Davis Donna Scott GENERAL BUSINESS Chairman Gregg Travis called The Town of Lansing Zoning Board of Appeals Meeting to order at 7:08 PM and reviewed the Agenda with the Public. Chairman Travis acknowledged the Legal Notice was duly published in The Ithaca Journal as required. Daniel Konowalow moved to open the Public Hearing at 7:08 PM. Linda Hirvonen seconded the motion and it was carried by the following roll call vote: *Daniel Konowalow will abstain from voting on the final decision as he resides within 600 ft of the property in question. (Aye) Gregg Travis, Chair Public Hearing – Area Variance, Applicant: Stephen Davis, 693 Lansing Station Road, Tax Parcel #13.-2-11 Zoning Board Members reviewed packets previously provided to them. Mr. Davis appeared before the Board requesting an Area Variance for road frontage. The property belongs to Everett & Mary Davis who previously consolidated 3 lots into one parcel for tax purposes. Stephen Davis would like to subdivide the parcel back to its original. Due to a garage being built in the right of way on the property with the home, the Zoning Officer requested that a 10 ft boundary setback be done. See copy of consolidation of parcels (3) and current Map. Member Comments/Concerns Linda Hirvonen states the small strip can’t be considered a buildable lot. It should be consolidated with the parcel across the street and then it will be two lots. Daniel Konowalow states two of the original lots are non conforming to begin with, and by granting Stephen’s request and allowing the additional 10’ on the garage, that would make the lots even more non conforming. Hurf Sheldon suggested that a right of way be placed in the deed for the house that states whoever owns the property across the street will have an easement to the beach. The Board inquired as to who has power of attorney. Stephen Davis states his younger brother does. After much discussion, the Board suggested that the Davis’s involve an attorney to help them figure out what is best for them to do. Public Comments/Concerns Donna Scott a resident of Lansing Station Road states the railroad owns the beach and it doesn’t matter what the right of way width is. Linda Hirvonen made a motion to table the Public Hearing until August 2012 or possibly longer to allow the Davis’s to get legal advice on this matter. Someone who has the legal authority shall return with a revised proposal. Judy Drake seconded the motion and it was carried by the following roll call vote: Vote of Zoning Board . . .
