The Board of Public Works meets on the second and fourth Mondays at 4:45 p.m. All meetings are voting meetings, opening with a public comment period. Meeting agendas are created from prior public input, Department operating, planning issues, and requests made to the Superintendent. The Board reserves the right to limit verbal comments to three minutes and to request written comments on lengthy or complex issues. This information may then be used to create committee agendas, with the speaker or author invited to attend. Notes for BPW Agenda, August 11, 2014 7.1 2015 Budget Proposal The proposed departmental budgets are turned in for preliminary review. We will provide a binder containing the proposed Public Works budgets at the meeting. 8.2A Award of Bid for 2014 Sidewalk Improvement District Work, SID Proiect #1 — Resolution Bids will be received on Friday, August 8, 2014, for this project. An updated resolution will be provided at the meeting. 8.213 A Resolution to Apportion and to Recommend Assessment of New Sidewalk Construction Costs along portions of Cornell Street and Hancock Street A resolution and schedule of costs that will be apportioned for the new sidewalks on Cornell and Hancock Streets are enclosed. The Board had previously decided to apportion half of the costs to the adjacent property owners and half to the Sidewalk Improvement Districts. 8.4A A Resolution Accepting a NYSDOT Use and Occupancy Permit for the Cayuga Waterfront Trail NYSDOT needs a new resolution from the City accepting the permit for the Cayuga Waterfront Trail. The resolution is self - explanatory. 9.1 Advertising Waste Receptacles Proposal A group of Cornell students have submitted a proposal to install waste receptacles in Collegetown that small businesses can advertise on. This proposal is similar to the discussions that the Board held 5 -6 years ago about Tompkins Trust Company putting their logo on the clock towers on the Commons. 9.2 Proposed Updated to the 1976 Agreement with Bolton Point Bill Gray, former Superintendent, has created an updated agreement with Bolton Point that needs the Board's approval. 9.3 Panhandling in Ithaca Commissioner Jenkins would like to discuss the panhandling law that was removed from City Code and the panhandlers that have popped up throughout the city. Opportunity Employer with a commitment to worldorce diversification." 00 8.213 A Resolution to Apportion and to Recommend Assessment of New Sidewalk Construction Costs alona portions of Cornell Street and Hancock Street WHEREAS, on May 7, 2012, the Board of Public Works directed new sidewalk construction by City forces along the west side of Cornell Street, between East State /MLK Jr. Street. and Eastwood Avenue, in accordance with Uniform Sidewalk Improvement sections of the City Charter, pursuant to plans and specifications prepared by the Office of the City Engineer, and under the direction of the Superintendent of Public Works, and WHEREAS, after a recommendation from the Board, Common Council created Capital Project # 779 in the amount of $50,000 for Cornell Street sidewalk construction and associated costs, with the understanding that approximately half of that amount would be recoverable under sidewalk assessments authorized under the Uniform Sidewalk Improvement sections of the City Charter, and WHEREAS, on June 4, 2012, the Board of Public Works directed new sidewalk construction by City forces along the north and south side of the 700 block of Hancock Street, in accordance with Uniform Sidewalk Improvement sections of the City Charter, pursuant to plans and specifications prepared by the Office of the City Engineer, and under the direction of the Superintendent of Public Works, WHEREAS, the Cornell Street and Hancock Streets sidewalks were constructed by the City Department of Public Works in the summers of 2012 and 2013, respectively, and WHERAS, Common Council passed Local Law No. 3 -2013, effective January 1, 2014, in essence modifying the City Charter's policy in regard to responsibility for sidewalk construction costs, and WHEREAS, in the context of the new law, and through the adoption of the 2014 Sidewalk Improvement District budget and work plan, the Board indicated their intent to share the costs of the new sidewalk between the adjacent property owners and the newly created Sidewalk Improvement Districts, and WHEREAS on June 9, 2014, the Board held a duly advertised public hearing in accordance with Section C -89 of the City Charter, in regard to apportioning and assessing sidewalk costs for both Cornell Street and Hancock Street construction, in accordance with plans and schedules of cost prepared by the Office of the City Engineer, now therefore be it RESOLVED, That the Board of Public Works hereby approves the apportionment of costs as shown in the attached schedule of costs prepared by the Office of the City Engineer, and be it further RESOLVED, That the Board of Public Works hereby recommends to Common Council to assess such apportioned costs to the adjacent property owners in accordance with Section 89 of the City Charter. Martin Luther King Jr./ State Street (side yard abuts Cornell St.) • 