TOWN OF DANBY
TOWN BOARD MINUTES
' March 8 , 1971
The regular meeting of the Danby Town Board was held at the Danby
Town Hall , March 8 , 1971 , at 8 : 00 P . M .
Present : Supervisor Donald C . Makie

The meeting was called to order by Superintendent Makie at 8 : 00 P . M .
COMMUNICATIONS :
1 . Agenda ' s of the Tompkins County Board of Representatives
Meeting covering the period of February 8 , 1971 through
March 8 , 1971 .
Included in the Board of Representative ' s Agenda , it was
noted that they had received Statements of Town Accoun£ s
from Caroline and Danby . It was also noted that Pistol
Permits for the month of January , fees were in the amount
o f $ 97 . 00 ,
Annual reports were given at that time , and there is
nothing from the other meetings .
2 .. We have received a copy of Resolution No . 43 reporting
the Appott.ionment of Dog Monies to the various towns in
the County . Danby will receive $ 527 . 75 .
3 . A copy of a letter from Frank Liguori , Commissioner of
Planning was received re : " Request for Considera- . .
tion of Changes in Operating Hours - - Refuse Sites " .
After a re - evaluation of the present schedule it was the
consensus of the Planning and Public Works Committee
that the present opening hours are meeting the needs of .
the people in the municipality and others . A further
re -evaluation is to be made on July 1 , 1971 .
4 . Tompkins County Department of Health - to Donald Makie
re : The West Danby Water Supply . New York Sanitary
Code requires a qualified operator to be in responsible
charge of public water supply . There are two courses of
action open to comply with this requirement . One would
be to have the operator become qualified by 'applying
for a Grade 3B certificate . Qualifications are - high
school or equivalency diploma and at least 3 months of
o perating experience , and attendence at a Grade 3
School for about one week $ ;® duration . An application
and requirements are enclosed for the use of your
o perator . The second method would be to have an
operator who is qualified give adequate supervision .
The West Danby Water District is to take any necessary
action to implement this as soon as is reasonably possible .
Councilman Crance is to call George Guest as no application
was received .
5 . A letter was received from Robert A . Boehlecke , Jr .
Architects for consideration in the design of the new Town
Barn .
6 . An engineering firm in Cortland also sent information
relative to the Town Barns with respect to different
projects that they do .

Petition Against the Proposed Trailer
Park in the Township of Danby on the
South Danby Road
We , the undersigned , Home and Land owners , residing in the Township
of Danby and on the South Danby Road , hereby , voice our negative opinion
of the proposed Trailer Park :

