The Board of Public Works meets on the second, third and fourth Wednesdays of the month at 4:45 p.m. All meetings are voting
meetings, which opens with a public comment period. Meeting agendas are created from prior public input, Department operating
and planning issues, and requests made to the Superintendent. The Board reserves the right to limit verbal comments to three
minutes and to request written comments on lengthy or complex issues. This information may then be used to create committee
agendas, with the speaker or author invited to attend.

This cleans up curb side parking along the new curb line of Franklin Street.

restaurant. Since the water was delivered but only a portion • it was later processed as
wastewater, a correction has been applied to the wastewater portion of the bill, based on t

Whereas, inspection • the Seneca Street Parking Garage has revealed defects to slabs and
beams which require immediate repair in order to permit continued use of portions of the
garage for parking, and,
Whereas, repair of some structural defects before winter weather conditions prevail
constitutes an emergency and,
Whereas, proposals to make emergency repairs were solicited from five contracting
companies engaged in structural repairs • parking garages and,
Whereas, proposals were received on November 5, 2010 for Seneca Street Parking Garagi.,
- Slab and Beam Repairs — 2010 and,
Whereas, the 2010 General Fund Budget includes capital funds for repairs to the Seneca
Garage and,
Whereas, Patterson-Stevens, Inc., 400 Sawyer Avenue, Tonawanda, NY, submitted the
lowest qualified proposal of $36,555.00 and, now therefore be it
RESOLVED, That the City • Ithaca Board of Public Works hereby awards the contract for
Seneca Street Parking Garage - Slab and Beam Repairs — 2010 to Patterson-Stevens,
for $ 36,555.00, and be it further
RESOLVED, That the Mayor be and hereby is authorized to execute this contract, and that
the Superintendent of Public Works be and hereby is authorized to administer the same.

WHEREAS, the Board of Public Works has expressed interest in having the E. State St.
uphill bike lane extended up Mitchell St. (to Ithaca Road) to better serve bicyclists travelinif
from the downtown Ithaca area to the Collegetown/Cornell/East Hill area, and
WHEREAS, uphill bike lanes benefit bicyclists by allowing them to travel comfortably at their
own pace without feeling that they are impeding overtaking motorists, and benefit motorists
• allowing them to safely pass bicyclists without crossing the centerline, and
WHEREAS, the Ithaca Bicycle Plan recommends the installation of a bike lane in th
location, and I
WHEREAS, the recent elimination of on-street parking in this vicinity will easily facilitate th-1W
installation of such a bike lane, and
WHEREAS, the addition of this bike lane segment will increase the City's total length of bike
lanes by 16% (1,100 feet), and
WHEREAS, the existing Bike Plan Capital Project #325 has sufficient funding remaining to
cover the design and installation of said bike lane, now therefore be it
RESOLVED, That the Board • Public Works directs staff to design and install said bike
lane.

8.313 To Amend Vehicles and Traffic Schedule X11, Parking Prohibited at All Times, in
regard to the 400 block of Franklin Street
WHEREAS, the Department of Public Works is progressing a project to redesign the north
side of the 400 block of Franklin Street in conjunction with the redevelopment of the of the
Water & Sewer Division's yard • the street, and
WHEREAS, the design for the street calls for parking on the north side of the block along a
tree lawn and sidewalk and no parking on the south side of the street, and
WHEREAS, the Board of Public Works is authorized by Section 346-4 of the City Code
2dopt and to amend a system of Schedules in order to administer the Vehicles and Traff
Law, and
WHEREAS, the Board of Public Works is in agreement with this plan and the associated
changes to the Schedules, now therefore be it
RESOLVED, That the northside of the 400 block of Franklin Street shall be considered
Odd/Even parking and therefore, in accordance with Section 346-26 of the City Code, does
not need to be listed in the Schedules, and be it further,
RESOLVED, That Schedule X11, Parking Prohibited at All Times, be hereby amended to ai�i

WHEREAS, Guiliano Lucatelli, owner of Lucatelli's Ristorante at 205 Old Elmira Road, has
protested - water i sewer bill received in the fall of Sri in the amount of $3,389.12,
which is roughly five times higher than subsequent bills, and
WHEREAS, a records search for the property shows that notices of a possible leak wer
sent with the quarterly bills for March, June and September 2009, and the property own
reported that both a gas - and s water service leak were discovered under
Supt. restaurant's concrete slab in the fall of 2009, and 11

sewer bills for March, June and September 2009 to allow for water that was lost beneath the

