The Board of Public Works meets on the second, third and fourth Wednesdays of the months at 4:45 p.m. All meetings are voting
meetings, opening with a public comment period. Meeting agendas are created from prior public input, Department operating, planning
issues, and requests made to the Superintendent. The Board reserves the right to limit verbal comments to three minutes and to request
written comments on lengthy or complex issues. This information may then be used to create committee agendas, with the speaker or

Operator — Resolution
Ray Benjamin is considering a number of recommendations to change the personnel roster to
match the way we are now operating under the impacts of last year's open positions and this
year's budget reductions. This particular change is also triggered by our being removed from
South West Park and the operational impacts of greater haul distances we now need to travel.

This is the next grouping of appeals that we have in our current backlog of sidewalk appeals
9.5 Bicycle Boulevards /Neighborhood Greenways — Update
I have asked Tim Logue for an update on the bicycle boulevard, as a follow up to the
discussions of the Board in late fall of 2011. We have a long range view of these changes
required to implement a new program. This is based on our understanding of the process
required to provide the public education and opportunities for public input customary with such
changes.

8.1A Appeal of License Fee for 339 Elmira Road (Old Salvation Army site) — Resolution
WHEREAS, the owner of 339 Elmira Road, Mr. Uotila, has appealed the license fee
charged for use of City property abutting the aforementioned property, and
WHEREAS, the owner has suspended use of City property abutting the aforementioned
property since demolition of the building located on the property, and
WHEREAS, the Board of Public Works deferred construction of public sidewalks in 2000
at 339 Elmira Road in deference to imminent development at the site, and
WHEREAS, there has been no further development of the site at 339 Elmira Road, now
therefore be it
RESOLVED, That Mr. Uotila's appeal be granted and the license fee for 2012 for use of
City property be expunged, and be it further
RESOLVED, That Board of Public Works direct, based on the process and procedure of
2000, the construction of sidewalk across the frontage of 339 Elmira Road.
8.11113 Appeal of License Fee for 210 Hancock Street (Old P &C Store) —Resolution
WHEREAS, the owner of 210 Hancock Street, Tony Petito, has appealed the license fee
charged for use of City property abutting the aforementioned property, and
WHEREAS, the owner of 210 Hancock Street has suspended use of City property
abutting the aforementioned property during renovations of the building located on the
property by removing all encroachments in the right of way, now therefore be it
RESOLVED, That Mr. Petito's appeal be granted and the license fee for 2012 for use of
City property be expunged, and be it further
RESOLVED, That Public Works staff re -visit the site prior to the end of 2012 or upon
completion of renovations of 210 Hancock Street to determine if any City property is being
used for these improvements and a new license agreement and fee shall be enacted and
paid.

8.1C Appeal of License Fee for 344 Elmira Road (Garcia's Restaurant) —Resolution
WHEREAS, the owner of 344 Elmira Road (Garcia's Mexican Restaurant), Marty
McElwee, has appealed the license fee charged for use of City property abutting the
aforementioned property, and
WHEREAS, the owner continues to use City property abutting the aforementioned
property for parking and access to the tenant's business, and
WHEREAS, field measurements of the amount of paved parking area located within the
City right of way and exclusive of the driveway area are consistent with the area
assessed, now therefore be it
RESOLVED, That Mr. McElwee's appeal be denied and the license fee for 2012 for use
of City property be imposed, and be it further
RESOLVED, That Board of Public Works directs the Superintendent of Public Works to
review the Public Works need for continued City ownership of the right of way abutting
344 Elmira Road which is currently used by the licensee and report findings to the Board
at its next meeting.
8.2A Appeal of Sidewalk Assessment for 105 -107 Elmwood Avenue — Resolution
WHEREAS, the Board of Public Works has reviewed the protest of the property owner of 105-
107 Elmwood Avenue concerning the city's bill for replacing sidewalk at that address following
a series of sidewalk defect notices, and
WHEREAS, the sidewalk was replaced following the city's procedures for sidewalk
replacement following the property owner's failure to take actions which would resolve the
sidewalk notice, now therefore be it
RESOLVED, That the Board of Public Works hereby denies the property owner's protest of the
outstanding bill.

8.21B Appeal of Sidewalk Assessment for 401 Columbia Street — Resolution
WHEREAS, the Board of Public Works has reviewed the protest of the property owners of 401
Columbia Street who purchased the property in the fall of 2005 after the sidewalk repairs were
completed, and
WHEREAS, the new owners claim that they were not made aware of any liability or
outstanding bills concerning the sidewalk at the time of purchase, and
WHEREAS, the City has instituted a process that now places a notice of sidewalk liabilities
(either outstanding inspections or actual bills) on the tax search for properties, but that
procedure was not in place at the time of the owners' purchase of the land so they had no way
of knowing the liability existed, now therefore be it
RESOLVED, That the Board of Public Works hereby expunges the bill issued to the new
owners for sidewalk work completed at 401 Columbia Street in 2005.