Cerrache was not available , but in talking to the Manager , he thought
that Cerrache had a franchise . Supervisor Makie said he was unaware
of one if it existed . The matter was discussed , : however no information
• was obtained . Have had legal advice . Infor mation not forthcoming ,
Danby needs some stipulation in the franchise to prevent problems
which might arise . Fee is set , services and changes to be cleared
with the Town Board . Put this on the Agenda . The TV cable is' desired ,
must be gotten under control and done promptly . A clear agreement
should be - in the franchise protecting the Town of Danby as well as
Cerrache .
Roy Casterline would like to see the
Town of Danby have their Planning - Board or Zoning Board , which ever
it may fall under1 s -`:. .) study the feasibility of reducing the lot size
in the Water District . Minimum footage should be reduced from 150 ' feet .
This goes with the Health Department reoommendations . Floyd Dorn
is to take the matter under advisement . The problem of sewage disposal
ties into this . Rezone part of this on Water District , which is to
be done before making a new Zoning Map .
Moses Peter expressed his concern over the fact that the Town of
Danby seems to have very little representation with the County Board
of Representatives . Two months ago the County Representative did
appear at . the Town . Board Meeting for a short period of time . This
however , is a rarity . He spoke very intelligently about the SPCA
vs the Sheriff and the Dog Problem . However when the issue came to
a vote ', the Town of Danby was not represented . It was voted that
the dog matter would be contracted to the SPCA , and Mr . Peter feels
that had the Town of Danby been represented and had spoken atthe
meeting as he had at the Town Board Meeting , the outcome of the vote
might have been different . Why can ' t the representative attend
meetings regularly and some issues discussed more regularly with the
Representative at the Town B and Meetings . He feels that this is a
very unhappy situation . It is important that the Town of Danby have
an active County Representative . This is not a new situation, the
landfill site is not controlled as it should be by the Town . It is
one of the problems to . be faced . Place on the Agenda some means to
deal with this problem . The problems faced because of inadequate
representation can increase . The Dog situation was put on the Agenda ,
the amount increased in the care of dogs in the county' is more than
is spent on government in the Town of Danby . $ 100 , per dog . picked
up is average . .
Richard Blatchley would like to enlist the aid of Professionals or
the County Planning Board for a proposed trailer - park . He would have
25 to 30 trailers to start , and with permission would like to expand .
His proposal is to be put on the Agenda for recommndations .
Rick Dobson is very unhappy with Gordon Roberts checking around his
property without hisA) ermission . His address is Dobson Road , and
not Brown Road . West Danby Village ( hippie nature ) mentioned . Do
they pay taxes , have permits , approved sewage systems , and approval
forcperations . Dobson also states that permit rates have risen . Gordon
Roberts sys that they are established based on previous yearaa.
Permit fees are to be put on the Agenda . Attorney Thaler is out of
town . A copy of a letter sent to Rick Dobson is to be discussed in
the Zoning Officer ' s report . d
Gerald Crance asked if there are any Commercial Areas in the Town .
Supervisor Makie replied that there is . Supervisor Makie explained
the boundaries to him .
COMMITTEE REPORTS :
Highway .Report . Ralph Wilbur stated a need for radio equipment in
the Town equipment during bad storms , etc . Pro ' s and con ' s were
discussed . Ray Casterline does not recommend the Citizen ' s Band
Radio as they do . !. not work well . Ralph Wilbur would like to recommend
that the Highway Superintendent investigate the best means . Rick
Dobson mentioned a rental system . Ralph Wilbur asked for Board
approval for investigation of radio equipment . This was put on the
agenda . Is there insurance on the new grader . Has the collision
portion been increased ? Relative to the Highway Barn , Ralph Wilbur
is to meet with the Planning Board on Wednesday night . T 'rt

COMMITTEE REPORTS : Cont ' d
The Highway Committee has received many calls and letters relative
to the new Town Barn . " Consulting Engineering " representative from
Cortland impressed Ralph Wilbur in that he worked for a fee and not
a percentage basis such as architects do .
There wasn ' t a repo;t from the Planning Board . or :,Wate -District .
INSURANC.E :TPResume "cif employee insurance program has been added to insurance
fades. Ins . on new grader to be increased to $ 35 , 000 . 00 .
Dick Olsen questionedc , as to initial .. {proposal otn covered containers
to be used for garbage . This ruling shuld be enforced . There are
no problems with the Landfill itself . Could the covered garbage can
issue be brought to a County level by the Denby County Representative ?
Francis Wright would like to have a letter sent out about this , as
there is a limit as to what officers of the law can do . Litter is a
serious problem .
Youth : No report . --
Zoning Board and Planning Board williimeet on Wednesday night .
Fire :
There is a meeting for March 16th with Ralph Wilbur . Negotiations
on a new deal will take place .
Cemetaries : , No report . All quiet .
OLD BUSINESS :
Zoning : Read a letter from Attorney Thaler to Rick 'Dobson .
Supervisor Makie suggested that Gordon Roberts obtain proceedure in
writing for the performance of his duties as Zoning Officer relative
to right of entry , etc .
Public Utility : Ivy Broadcasting on the King Road . Permit was
ssWTK Wilbur utility ,

is to obtain more information .
The question a new voting machines was tabled until April .
As to the 18 year old vote Attorney Thaler pointed out that this is
a State controlled . item .
TV Cable Franchise : SuperVi §or Makie to obtain a legal opinion as
to the Cerrache cable operation . Said opinion to be in writing .
The Town of Danby feels that it should have some control over the
placement of the cable .
NEW BUSINESS :
43 Resolution No . 3 , 1971 was adopted to modify the budget , Item No .
- Machinery Appropriation DM5130 . 3 Equipment by $ 20 , 000 . 00 .

