WHEREAS, bids were received on January 19, 2010 for Spencer Street Slope

WHEREAS, staff has reviewed the three bids received and made recommendations for
award, and
WHEREAS, Common Council voted to amend Capital Project 746 to a total project
authorized budget not to exceed $345,774 at its meeting on February 3, 2010, now
therefore be it
RESOLVED, That the City of Ithaca Board of Public Works hereby awards the contract
for Spencer Street Slope Stabilization to:

8.2 Green Street Public Art Project — Resolution
WHEREAS, the City has been approached by the Downtown Ithaca Alliance to work
with the City's Public Arts Commission to select an artist to paint a mural on the north
face of the center bridge support under the Aurora Street Bridge over Green Street, and
WHEREAS, the Downtown Ithaca Alliance has set aside funds from its New York Main
Street Grant for this project, now therefore be it
RESOLVED, That the Board of Public Works approves the Green Street Public Art
Project in concept and directs the Superintendent to work with the Downtown Ithaca
Alliance and the Public Arts Commission to assist the selected artist during the creation
of the mural under the Aurora Street Bridge.

WHEREAS, Patricia Carlson, owner of 405 & 407 North Aurora Street, received a 2008
sidewalk assessment for sidewalk work completed adjacent to her properties, and
WHEREAS, a sidewalk defect notice for 407 North Aurora Street was sent to the owner
in 2007, and
WHEREAS, Patricia Carlson protested her assessments via letter dated February 17,
2009 and by speaking at the Public Hearing held on March 4, 2009; and
WHEREAS, a subcommittee of the Board of Public Works has met with staff and
reviewed information provided by the owner and staff regarding the appeal; now
therefore be it
RESOLVED, That the Board recognizes that City's sidewalk crew completed the
sidewalk replacement work at 405 and 407 North Aurora Street, and be it further
RESOLVED, That the Board hereby denies the request to expunge the sidewalk
assessment for 405 North Aurora Street and reduces the assessment for 407 North
Aurora Street and be it further
RESOLVED, that the new assessments, including the 25% administrative fee require4i,

9.1 Approval of Parking Policy for Persons with Disabilities — Resolution
WHEREAS, the City adopted a Handicap Parking Policy on January 12, 2000 to act as
a guideline for requests received for on- street handicap parking, and
WHEREAS, the current Handicap Parking Policy has become outdated, and staff has
met with the Disability Advisory Council to review and update the current parking policy,
now therefore be it
RESOLVED, That the Board of Public Works has reviewed and adopts the Draft
Parking Policy for Persons with Disabilities dated October 7, 2009 as department policy
for on- street disabled parking in order for staff to continue to respond to requests.

City of Ithaca Parking Policy for Persons with Disabilities
Adopted by the Board of Public Works on
Purpose: The City of Ithaca strives to provide convenient parking options for
persons with disabilities while balancing the exclusive use of such parking
spaces with the needs of the general public. To guide the provision of such
parking options, the following parking policy has been developed and adopted.
Legal Requirements: The federal rules and regulations enacted for the
implementation of Title III of the Americans with Disabilities Act and the New
York State Building Code contain accessibility requirements for places of public
accommodation and commercial facilities, including accessible parking spaces in
parking lots and parking garages. For parking areas of 1 to 25 spaces, at least one
(1) accessible space is required. The requirements index up from there, and
represent approximately two percent of the spaces. There are no requirements to
provide accessible spaces where no other parking spaces are provided or
required. There is no requirement to provide accessible spaces "on street."
City of Ithaca Provision for Off - Street Accessible Parking: The City's parking lots
and parking garages will meet at least the minimum standards set by law in all
cases. The actual provision of spaces beyond the minimum required will be
based on reasonable accommodation considering demand, cost to provide,
physical constraints, and utilization factors, among others. Spaces may be
relocated, added or reduced based on these factors and laws in effect.
City of Ithaca Provision for On- Street, Reserved Parking for Persons with
Disabilities (RPPM: The use of on- street, reserved parking for persons with
disabilities is considered a partial accommodation because the spaces generally
do not meet the requirements for accessible spaces (e.g., they do not have access
aisles or they may not be proximate to a curb ramp). The Central Business
District (and to a lesser extent other business districts, such as Collegetown and
the West End) contains a concentration of commercial and public facilities which
are not required to provide off street parking, or, consequently, accessible
parking. Municipal parking garages and lots do provide accessible parking
spaces and are reasonably distributed. However, the use of on- street, reserved
parking spaces for persons with disabilities within the areas of high parking
demand in business districts can provide a greater level of accommodation and
convenience for some persons with disabilities who do not require fully
accessible parking spaces.
For the purposes of this policy, high parking demand areas in business districts
will be taken as any area with metered parking. Since there is no requirement for
on- street, accessible parking spaces, there is no minimum number of spaces. The
actual provision of reserved spaces will be based on public requests, reasonable
accommodations and the same factors considered for off - street accessible spaces.

