuvanis then asked: What would be the starting salary? Mr. Baker: "Twenty to twenty-two thousand a year. " Commissioner Bantuvanis then asked: "How can you recruit without it being established?" Mr. Baker replied:"Other departments recruited without it being classified. " Commissioner Cooper said: Twenty-five per cent of the personnel associates time is involved in civil service matters according to the New Position Duties Statement. Is the person to assume the Executive Secretary functions and duties for the Commission?" Mr. Baker: "I don't know what will happen after January first. I spend time telling other Civil Service Rules." Commissioner Cooper then read from the Typical Work Activities section of the L- position specification" Oversees the civil service examination process for all positions under the jurisdiction of the Civil Service Commission." • 193 She continued: "Shouldn 't this be to possibly assume these particular duties if there is not an Executive Secretary to the Commission?" Mr. Baker: "I need to have this classified." Commissioner Bantuvanis: "We could pass it and it would not be legal . " Commissioner Cooper: "We could pass everything dealing with labor but not Civil Service. " Mr. Baker: "Common Council is saying that the Commission will stay in tact. " Commissioner Bantuvanis: . "In all fairness, we don't have a right to pass on it. I haven't been notified, " Commissioner Cooper: "Take all civil service matters out." Commissioner Bantuvanis : "I would be willing to pass it with everything deleted dealing with civil service." Mr. Baker: "I would rather see it deleted and I need to move ahead. We can go back to the drawing board. I have to go to Common Council on Thursday to get authorization to hire. " Commissioner Cooper: "The civil service matters can't be in it. The specification must be specific. Delete anything to do with civil service. Must comply with civil service law. " Commissioner Bantuvanis asked the Executive Secretary to contact the Field Representative and the City Attorney to arrange a meeting. " Commissioner Cooper agreeded. Mr. Baker: "I can delete civil service and would you classify?" Commissioner Bantuvanis : "Can,you get this to us by tommrrow or by Monday?" Commissioner Cooper: "By Monday at the latest." Mr. Baker replied: "OK." Commissioner Cooper: "Lets meet on Monday at 3:45 P.M. You will be there?" Mr. Baker: "Yes." NEW POSITION DUTIES STATEMENT - CLERK - FULL TIME FOR PRE K PROGRAM Commissioner Bantuvanis presented a New Position Duties Statement to the Commission for a full time Clerk position for the Pre K Program at the School District and moved that it be approved and placed Nn the competitiver;class. Seconded by Commissioner Cooper. The Commission reviewed the statement and the accompanying letter and then voted. Motion carried unanimously. 194 NEW POSITION DUTIES STATEMENT - CLERK - HALF. TIME ALTERNATIVE COMMUNITY SCHOOL Commissioner Bantuvanis presented to the Commission a New Position Duties Statement for a half time clerk position at the Alternative Community t School for the School District and moved that it be approved.and placed in the competitive elas5eoondedr,by. Commissioner Cooper. The Commission reviewed the statement and decided to delete the educational requirement on it in order to be in conformity with its specification for Clerk as an entry level position with no minimum qualifications. It then reviewed the accompanying letter and voted. Motion carried unanimously. DEPUTY POLICE CHIEF MINIMUM QUALIFICATIONS Commissioner Cooper remarked that the qualifications for Deputy Police Chief should not be higher than those for Police Chief. Mr. Baker asked to address the Commission on this matter: He said that a major change was going to go on in the Police Department, and that the Mayor had asked him to share comments with the Commission. The Mayor he said wants the Commission to put this matter on hold. A new Chief will want to re-organize the department. and the position of Deputy might not be required under the re-organization. There was general discussion of the matter. Following the discussion Commissioner Bantuvanis moved to table the matter of changing the minimum qualifications of Deputy Police Chief until the October meeting. Seconded by Commissioner Cooper. The Commission voted. Motion carried unanimously. RE-TEST POLICY ON TYPING AND STENOGRAPHY PERFORMANCE TESTS Executive Secretary Pezdek stated a new manual had arrived from the State Commission entitled: Manual for Decentralized Written/Performance Examinations. . . and that page sixteen of the manual deals with establishing a re-testing policy for performance tests on stengoraphy and typing and that he believed that the Commission should adopt such a policy. The Commission reviewed the page from the manual and discussed the proposed change. Commissioner Bantuvanis then moved that the following statement appear on all examination announcements requiring performance tests in typing or stenography or both: Candidates are required to take a performance test in (Insert typing or stenography) at (Appropriate number of words per minute depending on the position) . Should a candidate not pass the performance test he or she will be given a second opportunity to take the performance test. Seconded by Commissioner Cooper. The Commission then voted. Motion carried unanimously. Pezdek, Executive Secretary SPECIAL MEETING CITY OF ITHACA CIVIL SERVICE COMMISSION September 28, 1987 Present: Commissioner Bantuvanis, Commissioner Cooper, Executive Secretary Pezdek. Commissioner Bantuvanis called the meeting to order at 3:45 P.M. PERSONNEL ASSOCIATE POSITION SPECIFICATION The Commission reviewed the new position specification for Personnel Associate. Following the reading Commissioner Bantuvanis moved to table thematter until the October 13, 1987 meeting. Commissioner Cooper remarked that: I understand something has to be done on this. I guess I am not clear, but we set up a special meeting and Mr. Baker,, is not here." The Commission discussed the matter some more. Commissioner Cooper stated that under the Typical Working Activities number four should be deleted since this is straight a function of the Civil Service Executive Secretary. 7 i9 and Water/Wastewater Treatment Plant Operator/Trainee, No. 1987-7. Department of Civil - Service Jodi Lee. The Public Hearing was called to order at 3:45 P.M. by Commissioner Bantuvanis. The Notice of Public Hearing was read by Commissioner Bantuvanis: "Please take note that pursuant to section 20 of the Civil Service Law of the State of New York that the City of Ithaca Civil Service Commission will hold a Public Hearing at 3:45 P.M. in the Second Floor Conference Room, City Hall , 108 East Green Street, Ithaca, New York on October 13, 1987 to amend its Rules by adding to Appendix B to Rule IV Non-Competitive Class the position of Park Ranger - Seasonal . All citizens either for or against the change are invited to attend and be heard. " RESOLUTION TO OPEN THE PUBLIC HEARING - Commissioner Cooper. Resolved that the Public Hearing be opened. PARK RANGER - SEASONAL - RULES CHANGE Commissioner Bantuvanis moved: " WHEREAS, The City of Ithaca Civil Service Commission has held.a Public Hearing on October 13, 1987, at 3:45 P.M. in the Second Floor Conference Room, City Hall , 108 E. Green Street, Ithaca, New York, concerning the amendment of its Rules for the Classified Civil Service of the City of Ithaca by adding Park Ranger-Seasonal to. Motion carried. CIVIL SERVICE`PERSONNEL CONSOLIDATION Commissioner Cooper: "This is where we have lots of questions for Mr. Doyle. I'm not sure if we want an executive session." Commissioner Bantuvanis: "It is fine with me if you want one. " Mr. Doyle: "I have major reservations about Common Council 's reogranization. The City has three things to do. The options are: first, to leave the Commission as it it now an independent body. Second, the City need not maintain civil service commission at all . The law permits a personnel officer operation which has all the duties and obligations of a Civil Service Commission.
