Goodman and Paulette Rosa, who meet all the qualifications required by the Domestic Relations Law, have requested that the Town Board appoint them as Marriage Officers, therefore, be it Resolved that the Town Board of the Town of Ithaca hereby appoints William D. Goodman and Paulette Rosa as Marriage Officers for the Town of Ithaca, for which there will be no salary or wage, from the date hereof until January 1, 2020. These second meetings are commonly called study sessions which begin at 4:30 and are held in a smaller meeting room. Pursuant to the provisions of Section 284 of the Highway Law, we agree that moneys levied and collected in the Town for the repair and improvement of highways, and received from the State for State Aid for the repair and improvement of highways, shall be expended as follows: HIGHWAY: I. GENERAL REPAIRS. The sum of$185,000 shall be set aside to be expended for primary work and general repairs upon 7 miles of town highways, including sluices, culverts, and bridges having a span of less than five feet and walks or the renewals thereof. 2. PERMANENT IMPROVEMENTS. The sum of$185,000 shall be set aside to be expended for the permanent improvement of town highways, including paving, guide rails, etc. The sum of$150,000 shall be set aside to be expended for the permanent improvement of LaGrand Court to re-establish shoulders and install an asphalt overlay on 0.16 miles of road The sum of$250,000 shall be set aside to be expended for the permanent improvement of Chase Lane to re-establish shoulders and install an asphalt overly on 0.38 miles of road The sum of$650,000 shall be set aside to be expended for the permanent improvement of Perry Lane to re-establish shoulders, gutters, drainage facilities, replacement of gravels and asphalt on 0.20 miles of road Executed in triplicate this 8th day of January, 2018. TB Resolution 2018- : Authorizing Certain Expenditures by the Superintendent of Highways without Prior Town Board Approval Whereas, Section 142, Subdivision- 1(a) of the New York Highway Law authorizes the Town Board to adopt a resolution permitting the Town Superintendent of Highways to purchase equipment, tools and implements without prior approval of the Town Board in an amount or amounts to be fixed by it from time to time; and Whereas, the Town Board adopted a 2018 Ithaca Town Budget which included monies for the purchase of vehicles, tools and equipment; and Whereas, it is determined by this Board to be reasonable and proper and in the best interests of the efficient functioning of the Public Works Department that the Town Superintendent of Highways be granted permission to purchase such items without its prior approval in amounts not to exceed the approved respective budgeted amounts; now therefore be it Resolved, that the governing Town Board of the Town of Ithaca does hereby authorize the Town Superintendent of Highways to spend amounts, not to exceed what is identified within the adopted 2018 Ithaca Town Budget, without the prior approval of this Board, for the purchase during fiscal year 2018. of vehicles, tools and equipment to be used for highway maintenance, construction, reconstruction, and/or snow removal; except when the lowest responsive and responsible bidder is not selected and be it further Resolved, that the authorization hereinabove granted shall be construed as meaning that the total amount spent on each item purchased by the Town Highway Superintendent during fiscal year 2018 shall not exceed the respective budgeted amount for that item in the adopted 2018 Town of Ithaca budget. Moved: Seconded: Vote: Ayes— t wli^;)NI)D,s ORGANIZATIONAL MEETING OF THE ITHACA TOWN BOARD Monday,January 8,2018 TB Resolution 2018-xxx: Approval of Collective Bargaining Agreement with the United Auto Workers for Southern Cayuga Lake Intermunicipal Water Commission's Employees for 2018-2020 Whereas, the Southern Cayuga Lake Intermunicipal Water Commission, in good faith, entered into contract negotiations with the United Auto Workers union for a renewed collective bargaining agreement for the contract that expired on December 31, 2017; and Whereas, on December 18, 2017, the Commission's negotiating team reached tentative agreement with the union's negotiating team; and Whereas, on December 20, 2017, the employees in the union bargaining unit ratified the tentative contract; and Whereas, the Commission reviewed and approved the tentative contract at the January 4, 2018, Commission meeting; and