10 Cornell Street • 702 Hancock Street • 710 Hancock Street • 711 Hancock Street • 622 Cascadilla Street (rear yard abuts Hancock Street). Earlier this year, in the context of forming the SID work plans and budgets, you indicated your preference to apportion half the sidewalk- related costs to the adjacent property owners and half the costs to the Sidewalk Improvement Districts (SID District 2 for Cornell Street work and SID District 3 for Hancock Street work). The SID budgets were adopted by Common Council on May 7, 2014, thus committing that funding. To begin the process to assess the other half of the new sidewalk costs, the BPW held a duly advertised public hearing on June 9th. At that time, one property owner raised some concerns about how the sidewalk area was calculated. Since then, staff has reviewed his survey, visited the location, and discussed with him how he felt the area should be calculated. After a number of exchanges, we are not able to come to an agreement. Staff feels confident in our methodology and recommends proceeding in that manner. We have notified him of our intent. To that end, please find attached a resolution approving the schedule of costs and recommending that Common Council make the assessments of costs accordingly. E §: ) \ \ \ ( k / ) e i § � kk /\ r2 8.4A A Resolution Acceptina a NYSDOT Use and Occupancy Permit for the Cayuga Waterfront Trail WHEREAS, a Project for the CAYUGA WATERFRONT TRAIL — PHASE 2, P.I.N. 395047, (formerly PIN 395024), (the "Project ") is eligible for funding under Title 23 U.S. Code, as amended, that calls for the apportionment of the costs of such program to be borne at the ratio of 80% Federal funds and 20% non - federal funds, and WHEREAS, from time to time, from June 13, 2001 to the present, Common Council has authorized Capital Project #445 (then entitled Cass Park Waterfront Trail) in the total amount of $3,633,556.37, for the costs of design, right -of -way acquisition, construction and construction inspection for the three phases of the Cayuga Waterfront Trail (Phase 1 being a two -mile loop in Cass Park, which has now been completed; Phase 2 being a two -mile segment from Cass Park to the Farmers Market, not yet completed; and Phase 3 being a two - mile segment from the Farmers Market to Stewart Park and the Youth Bureau, which has been completed), and WHEREAS, on September 28, 2004, environmental review of the proposed design for Phase 2 of the Trail was completed, by the City of Ithaca Planning and Development Board, the designated lead agency for such review, and WHEREAS, a portion of the Project is to be constructed on lands owned by the New York State Department of Transportation, who requires that the City accept a Use & Occupancy permit in order to use and occupy the lands with the Project, and WHERAS, in accordance with the City of Ithaca Charter Section 63, "The Board of Public Works may enter upon any lands for the purpose of survey and examination; may contract for, purchase and acquire, by grant, purchase, gift, condemnation or otherwise, in the name of the City of Ithaca all lands, water rights, easements, privileges and franchises and all other real and personal property whatsoever, either within or outside of the corporation limits of the City of Ithaca, which are necessary, in the judgment of the Board, for any of the purposes herein set forth and shall have the right to enter upon, take possession of and appropriate all such property and to do any and every act or thing that may be necessary to carry out the full intent and purpose of all the provisions contained in this Charter;" now, therefore, be it RESOLVED, That the Board of Public Works hereby accepts NYSDOT Use & Occupancy Permit (Permit No. 33843) for $1 Payment Waived for the occupancy within the State's right - of -way for a portion of the Cayuga Waterfront Trail, and be it further RESOLVED, That the Mayor of the City of Ithaca, upon consultation with the City Attorney, be and is hereby authorized to execute the NYSDOT Use & Occupancy Permit for the Project and any subsequent papers which might be required for this permit, and be it further RESOLVED, That this resolution shall take effect immediately. Page 5 CladNetwork Advertising Waste Receptacles Proposal CladNetwork Advertising Waste Receptacles Proposal Who We Are CladNetwork is a Cornell -based social impact startup whose mission is to make advertising accessible for small businesses. We would like to install waste receptacles with embedded electronic billboards to sell ad spots to businesses while addressing the lack of waste bins in Ithaca.' We have received $10,000 in funding from the Cornell ECE Innovation Competition.2 Proposal CladNetwork would like to place four 3 -part (trash, composting, recycling) waste receptacle units, each with an embedded digital advertising billboard3, on sidewalks in Collegetown and in the Commons. CladNetwork will take full responsibility for the waste removal from these units at no additional burden to the City of Ithaca. Design Specifications4 The advertising waste receptacle unit is a weatherproof rectangular wooden frame with an embedded 40 inch