Page 2 WHEREAS, the Board of Public Works passed a detailed resolution on July 8, 2009, adopting the Rebuild Option and requesting Common Council to authorize funding as needed to implement this project, and WHEREAS, Common Council passed an equally detailed resolution on October 14, 2009, adopting the Rebuild Option, which recognized the responsibility of the Board of Public Works for the improvement of the City's water system and conditioned its adoption of that option on the implementation of the mitigation measures identified in Council's findings statement, and WHEREAS, the Board of Public Works, following its review of O'Brien & Gere's proposal for the next phase of work required to implement the two previously mentioned resolutions, passed a resolution on December 16, 2009, authorizing the Mayor to sign an amendment to the current contract for Engineering Services "in order to undertake the preliminary design services that will carry the project to approximately 30% complete in the project design, as outlined in O'Brien & Gere's letter proposal dated December 11, 2009, in an amount not to exceed $375,000," and WHEREAS, to date the work authorized under Addendum IV to the current contract has been an abbreviated work program centered • water quality pilot-related activities outlined in O'Brien & Gere's letter dated January 11, 2010, with an interim budget of $200,000, and WHEREAS, the Board recognizes that other work outlined in the December 11, 2009, proposal must occur concurrently with the pilot study in order to achieve a 30% complete project design by June 2010 as shown in the "Anticipated Implementation Schedule, December 11, 2009" for the broader project, as shown by the approximately 720 hours of effort outlined in the January 11, 2010, letter and the approximately 1,810 hours in the December 11, 2009, letter, now therefore be it RESOLVED, That the Board of Public Works directs the Superintendent of Public Works to enter into the necessary addendums to the existing contract for Engineering Services in order to complete the work anticipated in the Board's resolution of December 16, 2009, with the understanding that the "not to exceed" figure of $375,000 remains, but some adjustment to the implementation schedule may be required. Page 3 3.1 Request for Sidewalk Variance for 211 Columbia Street — Discussion and Resolution WHEREAS, the owner of the property at 211 Columbia Street has applied for a street permit to build a new driveway, and WHEREAS, staff has reviewed the application, including multiple resubmissions and revisions, and has so far denied the permit due to the proposed grades of sidewalk and the driveway, which staff has found unacceptable, and WHEREAS, staff has written a memo dated March 5, 2010, further explaining why the permit has so far been denied and recommending that the Baord deny the appeal as well, now therefore be it RESOLVED, That the Board of Public Works hereby denies the appeal to build a new driveway at 211 Columbia Street. Page 4 CITY OF k l New 14850-5690 OFFICE OF THE CITY ENGINEER Telephone: 607/274 -6530 Fax: 607/274 -6587 To: Board of Public Works From: Tim Logue, City Transportation Engineer '('s6 L- Kent Johnson, Junior Transportation Engineer T Date: March 5, 2010 Re: 211 Columbia Street Driveway Request and Proposed Sidewalk Modifications We are very familiar with the request to build a driveway at 211 Columbia Street and the related, proposed sidewalk reconstruction that would be required to make the driveway useable. Kent, particularly, has spent hours with the owner, design consultant, and contractor on drawings for the street permit application to do this work. The application was submitted in November 2009. We have tried to find a way to allow the driveway to be built without compromising the grade of the sidewalk, particularly in regard to guidelines from the Americans with Disabilities Act (ADA), but have not found a way to get acceptable sidewalk grades (max. 8.3% grade allowable per ADA, Mr. Fox is proposing a 10% sidewalk grade). Additionally, we have sought feedback and recommendations from the Disability Advisory Council (DAC) and the Bicycle/ Pedestrian Advisory Council (BPAC) —they concur that non - accessible sidewalk grades should not be created along an otherwise accessible sidewalk segment. Based on the above, we have denied the street permit application and recommend that the Board of Public Works deny the request as well. We understand that the condemned house is an eyesore and a problem in the neighborhood, and we would love to see the property rehabilitated. The City's off - street parking requirement in the zoning ordinance requires that the property provide two off - street spaces (unless each of the dwelling units has 4 or more bedrooms, in which case four off - street spaces must be provided). The ordinance also requires that for an off - street lot of four or more spaces, the driveway must not be steeper than an 8% grade over the first 25 feet from the curb, however, the Superintendent has also indicated that regardless of the number of parking spaces, he is not interested in seeing the driveway apron (between the curb and the sidewalk) steeper than 8 %. In this case, there is no feasible way to provide this gradient without making the sidewalk steeper than ADA would allow or Page 1 of 2 "An Equal Opportunity Employer with a commitment to workforce diversification." c o without bending the sidewalk out of the right -of -way and into private property. In order to build the parking lot, the property either needs a zoning variance from the off - street parking requirement, a variance from our driveway apron requirements or a variance from our sidewalk requirements. We are not willing to allow a too steep sidewalk segment in order to build off street parking for two to four vehicles. ADA guidelines recommend that sidewalk grades be generally in line with adjacent street grades. This part of the block of Columbia Street does not have a particularly steep grade. Except at the ends of the block, where the street slopes down to meet Aurora Street or Hudson Place, the street probably has a slope of 5% or so. For sidewalk ramps, grades are allowed to vary between 5% and 8.3%, with the maximum length of a ramp being 15 feet. Due to the physical constraints of the property, we would recommend that the Board of Public Works deny the request as presented. It seems that the owner can make a strong hardship case for a zoning variance from the off - street parking requirement. If the owner or a tenant has a vehicle, four options for parking in that scenario would at least be: 1) use on- street parking in the neighborhood, which is a mix of 24 parking limit and odd/ even regulations; 2) acquire an easement from a neighbor to access the backyard from an existing driveway (the property next door at 213 -215 Columbia St could possibly provide access, as could the property behind at 410 -412 Hillview); 3) purchase or rent off - street parking from a property nearby (which could actually be a similar cost to building it on the property); or 4) park remotely in the Cayuga Street garage, which allows 24/7 parking with a monthly permit (it's only a four or five block walk between the two). If the Board is willing to grant the driveway, we would recommend that the owner be required to submit a construction -level grading plan for the driveway apron, sidewalk, and driveway stamped by an engineer or landscape architect licensed to work in New York State. The plan shall follow the ADA guidelines for public rights of way and keep the sidewalk to not more than an 8.3 % gradient with a four foot, flat landing area every 15 feet and with a 2% cross- slope, The grades would then be achieved by making the driveway steeper. This is likely to make a driveway on which a car will scrape its bottom or bumpers.