Whereas, the Town of Ithaca Town Board has reviewed the tentative agreement and determined it to be acceptable as required by the contract and the Public Employees Relation Board; now, therefore, be it Resolved, the Town of Ithaca Town Board does hereby approve the tentative collective bargaining agreement between the Commission and UAW unit; and, be it further Resolved, the Town of Ithaca Town Board authorizes the Commission's negotiating team to sign said contract as presented. Moved: Seconded: Vote: Bolton Point-UAW Collective Bargaining Agreement for 2018-2020 Summary of Tentative Agreements 12/18/17 7.04 Stewards Negotiations—Addition of paid time for negotiations 1 hour prior to start of meeting Health Consortium-Allow 1 steward to attend Joint committee with paid time P&O Committee—Allow 1 steward to attend committee with paid time 7.05 Non-Discrimination Clean up of protected class listing. Discrimination claims will start at Step 2 of Grievance Procedure and require notification to the HR Manager under Personnel Policy to investigate. 7.07 Union Orientation- New: Allows for a Steward to meet with a new employee for hour of paid time to provide a union orientation. 12.01 Grievances Defined Additional language to include items beyond terms of agreement "any past practice, company policy and applicable laws." 16.05 Compensatory Time Update language to include MOU language regarding non-emergency overtime hours by office staff to be compensatory time not paid overtime. 16.07 On-Call ICMO's on call was changed to match Distribution staffs on call of 4pm to Sam. Article 17 Wages Wage increases established for wage scale are: 2018=2.5% 2019=2.5% 2020=2.75% Appendix 1 —new administration positions were added to the wage classification listing and positions from MOU were added. 17.01 Longevity Each 5 year increment was increased by$25. 10-14 Years- $425 20-24 years - $625 15-19 years- $525 25 years or more- $725 Article 18 Holidays Holiday list was corrected to have the day after Thanksgiving listed as such instead of 4's Friday. 18.02 Holiday Pay Floating holiday was included to be paid at overtime rate instead of being floated and taken at a later date. 18.03 Banked Holiday Time (10 hour Production emolovees) Holidays that fall outside the employees regular 4 day shift will be banked for future use. (Same as current practice) Article 19 Vacation Old vacation schedule language that is no longer applicable due to retirements was removed. 20.03 Bereavement Leave Added: Employees must use bereavement time within 30 calendar days of the date of death and will complete a bereavement leave form detailing the person, relationship, date of death and when the leave days will be used, however, employees can use days beyond 30 calendar days with approval by immediate supervisor on a case by case basis. (side note: Form can also be completed by Manager via phone conversation with employee) 21.01 Health Insurance Plan Establish that employees hired on or after 1/1/18 will only be eligible to enroll in the Platinum Plan. Clarifying language regarding the Actuarial Value of the Platinum plan and how it is established by the Health Consortium. 21.02 Health Insurance Cost Share Current PPO Health Insurance Plan 2018- 12% employee monthly premium contribution for Individual or Family coverage 2019- 13% employee monthly premium contribution for Individual or Family coverage 2020- 14% employee monthly premium contribution for Individual or Family coverage Standard Platinum Plan (employees hired prior to 1/1/2018): 2018- 8%employee monthly premium contribution for Individual or Family coverage 2019- 9% employee monthly premium contribution for Individual or Family coverage 2020- 11% employee monthly premium contribution for Individual or Family coverage Standard Platinum Plan (employees hired on or after to 1/1/2018): 2018- 11%employee monthly premium contribution for Individual or Family coverage 2019- 11%employee monthly premium contribution for Individual or Family coverage 2020- 11%employee monthly premium contribution for Individual or Family coverage 21.03 Health Insurance Buy Back Employees hired on or after 1/1/2018 will be eligible for health insurance buy back based on the individual Platinum Plan rate. Article 23 Training and Travel Update language to include MOU language agreed to that establishes Meal Breaks taken at training will be included in hours worked—same if they were at the facility working. Article 24 