PUBLIC HEARING NO. 1 AQUIFER PROTECTION PERMIT SHAWN MALCHAK, OWNER DBA CORTLAND USED CARS 3600 ROUTE 281 TAX MAP #95.12-01-21.000 & 95.12-01-24.000 A Public Hearing was held by the Town Board of the Town of Cortlandville at the Raymond G. Thorpe Municipal Building, 3577 Terrace Road, Cortland, New York with Deputy Supervisor Guido presiding, concerning an application for an Aquifer Protection Permit submitted by Shawn Malchak, DBA Cortland Used Cars, for the purpose of replacing a current automobile sales and service building with a new 8,700 sq. ft. facility with accessory parking for 62 vehicles with additional stormwater runoff infrastructure and retention areas, for property located at 3600 Route 281, tax map #95.12-01-21.000 and #95.12-01-24.000. Deputy Supervisor Guido called the Public Hearing to order. Town Clerk, Kristin Rocco-Petrella, read aloud the published, posted and filed legal notice. Deputy Supervisor Guido offered privilege of the floor to those in attendance. Attorney Francis Casullo introduced himself as well as Tim Buhl, Engineer, who were in attendance on behalf of the applicant, Shawn Malchak DBA Cortland Used Cars, to answer any questions regarding the application. Town resident, Pamela Jenkins addressed the Board with regard to the SEQR on file for the Gutchess Lumber Sports Complex (GLSC) and the Town’s recently awarded NYS ESD Grant 135,435 in the amount of $32,500 for a planning and feasibility study. She questioned the validity of June 2017 SEQR for GLSC, the documentation, and the process claiming that SEQR was never done for the construction of the park but rather only for the land swap. She requested the Board respond to her inquiry in writing as well as to the State with regard to the grants and the SEQR documentation provided. She stated that the GLSC project violates General Municipal Law because it was not forwarded to the Town and County Planning Boards for review, adding that by not following SEQR or receiving comments from the planning boards, that only a few people are making decisions that involve taxpayer dollars. Ms. Jenkins indicated that she would email the Town Clerk her written comments for the record. Deputy Supervisor Guido offered privilege of the floor to Robert Martin. Town resident, Robert Martin addressed the Board with regard to the recent proposal to abolish the second Town Justice position and the projected cost savings to the Town. He offered examples of possible savings, including the following: the reduction of other salaries such as for the Budget Officer or the Deputy Supervisors; eliminate redundancy in park management; review the Town’s water system leakage and locate and repair leaks; consider installing a solar farm for the next phase of GLSC to generate electricity for the Town. Mr. Martin referenced the November 9, 2022 Town Board meeting in which “Supervisor Williams noted that he has been working on the financial formulation for GLSC and planned to have a report to the board soon regarding a plan for financing the project”. He asked, “What is the projected total cost for GLSC phase 2?” and “What is the plan for financing this project?” Mr. Martin provided his written comments to the Town Clerk for the record. Councilman Leach made a motion, seconded by Councilman Cobb, to receive and file the monthly report of Town Justice Mathey and Town Justice DeMarco for the month of April 2023. All voting aye, the motion was carried. Councilman Leach made a motion, seconded by Councilman Cobb, to receive and file the monthly report of the Cortland Community SPCA for the month of April 2023. All voting aye, the motion was carried. Councilman Leach made a motion, seconded by Councilman Donlick, to receive and file the monthly report of the Water & Sewer Department for the month of April 2023. All voting aye, the motion was carried. Under old business there was discussion regarding