The Board of Public Works meets on the second, third and fourth Wednesdays of the month at 4:45 p.m. All meetings are voting meetings, which opens with a public comment period. Meeting agendas are created from prior public input, Department operating and planning issues, and requests made to the Superintendent. The Board reserves the right to limit verbal comments to three minutes and to request written comments on lengthy or complex issues. This information may then be used to create committee agendas, with the speaker or author invited to attend. Page 3 Notes for BPW Agenda, Date 8.3A Request for Parking Modifications on 300 Block of Mitchell Street – Resolution A resolution written by Tim Logue will be provided early next week in response to a resolution presented to the Board by residents of the 300 Block of Mitchell Street, as well as his own observations. While I personally believe the traffic calming affects of the parking are valuable, professionally, it is not often that we are given an opportunity to extend our uphill bicycle lanes in important high demand areas. 8.4A Negative Declaration of Environmental Significance for East Clinton Street Bridge Replacement and Prospect Street Reconstruction Project – Resolution Addisu Gebre and Delta Engineers were going to make up the corrected/expanded Parts I, II, and III for the LEAF in response to comments made at the Board meeting on October 13, 2010. While I will not have a chance to review the document prior to our mailing of the agenda, I have discussed it with both. Incidentally, a public presentation of the project is currently scheduled for October 27, 2010, prior to submission of the final design report to NYS Dept. of Transportation. 8.5A Appeal of Water Bill for 109 North Cayuga Street – Resolution The attached resolution was written following the Board’s discussion with Mr. Bilinski at the October 13, 2010, meeting. 9.4A Cass Park Dock Use Summary – Update Please see the information from the October 13, 2010 agenda packet. 9.5A Appeal of Water Bill for 205 Old Elmira Road – Discussion 9.5B Appeal of Water Bill for 804 Stewart Avenue – Discussion Please refer to the information provided in the September 22, 2010, agenda packet. Superintendent of Public Works October 15, 2010 Page 4 8.4A Negative Declaration of Environmental Significance for East Clinton Street Bridge Replacement and Prospect Street Reconstruction Project – Resolution WHEREAS, State law and regulations and Section 176.6 of the City Code of the City of Ithaca require that a lead agency be established for conducting environmental review of certain proposed actions, in accordance with applicable law, and WHEREAS, State regulations and the City Code specify that the lead agency shall be that agency which has primary responsibility for undertaking, approving or funding the action, and WHEREAS, the East Clinton Street Bridge is located in the City of Ithaca and carries East Clinton Street (State Route 96B) over Six Mile Creek, and Prospect Street is a continuation of Route 96B from the eastern limits of East Clinton Street to South Aurora Street, and WHEREAS, the East Clinton Street Bridge has been rehabilitated numerous times and is in poor condition with areas of severe deterioration, and WHEREAS, Prospect Street and East Clinton Street were built in 1919, with a concrete base laid over native soils and surfaced with bricks, and that concrete base has deteriorated significantly, causing unstable conditions and potholes, and WHEREAS, to improve the streets to accommodate the current level of use, and to render them safer for motorists, bicyclists and pedestrians, the City of Ithaca retained Delta Engineers, Architects and Surveyors, to prepare a proposed design for the City’s replacement of the bridge and reconstruction of the street, and WHEREAS, on September 22, 2010, the Board of Public Works declared to act as a lead agency for the environmental review of the proposed replacement of the Clinton Street bridge and reconstruction of Prospect Street , and WHEREAS, appropriate environmental review has been conducted including the preparation of a Long Environmental Assessment Form (LEAF) part II, and WHEREAS, the Board of Public Works of the City of Ithaca, acting as Lead Agency, has reviewed the LEAF Part II, and RESOLVED, That Board of Public Works, as lead agency in this matter, hereby adopts as its own, the findings and conclusions more fully set forth on the LEAF, and be it further RESOLVED, That Board of Public Works, as lead agency in this matter, hereby determines that the proposed action at issue will not have a significant effect on the environment, and that further environmental review is unnecessary, and be it further RESOLVED, That this resolution constitutes notice of this negative declaration and and requests that staff provide notice of the same to all involved and interested agencies. Page 5 8.5A Appeal of Water Bill for 109 North Cayuga Street – Resolution WHEREAS, James Bilinski, representing the owner of 109 North Cayuga Street, contacted several departments to protest the supplemental bill of $891.84 he had received due to the incorrect meter head, which was installed as part of the city-wide program to change to automated meter reading, and WHEREAS, a review of the data showed that the water meter had not been changed but a new register which would under register water passing through the meter by a factor of approximately 5 had been changed, and that the four quarters before the change showed an average water consumption of ¼ (199 + 168 + 254 + 207) = 207 units, while the four quarters after the changes was ¼ (36 + 17 + 16 + 18) = 22 units, indicating that the register was significantly under recording actual consumption, and WHEREAS, the Board has determined that the services represented by a corrected bill were received and consumed by 109 North Cayuga Street and should be recovered through the supplemental billing, now therefore be it RESOLVED, That the supplemental bill to 109 North Cayuga Street in the amount of $891.84 is due and payable and that any penalties billed or accrued on this amount are waived but will start to accrue after November 15, 2010.
