The Board of Public Works meets on the second, third and fourth Wednesdays of the month at 4:45 p.m. All meetings are voting
meetings, which opens with a public comment period. Meeting agendas are created from prior public input, Department operating
and planning issues, and requests made to the Superintendent. The Board reserves the right to limit verbal comments to three
minutes and to request written comments on lengthy or complex issues. This information may then be used to create committee
agendas, with the speaker or author invited to attend.

I have drafted a resolution for the water and sewer connections. This has not been reviewed
by the Attorney, Dave Warden, or Erik Whitney. Please expect revisions.
9.4A Funds for Cayuga Waterfront Trail — Update
Tim has requested Common Council, via City Administration Committee, to amend the trail
project budget in order to include federal funds we had been promised but had not yet
received. No action is required.
9.413 Clinton Street Bridge /Prospect Street Reconstruction Project Schedule -
Discussion
The repairs to the Clinton Street Bridge and the rebuilding of Prospect Street above the
bridge have slid back into 2012 due to the need to follow federal rules for land acquisition
(the retaining walls) and the various federal approval processes. It will make for a long
detour of traffic that year, and related traffic complaints. No action is required.
9.5A Appeal of Water Bill for 109 North Cayuga Street — Discussion
The water meter at 109 North Cayuga Street is a 1'/2" Badger meter which was fitted with a
new automatic meter reading (AMR) head in September 2008. The Badger Model 70
measures one cubic foot in 87 revolutions. The new AMR head initially fitted to the meter
required 236 revolutions to register one cubic foot of water, resulting in a substantial under
billing for water consumed. The Model 70 would record (87.37/236.39 =) 0.370 for each
1.000 cubic foot of water passing through the meter, resulting in under billing by a factor of
(1/0.370 =) 2.71. It appears that the property owner took some efforts to change water
consumption because the pattern has changed after correcting the meter head. The meter
body was not changed. The charge for the corrected bill is substantially lower than I would
have expected based on the billing history.

9.513 Appeal of Water Bill for 205 Old Elmira Road
I am told that the water service inside the building, but below the concrete slab, broke,
resulting in the spike of water use in the summer of 2009. Erik has indicated that we sent
notices of a leak as early as March of 2009. It would be reasonable to adjust the sewer bill
now that we know the water was lost below the building's foundation and did not enter the
sewer.
9.5C Appeal of Water Bill for 804 Stewart Avenue — Discussion
There is something here I don't understand and so I will have to check with staff. The new
meter head was reading with the decimal point one place too far to the left when it was
started up. The big jump in consumption at the start of the new meter appears to be due to
the difference between the inside meter head on the old meter and the outside register
requiring a jump in consumption for that quarter. Then the new meter and meter head were
reading low by a factor of 10 due to the misplaced decimal point for the next two quarters.
Once the meter readout was corrected in June 2009, the consumption jumped up and has
continued to climb. I don't know if the old meter was checked for accuracy when it was
removed. We don't have enough data to know if a new use pattern has developed.

8.2A Declaration to Act as Lead Agency for the Environmental Review of the East
Clinton Street Bridge /Prospect Street Reconstruction Project — Resolution
WHEREAS, State law and regulations and Section 176.6 of the City Code of the City of
Ithaca require that a lead agency be established for conducting environmental review of
certain proposed actions, in accordance with applicable law, and
WHEREAS, State regulations and the City Code specify that the lead agency shall be that
agency which has primary responsibility for undertaking, approving or funding the action,
and
WHEREAS, the East Clinton Street Bridge is located in the City of Ithaca and carries East
Clinton Street (State Route 96B) over Six Mile Creek, and Prospect Street is a continuation
of Route 96B from the eastern limits of East Clinton Street to South Aurora Street, and
WHEREAS, the East Clinton Street Bridge has been rehabilitated numerous times and is in
poor condition with areas of severe deterioration, and
WHEREAS, Prospect Street and East Clinton Street were built in 1919, with a concrete base
laid over native soils and surfaced with bricks, and that concrete base has deteriorated
significantly, causing unstable conditions and potholes, and
WHEREAS, to improve the streets to accommodate the current level of use, and to render
them safer for motorists, bicyclists, and pedestrians, the City of Ithaca retained Delta
Engineers, Architects and Surveyors to prepare a proposed design for the City's
replacement of the bridge and reconstruction of the street, and
WHEREAS, on January 6, 2010, the Board of Public Works concurred with the preliminary
project scope as presented by the consultant, and
WHEREAS, in addition to the Board of Public Works, the Planning and Development Board
and Common Council are involved agencies for this project, now therefore be it
RESOLVED, That the City of Ithaca Board of Public Works does hereby declare itself as
lead agency for the environmental review of the proposed replacement of the East Clinton
Street Bridge and reconstruction of Prospect Street (which includes increased bridge and
roadway widths, changes in horizontal and vertical alignment, improvements to the Prospect
Street and Turner Place intersection, construction of continuous sidewalks, construction of
three new retaining walls, and construction of a separation island near the entrance to City
View Apartments), and requests that staff provide notice of the same to all involved and
interested agencies.