the Aquifer Protection Permit application submitted by Shawn Malchak, DBA Cortland Used Cars, for the purpose of replacing a current automobile sales and service building with a new 8,700 sq. ft. facility with accessory parking for 62 vehicles with additional stormwater runoff infrastructure and retention areas, for property located at 3600 Route 281, tax map #95.12-01-21.000 and #95.12-01-24.000. Attorney Francis Casullo, representing Cortland Used Cars briefly explained the project, mentioning that MAY 17, 2023 TOWN BOARD MEETING PAGE 3 the current building would be demolished and replaced with a state-of-the-art facility that would be safer and more environmentally friendly. He mentioned that the applications were reviewed by the Town and County Planning Boards, and that a recommendation was made to the Town Board to approve the Aquifer Permit. Attorney Casullo offered to answer any questions the Board had, to which there were none. The Board commenced their review of Part 2 of the SEQR Short Environmental Assessment Form with Attorney DelVecchio reading the questions. The Board answered no impact to small impact for all questions. RESOLUTION #167 DECLARE NEGATIVE IMPACT FOR AQUIFER PROTECTION PERMIT #2 OF 2023 SUBMITTED BY SHAWN MALCHAK DBA CORTLAND USED CARS FOR PROPERTY LOCATED AT 3600 ROUTE 281 AND AUTHORIZE DEPUTY SUPERVISOR TO SIGN THE SEQRA APPLICATION Motion by Councilman Cobb Seconded by Councilman Leach VOTES: AYE – Cobb, Donlick, Guido, Leach NAY – 0 ABSENT – Williams ADOPTED WHEREAS, an Aquifer Protection Permit application was submitted by Shawn Malchak, dba Cortland Used Cars, for the purpose of replacing a current automobile sales and service building with a new 8,700 sq. ft. facility with accessory parking for 62 vehicles with additional stormwater runoff infrastructure and retention areas, for property located at 3600 Route 281, tax map #95.12- 01-21.000 and #95.12-01-24.000, and WHEREAS, the Town Board as Lead Agent, duly reviewed and completed the Short Environmental Assessment Form, therefore BE IT RESOLVED, the Town Board as Lead Agent does hereby declare the proposed project of Shawn Malchak, dba Cortland Used Cars, Aquifer Protection Permit #2 of 2023, shall have no significant environmental impact, and it is further RESOLVED, the Deputy Supervisor is hereby authorized and directed to sign the SEQRA application relating to Aquifer Protection Permit #2 of 2023. RESOLUTION #168 APPROVE AQUIFER PROTECTION PERMIT #2 OF 2023 SUBMITTED BY SHAWN MALCHAK, DBA CORTLAND USED CARS Motion by Councilman Donlick Seconded by Councilman Cobb VOTES: AYE – Cobb, Donlick, Guido, Leach NAY – 0 ABSENT – Williams ADOPTED WHEREAS, the Cortland County Planning Department and Town Planning Board reviewed and recommended approval of this Aquifer Protection Permit application, and WHEREAS, a Public Hearing was duly held by this Town Board, and WHEREAS, the Town Board duly reviewed and completed the Short Environmental Assessment Form and declared that the proposed project of Shawn Malchak, dba Cortland Used Cars, shall have no significant environmental impact, therefore BE IT RESOLVED, the Town Board does hereby approve Aquifer Protection Permit #2 of 2023, submitted by Shawn Malchak, dba Cortland Used Cars, for the purpose of replacing a current automobile sales and service building with a new 8,700 sq. ft. facility with accessory parking for 62 vehicles with additional stormwater runoff infrastructure and retention areas, for property located at 3600 Route 281, tax map #95.12-01-21.000 and #95.12-01-24.000, subject to the following conditions from the Town and County Planning Boards: MAY 17, 2023 TOWN BOARD MEETING PAGE 4 1. The applicant must coordinate the site development with NYSDOT, including site plan, drainage report, and photometric plan. 2. That any work within the State right-of-way will require a Highway Work Permit. 