HomeMy WebLinkAboutG - 04 Treasurer's Report 08/2023August 2023 Treasurer’s Report 1. “Funds Paid into Court”: Trusts & Bail Currently all trust funds have been distributed or sent to Albany. In 2023 we sent $0 in abandoned released bail funds to Albany. In 2024 we are only sending Albany $250, $50 in 2025, and $0 in 2026. We have been unable to locate Maria Rawson or Merritt Fletcher to claim their released bail funds. Please notify these individuals that the funds are available if you know them. 2. Open Estates: Surrogate Courts handle Estates; Supreme Courts handle Real Estates. Currently I am not the Administrator of any Surrogate Court mortgage foreclosure estates. A “Summons” and “Complaint” received from the Supreme Court regarding Real Estate closes the case with the Surrogate Court but remains open with the Supreme Court. “Referee’s Report of Sale” concludes the case with the Supreme Court. Auctions for foreclosed mortgaged properties are arranged by a court appointed “Referee” (attorney) independent of our office. Surplus funds as a result of sale are considered “funds paid into court” (Trusts), transferred to the County Clerk for recording, then deposited with the Treasurer until claimed and disbursed or deemed abandoned and transferred to the NYS Comptroller in Albany. 3. Delinquent Tax Foreclosure Auction: In November a list of potential foreclosure parcels for years 2019, 2020, and 2021 was submitted to Phillips Lytle to conduct title searches, which requires ~ 90 days. The Petition of Foreclosure was filed with the County Clerk and notice mailed to property owners in February. Property owners had 90 days to enter into a Delinquent Tax Agreement with the county to make partial payments without a ~$500 title search fee added. This month an updated list of Properties was sent to Phillips Lytle, reviewed, and submitted to the Supreme Court requesting a “Judgement of Foreclosure”. The judgement was approved. Auctions International was notified and we negotiated a date for the auction: August 17 – 31. 54 properties are listed, 17 of which are estates of deceased owners. Properties can be reclaimed up to 9 business days prior to the scheduled foreclosure auction by paying in full: back taxes, fees, penalties, and accumulated interest. The number of parcels is constantly changing due to payments, installment agreements & defaults, bankruptcies, legal actions, etc… John T. Banewicz County Treasurer