The DEC concurs with the designation of the City of Ithaca Board of Public Works as Lead Agency for
the above - referenced project.
According to location information provided in your Request for Lead Agency, it has been determined that
no NYSDEC Protection of Streams, Navigable Waters (ECL 1.5 -0501 and 15- 0505) or Freshwater
Wetlands permits will be required.
You have indicated that approximately 1.5 acres of the project site will be disturbed. Soil disturbance of
one or more acres of land from construction activities must obtain permit coverage under the NYSDEC
SPDES General Permit for Stormwater Discharges from Construction Activities (GP -0 -10 -001) by
submitting a Notice of intent and developing and implementing a Stormwater Pollution Prevention Plan.

8.213 Request for Revocable License for Use of 611 W. Buffalo Street
(by the Owners of 602 -612 W. Seneca Street)
WHEREAS, James and Antoinette lacovelli (hereinafter "lacovelli "), owners of record of the
property at 602 -612 W. Seneca Street (Tax Map Parcel No. 59- 7 -17), in the City of Ithaca,
have requested permission to use an adjacent parcel owned by the City of Ithaca (611 W.
Buffalo Street, Tax Parcel No. 59 -7 -9) in order to provide ingress and egress to a 14 -space
parking lot proposed to be constructed by lacovelli in the northwesterly corner of lacovelli's
property, to serve a 24 -unit rental complex to be constructed at that site; and
WHEREAS, the City -owned parcel is currently a parking lot intended for use by residents in
the neighborhood in its vicinity; and
WHEREAS, the parking area proposed by lacovelli would in effect act as an extension of the
City -owned parking lot, with ingress and egress to be achieved by way of a continuous north -
south aisle from W. Buffalo Street, as illustrated on a site plan map prepared by L. Fabbroni,
P. E., for "lacovelli 612 W. Seneca Apartments," dated 7/15/10; and
WHEREAS, the Superintendent has reviewed this request and does not anticipate any
conflicts in the near future, from a public works standpoint, with the proposed shared use of
the property at 611 W. Buffalo Street; and
WHEREAS, Chapter 170 of the Municipal Code of the City of Ithaca stipulates that as a
general practice the City shall receive value equivalent to fair market rent for the use of City
land by others; and
WHEREAS, while the Board of Public Works has not yet adopted a schedule of fees for such
usage, pursuant to Chapter 170, the City nevertheless has an estimate of the value,
generally, of "prime commercial highway land" (e.g., along Route 13), from a professional
appraiser retained by the City, which value (assuming a rate of return of % for the City) is
$ per square foot per year; and
WHEREAS, to provide the requested access to a parking area at the rear of 602 -610 W.
Seneca Street, lacovelli would require shared use of a corridor through the City -owned
parcel at 611 W. Buffalo Street, approximately 15 feet wide by 130 feet in length, comprising
approximately 1,950 square feet, the fair rental value of which area (not including any
improvements provided by the City) is $ /year; and
WHEREAS, vehicular use of the access aisle through the City lot, by the licensee and its
invitees, will cause additional wear and tear upon the pavement installed and maintained by
the City, as well as the adjacent sidewalk and driveway apron, which wear and tear is
estimated to represent an amortized cost to the City of $ per year; and
WHEREAS, lacovelli has offered to plow and remove snow from the shared access corridor
(on City property) during the term of the license, at lacovelli's cost, which service is deemed
to have a value to the City of $ per year; now therefore be it

