The Board of Public Works meets on the second and fourth Mondays at 4:45 p.m. All meetings are voting meetings, opening with a public comment period. Meeting agendas are created from prior public input, Department operating, planning issues, and requests made to the Superintendent. The Board reserves the right to limit verbal comments to three minutes and to request written comments on lengthy or complex issues. This information may then be used to create committee agendas, with the speaker or author invited to attend. Notes for BPW Agenda, August 25, 2014 3. 2015 Sidewalk Program Draft Work Plan Public Hearing- Sidewalk Program Manager Eric Hathaway has provided a draft work plan for 2015. The public will have an opportunity to make comments and suggestions regarding the work plan. The Board will discuss the work plan after the public hearing. 8.1A Temporary Construction Easement during Construction of Marriott Ithaca Hotel — Resolution The developers of Marriott Hotel (AKA Hotel Ithaca) is asking for a temporary easement so they can utilize city property, including air rights, during the construction of the hotel. A map is included. 8.2A Authorization to Use Sidewalk Improvement District Funds to make Necessary Grade Transitions to Aprons, Walks, and Driveways — Resolution The current law does not address when city crews need to make grade transitions from sidewalks to aprons, walks or driveways. This proposed language will remedy that. 8.213 A Resolution Accepting a NYSDOT Use & Occupancy Permit for the Rt 13 Pedestrian Crossings Project A final administrative task that needs to be completed before the city can advertise the project, this is essentially the same resolution the Board passed last meeting related to Cayuga Waterfront Trail. 9.1 Request for Use of City Property from the Sciencenter The Sciencenter would like to construct a new sign at the corner of First and Franklin Streets. It is a small parcel of city -owned property within the right of way. The City Forester has been asked to review the request as it would relate to maintenance of that parcel, along with the tree that currently grows there. 9.2 2014 Sidewalk Program Work Plan Design Constraints Sidewalk Program Manager Eric Hathaway will provide more information at the meeting. RA Ln o N O LO N d w v v En 0 -o in n � v x � (J gg M N �n N O CD CD 0 0 w � d A 0 q o CD C: o u d� m q 0 v H U ttr 3 0 O 00 N 11 CD v 0 O u v H 3 � au+ w 'o a d, ° H 0 r m A x 8.1A Temporary Construction Easement during Construction of Marriott Ithaca Hotel - Resolution WHEREAS, Hotel Ithaca, LLC, (Hotel Ithaca) is the developer of a proposed 159 -key Marriott Hotel at 120 South Aurora Street, Ithaca, NY, and WHEREAS, Hotel Ithaca has requested permission to use City property during the course of construction as indicated in the drawing entitled "Temporary Easement Plan" prepared by Fisher Associates, and namely for construction staging, use of a crane on City property and within the City's air rights, and installation of a shoring system, and WHEREAS, Hotel Ithaca has also requested permission to install a shoring system underneath the City's Property during the excavation and construction of the Project, with such shoring system to be installed in accordance with plans submitted and approved by the Department of Public Works, and WHEREAS, prior to completion of construction, Hotel Ithaca shall cut off and remove the shoring below the surface grade in accordance with the plans submitted and approved by the Department of Public Works, and WHEREAS, Chapter 170 of the City Code authorizes the Board of Public Works to approve temporary easements of City Property, and WHERAS, upon consultation with Department of Public Works staff, the City property is not otherwise needed for other City purposes, now therefore be it RESOLVED, That the Mayor, subject to review by the Superintendent of Public Works and the City Attorney, is authorized to execute a temporary construction easement agreement with Hotel Ithaca for the purposes of permitting construction staging, installation of a shoring system, and use of a crane on and over City property. NY 1462S 123030 1' =3d RKW Phor.e� :4 -1 ?10 8.2A Authorization to Use Sidewalk Improvement District Funds to make Necessary Grade Transitions to Aprons, Walks, and Driveways — Resolution WHEREAS, Section C- 73.13(3) of the City Charter states that "The Board of Public Works or Common Council shall not include construction or repair of driveway cuts or aprons, which shall remain the financial responsibility of the abutting property owner," and WHEREAS, for the purposes of good design and constructability, sidewalk grades and elevation may change upon replacement of public sidewalk, and RESOLVED, That the Board of Public Works hereby authorizes use of SID funds to re- establish grade transitions in existing, permitted aprons /walks /driveways as work "necessary to the construction or repair of sidewalk," and be it further RESOLVED, That such authorization is limited to those transitions in which the sidewalk work itself creates or substantially enlarges the grade mismatch, and be it further RESOLVED, That any such transition shall extend no further outside the lines of the public sidewalk being constructed than required to permit the continued permitted use of driveway and sidewalk access to the abutting property as determined by the Superintendent of Public Works or designee, and be it further RESOLVED, That no such work shall be undertaken in aprons /walks /driveways without first obtaining from the Owner of Record of the private property at issue legal authorization for said work and indemnification from any resulting liabilities, all in a form approved by the City Attorney. Page 4 8.213 A Resolution Acceptina a NYSDOT Use & Occupancy Permit for the Rt 13 Pedestrian Crossinas Project WHEREAS, a Project for the ROUTE 13 PEDESTRIAN CROSSING IMPROVEMENTS AT THIRD STREET AND DEY STREET, P.I.N. 395035, (the "Project ") is eligible for funding under Title 23 U.S. Code, as amended, that calls for the apportionment of the costs of such program to be borne at the ratio of 80% Federal funds and 20% non - federal funds, and WHEREAS, a portion of the Project is to be constructed on lands owned by the New York State Department of Transportation, who requires that the City accept a Use & Occupancy permit in order to use and occupy the lands with the Project, and WHERAS, in accordance with the City of Ithaca Charter Section 63, "The Board of Public Works may enter upon any lands for the purpose of survey and examination; may contract for, purchase and acquire, by grant, purchase, gift, condemnation or otherwise, in the name of the City of Ithaca all lands, water rights, easements, privileges and franchises and all other real and personal property whatsoever, either within or outside of the corporation limits of the City of Ithaca, which are necessary, in the judgment of the Board, for any of the purposes herein set forth and shall have the right to enter upon, take possession of and appropriate all such property and to do any and every act or thing that may be necessary to carry out the full intent and purpose of all the provisions contained in this Charter;" now, therefore, be it RESOLVED, That the Board of Public Works hereby accepts NYSDOT Use & Occupancy Permit (Permit No. 33843) for $1 Payment Waived for the occupancy of the State's lands for a portion of the Project, and be it further RESOLVED, That the Mayor of the City of Ithaca, upon consultation with the City Attorney, be and is hereby authorized to execute the NYSDOT Use & Occupancy Permit for the Project and any subsequent papers which might be required for this permit, and be it further RESOLVED, That this resolution shall take effect immediately. It is essentially the same as the one you passed last week for the Cayuga Waterfront Trail - Phase 2. This one, however, is for the Route 13 Pedestrian Crossing Improvements at Third Street and Dey Street. One of the last administrative tasks we need to complete before advertising the project for bidding is to complete a Use & Occupancy Permit for the portion of the project that crosses lands owned by NYSDOT for the maintenance facility; a map is attached. NYSDOT is willing to cover this project under the same permit as the waterfront trail, but they would like a separate resolution. The rest of the right of way for the project has been acquired. J:1Front Office Files\Forms\Use of City Property Application.doc Sciencenter To Whom It May Concern: The Sciencenter proposes to place a new sign on the corner of Franklin and I" streets. This new sign will replace our roof - mounted sign that is not visible when trees are in bloom. Because our current sign isn't visible during many months of the year including peak tourist season, visitors unfamiliar with Ithaca are unable to easily find the Sciencenter when traveling down Franklin and 1 st streets causing undesirable additional traffic in the neighborhood. This new sign will alleviate confusion among drivers by allowing them to easily find their way to our parking lot and main entrance. The proposed sign will be mounted on an attractive Llenroc stone base (please see attached illustration). The Sciencenter also proposes to excavate 12" below grade to install a loose gravel foundation for drainage and resistance to freeze /thaw cycles. The Sciencenter was recently approved by the Board of Zoning Appeals for two variances to install this sign. One variance was granted for having a second freestanding sign. The other variance was granted for placing the sign within the City's Right of Way. The Board spoke favorably about this sign and the positive impact it will have on the community and the Sciencenter.