3. That all collected waste fluids should be pretreated in an oil-water separator under cover and discharged to the public sewage treatment infrastructure. 4. That the applicant provides to the Town a list and quantity of all chemicals to be stored on site, including a plan of primary and secondary storage for these chemicals. 5. The applicant provide detail any plans for paint booth use, car wash or other operations including chemicals with the chemical list/storage plan mentioned above if they apply. 6. That the applicant submits to the Town a Spill Response Plan and Spill Prevention, Control & Countermeasures Plan for the facility for review and approval. 7. That the applicant consult with the County Health Department and Town regarding any approvals required for these connections and to ensure the existing connections will be sufficient. 8. That any new lighting be designed in accordance with the Design and Development guidelines outlined in Article XXIII of the Code section 178-140 (D.) (4). Any lighting for the proposed facility shall also be directed in such manner so as not to inf ringe on the neighboring properties. 9. If that applicant includes any signage either on the building or near NYS Route 281 that the signage be in accordance with the Town of Cortlandville Zoning Code Article XVIII: Signs. 10. That the applicant consult directly with SHPO under section 106 of the National Historic Preservation Act of 1966 of DHP under Section 14.09 of the New York State Historic Preservation Act to verify the site as archeologically sensitive. 11. The applicant must also file a Notice of Intent with the NYS Department of Environmental Conservation (DEC) in addition to the preparation of a stormwater pollution prevention plan for the site per the NYS Phase II stormwater regulations. 12. Compliance with SEQR requirements. AND IT IS FURTHER RESOLVED, the Deputy Supervisor is hereby authorized to sign the permit. Attorney DelVecchio reported: Town Court Cases Involving Dogs: Attorney DelVecchio briefly commented on complaints involving dogs that the SPCA becomes involved in, and situations that end up in Town court. As the Town Attorney, he mentioned that there have been a number of court cases in which the defendants do not appear in court. There is not a mechanism to force the defendants to appear; an arrest w arrant cannot be issued as there is no jurisdictional duty to do that. He stated that both he and the SPCA are doing the best they can and that it has been a frustrating process. In the event the Board receives a complaint or concern from a resident, Attorney DelVecchio informed the Board that he appeared on every case, has not been negligent, and that in more cases than not, the defendants are not appearing in court. Deputy Supervisor: Deputy Supervisor Guido requested the Board authorize the Supervisor to engage the services of Service Alert Systems Inc. to provide alarm service monitoring for the Town of Cortlandville municipal buildings and to terminate services with Doyle Security. MAY 17, 2023 TOWN BOARD MEETING PAGE 5 RESOLUTION #169 AUTHORIZE SUPERVISOR TO ENGAGE THE SERVICES OF SERVICE ALERT SYSTEMS INC. TO PROVIDE ALARM SERVICE MONITORING FOR THE TOWN OF CORTLANDVILLE Motion by Councilman Leach Seconded by Councilman Cobb VOTES: AYE – Cobb, Donlick, Guido, Leach NAY – 0 ABSENT – Williams ADOPTED BE IT RESOLVED, the Town Board does hereby authorize and direct the Supervisor to engage the services of Service Alert Systems Inc. to provide alarm service monitoring for the Town of Cortlandville for fire protection and burglar protection for the Raymond G. Thorpe Municipal Building, Peter Alteri Jr. Municipal Garage, Highway Garages, and Municipal Well Houses, and it is further RESOLVED, that service with Doyle Security is hereby terminated effective immediately. Town Board reports: Councilman Cobb reported that he visited Bell Drive to review