RESOLVED, that the Board of Public Works hereby authorizes the Mayor, upon consultation
with the City Attorney, to sign a one -year revocable (and renewable by mutual consent)
license /agreement containing the standard terms and conditions of such licenses (where
applicable), that would permit lacovelli to use the north -south access aisle of the City -owned
parking lot 611 W. Buffalo Street for vehicular ingress and egress to and from the lacovelli
property at 602 -612 W. Seneca Street, upon its development as a apartment building,
subject to any terms and conditions of final site plan approval of the project by the City's
Planning and Economic Development Board; and be it further
RESOLVED, that the license shall be subject to an initial, annual fee of $ , which
fee takes into account the fair rental value of the City land subject to (shared) use by
lacovelli, the additional cost of wear and tear on improvements maintained by the City, and
the value to the City of lacovelli's timely removal of snow from the licensed premises; and be
it further
RESOLVED, that as part of the consideration to be provided by the licensee, lacovelli shall
be required to take responsibility, at licensee's sole cost, for the timely plowing and removal
of snow from the central access aisle of the City -owned lot at 611 W. Buffalo Street; and be it
further
RESOLVED, that a condition of the license shall be the licensee's agreement to restore the
appropriate separation and buffer between 602 — 612 W. Seneca Street and 611 W. Buffalo
Street, on the property of licensee, including a privacy fence at least six feet in height and
any required landscaping, upon the termination of the license by either party.
NOTE TO BOARD: Additional information received by the City in August from Pomeroy
Appraisal Associates (amending their original report from December 2009) provides a range
of fair rental values for "primary highway commercial land "(unimproved) in the City ( "i.e., on
Route 13, etc'), tied to the rate of return sought by the City. The rates of return in the chart
range from 7% to 13% (with Pomeroy suggesting 8% for general application).
At 7 %, the value is $0.67 1square foot/year, and $1,306 for this license.

8.5A Request for a Single Water /Sewer Connection for 519 -525 North Aurora Street —
Resolution
WHEREAS, Sue Cosentini, President of New Earth Living LLC, has requested that 519 -525
North Aurora Street be allowed to be serviced by a single water and a single sewer
connection as allowed under Section 348 -3 of the City's Water and Sewer Code, and
WHEREAS, under Section 348 -3 a single principal water and sewer service may be allowed
for a group of buildings under the same tenant occupancy, use and exclusive control upon
permission and terms granted by the Board, in lieu of independent service pipes for each
building, which is preferred and generally recommended by staff, and
WHEREAS, Commissioner Warden and staff met with Ms. Cosentini on September 3, 2010,
to review the request as well as staff concerns, now therefore be it
RESOLVED, That a single principal water and sewer service will be provided with the
understanding that these buildings are under a single ownership, with all bills and
correspondence going to a single party and that should the property be subdivided at some
future date and the buildings' ownership broken apart, then the requirement for independent
service pipes shall be reinstituted, and be it further
RESOLVED, That New Earth Living LLC shall record a copy of this resolution with the
County Clerk as it relates to the ownership requirements of the property at 519 -525 North
Aurora Street, known as Aurora Street Dwelling Circle, and that a copy of that filing will be
provided to the City as part of the application for water and sewer service to this address.

Subject: N Aurora water service update
I apologize for being so slow on this update. Anyway...
We had a meeting with Bill Grey, Eric Whitney, Sue Cosentini and myself. It went very well and it
looks like things were resolved. The issue was having one service to serve multiple houses, which has
been problematic for the city in the past. There can be issues as to who is responsible for bills and
repairs as well as there being proper access for the city to work on the lines. If there are disagreements
among the home owners, this can drag the city into a legal mess. The standard practice has been one
meter, one owner.
The simple way would be to have a separate tap for each house. Sue was asking to consolidate that in
order to save money and be more efficient. One solution was to have the main service come into the
first house with one city meter. From there, separate services could be run to the other two houses. Any
metering of this would be up to the owners, not the city. This would leave the city dealing with one
meter and one owner. If, in the future, the houses were sold and separated, they would then have to run
their own service from the street.
Eric brought up a problem with this solution. The back duplex is shown to need a sprinkler line.
Typically, a sprinkler line is separate from domestic metered water. This would require a designated
line run to the back duplex just for sprinklers. This would create a long water line with stagnant water,
since there would be no flow except for the yearly sprinkler test. This could cause contamination of the
city water system.
It was agreed that this problem overrode the other concerns. What we settled on was to leave the
existing service into the southern house with its own meter and run a new line to the back duplex
combining the sprinkler and the domestic. There will be two taps off of this line just outside the duplex,
one for each domestic service, and the sprinkler line would come into the building without being
metered. The north house would have a tap off of this line with a curb box and meter. The city would
end up with 3 meters to bill, but one owner would be responsible. If the ownership of the houses were
to be separated in the future, it would be required for the north house to have a new tap from the street
and the tap off of the main line would be capped. This would leave a separate tap off of the main and a
meter for each house.
This compromise is based on there needing to be a sprinkler line for the rear duplex. One thing that I
thought of after the meeting is that if the design changes so that a sprinkler system is not needed, that
would change the situation and we would have to revisit this.
I hope that I got this right. Bill and Eric will certainly let me know if I didn't. If there are any other
concerns that we didn't address, let me know also.

