The Board of Public Works meets on the second, third and fourth Wednesdays of the months at 4:45 p.m. Al meetings are voling meetings, opening with a public comment period. November 25. 2013 8.1A 2014 Trash and Yard Waste Tau Rates — Resolution The final approved budget recommends a $.25 increase in the price of trash tags for 2014. The fee for yard waste tags will remain at $1.50 each. 8.3A A Resolution To Grant a Hardship Request for 202 Ridgedale Road under the Residential Parking Permit System Kent Johnson, Junior Transportation Engineer, received a hardship request for a residential parking permit system on Ridgedale Road. He has provided a memo explaining his recommendation, along with a resolution for the Board's consideration. 8.5A 2014 Water and Sewer Rates —Resolution The 2014 final budget approved an 8% increase in the water rate, and 0% increase for the sewer rate. A resolution is enclosed for the Board's consideration. 9.1 Appeal of License Fees for Golf Course Property and Agway Parcel Steve Flash submitted an appeal of the license fees for the use of two city -owned parcels in 2012. The Board discussed the appeals in June 2012 and May 2013. Staff has reviewed both appeals; City Attomey Ad Lavine and City Chamberlain Debbie Parsons will attend the Board meeting to present their findings and make recommendations. 9.2 Request for Encroachment Agreement for 126 -128 South Cayuga Street The owner of this property is requesting an encroachment agreement so she can continue to utilize the basement entrance for her building at the comer of South Cayuga Street and Green Street. Kathy gekring, Executive Assistant f=or rzay Senjarw.in, Acting Skpevintendemt of PkKic Works mwe✓u.ber 20, 2013 Page 2 SAA 2014 Trash and Yard Waste Tan Rates —Resolution WHEREAS, the Board of Public Works has reviewed and discussed information from the Solid Waste Division and the Chamberlain's Office regarding trash tags and yard waste tags, and WHEREAS, the Common Council has accepted the recommendation in the Mayor's 2011 Budget Narrative stating that trash tag rates should increase by $0.25 per tag, now therefore be it RESOLVED, That the Board of Public Works hereby adjusts the purchase price of the 35 lb. trash disposal tag from $3.50 to $3.75 per tag, effective January 1, 2014, and be it further RESOLVED, That the Board of Public Works hereby retains the purchase price of the yard waste disposal tag at $1.50 for each bag or bundle of not more than 50 lbs. of yard waste, effective January 1, 2014, and that these rates will stand until changed. Page 3 8.3A A Resolution To Grant a Hardship Request for 202 Ridgedale Road under the Residential Parking Permit System WHEREAS, the Board of Public Works (BPW) has promulgated regulations (adopted June 9, 2004) for implementation of the Residential Parking Permit System, which was established by Common Council on May 6, 1998 after an act of the New York State Legislature, and WHEREAS, in accordance with Section 260 -4 of the City Code and in accordance with the BPW regulations, the BPW may grant hardship requests, and WHEREAS, the Board of Public Works has received a written petition for a hardship request from the current owners of a single family home at 202 Ridgedale Road, and WHEREAS, the 200 block of Ridgedale Road is currently Odd /Even Parking and the 90 block of Ithaca Road is currently in the Residential Parking Permit System; and WHEREAS, the property in question is a single family house with a front door and walk to Ithaca Road, but a driveway and street address on Ridgedale Road and is thus not allowed to purchase permits, and WHEREAS, Engineering staff do not have an objection to granting the request, and WHEREAS, the Board of Public Works recognizes that the hardship is not self- imposed but rather results from personal health issues and the existing layout of the property, now, therefore be it RESOLVED, That the Board of Public Works hereby approves the hardship request for 202 Ridgedale Road, allowing the residents of said property to purchase permits for Residential Parking Permit System block otherwise in accordance with the above - mentioned regulations, and be it further RESOLVED, That the hardship allowance shall continue to be in effect as long as the property owners continue to reside at the dwelling, but shall be extinguished should the owners move to another residence. The residents of 202 Ridgedale Rd. (bordering the 00 block of Ithaca Rd.) have applied for inclusion into the RPPS system in place along the 00 block of Ithaca Rd. so as to better meet the medical/ mobility needs of their daughter. Details of their particular situation can be seen in their letter dated October 29, 2013. Chapter 260 of the City Code provides some limited guidance on how to handle RPPS hardship requests: § 260-4 Exemptions [Amended 6-2 -2004 by Ord. No. 2004 -91 A. Motor vehicles registered pursuant to § 404-a of the Vehicle and Traffic law shall be exempt from any permit requirement establish pursuant to this chapter. B. A resident may apply to the Board of Public Works for a permit not otherwise available pursuant to the aforementioned rules and regulations in the following circumstances: (1) Where a home health care provider provides home health care to a resident and regularly drives to the residents home. (2) Where a resident has a short-tern health emergency. (3) Where residents living on a street within the residential puking permit zone without on -street puking wish to purchase a permit for on -street parking on a street where permits are required. (4) Such other instances of hardship (excluding self - created hardship) as the Board of Public Works in its discretion determines sufficient for issuance of additional residential parking permits. For this particular application, only § 260- 4(B)(4) is relevant. From a traffic and puking perspective, I see no particular reason to deny the applicants request In fact, the residents have been using this parking location for some time and have been moving their vehicle when needed to adhere to the posted RPPS regulations. However, on occasion they forget to move their vehicle in time and receive tickets; expecting higher ticket prices soon, the residents are now motivated to address this matter. I recommend approval of the residents request to be included in the RPPS and to purchase a Residential Parking Permit; this will support thew daughter's unique medical /mobility needs, will reduce unnecessary short- distance driving, and will not result in any foreseeable traffic or parking problems for the general public. 