City of Ithaca has inspected the condition of the public sidewalk along the street at this
address. At this time of inspection, the following sidewalk was found to be defective:
TREE DAMAGED WALK:
0 square feet of 4" thick sidewalk
0 square feet of 6" thick sidewalk
0 grind locations
OTHER DAMAGED WALK:
225 square feet of 4" thick sidewalk
75 square feet of 6" thick sidewalk
0 grind locations
This location is on the City's repair list and will remain on the list until the repair work is
completed by you or by the City. At the first opportunity, all defective sidewalk found at
this location at the time of the work will be replaced. City of Ithaca Code requires that
sidewalk repairs made by City of Ithaca be billed to the owner at cost plus 25 %.
You are encouraged to hire a contractor to do your repairs. Obtain a sidewalk permit so
the location can be removed from City of Ithaca's repair list when work is completed.
Please read the attached document and if you still have questions, you may contact the

Hello Mr. Gray,
I am writing to follow up on our conversation on 7/27/10 regarding the sidewalk repair being done at
402 South Plain. As I stated before the criteria for the work being done does not justify a total removal
of and entire section of side walk. I also need to stress that the total cost of this expense is being kept
from the tax payers. I received notice in 2007 regarding sidewalk repairs and contacted the city
representative at that time ( who indicated to me that they where a part time intern) and explained to him
that I had the necessary work completed on my property. This work was a missing section of concrete
from the Clinton street side of my property I was told that they would go out and inspect the work done
and notify me of the status. I fotlowed up with this individual and he said that I was fine.
Mr. Gray the work being done to my property is excessive and unnecessary to say the least The entire
front portion of sidewalk has been removed and re- poured because of sections that are considered
unsatisfactory and so called condemned and the city plans to bill me thousands of dollars to do this
repair.
I want to stress that I do not want the city to proceed any further with any repair to my sidewalks
especially starting any new work on the Clinton street side of my property. I am securing the
necessary permits to get the work completed and will refuse access to my property if needed so
this work will not continue.

I am writing to request a dismissal of my charges for the sidewalk repair done on my
property 402 South Plain Street on July of 2010.
The process of notifying property owners of the time of repair is flawed not to mention a
letter was put in my mailbox at 11:00 am after the work had already been started.
Inconsistency with notifying property owners of work. Some property owners where
notified verbally of the impending work and asked verbally if they wanted the work to be
done. Thus giving the property owner a real opportunity to decline the repair.
At no time was I informed of the cost of the repair.
I obtained a permit to patch the Clinton street side of my property- and the cost for me to
repair the Clinton street side of my property was $80.00 versus the thousands 1 am being
billed by the city for work that is already deteriorating. I have pictures to prove this.
I am asking that board give me an opportunity to present my case before them and speak
to my situation.
I have also included my original email that I have sent to Mr. Gray disputing the repairs. I
must note that I have yet to get a response.

You have probably observed that Ithaca's sidewalks are rebuilt on an ongoing basis. One reason
for this is Ithaca's sidewalk repair and inspection program. At the time of inspection, the
deteriorated sidewalk at 205 Utica St. consisted of the following:
TREE DAMAGED WALK (by current policy, the city assumes expense for this repair):
0 square feet of 4" thick sidewalk
0 square feet of 6" thick sidewalk
OTHER DAMAGED WALK (for which you are responsible):
125 square feet of 4" thick sidewalk
125 square feet of 6" thick sidewalk
The City is exercising its option to complete the necessary repairs and has tentatively scheduled
your property for work this year. You will be billed for your portion of the expense plus an
additional 25% administration fee required by the City Engineer. Please note that some
inspections were done several years ago and sidewalk condition will be reevaluated based on
current conditions at the time of construction. It is possible more sidewalk will be replaced than
the quantities listed above.
You may wish to review the enclosed excerpts from the City Charter and City Code. The

Dear Charlie:
Prices for sidewalk replacement work by City of Ithaca are fixed.
2009 Prices for sidewalk work by City crews are:
$11.09 /sq ft for 4" thick sidewalk
$12.21 /sq ft for 6" thick sidewalk (gets driven over)
$25 /joint for grinding (maximum 1/2" out of level)
PLUS 25% added during the assessment process.