At the Board of Public Works next available meeting, New Earth Living LLC would like to have the
board consider allowing our proposed development of 2 new two- family homes, located at 519-
525 North Aurora Street, to be served by a single water and sewer connection per section 348 -3
of the city code.
The property in question will fall under a single ownership, the Aurora Street Dwelling Circle
Cooperative, a New York State incorporated housing coop. Member households of the
cooperative will be bound by cooperative bylaws which clearly define equally shared
responsibility for maintaining water and sewer lines on the property (regardless of which dwelling
unit is affected by a maintenance issue). It further defines a utility corridor on the property which
may not contain any permanent structures (such as buildings, decks, planter boxes, sheds, etc)
and which must be kept accessible to water and sewer department personnel. (see utility plan
provided).
Per discussion with the water department, each new dwelling unit within the cooperative will have
a separate shutoff valve and meter, and two of the units ( #521 & 523, which are 3 stories) will
have a shutoff valve for a fire protection system.
The primary reason for this request is to keep utility construction costs affordable, street
disruption to a minimum, and to reduce the use of resources in keeping with the Aurora Dwelling
Circle's commitment to environmental sustainabiiity.

Please find enclosed a resolution authorizing a supplemental agreement for
additional federal funding for the Cayuga Waterfront Trail. The supplemental
agreement adds $1,072,000 to the project, of which 80 or $857,000 is
reimbursable, federal -aid. The local match of 20% or $214,000 has already been
authorized by Common Council in the 2010 City Capital Budget (actually
$215,000 was authorized). Therefore, no new funds are required to add the
$857,000 of federal -aid to the project.
This federal -aid is a secondary benefit of last year's stimulus package, the
American Recovery and Reinvestment Act (ARRA). The Cayuga Waterfront Trail
did not receive any direct ARRA funds; however, Tompkins County did receive
ARRA funds for their Warren Road Reconstruction project, freeing up other
federal -aid that had been programmed for this use. Working with the Ithaca
Tompkins County Transportation Council, we were able to reprogram some of
these "displaced" funds to the Cayuga Waterfront Trail. With this expanded
budget, it looks as if we will have sufficient funds to complete Phase 3, which is
currently under construction, as well as Phase 2 of the trail based on its current,
pre-bid cost estimate. The final local cost and project budget will depend on land
acquisition costs and the actual project bids.

The problem here was one of an improperly factory programmed gear ratio in the retrofitted meter register /head. This
property had a meter head retrofit on 9/29/08. The Mastermeter retrofit had been programmed with a gear ratio of 236.39 -
turns per cubic foot, the measuring chamber was a Badger Model # 120 which has a ratio of 44.63 -turns per cubic foot. This
effects an under measurement factor of 5.2967, in other words for every cubic foot of water passing the measuring chamber
only 0.1888 -CF of water is recorded on the register. Here the corrected numbers are running below the previous 5 -6 year
historical average: Q -1 = 145 -HCF, Q -2 = 157 -HCF, Q -3 = 157 -HCF, Q -4 = 155 -HCF, Yearly Average Total = 614 -HCF. Here
are the corrected / billed numbers for 2009, (the year in question): Q -1 = 90 -HCF, Q -2 = 85 -HCF, Q -3 = 95 -HCF, Q -4 = 264 -
HCF, Year Total = 534 -HCF. So, for the year of 2009 Mr. Bilinski paid for 80 -HCF less consumption than on average over the
last 6- years.

