M . Board Members Present : Supervisor Donald C . Makie Councilman Ralph Wilbur Councilman Gerald Crance Town Justice Floyd Dorn Town Justice A . Francis Wright Also Present : County Representative E . J . Miller , Moses Peter , Doyle Webber , Mr . and Mrs . Harry Evelien , Kenneth Colburn , Roy Casterline , Edward Roberts , Charlotte Hautala , Sue Hautala , Rick Dobson and the Journal Reporter , and Robert Eckert . Supervisor Makie called the meeting to order . Minutes of the August meeting were approved as submitted . COMMUNICATIONS 1 . Planning Board Minutes of June 10 , 1970 .x' July 8 , and August 12 , 2 . Letter from Edward Douglas in West Danby for help in obtaining a " No Parking " sign in front of gate of residence . 3 . Memo on change of statewide speed limit to become effective 10 /1 /70 . 4 . Reminder from Civil Defense re : damage to property etc . as a result of July 3 , 1970 storms . 5 . From the Division of Assessment re : Duties of other officers to furnish information according to the laws effective 4/27 /70 . 6 . Resolution from Tompkins County re : Proper Closing of Refuse and Sites . 7 . Seminar Scheduled for town officers re : Uniform System of Accounts for Towns - August 24 and 25 . 8 . Notice from the Danby Fire District of two public hearings on the sale of the old Danby Fire House which were held on August 12 and 13 . 9 . From the Erie Tank Coating Co . quoting price on painting outside of water tank . 10 . From Acme Pest Control Co . quoting price for treatments on dump closing . 11 . From Division of Assessment re : Special District's formula needed in making the roll . 12 . From Department of Agriculture and Markets re : Appointment of Dog Enumerator for 1971 to be appointed in September . 13 . Resignation of Planning Board member John Myers , effective September 30 , 1970 . PRIVILEGE OF FLOOR None from the Board . Edward Roberts requested for another year more money be appropriated for caretaker services and that these serviceste started from the 1st of May until September 30 - - same as other state parks . This amount has been presented to the Community Council . Also , $ 200 . 00 should be set aside for topping the dike at Jennings Pond . Moses Peter suggested a follow- up letter to the Department of Transpor - tation in that no reply has been received regarding mowing along the state highways . Also , stressed the need for a town office building , with mention of some 28 acres across from the Danby Fire House on Route 96B . Roy Casterline and Ken Colburn , Water Commissioners , mreported a water line break creating an emergency . This was repaired by obtaaining a sleeve from the City of Ithaca and installed with Roy ' s machinery . Roy suggested purchasing at least three to have on hand and replacing one to the city and recommended 16- inch size . Town Board Minutes - August 17 , 1970 Sheet # 2 Robert Eckert asked about procedure on garage which he erected in a planned development district and is in violation according to the Zoning Officer . Discussion regarding understanding . Wright suggested tabling . Edward Hill presented complete plans of Mobile Park for Town Board approval . These were viewed in a ten--, minute recess . COMMITTEE REPORTS Highway - Wilbur reported that Fisher Settlement Road ( Erwin Road ) is completed . Hill Road is shaped . Deputron Hollow Road is shaped . On Beech Hill Road , Chaffee has agreed to spend 3- 5 days in repairing road . Bid opened today for new grader . ON AGENDA . Insurance - Wright did not check with Ithaca Agency that all bills have been presented to the Town . RefusevDisposal - Crance reported the question of when an attendant is on duty and how often dump is to be covered . Makie asked Crance to ask how often the dum . is to be covered . Also who oversees the clean-up on roads en route to dump . Youth - Wright - no report . Zoning - Dorn - no repot . Fire - Wilbur - no report . Cemeteries - Dorn reported discussing with Rick Dobson the shaping up of a cemetery on Peters Road . ON AGENDA . OLD BUSINESS_ Highway Superintendent absent , for a report on Highway Department . Zoning Officer absent , for a report on Zoning . Planning Board Chairman absent . Appeals Board Chairman Webber reported a hearing scheduled on September 3 on three cases . Code of Ethics - Crance has copy for reviewing . Planning Board Appointment - Two vacancies exist , with resi4nation of John Myers 9 /30 /70 . Makie reported that the Planning Board wished to choose their own chairman . Crance does not have a definite answer from a possible member in West Danby and after some discussion of filling one vacancy right now , Crance suggested to table . NW BUSINESS Planning Board Local Law No . 