Dawn Stevens, Applicant; Town Councilman Rick Gamel. REGULAR MEETING The Regular Meeting of the Town of Groton Planning Board was called to order at 7:30 p.m. by Chairperson Barbara Clark. OLD BUSINESS None. APPROVAL OF MINUTES — 20 MARCH 2008 A motion was made by Member Janice Haines to approve the Minutes of the 20 March 2008 meeting of the Town of Groton Planning Board, as submitted. The motion was seconded by Member Monica Carey, with the vote recorded as follows: Ayes: Chair Clark Nays: None Member Baxendell Member Carey Member Haines Absent: Member Donlick Member Neuhauser Motion carried. This becomes Action #16 of 2008. NEW BUSINESS Lionel Couture, Applicant/Owner - 441 & 449 LaFayette Road - TM #28.-1-21 & 22.1 - Boundary Line Change Chairperson Barbara Clark recognized Denise & Ray Brown who explained that they would like to change the boundary line between these two parcels as indicated on the map accompanying the application. They would retain the southern parcel and transfer the northern parcel to their daughter. Board members discussed access, and found it was adequate; survey distances had been reviewed with the surveyor by CEO Gary Coats. Chair Clark acknowledged that "under 6 NYCRR Part 617.5(c)(10), (12) or (13) of the State Environmental Quality Review Law, the proposed action is a Type II action and is determined not to Page 1 of 3 (T)Groton Planning Board Minutes of Regular Meeting 17 April 2008 have a significant impact on the environment, or is otherwise precluded from environmental review under the Environmental Conservation Law, Article 8." A motion was made by Member Mary Gloster to approve the Boundary Line Change, as requested. The motion was seconded by Member Janice Haines, with the vote recorded as follows: Ayes: Chair Clark Nays: None Member Baxendell Member Carey Member Haines Absent: Member Donlick Member Neuhauser Motion carried. This becomes Action #17 of 2008. Albanese Law Office, Applicant/Doris Pierson, Reputed Owner - Devlen Road - Tax Msp #15.-1- 5.2 - Rural Subdivision Chairperson Clark recognized Gwen Seaquist of the Albanese Law Firm, representing the owner who was seeking to subdivide 67.76± acres into four 16.94± A. lots as shown on the tax map accompanying the application. Ms. Seaquist explained that this parcel had been subdivided in 1997 by survey. Although the subdivision was never approved by the Town, the survey map was filed and tax map numbers assigned. This application was being made merely to secure Town approval. As requested by Chair Clark, the Board Secretary read aloud Part II of the Short Environmental Assessment Form. Negative responses were given to all questions. A motion was made by Member Carey for a Negative Declaration under SEQRA. The motion was seconded by Member Mark Baxendell, with the vote recorded as follows: Ayes: Member Neuhauser Nays: None Member Baxendell Member Carey Member Haines Absent: Member Donlick Abstain:Chair Clark Motion carried. This becomes Action #18 of 2008. A motion was then made by Member Carey to approve the subdivision, as requested. The motion was seconded by Member Baxendell, with the vote recorded as follows: Ayes: Member Neuhauser Nays: None Member Baxendell Member Carey Member Haines Absent: Member Donlick Abstain:Chair Clark Motion carried. Dawn Stevens, Applicant/Reputed Owner - Cobb Street & Sovocool Hill Road - TM #24.-1- 13.2 - Rural Subdivision Chairperson Clark recognized Tim Warner who explained that the applicant was seeking approval to subdivide her 25-acre parcel into five 5-acre lots, as shown on the aerial photo accompanying the application. Member Gloster noted that, according to a copy of the tax map, also accompanying the application, the parcel contained a total of 22.03 acres; therefore, it would not be possible to subdivide this into five 5-acre lots. If divided into four acres, this would be a minor subdivision. Member Baxendell advised Mr. Warner that the applicant needed to reapply for a Minor Subdivision and the fee will be recalculated. Member Gloster advised having a survey completed first before next month's meeting. Minimum lot size for a minor subdivision would be 3 acres. With no further discussion, a motion was made by Member Ed Neuhauser to postpone any action on the proposed Rural Subdivision until the 15 May 2008 meeting of the Town of Groton Planning Board. The motion was seconded by Member Haines, with the vote recorded as follows: Ayes: Chair Clark Nays: None Member Baxendell Member Carey Member Haines Absent: Member Donlick Member Neuhauser Motion carried. This becomes Action #20 of 2008. Deena Haines, Applicant/Reputed Owner - LaFayette Road - TM #29.-1-14.4 & 14.3 - Boundary Line Change Chairperson Clark asked if there was anyone present to represent the applicant regarding this matter. There was no one. With no further discussion, a motion was made by Member Gloster to postpone any action on the proposed Boundary Line Change until the 15 May 2008 meeting of the Town of Groton Planning Board. The motion was seconded by Member Neuhauser, with the vote recorded as follows: Ayes: Chair Clark Nays: None Member Baxendell Member Carey Member Haines Absent: Member Donlick Member Neuhauser Motion carried. This becomes Action #21 of 2008. ADJOURNMENT At 8:10 p.m., a motion was made by Member Haines to adjourn the meeting. The motion was seconded by Member Baxendell, with all members present voting in favor. Joan E.