Dear Sir,
I am writing to protest the water / sewer billing I have been trying to resolve for Several
months. Last October I received an additional charge for water / sewer in the amount of
$891.84.There was no or little explanation of the charge. I called the water department
and spoke with Eric Whitney and he told me someone would call me back with details.
No one called.
I sent a letter to the chamberlain's office seeking an explanation and they sent me back a
copy of the bill. I then contacted Barbara Frycek and she tried to explain how the meter
had malfunctioned and our account had been under billed. I don't understand how if the
meter wasn't accurate how you can bill me for additional usage. I'm not convinced we
did use more services.
The water department did state that I could protest the bill by going to the chamberlain's
office and filling out a form. I went to the chamberlain's office and was told there was no
such form and I should address my request to you.
Regardless, I request because of the city's failure to provide information regarding this
bill and the fact that it was the city's mistake that all additional charges and any
associated penalties be removed from my account. How is it fair to back bill a customer
for your mistake.

Hello Kathy & Bill,
Please note a leak notice was sent along for the quarters ending in the March 12th, June 8th, and September 8th meter
reads.
Note the consumption for this property is very uniform each quarter dating all the way back to 2003. So i summed and
averaged the consumption for each respective / corresponding quarter to the 2009 "leak" for the five previous years. The
average for the quarter ending in March was 103 -HCF, June 125 -HCF, September 122 -HCF. The difference between the
corresponding leaky quarters in 2009 and the five year average consumptions is as follows: March 52 -HCF, June 54 -HCF,
September 354 -HCF, totalling 460 -HCF. We can relatively confidently conclude that these differences where the portion that
leaked. The leak was located under ground in an area where it did not enter our sanitary sewer system. So, I would
recommend that we expunge the 2009 sewer charges to the tune of 460 -HCF @ $4.10 per HCF for sewer charge that would
amount to a dollar figure of $1,886.00. Note this figure does not account for any interest accrued on the $1,886.00, or any
other part of the outstanding bill since the owners protest. The BPW will want to figure in that too.

and she suggested that I email you once again about a water leak that I had underground at my building at
Lucatelli's Restaurant. Last year I had discovered it when I had received my water and sewer bill and also noticed
that my NYSEG bill kept increasing. The past year or so I had noticed my water bill increasing but I had just
thought that it was just a rate increase. My latest water and sewer bill 581.25 which reflects the busiest time of
year and is the lowest bill I've had in a few years, if you look up my history. The ci never contacted me about my
ater usage until after I had discQV� red it mvself,when

leak as my nyseg bill went through the roof. The city notified m with a letter on Sept. 11th 2009—aac.t -.#L_

paying my water bill's as they come in but the amount of 3 89.12 dated 9/18109 1 have not paid and the water
department is charging me interest on this amount. My SEG and water bills have gone down significantly since
the leak was repaired. This has been a tremendous ancial burden on me. Mayor Peterson I am asking for your
help in this matter as I am just a small business o erator in this community. I have been in this
restaurant business for over 25 years at this lac tion. I would truly appreciate your help in this matter as I don't
know were to turn.

The problem here was a read start decimal place (factor) error. The result were that the readings were low by a factor of
exactly 10X. This error occurred in the 12/10/08, 3/12/09, and 6/8/09 meter readings before the register was reprogrammed
correctly. So the reads were really 150 -HCF, 150 -HCF, and 130 -HCF respectively, not 15,15, and 13 as initially recorded.
Historically over the 6 years previous to 12/2008 the consumption average for the quarters in question has been: Q -1 = 113 -
HCF, Q -2 = 126 -HCF, Q -4 = 140 -HCF. So the quarters in question are 37 -HCF, 4 -HCF, and 10 -HCF higher than historical
average. However the same quarters of the last year 2009/10 are substantially higher. Q -4 (2009) = 177 -HCF, Q -1 (2010) _
150 -HCF, and Q -2 (2010) = 256 -HCF. I believe these numbers represent both increased meter accuracy and increased usage.
Bottom line the correct readings are right where one would expect judging both from recent and past historical readings.

Petition to Reduce the Excessive Water and Sewer Bill dated September 18, 2009 to Alpha Sigma
Phi Fraternity at 804 StewartAvenue, Acct #: 5002108100.
The fraternity received a copy of a memorandum from Barbara Frycek to Debra Parsons regarding
some sort of meter programming error that resulted in incorrect water and sewer usage readings (copy
attached). An additional 305 units of water and sewer usage were added to the Fraternity's bill
ostensibly to account for the incorrect readings. However, the additional charges are inconsistent with
historic water and sewer usage. Given that the water and sewer usage has been fairly consistent from
month to month over the past three years, we believe that the additional charges are in error and we are
seeking the amelioration of these excessive charges. We are attaching a spread sheet reflecting the bills
and usage over the past three years.