Uniforms and Safety Shoes Production employees will also be required to wear uniform style clothing with Name. Reimbursement increases $100 from$300 to $400 per Distribution and Production employee per calendar year. Article 26 Cell Phone Reimbursement Reimbursement increases $10 per month from$20 to$30 per month per specified employee. OF THE YEAR 2018 A LOCAL LAW AUTHORIZING A MONETARY GIFT TO THE CITY OF ITHACA TO SUPPORT CASS PARK AND STEWART PARK RECREATIONAL FACILITIES Be it enacted by the Town Board of the Town of Ithaca as follows: Section 1. Authorization. This local law is adopted pursuant to New York Municipal Home Rule Law §10(1)(i), which grants local governments the power to adopt local laws not inconsistent with the New York State Constitution or any general law, relating to their property, affairs or government. The New York State Constitution, Article VIII, §1 does not prohibit municipalities from making gifts to or in aid of public entities for public purposes. Section 2. Purpose. The purpose of this local law is to authorize the Town of Ithaca to make a gift to the City of Ithaca to support the City's Cass Park pool and skating rink, and the City's recreational facilities at Stewart Park. The Town of Ithaca intends to give the City of Ithaca Fifty Thousand Dollars ($50,000.00)in 2018 to support these facilities, which are used by Town of Ithaca residents and serve a Town of Ithaca public purpose. In exchange,the City of Ithaca will offer Town of Ithaca residents a discount on recreation programs that is anticipated to save Town of Ithaca residents approximately Thirty-Eight Thousand Dollars ($38,000). This law authorizes the Town of Ithaca to make a gift to the City of Ithaca to the extent the Town's payments to the City exceed the monetary benefit of the discounts received by Town residents. Section 3. Gift to City of Ithaca. Upon execution of a Memorandum of Understanding between the Town of Ithaca and the City of Ithaca,the Town of Ithaca is authorized to make a gift to the City of Ithaca, pursuant to the Memorandum of Understanding's terms, in the amount and for the purposes described in Section 2 above. Section 4. Partial Invalidity. In the event that any portion of this law is declared invalid by a court of competent jurisdiction, the validity of the remaining portions shall not be affected by such declaration of invalidity. Section 5. Effective Date. This local law shall take effect immediately upon its filing with the New York Secretary of State. Summary of Personnel and Organization Discussion mI)A I T�µ l Noise Permit Changes This topic came from the last Ithaca Beer permit application and questions from the public and interpretations from the board regarding a)whether the 500 feet was from the property line or the noise, b)whether multiple events could be approved as a block, and c) lining up the application to the questions in the law. In essence,this comes down to the question of whether the board wants hospitality businesses in the area. The Town is looking to add more agri-businesses and mixed uses which will entail even more normal or"natural noise for the time, place and use".... I think the noise may be more than what was anticipated during the Planning Board and Town Board process of the PDZ approval, but with more development being looked at, the time to decide is here. In looking at the City of Ithaca's permit process,they have a yearly permit for businesses where this type of noise is"usual". We are not a city so the expectations are a little different, but the concept of allowing a business to have entertainment twice a week on a smallish scale was discussed at P&O and we moved forward with that concept. Susan is still working on the final tweaks of the law, but the essence is to allow a permit to be submitted that would not have the usual details because they can't be known but would set parameters around the events. One permit covering a 6 or 12 month period for up to two events a week consisting of no more than 6 musicians,for no longer than five hours, during the hours of 12:00 noon and 9:00 p.m.with a single public hearing. What this allows is for businesses to book entertainment when they can under certain parameters/restrictions. Larger and/or more frequent events would need a separate permit and public hearing. I know from being in the industry that bookings are very often impromptu and unknown so giving details in advance to meet our requirements simply doesn't work.