Please note that areas shown on your sidewalk notice estimate each slab of sidewalk at 25 sq ft, regardless of its actual size.
Careful measurements are done when and if City of Ithaca performs the work.
Based on the estimated area, and no change in condition since the previous inspection, your estimate for owner responsibility work
if performed by City of Ithaca, is:
$2828.50 +25%
You may choose to fix only condemnable conditions or consider temporary patching or grinding to reduce costs.
Inspection maps remain on public file for at least 6 years.
Although your neighborhood was on the list of possible work for this year, I no longer expect that the City crew has potential to
reach your neighborhood this year.
I expect the Board of Public Works to participate in setting priorities for work next year and I have no way of knowing if they will
select your neighborhood as a priority or not. The sidewalk program has approximately 600 properties identified as in need of
repairs at this time. Last year, approximately 60 properties were repaired by owners or the City.

Is the price that the city charges homeowners for sidewalk repairs
fixed, or does it vary from job to job based on how long it takes the

varies, what are the ranges that have been charged.
This information is needed to compare hiring a private contractor to do
the work vs. having the city do it.

Subject: Disagreement with Square Footage Calculation for Sidewalk Repair
Kathy,
I received the attached bill for 100 square feet of sidewalk at 221 Cornell St. I believe the
correct amount should be 84 square feet.
The area in question is shown on the attached map. Before the work was done, there were
six squares of sidewalk, each about 4' by 4'. Four of the six were deficient and needed
replacement. The installers wanted to install 5' wide walks, so they said the City would
cover the cost of replacing the two squares that were in good shape.
The total area of new sidewalk is 125 square feet (25' by 5'). By my calculation, I am
responsible for two - thirds (4 of 6 original squares) and the City is responsible for the
other one -third (2 of 6 original squares). So my share is 84 square feet. At $14.64 per
square foot, this comes to $1229.76.
I have written a check to the City for $1229.76. If you agree with my calculation, please
have the clerk send me a paid -in -full receipt. If you disagree with my calculation, please
contact me so that we can discuss this further.

Re: Bicycle Boulevards/ Neighborhood Greenways - Update
This memo is meant to provide a short update on our progress toward preparing a Bicycle
Boulevard/ Neighborhood Greenways plan for your review and ultimate adoption. Since our
last discussion in early November, we have focused primarily on two things: further
development on the proposed routes & treatments, and outreach to potentially affected city
departments and neighborhoods.
Routes & Treatments
While no final decision has been made, staff are getting more and more comfortable with the
concept of using Tioga Street and Plain Street as the main backbones of the greenways system.
We have spent some time looking at treatments along the streets and are settling into the idea
that as far as traffic calming devices, we would focus on the use of speed tables as the primary
strategy. Though we have gotten some mixed feedback on the idea, we are also interested in
the idea of partial closures for motor vehicles in a few select locations in order to keep traffic
volumes at the levels that make a bicycle boulevard family friendly. At this point, we think
this would have minor impacts on traffic diversion and motorist convenience. The three
locations we are considering for this kind of treatment are: 1) the northbound leg of N. Tioga
Street at Court Street; 2) the northbound leg of N. Plain Street at Seneca Street; and 3) the
southbound leg of S. Plain Street at Green Street. This treatment would allow bicyclists to
proceed through, but not motor vehicles. Emergency vehicles could get through it if need be.
We are also looking at different concepts for the intersection of S. Plain Street and W. Clinton
Street because this can be a difficult intersection to cross.
Outreach
In late November, we attended a webinar on "Increasing Bicycling in Low - Income
Communities." Though the subject was interesting, the greater benefit was the discussion
afterward with staff from Way2Go, the Multi- Cultural Resource Center, the Ithaca Tompkins
County Transportation Council, and County Human Services that followed. We talked about
how to do further outreach into our community to find synergies with other community
initiatives, to expand access to bicycles and safety equipment (helmets, lights, etc.), and to
build on education, encouragement and other activities. We are considering a big community
meeting toward the end of the winter, perhaps at the Southside Community Center.

On December 15t", we attended a Fall Creek Neighborhood Association meeting to discuss the
concepts and potential details of the bike boulevard plan. There were a number of cyclists in
attendance and we had a very interesting discussion. Overall, there was a fair amount of
support for the concept. There was some concern about how to treat the last two blocks of
Tioga Street approaching the Commons so as to ensure that they are bike friendly. There was a
bit of a mixed reaction to the concept of diverting motor vehicle traffic on Tioga Street heading
north of Court St, but overall the reaction was favorable.
Also, in December, we began discussions with other City departments, including the Fire
Department, Streets & Facilities, and very favorable discussions with the Police Department.
We have not finished these discussions and will continue with them over the next month or so.
At this point, our intent is to continue to work on the intersection plans in January and
February. We will then hold a neighborhood meeting as noted above toward the end of the
winter. After that, we would like to present the draft plan to the Board and work toward
approval. Currently, there are no funds and no schedule for construction or implementation,
but we would like to have a plan in place by late spring so that we can anticipate the capital
project request process, a potential federal -aid Transportation Enhancement Program grant
application, or even a new project for a Transportation Improvement Program update through
the Ithaca- Tompkins County Transportation Council.