RE: Request for Expungement of Sidewalk Assessment (218 -220 University Ave.)
Last week I received the enclosed letter from Attorney Richard Thaler, who represents the
current owner of 218 -220 University Avenue (Cooke Properties, LLC). The property was
purchased from Peter & Cherie Newell, in August 2008. The Newells had purchased it in 2002.
In 2000, the City found the sidewalk at this property to be defective, and so notified the owner (a
predecessor to the Newells). In January 2005, after the owner had failed to make the required
repairs, the City's Engineering office prepared a notice, addressed to the Newells, stating that the
damaged sidewalk consisted of 200 square feet, and that the City was exercising its option to
make the repairs and charge the owner (including a 25% administration fee). It appears that at
some point the owner arranged for a contractor to repair a portion of the sidewalk, apparently
without notifying the City. However, when the City's contractor arrived to make repairs, in the
summer of 2005, it was found that the owner's work was not to the required City standards (the
new concrete being only 1.5 inches in thickness, rather than the minimum of 4 inches). The
City's contractor then replaced the entire sidewalk (431.3 square feet). A notice of the
"estimated" cost of repair by the City (addressed to the Newells) was prepared by the
Engineering office in March 2007. According to the notice, a public hearing on the 2005
assessments was scheduled for the Board's meeting on March 14, 2007. According to the
minutes, the hearing occurred on that date, and no one appeared to speak about the property in
question. At that meeting, the Board gave itself power to act on the 2005 assessments on April
4, 2007. According to the minutes for that meeting, there was no vote on the matter at that time.
I am not sure when the vote actually occurred.
According to Mr. Thaler, the first billing for the sidewalk repair received by his client was in
December 2009. Prior to the 2008 purchase of the property, Scott Miller (the Newells' attorney)
ordered a tax search from the City Chamberlain. At the bottom of the search document (dated
July 9, 2008; copy enclosed), was a typed statement that read: "SUBJECT TO 2005
SIDEWALK ASSESSMENT." No amount due (for the assessment) was indicated; the
Chamberlain says that is because her office had not been notified by that time that an actual
assessment amount had been finalized. She says that when such a figure is made available to
her, it is included on the tax search.

After his client received the December 2009 billing, Mr. Thaler contacted Attorney Miller,
indicating that if any amount were owed for sidewalk repairs, it would be the Newells'
responsibility, not his client's, as his client was unaware of the obligation at the time of the 2008
purchase. In June 2010, Mr. Miller submitted a FOIL request to the City, seeking "ALL notices
of sidewalk repairs to the real property located at 218 -220 University Avenue" (from 2004 to
date). In response, the Engineering Office provided printouts of 2 notices (without actual
signatures), from the files on that office's computers.
These documents (copies enclosed) are addressed to the Newells, and are dated January 24, 2005
(indicating that the City intended to fix the sidewalk at the owners' cost plus 25 %, and noting
that "it is your responsibility to notify any new owner of this outstanding sidewalk notice "), and
March 1, 2007 (indicating the estimated cost to the owners of the sidewalk work - $4,000.12 —
with a note stating "PLEASE DO NOT PAY AT THIS TIME" and informing the owners of the
public hearing on March 14, 2007, and their right to address a written protest to the Board. The
Engineering Office indicated that it did not have hard copies of the actual, signed notices.
Attorney Thaler is requesting that this assessment be expunged. He argues that the 2008 tax
search produced by the City did not provide adequate notice of a lien on the property, and that
the City cannot prove that notice of the assessment was actually sent by the City to the Newells.
Assistant Civil Engineer Lynne Yost has said that in her opinion the "SUBJECT TO..."
reference on the tax search constituted fair warning to the buyer and its attorney in 2008, as an
inquiry to her office would have confirmed the obligation and the exact amount (which she notes
had not been fixed by Common Council, as of the time of the tax search). She says other buyers
(or their attorneys) have made such inquiries, after seeing such a note on a tax search. Also, she
found notes in her files indicating she received a phone message from Peter Newell in July of
2005, about the property in question, and that she told him that the City had received a return
receipt for the notice and that the entire sidewalk was replaced because the owner's repairs were
inadequate. (Copies of hand - written and electronic logs enclosed.) She believes this rebuts
Attorney Thaler's implication that the Newells may not have received the City's notices about
the repairs or been aware of their obligation.
The Board's direction is requested, as to how to resolve this matter. I have asked for this issue to
be placed on the Board's agenda for its November 10th meeting.

Pursuant to our telephone conversation on October 14, 2010, please be advised that the
present owners of 218 -220 University Avenue are our clients who have purchased the
property from Peter and Cherie Newell in August of 2008 in the name of Cooke Properties,
LLC. At the time of the purchase, we were not provided with any notice concerning a
potential lien by the City of Ithaca for sidewalk repair at the premises purchased which said
repair was done in 2005, while the property was owned by the Newells.
Attached hereto is a tax bill dated July 9, 2008 from Deborah A. Parsons, City Chamberlain
for the City of Ithaca certifying that there are no taxes or charges assessed or payable against
the p remises, 218 -220 University Avenue. Also attached is a tax search done in 2008 covering
a ten (10) year tax search done by David M. Squires, the Financial Director of Tompkins
County indicating that there were no delinquencies outstanding on said premises for 2008.
These documents were produced by the attorney for the Newells to the undersigned on
September 10, 2008, for which, our client paid $77.00.
The first notice concerning the City's bill for sidewalk repairs for 218 -220 University Avenue
came to our client by an invoice dated December 31, 2009. Upon receipt of that notice from
our client, I contacted Attorney Scott Miller, the attorney representing the Newells at the 2008
closing concerning the fact that our client and the undersigned had no knowledge of the
City's bill for the repair of the sidewalk, therefore it was his client's duty, if there was a duty,
to make such payment.