the drainage and flooding concerns that were discussed at the last Town Board Meeting. He also reviewed the information forwarded to the Town by Ms. Abate. Councilman Cobb did not have an answer to the residents concerns at this time. As done in the past and prior to 2020, Councilman Leach requested the Board consider holding Town Board meetings in the Village of McGraw, Blodgett Mills and perhaps at the Living History Museum. Members of the Board agreed they would like to pursue holding meetings at different locations in the Town in the future. Town Clerk Rocco-Petrella explained that the Board could schedule a meeting at a different location within the Town as long as proper notice was provided. No action was taken to schedule meetings at different locations at this time. Councilman Leach updated the Board with regard to the McGraw Marching Band attending a future Board meeting to show off their new uniforms. The Director of the Band was making arrangements with the Supervisor’s Assistant, Amanda Rainbow to attend a meeting or to perhaps perform at GLSC. At this time in the meeting the Board proceeded with new business items. RESOLUTION #170 AUTHORIZE APPROVAL OF PAYMENTS (DRAW #14) REGARDING THE TOWN’S 2021 COMMUNITY DEVELOPMENT BLOCK GRANT TOWN-WIDE HOUSING REHABILITATION PROGRAM (CDBG #287HR317-21) Motion by Councilman Leach Seconded by Councilman Cobb VOTES: AYE – Cobb, Donlick, Guido, Leach NAY – 0 ABSENT – Williams ADOPTED BE IT RESOLVED, the Town Board does hereby authorize approval of payments (Draw #14) for the following regarding the Town’s 2021 Community Development Block Grant Town-Wide Housing Rehabilitation Program (CDBG #287HR317-21): Hammer & Nail Home Improvement – Payment to contractor (Coville) - $16,100.00 Thoma Development Consultants – Payment to contractor (Coville) – $1,468.40 Thoma Development Consultants – Program Delivery – $6,225.00 Thoma Development Consultants – Administration – $1,650.57 MAY 17, 2023 TOWN BOARD MEETING PAGE 6 Councilman Cobb made a motion, seconded by Councilman Leach, to receive and file correspondence from the New York State Legislative Office, dated May 9, 2023, regarding the Inter-Municipal Shared Services Mobile Stage Grant between the Town of Cortlandville, The City of Cortland and Cortland County, requesting documentation from the Town of Cortlandville in order to receive capital funding in the amount of $229,605.00 from the State and Municipal Facilities Program (SAM). All voting aye, the motion was carried. RESOLUTION #171 AUTHORIZE SUPERVISOR TO FILE AN APPLICATION FOR FUNDS FROM THE STATE AND MUNICIPAL FACILITIES PROGRAM (SAM) FOR AN INTER-MUNICIPAL SHARED SERVICES GRANT IN THE AMOUNT OF $229,605.00 BETWEEN THE TOWN OF CORTLANDVILLE, CITY OF CORTLAND AND CORTLAND COUNTY FOR A MOBILE STAGE Motion by Councilman Donlick Seconded by Councilman Cobb VOTES: AYE – Cobb, Donlick, Guido, Leach NAY – 0 ABSENT – Williams ADOPTED BE IT RESOLVED, the Town Board does hereby authorize and direct the Supervisor to file an application for funds from the State and Municipal Facilities Program (Sam) for an Inter-Municipal Shared Services Grant in the amount of $229,605.00 between the Town of Cortlandville, City of Cortland and Cortland County for a mobile stage, and it is further RESOLVED, that the Town’s Grant Writing Consultant, Mari Giurastante is hereby authorized and directed to proceed with the application process. Councilman Donlick made a motion, seconded by Councilman Cobb, to receive and file correspondence from Public Employer Risk Management Association (PERMA), from dated April 24, 2023, requesting the Town’s support with regard to two bills (S.6410, A.52A) currently before the State Legislature that would allow PERMA to continue to offer an Alternative Contribution Program (ACP). All voting aye, the motion was carried. RESOLUTION #172 ACCEPT RESIGNATION FOR RETIREMENT FROM PATRICIA