202 Ridgedale Rd. My exact street address is 202 Ridgedale Rd. on the corner of Ithaca Rd. and Ridgedale Rd. I do have a driveway on Ridgedale Rd. The way my home is laid out makes it ve difficult for my 7 year old daughter who is diagnosed wit motor delay, weakness in the lower muscles of her egs to climb the steps from our driveway to our front entrance on Ithaca Rd. We do have a much better walkway coming from Ithaca Rd to our front entrance which we use all the time. The way the driveway steps were designed into the landscape many years ago make that entrance for our daughter impossible, especially in the fall and winter months because of ice, snow and slippery steps. It's much easier for my family to maintain and use the front entrance from Ithaca Rd. At this time, the 90 block of Ithaca Road is absent of any cars during the weekday. The alternate parking signs make it impossible to park for residents and students. If I was allowed to park on Ithaca Rd, my car would be the only car parked there most of the time during the work week. Please consider my application for a parking permit on Ithaca Rd. My family would very much appreciate it. Also attached is a copy of a letter (without attachments) I had previously delivered regarding fees charged to Marina Realty of Ithaca for the use of the "Agway" parcel. I have spoken to Debra Parsons about both of these matters. I believe there is some urgency on both just so that if there is to be a modification she can receive direction from the Board before her December I" deadline for billing. I remain hopeful that the "Agway' matter is really more ministerial and perhaps not requiring to be calendared as it was her belief that the appraisal based fee may have been removed but she just had not received that direction when that bill went out. We have continued to pay the $200 /month as well. In any event, thank you for your time and attention to these matters and if you could let me know when they are calendared that would be great. I had already appealed this back in March and this Invoice is the first I had heard that the appeal was denied. I can provide copies to the Board of my letter of March 20, 2013 appealing this same charge if necessary and ask that you return this matter to the BPW calendar as soon as possible. We had a couple of public sessions and the Board, I thought, agreed that the appraiser made the error of assuming the docks were City Property. The matter was put over for further consideration and that is the last we heard of it. We did pay the fees that were placed on our tax bill in the Interim. As I indicated in my appeal we own the docks and maintain them. Article 170 of the City Charter establishes that annual use or license fees shall be based on the appraised value "of the encroached upon land or type of land to be occupied pursuant to the permit." The permit is for land the City owns not for docks we own. The appraisal sets the fee based upon a $00.47/sq. foot value (including cpi increase). The appraisal takes into amount the nature, location and shape of the property. The appropriate fee on this basis would be $2,820.00 without any seasonal use adjustment. The discussion also indicated we were being treated differently than other users of City Property such as Commons restaurant vendors because we are paying fees based upon projected income from our docks rather than for land use. The fee for restaurants using sidewalk space is not based upon what a restaurant may charge on their menu or how many tables they may place on that sidewalk space. The result is that we are being charged a license fee to use docks that we already own. There was no vote taken at any meeting of which I was given notice. The access is located on West Green St. on the side of the building housing Pizza Aroma, 128 South Cayuga St. The actual size of the opening is 38 "w x 35" d, with a 3" border on all sides making the total area 41 -1/2 by 45 inches. 1 have no knowledge of when the access, also known as the encroachment, was constructed. It consists of metal doors covering a set of concrete steps leading to the basement of Pizza Aroma. My late husband, Serafun Nitsios, was the proprietor of the bar known as "The Ritz" before he changed that business to the pizza restaurant. He had purchased the bar business (I assume in the late 1970s) and the access was already there. At one time, there was a restaurant named "George's" in the some space, so I assume tills access existed at that point in time also although it is not drawn on the map dated October, 1953 (enclosed). The access was used for deliveries to the businesses. The current owner of the Pizza Aroma, Mauricio Rosa, uses this access and also needs it when he has his grease trap cleaned as that is the entrance for the equipment to complete that process. This past early spring of 2013, a passerby walking on Green St., reported the smell of gas coming from the building. The Ithaca Fire Department and NYSEG arrived and their way of entrance into the basement of the Pizza Aroma was via the access door. The only other entrance to this basement is through a 8ft -up door in the kitchen of the restaurant. I am currently working with the Sidewalk Department to upgrade the metal door and repair the sidewalk in that particular area Thank you for your consideration of this request Doris A.