1 Subdivision Maps to County , Division of Assessment -- Supervisor Makie proposed to Mr . Hill that he take a copy of his Mobile Park Plan to the Assessment Department for tax parcel numbers on each lot , then to person that made the original for making the parcel numbers , lastly run off five copies as the least that are needed , plus any more as develper wants . RESOLUTION # 13 SPECIAL DISTRICT ROLL AND FORMULA Councilman Crance moved that the Tompkins County Assessment Department prepare the West Danby Water District Roll . Seconded by Wright . 5 ayes , 0 noes , carried . Makie will advise Assessment Department and reported that the water commissioners are studying different formulas for a recommendation on a a rate schedule and pottedaout to _ - the Board , information he has prepared in preparation of the board accepting or rejecting the formula , Town Board Minutes - August 17 , 1970 Sheet # 3 School on New Uniform System of Accounts for Towns - Supervisor Makie and his wife will attend the school . Dos Enumerator - Appointment to be made in September . New Savings Account Deposits - Supervisor Makie reported that the Highway bheckbook has $ 38 , 500 , $10 , 000 certificate of deposit coming due next month and with the completion of two Erwin projects , receiving $ 13 , 000 . totalling around $ 61 , 500 . Estimate spending $ 25 , 000 until end of year , therefore should deposit $20 , 000 -$ 30 , 000 in a Certificate of Deposit . Board in agreement and Makie will take of . RESOLUTION # 1k PURCHASE OF NEW GRADER , HIGHWAY DEPARTMENT Councilman Wilbur moved that the Town of Danby purchase a new grader for the Danby Highway Department for the sum of $ 31 , 195 . 00 with method of payment to take $ 11 , 195 . 00 from Surplus Funds and borrowing $ 20 , 000 . 00 from Tompkins Counth Trust Company with the first full payment being February 15 , 1971 . Seconded by Dorn . Roll Call Vote : Makie - aye Crance - aye Wright - aye Wilbur - aye Dorn - aye Planning Board Recommendations - Makie moved to accept the Planning Board ' s recommendations as submitted in their minutes of June 10 , July 8 , and August 12 , 1970 . Seconded by Wright . 5 ayes , 0 noes , carried . Edward Douglas letter re : cars parking on road in front of residence - Discussion . Makie will call the sheriff ' s department . Acme Pest Control Rat Control Treatment - Makie will call Carl Foote Sr . that any committment is pending Board of Health authorization . Chairman of Planning Board - On agenda for September meeting . Jennings Pond - Request for dike repair , custodial work , oiling the road and Makie added more definite cleanup which was never completely finished when constructed . Makie has talked with the Chairman of the Community Council asking that they talk with the Finger Lakes State Parks Commissioners to use a drag line on this swimming area as they do Buttermilk Falls swimming area in the spring . Dike Repair - cost to come from Contingency Fund . Oiling the Road - Parks Commission should do this . Route 96B follow- up letter - Makie will also ask that the ditches be cleaned out lower than the culverts . Town Office Building - Rick Dobson offered land on Route 96B to the Town for an office building . Board to look at at 7 : 00 P . M . Wednesday , August 19 . South Danby Cemetery - Dorn moved to hire Rick Dobson to smooth off and be seeded the South Danby Cemetery for the sum of 5230 . 00 . Seconded by Wright . 5 ayes , 0 noes ', carried . { ti Town Board Minutes - August 17 , 1970 Sheet # 4 F Change of Resolution on Purchase of old .nby Fire House - In the original motion that the Town decided to purchase the old Fire House , it was included that there be a referendum the same time the Fire Commissioners do . Now it is understood , the 'Fire Commissioners dd5not have to have a referendum if the Town buys it . Wilbur feels that the people should have the decision as to how the money is spent , therefore there should be a referendum . Table until September meeting . Youth Program - General discussion on the lifeguard situation at Jennings Pond . Wright recommended that Donald Burdick and Mrs . Cynthia Colman from the Community Council meet with the Town Board at the scheduled meeting for Wednesday , 7 : 30 P . M . August 19 . General Fund Bills - Wright moved to pay General Fund Bills # 69 through # 76 as listed on Warrant 8 totalling $326 . 85 . Seconded by Crance . 5 ayes , 0 noes , carried . Highway Fund Bills - Wilbur moved to pay Highway Fund Bills ## 67 through # 72 as listed on Warrant 8 totalling $ 620 . 50 Water District Bills - Crance moved to pay Water District Bills # 13 through # 14 as listed on Warrant 8 totalling $ 525 . 80 .