Spaces may be relocated, added or reduced based on these factors. Additional
consideration will be given to safety issues associated with the location and use
of the reserved spaces since they are not fully accessible spaces.
Requests for On- Street, Reserved Parking for Persons with Disabilities (RPPD)
Spaces in Residential Areas: The City of Ithaca provides on- street, RPPD in
residential areas on a very limited basis. The following criteria must be met to
consider an on- street parking space for RPPD designation:
1. The request must be accompanied by the applicant's valid proof of
permanent disability status for parking purposes recognized by New York
State in accordance with Section 1203 (a -d) of the NYS Vehicle and Traffic
Law.
2. If the applicant's (rented or owned) place of residence is capable of having
off - street parking under zoning codes, the request must include a
statement concerning the duration of the request and why a curb cut for
off - street parking is not being requested instead. If the residence currently
has off - street parking available, the request must include a statement
concerning why the applicant's accessibility needs cannot be met through
modification of the existing parking area.
The Office of the City Engineer will create an application form for requests for
on- street, reserved parking for people with disabilities. Upon application, staff
will evaluate the request. If the request meets the above criteria and if it poses no
traffic safety problem in the opinion of the City Transportation Engineer, then
the City Transportation Engineer shall forward the request to the Board of Public
Works for consideration and may include a recommendation. If the request does
not meet the above criteria or if it poses a traffic safety problem in the opinion of
the City Transportation Engineer, then the City Transportation Engineer shall
deny the request. The applicant shall have the right to appeal this decision to the
Board of Public Works in writing.
If the request is granted by the Board of Public Works, the RPPD signs will be
installed and maintained for five (5) years, at which time the request must be
renewed or the signs may be removed. If the applicant moves or if the RPPD
signs are no longer needed for some reason, the applicant shall agree to notify
the City of Ithaca within a month of the time that the RPPD signs are no longer
needed so that the signs may be removed. It should be noted that an on- street,
RPPD parking space is not reserved for the applicant or any specific person, but
is available to a person with a valid parking permit for people with
disabilities.

9.2 Adoption of the 2010 Vehicle and Traffic Schedule Update — Resolution
WHEREAS, the Board of public Works is authorized by Section 346 -4 of the City Code
to adopt and to amend a system of Schedules in order to administer the Vehicle and
Traffic Law, and
WHEREAS, the Schedules have not been published as part of the City Code in many
years because they are in need of review and updating, and
WHEREAS, the Office of the City Engineer has been carrying out this review to effect
an update, and the Board has amended a number of Schedules in the past few years,
and
WHEREAS, staff recommends to the Board that the full set of Vehicle and Traffic
Schedules be adopted, even as staff continues to review and propose amendments to
the Board of Public Works, in order to properly publish the most current set of
Schedules for use by the public and the courts, and
WHEREAS, it is noted that Article 24 of the New York State Vehicle and Traffic Law
essentially states that the traffic control devices currently in place are presumed to be
the official regulation regardless of what has been adopted on paper, now therefore be
it
RESOLVED, That the Board of Public Works hereby adopts the Vehicle and Traffic
Schedules, dated December 17, 2009, and directs staff to continue their efforts to
conform the on- street signs or devices and the schedules.
9.3 Award of Contract for Collegetown Traffic Signal Upgrade — Resolution
WHEREAS, bids were received on January 11, 2010 for the Collegetown Traffic Signal
Upgrade, CP 709, PIN 375504, and
WHEREAS, staff has reviewed the five bids received and made a recommendation for
award, now therefore be it
RESOLVED, That the City of Ithaca Board of Public Works hereby awards the contract
for the Collegetown Traffic Signal Upgrade to O'Connell Electric Company, Inc., 830
Phillips Road, Victor, NY for their low bid meeting specifications of $132,918.40.

Collegetown Traffic Signal Upgrade - Award of Contract
On Monday, January 11, 2010, five bids were opened for the Collegetown Traffic Signal
Upgrade, Capital Project #709, PIN 375504. This project will replace the signal at the
intersection of College Avenue and Dryden Road, including a number of pedestrian
improvements. Design of this project is funded by the City of Ithaca. Construction and
construction inspection is fully funded by the American Recovery and Reinvestment
Act (stimulus funds).
The total budget authorization for this project is $325,000. The budget for construction
and construction inspection is $200,000.
Staff recommends award of contract to O'Connell Electric Company, Inc., for its low
bid of $132,918.40. There is a long lead time to order the signal poles and construction
is limited to the time between June 14, 2010 and August 6, 2010.

On Tuesday, February 2, 2010, ten bids were opened for the Winter Village Trail, which
is a segment of the Six Mile Creekwalk behind the Gateway Commons buildings at 401
East State Street. This project is funded in large part through a New York State Office of
Parks, Recreation and Historic Preservation grant, written by the City's Department of
Planning and Development. The work is essentially to extend the existing stone dust
walkway, to cap the creek wall, and to fabricate and install a railing on top of the wall.
Though the original grant was written to fund approximately 400 linear feet of work,
our cost estimates led us to bid only 250 linear feet.
The budget authorization for this project is $100,000.
Staff recommends award of contract to Procon Contracting, LLC for its low bid of
$61,880. Based on the low bid, we are hopeful to extend the work back to the original
extent of approximately 400 linear feet. Once the creekwalk work is done, the property
owner will install lighting and landscaping similar to the existing adjacent to the
walkway. The City of Ithaca has an easement on the property for the creekwalk and
utilities.
