REGULAR MEETING The Regular Meeting of the Town of Cortlandville Planning Board was called to order at 6:30 p.m. by Chairman Christopher Newell. APPROVAL OF MINUTES – MAY 30, 2023 A motion was made by Member Renzi to approve the Town Planning Board Minutes of 30 May 2023, as submitted. The motion was seconded by Member Hotchkin, with the vote recorded as follows: Ayes: Chair Newell Nays: None Member Hotchkin Member Parvizi Member Renzi Member Updyke Motion carried. This becomes Action #37 of 2023. OLD BUSINESS CORTLANDVILLE PV, LLC, APPLICANT/RIC NEW YORK, LLC, REPUTED OWNER – 3023 ROUTE 215 – TM #106.00-03-13.100 - Aquifer & Conditional – The Application for – Large-Scale Solar Energy System Chairman Newell recognized Andrew Welch, Senior Project Manager from RIC New York, LLC, representing the applicant Cortlandville PV, LLC. Mr. Welch and the Board briefly discussed the proposed project while reviewing Part 2 of the Full Environmental Assessment Form. Mr. Welch informed the Board that any slopes greater than 15% would be graded to level the land, that the land had not been used as farmland in over five years, and that grass planted between the panels to absorb stormwater and dry detention ponds for any runoff would be in place. Member Parvizi asked Mr. Welch to provide a quick review of the project, which he did. Member Hotchkin asked Mr. Welsh if the trees that would be planted would be far enough away from the solar panels to avoid pine needles dropping on them and if there would be a sign with a number to call in case of emergencies. Mr. Welch answered yes to both questions. Finally, the Board and Mr. Welch discussed the twelve recommendations from the Cortland County Planning Department. (T) Cortlandville Planning Board Regular Meeting Minutes 27 June 2023 Page 2 of 3 Chairman Newell then read aloud Part 2 of the Full Environmental Assessment Form followed by Part 3 Supporting Information with the participation from the Board Members and Mr. Welch. With no further discussion, a motion was made by Member Hotchkin, that the proposed action, based on the information and analysis of the SEQR concerning this application for an Aquifer Protection District Special Permit and a Conditional Permit for the large-scale solar energy system, will not produce a significant adverse environmental impact, resulting in a Negative Declaration. The motion was seconded by Member Renzi, with the vote recorded as follows: Ayes: Chair Newell Nays: None Member Hotchkin Member Parvizi Member Renzi Member Updyke Motion carried. This becomes Action #38 of 2023. A motion was then made by Member Updyke to approve the Conditional Permit for the large-scale solar energy system, contingent on following the Cortland County Planning Department recommendations, with a recommendation to the Town Board that they issue an Aquifer Protection District Special Permit. The motion was seconded by Member Renzi, with the vote recorded as follows: Ayes: Chair Newell Nays: None Member Hotchkin Member Parvizi Member Renzi Member Updyke Motion carried. This becomes Action #39 of 2023. STEVEN HARTLEY, APPLICANT/KATHLEEN M. TUTINO, REPUTED OWNER – 1076 ROUTE 13 – TM #96.09-01-60.000 – Conditional Permit – The Application for – RV Sales Chairman Newell recognized applicant Steven Hatley. Mr. Hartley presented the Board with a revised plan, which included an updated drawing of the parking area. Member Hotchkin apprised the Board and Mr. Hartley that, with the help of Member Parvizi, she drew up a plan containing some of the things she would like to see happen pertaining to this application and property. Member Hotchkin passed out her renderings of the color scheme and green space to the Board and Mr. Hartley. The Board and Mr. Hartley discussed the number of units (RV’s) that would be parked on the lot. Mr. Hartley’s application showed fifty units. The Board’s consensus was that fifty units would be too many for the size of the lot. Mr. Hartley stated that it would not be worth it for him to proceed with the application if the Board was going to require him to have less than fifty units. Planning/Zoning Officer Bruce Weber stated that the applicant would not be required to have 10 x 20 parking spaces for the inventory, just for the staff and customers. Member Renzi asked Mr. Hartley if he would be willing to sit down with an architect and try to revise the plan to show 35-40 spaces for units and soften the view with some green space, Mr. Hartley stated yes. The Board thanked Mr. Hartley, stating see you next month. No Action Taken. (T) Cortlandville Planning Board Regular Meeting Minutes 27 June 2023 Page 3 of 3 Other Discussion Member Hotchkin asked Attorney DelVecchio if he had been in contact with anyone from Gutchess Lumber Sports Complex regarding the planting of trees. Attorney DelVecchio stated that he had not and that he would try to reach out in the next week and a half. EXECUTIVE SESSION At the request of Town Attorney DelVecchio, at 7:25 p.m., a motion was made by Member Hotchkin to recess the meeting to an Executive Session to discuss pending litigation. The motion was seconded by Member Updyke, with all Board members present voting in favor. At 7:36 p.m., a motion was made by Member Hotchkin to adjourn the Executive Session and reconvene the regular meeting. The motion was seconded by Member Updyke, with all Board members present voting in favor. No Action Taken. ADJOURNMENT At 7:36 p.m., a motion to adjourn the meeting was made by Member Renzi, seconded by Member Parvizi, with all members present voting in the affirmative. Abigail C.
