HomeMy WebLinkAbout1971-11-03 0 TOWN OF DAN BY TOWN BOARD MINUTES NOVEMBER 3 , 1971 A Public Hearing of the Town of Danby Town Board was held in the Danby Elementary School , November 3 , 1971 , at 8 : 00 P:.: M . No one was present to protest or question the budget . A Special Meeting was called . Supervisor Donald Ma.kie asked that the Board waive the three day notification of the meeting . A motion was made by Councilman Ralph Wilbur and seconded by Justice A . Francis Wright to waive the three day notification period . The motion was carried by a vote of four ayes and no noes . Frank Chase Proposal - Mr . Frank Chase presented preliminary plans for a Planned Development District on Bald Hill Road . The plans consist of nine one acre lots on the W . Locke property by Danby Pond . Mr . Chase was advised to take the matter to Planning Board Chairman Richard Olsen - and the Planning Board for further action . DHS & RGB Holding Company - Attorney George Pfann spoke regarding there plans . A report of plans has been filed . It is a written report and has been discussed with Dick Thaler . Pfann has certi - fied that he has examined the property and the Holding Company are the owners with the exception of three properties . A certified copy of the Certification of Incorporation of the Holding Company has been filed with the Department of State and the County Clerk . Permits must be obtained from the State , Board of Health , etc . , prior to re - zoning action by the Town Board . H . R . Schlieder , City of Ithaca Engineering Department was present and explained how they had arrived at the figures for proper water supply : The basis was fifty - one homes , occupied by four persons each , using 100 gallons per day per person . There was a discussion about a water tank in future extension . Mr . Schlieder thinks 90 pound pressure on the tank will be sufficient . The tank will be elevated above the road and the proposed homes . State Audit Control approval is not necessary if it is not going to cost the Town any money . Specifications of Article 12A of the Town Law have to be met . Thaler suggested that the Town have an Engineer check Mr . Schleider ' s work on behalf of the Town . The State Water Resources Comission has the right to demand a Public Hearing on this . Thaler sug - gested Mr . Pfann get some recognition from them that they are aware of this extension and do not anticipate a public hearing . Mr . Roy Casterline said that State Law says all extensions must be approved by the State Water Resources Commission . The FHA is delighted as it makes the district more able to pay through sharing the capital costs with the Holding Company . Original capitalization was 3263 , 000 , spread over assessed ✓ aluation . The Holding Company must pay their capital share o f this valuation , after which they will pay their ad - valorem tax . The amount will depend on the assessed valuation right now . N o trouble is forseen with Mr . Lehto and Mr . Nelson . Mr . Richard Thaler read the proposed resolution . A Public Hearing is to be held in the West Danby Fire Hall at 7 : 30 P . M . on N ovember 22 , 1971 . Danby Town Board Minutes - November 3 , 1971 - Page 2 Justice A . Francis Wright made a motion adopt the proposed Resolution # 15 . The motion was seconded by Councilman Gerald Res . #15 Crance and duly put to a roll call vote . The motion was carr& dd by a vote of five ayes and no noes . Supervisor Donald Makie reviewed the Preliminary Budget . There was some discussion regarding the Water District Tax and Ad- Valorem Tax . A motion to adjourn the Meeding was made by Councilman Gerald Crance , seconded by Justice A . Francis Wright and duly carried by a vote of five ayes and no noes .