R. O’MARA AS AIDE TO THE SUPERVISOR FOR THE TOWN OF CORTLANDVILLE EFFECTIVE JUNE 5, 2023 Motion by Councilman Leach Seconded by Councilman Cobb VOTES: AYE – Cobb, Donlick, Guido, Leach NAY – 0 ABSENT – Williams ADOPTED WHEREAS, after 32 years of dedicated service to the Town of Cortlandville as Aide to the Supervisor, Patricia R. O’Mara has submitted her letter of resignation for retirement, therefore BE IT RESOLVED, the Town Board does hereby accept, with deep regret, the letter of resignation from Patricia R. O’Mara as Aide to the Supervisor for the Town of Cortlandville, to be effective June 5, 2023 (last day of work is June 2, 2023), and it is further RESOLVED, the letter of resignation, dated May 9, 2023, is hereby received and filed. Councilman Leach made a motion, seconded by Councilman Cobb, to receive and file correspondence from John DelVecchio, received May 10, 2023, requesting relief for sewer charges due to a water leak at his residence (1314 Bell Drive) in which the water did not go through the Town sewer system. All voting aye, the motion was carried. MAY 17, 2023 TOWN BOARD MEETING PAGE 7 Deputy Supervisor Guido mentioned that the Town Board approved the relief of sewer charges [at the recommendation of Water & Sewer Superintendent Congdon] at the last Town Board meeting subject to receipt of the written request. RESOLUTION #173 APPROVE EASEMENT AGREEMENT FOR INGRESS AND EGRESS BETWEEN THE TOWN OF CORTLANDVILLE AND JOSEPH HAGE FOR PROPERTY LOCATED ON DAVINCI DRIVE, TAX MAP #76.14-04-03.000 Motion by Councilman Donlick Seconded by Councilman Cobb VOTES: AYE – Cobb, Donlick, Guido, Leach NAY – 0 ABSENT – Williams ADOPTED BE IT RESOLVED, the Town Board does hereby approve the Easement Agreement for Ingress and Egress between the Town of Cortlandville and Joseph Hage, for a permanent easement and right-of-way for property located on Davinci Drive, tax map #76.14-04-03.000, over, under and across the north westerly most two hundred and seventy-nine (279) square feet of the Easement Tract for a driveway, for motor vehicle and pedestrian ingress, egress and as right-of-way across the Easement Tract, and for construction, maintaining, repairing, operating and using the Easement Tract subject to the conditions and limitations of the easement, and it is further RESOLVED, the Supervisor is hereby authorized and directed to sign the Easement Agreement. MAY 17, 2023 TOWN BOARD MEETING PAGE 8 RESOLUTION #176 ACKNOWLEDGE RECEIPT OF A PROPOSED LOCAL LAW OF 2023, “A LOCAL LAW AUTHORIZING REAL PROPERTY TAX EXEMPTION FOR VOLUNTEER FIREFIGHTERS AND VOLUNTEER AMBULANCE SERVICE WORKERS” AND SCHEDULE A PUBLIC HEARING FOR JUNE 7, 2023 AT 5:00 P.M. Motion by Councilman Leach Seconded by Councilman Donlick VOTES: AYE – Donlick, Guido, Leach NAY – 0 ABSTAIN – Cobb ABSENT – Williams ADOPTED BE IT RESOLVED, the Town Board does hereby acknowledge receipt of a proposed Local Law of 2023, “A Local Law Authorizing Real Property Tax Exemption for Volunteer Firefighters and Volunteer Ambulance Service Workers”, received May 17, 2023, and it is further RESOLVED, a public hearing shall be scheduled for June 7, 2023 at 5:00 p.m., or as soon thereafter as the parties may be heard, at the Raymond G. Thorpe Municipal Building, 3577 Terrace Road, Cortland, New York, concerning the proposed Local Law of 2023. Councilman Cobb made a motion, seconded by Councilman Leach, to receive and file correspondence from the Cortland County Legislature, dated May 12, 2023, regarding a State of Emergency Declaration effective May 12, 2023 through June 11, 2023 in Cortland County regarding a housing crisis and Cortland County not being capable of receiving or sustaining any number of migrants and/or asylum seekers. All voting aye, the motion was carried. Attorney DelVecchio requested the Board meet with him at the conclusion of the meeting for an Attorney Client Privileged meeting.