Mr. Miller sent the undersigned a letter on October 12, 2010 indicating that the City's
response to his FOIL request of June 17, 2010 contained two (2) documents purportedly sent
to his clients from the City, the first dated January 24, 2005 and the second dated March 1,
2007. The documents provided to Mr. Miller were unsigned copies of letters allegedly in the
City's files. The City did not have the ability to prove that there was a mailing of the two (2)
letters to the Newells. Peter Newell apparently died in November 2008 and his wife currently
resides in South Carolina, and according to Mr. Miller, she has no knowledge of any sidewalk
repair notices from the City of Ithaca.
It is my request to you, that you present this matter to the Board of Public Works and that the
claim that the sidewalk repair of 218 -220 University Avenue be terminated without payment
by our clients since we had no notice of any lien(s) based upon unpaid claims by the City at
the time our clients purchased the premises.

10.4 Common Council — Direction to Board of Public Works Regarding Parking
'Revenue - Resolution.

WHEREAS, as part of the 2011 Adopted City of Ithaca Budget, Common Council approved
$2,025,000 in parking revenue from all services, garages and meters, and
WHEREAS, the Mayor and Controller recommended eliminating the first hour free in City
garages, which in conjunction with other rate changes would translate to an increase •
approximately $200,000 in parking garage revenue for 2011, and
WHEREAS, Common Council, during the 2011 budget discussions, voted to direct the Board
of Public Works (BPW) to develop parking rates that would produce the needed $200,000
without necessarily eliminating the first hour of free parking in downtown garages; now,
therefore be it
RESOLVED, That Common Council hereby directs the BPW to develop parking rates and
efficiencies for 2011 that would produce the needed $2,025,000 in parking revenues, and be
it further
RESOLVED, That said planned parking changes need to be completed • December 22,
2010 for implementation • January 1, 2011, and be it further

Parking revenues reflect CPI rate adjustments for all city garages per applicable parking agreements:

Golf Course rates increased or decreased based on actual activity and rate changes
Site Development fees estimated at $20,000 to reflect flat activity
Fire Protection Service represents the Town/City fire service contract: the Town of Ithaca share for
2011 is 32.71%, the new contract continues for 2011
Projecting interest rates to remain low in 2011. interest revenue for 2011 is calculated at $200.000
Rental of property includes rental income from retail space under the parking garages
Expecting building permit activity to increase in 2011. estimated at $430.000, increased amount by
$180,000 from 2010 budget amount per Building Department estimated Cornell and City projects;
assumed a partial permit Collegetori n Terrace Apartments
Fines and Bail revenue estimated at 51,120,000 for 2011, reflective of actual activity and
continued elimination of the waiver of first ticket program
Gifts and donations reflect contribution from Cornell University per MOU, the contribution now
increases by the CPI annually; the estimated CPI used for 2011 is 1,5%
Contributions from low and mod housing reflects interest earned on IURA Housing initiative
borrowing, may be last year of program
Transfers from other funds.for water /sewer increase related to payroll and G/F overhead increases.
reflects a continued 35% 65 % allocation of water and sewer fund activity. l % increases were budgeted
Transfer from Capital Fund represents interest and unneeded project authorizations, the amount is
used to pay down debt
Transfer from Joint Activity reflects a 10% G/F overhead allocation of the Wastewater Treatment
Plant
Transfer from Debt service relates to bond payments li,om bridgework or other projects funded by
Federal and State aid fronted by city fiends
State Aid Per Capita reflects a decrease of $91.000 from the 2010 Budget. the $2.559.000 amount is
the estimated payment for 2011. the new AIM payment from NYS is made to help reduce the tax burden
of the local taxpayer. due to the State`s fiscal problems we have decreased this amount in 2011 from the
2010 actual amount expected to be received of 52.663.671. we must be careful with this amount as
additional cuts may take place if the economy does not improve...this is an rmcertain revenue source
Ioitgage tax revenue is decreased to reflect current trends. continue to watch weaker housing market