LED TV, three galvanized 31 gallon steel waste bins, three waste openings, and two waste bin access doors. The waste bins are encased in a building -code compliant pressure treated wood frame. On the backside facing the street is a 40 inch LED TV that displays electronic ads encased in a protective frame with a chemically strengthened glass panel. The front is comprised of a padlocked double door system to allow easy access to the waste bins for removal. A fiberglass panel seals the plywood roof from the elements. Waste openings on both the street and sidewalk sides allow easy disposal of waste by pedestrians on both sides. The unit - one waste bin wide and three waste bins long and one waste bin high — measures 31.5" x 37 13/16" x 72.5 ". Design features and specifications can be modified to address Public Work's specifications. Logistical Concerns Trash — The double doors facing the sidewalk will allow Waste Management Employees to quickly and easily replace the trash bags. The doors of the waste receptacle units will be locked and access given only to waste removal personnel. Maintenance — The waste receptacle is composed of all weather wood siding and a weatherproof fiberglass roof. CladNetwork will take all ownership and liabilities of malfunctions and the appearance of the waste receptacle and electronic billboard. Preventive maintenance will be addressed with bimonthly routine checks to examine the functionality and appearance of the receptacle and electronic billboard. Size — The waste receptacle unit will take as much space as existing waste receptacles. Power — The TVs within the advertising waste receptacles require electricity to operate, so the proposed locations for waste receptacles are next to potential power sources. CladNetwork would like to work with Public Utilities to connect the waste receptacles to power sources in a safe and effective manner. CladNetwork Insurance — CladNetwork intends to insure its waste receptacles from the outside weather and potential damages. Appearance and Smell — The waste receptacles are designed and built be durable and robust, addressing weatherproof, smell, and aesthetic concerns. Locations 2 Colleggtown Locations - Near the vacant Green Cafe - Outside Stella's coffee shop 2 Commons Locations - Outside the Chanticleer bar - Outside Contemporary Trends Financial Cost The City will incur no financial burden for these advertising waste receptacles. CladNetwork will assume all responsibility for installation, operation and maintenance of the units. The receptacles do require electricity, but CladNetwork will pay for electricity. These waste receptacles generate revenue from the sale of advertising spots to cover operating and maintenance costs while making a profit. Timeline Upon Notice to Proceed, CladNetwork will have substantially completed the construction and installation of the waste receptacles in the aforementioned locations within 90 consecutive calendar days. Summary CladNetwork will offer the City of Ithaca four 3 -part waste receptacle units and pay for the installation, operation, and maintenance of the receptacles in an effort to make the city greener and cleaner. The City of Ithaca will examine the possibility of acquiring power for the units, review placement of waste receptacles, and assess digital advertising on public streets. With our technology, we hope to make advertising accessible and cheap for local businesses. CladNetwork Appendix "'Concerns of Collegetown" From the Ithaca Times: David Pepin, owner of Dunbars ... spoke mainly about the lack of garbage cans in Collegetown. He noted that Collegetown is the main entranceway to the university, and with all the garbage thrown around it, it gives a bad first impression. [emphasis added] Betsy Po, owner of Po Family Realty, seconded Pepin's opinion. "[ Collegetown] is what the parents first see," she said, after complaining of Collegetown's broken meters, lack of garbage cans [emphasis added] and traffic lights that she considers inadequate. Tompkins County Legislator Nancy Schuler (D- District 4) said change is needed. "It is the entrance to the university," she said, "and we need to look at [ways to improve it]." z "Student Inventors Receive Innovation Prizes" From the Cornell Chronicle: Team CladNetwork — Brian Xu '15, Viswesh Swaminathan '16 and Nyan Gadepalli '16 — was presented with a $10,000 prize for its digital billboard system. "Unlike the conventional model, where you have to contact the advertising agency on the billboard, we built a website — and with a few clicks, any company can deploy an ad onto one of our billboards," CEO Swaminathan explained. "We're also working on an analytics engine which allows our billboards to collect real-time information about who's looking at the ads." Xu, the company's CFO, said the $10,000 will go toward creating the minimum viable product and purchase the $1,000 - per -piece boards from China. The team plans to set up a small Ithaca network of three to five boards first. "We plan to expand into a larger metropolitan city, set up a network of advertising digital billboards there, and start generating ad revenue," Xu said.