Francis Wright moved to modify the budget item , and motion was
seconded by Floyd Dorn . Roll call rote :
Councilman Crance , aye ; Councilman Wilbur , aye ; Supervisor Makie ,
aye ;. Justice Wright , aye ; Justice Dorn ; aye . Five ayes and no noes .
It was also moved to modify budget item No . 4 , Snow Removal DM5142 . 1
as the $ 2 , 200 budgeted last fall was inadequate . $ 1 , 600 for snow
removal and sand for this month ' s work . $ 3 to $ 4 , 000 modification
is needed . Reimbursement should come from the County .

Radio contact with highway equipment was discussed . Type of
procedure needed . Ralph Wilbur suggested authority be given to
the Highway Superintendent to check the various methods and Francis
Wright also suggested that Civil Defence of the County be checked
with rather than individual sales representatives . Crane suggested
the Cesco service of the County Communications . All possible

sources to be checked before . any decision to be made . Francis
Wright made the motion that the _ Highway Supertendent check with all
of the aspects of such communications . Motion seconded by ' Raiph
W ilbur . Five ayes and no noes . Ralph Wilbur to advise Highway
S uperintendent of this decision . .
Basin Board Study - a letter was read by Makie . Tompkins County
opposes the study . This Basin Board study represents $ 190 , 000 .
Supervisor Makie feels 'that a good proposal is needed to cut the
budget . It is felt that Cayuga Lake presents a good supply and an
. upland reservoir or dam being built reeks of being a political item .
A motion was made by Ralph Wilbur , and seconded by Francis Wright
to support the Town of Ithaca ' s opposition to this study . Letter
is to be sent to various Assemblymen . Motion2passed with five ayes .
Equalization Rates : Most townships have dropped 6% , Denby has
. dropped 5% .
A Motion.. was made by Gerald Crance to send a letter to Erie J .
Miller , Jr . requesting his attendence at the next meeting of the
Denby Town Board . The meeting will be held an April 12 , at 8 : 00
P . M . , Erie J . Miller is requested to stay for the entire meeting .
Motion passed with five ayes .
SPCA situation . The County reversed its position . This item is
to be placed . on the Agenda for the next meeting . Publicity should
be given that the Town of Danby is opposed to the present situation .
Motion for such publicity was made by Dorn , that Supervisor Makie
make a strong statement to the Ithaca Journal that the Town of
Danby is opposed to the SPCA thandling the dog problems , and at the
cost which is , involved . Motion seconded by Wright . Motion passed
with. five ayes and no noes .
Blatchley Trailer Park . Procedures were read and reviewed by the
Board.. Motion made by Floyd Dorn to refer Blatchley to the Town
. Planning Board with his presentation and application . Motion
- seconded by Gerald Crance . Four ayes , one no - Ralph Wilbur dissenting'.
Gordon Roberts sent a Condemnation procedure letter to Awad relative
to his burned house . Roberts to report at the. April meeting .
P ermits - Zoning - fee schedule is felt to _ be equitable . _ Rick
Dobson_ _is . to submit any complaints which he might have in writing .
. A permit must be obtained for everything . $ 5 . 00 fee is minimum .
Permit to Ivy Broadcasting questioned and discussed . They were
turned down in Ithaca . To be in an area between Ridgecrest and Troy
Roads . Gordon . Rober- ts_ talked with attorney first . Legality of it
is questioned however . Makie is to clear up the point as to
whether this is a utility or a commercial venture and to report on
same at next meeting . Makie to call a special meeting if such is
necessary .
. . Payment of bills - Wattant # 3 , on the General Fund in the amount
of $ 1 , 922 . 19 . Motion madrbyTrancis Wright , seconded by Floyd Dorn .
Motion passed with five ayes . Highway bills in the amount of $ 640 . 84 ,
Warrant No . 3 . Motion made by Wilbur , seconded by Wright . Motion
passed with five ayes . Warrant No . 3 , Water . District bills in
amount of . $183 . 15 . Motion made by Crance and seconded by Wright .
Motion passed with five ayes .
Supervisors report was accepted on motion of Wright and seconded
by Floyd Dorn .