Case Report:
Jennifer Cleland of 333 Spencer Road contacted Alderperson Maria Coles through a
series of e -mails about a local drainage concern upstream of her property.
Recent climate data shows that the Ithaca area received approximately 4- inches of rainfall
between Friday, October 1, 2010 and Saturday, October 2, 2010. The intense storm
caused localized flooding and enhanced existing drainage problems throughout the area.
Ms. Cleland's report concerned excessive runoff emanating from the hillside above her
residence causing property damage. Ray Benjamin and Scott Gibson arrived on site at
approximately I0:00am on October 5, 2010 to investigate. It was immediately apparent
that fresh rill and gully erosion had formed on the extremely sloped hillside just above
the residence's driveway washing a plethora of debris, mud, stone and dirt into the drive
landing.
The Cleland residence sits on a 2.42 -AC parcel along the southeastern border of Spencer
Road in the City of Ithaca as part of an area locally known as "The Quarry." To the north
and east of the lot is a drainage channel/creek that is lined with natural shale stone and
other bedrock ranging anywhere from 1 -foot to many feet in depth by an average width
of 10 -feet. Field and aerial imagery revealed that the creek is fed by two primary sources
beginning in road swales at several key points along Route 96. From the north, a network
of channels carries runoff from the Rogan's Corner area where they then cross the
highway toward the Emerson Power Transmission property. The other source begins at
or near Ithaca College to the south where it flows northward, crossing Route 96 and into
Emerson's lot as well. Both streams converge on the Emerson Power property, just to the
south of the complex's access road. The single channel then continues onward to the
northwest and feeds through a large box culvert underneath an abandoned railroad bed. It
eventually finds its way past the subject property and then into Spencer Road.
Several items of interest were noted during Mr. Benjamin and Mr. Gibson's field visit.
Shortly downstream from the flow convergence, it appears that the creek had completely
eroded away its downslope embankment carrying a large volume of runoff outside of the
creek channel and down toward the subject property. The area was littered with large and
small pieces of shale, gravel, and top soil, with areas of rill and gully erosion prevalent.
The new channel made cuts downward to the railroad bed where it then met the bed's
level grade. Flow continued across this surface and into the subject property. Downslope
of the railroad bed was what appeared to be a historical catchment drainage Swale. The
position and berming of the structure is in a location that appears to have once caught
flow in a similar fashion by channeling it to the north and back into the creek. The Swale
was filled with loose gravel and soil but could likely be cleaned out and restored to
proper working order by the Owner.
Attached you will please find several photos of the site visit for documentation purposes.
In addition, we have provided an aerial to help identify the subject site, its neighboring
owners and proximity to the problem areas.

Thank you for your prompt investigation of this matter. There are a couple of points that I'd like to clarify.
The rain event started on Thursday Sept 30th and the creek jumped it's downslope embankment at
approximately 7pm. I went up the hill to investigate whether or not the box culvert was blocked. If so,
something could be done about it by using the old rail road ROW to gain access with an excavator. When I
reached it, it was near capacity and I could see the problematic flow was from the location you described. I
returned to the bottom of my drive and encountered a city employee who noticed flooding while picking up
dinner at Pudgies. City crews scraped the road later that evening and again in the morning.
This problem has occurred periodically for the past 10 years. The cause is the collapse of the "engineered"
hillside of large stones and boulders that make up the Emerson side of the creek. They have pushed the creek
out of it's natural bed. That's why it's so easy for the creek to jump it's embankment. It's not supposed to
where it now is. The collapsed area is quite overgrown because this problem has persisted for so long. I have
previously shown this problem to Emerson facilities reps and they discussed how they would clear their debris
from the streambed, but obviously didn't.
It is my opinion that the stream is at risk of completely re- routing itself. There is absolutely no way that a
swale would be able to intercept the full flow. When the culvert under our driveway gets constricted in heavy
rain events, it blast the approx.. 2'x4'x8" stones that form the channel directing the flow parallel to Spencer Rd
like rag dolls tossed by a bull. Further the location of suggested swale is not on our property. The aerial image
you attached shows our southern property line several yards further south than it actually is. The large maple
at the southwest corner of the box culvert is our south east corner.
In my opinion, our house, the house immediately south of us, the house across the road as well as Belmont
Apts and Spencer Rd are at very serious risk from the full flow of the re- routed stream flow should that occur.
It would blow through a Swale in seconds.
We understand that this problem is not within the city's control. But it's not within ours either. However, a
partially collapsed, manufactured hillside and storm flow intentionally routed by the Town of Ithaca is the
source of a serious threat to private and public property. Who else can help us to remediate this threat, if not
the city?
This problem has festered for a decade and I believe that the risk is increasing with each storm event.
Needless to say, I didn't sleep well Thursday night. Regards - -Bob

Attached are several files compiled to report on a site visit that Ray Benjamin and I had this
morning at 333 Spencer Road. Our investigation was prompted by Maria Coles who spoke
with the owners of the property that registered a complaint about drainage issues upstream
from their home.
