HomeMy WebLinkAboutB - 02 Town Board Minutes 07/05/2023 JULY 5, 2023 5:08 P.M. TOWN BOARD MEETING The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Raymond G. Thorpe Municipal Building, 3577 Terrace Road, Cortland, New York with Supervisor Williams presiding. Members present: Supervisor, Thomas A. Williams Councilman, Jeffrey D. Guido Councilman, Jay E. Cobb Councilman, David J. Donlick Councilman, Gregory K. Leach Town Clerk, Kristin E. Rocco-Petrella Others present: Deputy Town Clerk, Abigail Albro; Andrew Welch, Project Manager for RIC Development, LLC. Others present via Zoom video/telephone conference: Assistant to the Supervisor, Amanda Rainbow; and News Reporter: Kevin Smith from Cortland Voice. Supervisor Williams called the Regular Meeting to order. Councilman Leach made a motion, seconded by Councilman Guido, to approve the Draft Town Board Minutes of June 7, 2023 and June 21, 2023. All voting aye, the motion was carried. Councilman Leach made a motion, seconded by Councilman Guido, to receive and file the Cortlandville Planning Board Minutes of January 31, 2023 and February 28, 2023. All voting aye, the motion was carried. There was a brief discussion regarding payment of the bills. Councilman Guido noted that he did not yet review the bills but would do so after the meeting. Councilman Leach asked for future discussion regarding the Town’s agreement with HR One for human resource services, noting concerns regarding the monthly charges including mileage. Supervisor Williams agreed that a future conversation could be had regarding a possible replacement for services. RESOLUTION #215 AUTHORIZE PAYMENT OF VOUCHERS – JULY Motion by Councilman Leach Seconded by Councilman Cobb VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the vouchers submitted have been audited and shall be paid as follows: Funds A, B, DA, DB, Voucher #891-951 HG, SF, SS, SW General Fund A $ 111,282.51 General Fund B $ 2,010.43 Highway Fund DA $ 0.00 Highway Fund DB $ 169,714.36 Gutchess Lumber SC Project HG $ 94,940.33 C’Ville Fire District SF $ 0.00 Sewer Fund SS $ 4,256.08 Water Fund SW $ 11,058.23 Funds CD1, CD3, CD4 Voucher #(None) BMills Rehab CD1 $ 0.00 Town Wide Rehab CD3 $ 0.00 Business Devl CD4 $ 0.00 Funds TA, TE Voucher #18-20 Trust & Agency TA $ 56,021.30 Expendable Trust TE $ 0.00 RESOLUTION #216 ACCEPT 2022 ANNUAL REPORT OF THE CORTLANDVILLE POST-CONSTRUCTION STORMWATER MAINTENANCE INSPECTION PROGRAM Motion by Councilman Cobb Seconded by Councilman Leach VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED JULY 5, 2023 TOWN BOARD MEETING PAGE 2 BE IT RESOLVED, the 2022 Annual Report of the Cortlandville Post-Construction Stormwater Maintenance Inspection Program, as prepared by Cortland County Soil and Water Conservation District, dated June 28, 2023 is hereby accepted and shall be filed in the Town Clerk’s office. RESOLUTION #217 ACCEPT 2023 TAX COLLECTOR’S SUMMARY Motion by Councilman Cobb Seconded by Councilman Leach VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the 2023 Tax Collector’s Summary as submitted by Town Clerk/Collector Kristin E. Rocco-Petrella for the period of January 1, 2023 through July 1, 2023, is hereby accepted and shall be received and filed. Councilman Leach made a motion, seconded by Councilman Donlick, to receive and file the New York State Agriculture and Markets Dog Control Officer Inspection Report for the Cortland Community SPCA completed on May 19, 2023, dated June 22, 2023, in which the DCO services were rated “Satisfactory”. All voting aye, the motion was carried. Councilman Leach made a motion, seconded by Councilman Donlick, to receive and file the New York State Agriculture and Markets Municipal Shelter Inspection Report for the Cortland Community SPCA completed on May 19, 2023, dated June 22, 2023, in which the dog shelter services were rated “Satisfactory”. All voting aye, the motion was carried. Councilman Leach made a motion, seconded by Councilman Guido, to receive and file the following monthly reports: 1. Water & Sewer Department – June 2023; 2. Town Clerk – June 2023; 3. Code Enforcement Officer, Kevin McMahon – June 2023; and 4. Fire & Safety Inspector, Desiree Campbell, CEO – June 2023. All voting aye, the motion was carried. Councilman Cobb made a motion, seconded by Councilman Leach, to receive and file correspondence from Charter Communications, dated June 28, 2023, regarding programming services. All voting aye, the motion was carried. Under new business, Town Clerk Rocco-Petrella reminded the Board that the ceremony for the South Cortland Cemetery marker unveiling would be held on Sunday, July 9, 2023 at 1:00 p.m. Through a grant from the William G. Pomeroy Foundation, a historic marker was placed at the Cemetery to honor at least two veterans of the Revolutionary War. She encouraged members of the Board and the community to attend the ceremony. Attorney DelVecchio had no new business to report, however he requested an Attorney- Client privilege meeting at the end of the meeting. He did not expect any action to be taken as a result of the meeting. Supervisor Williams reported: Emergency Purchase of a Pump – Water/Sewer Department: Supervisor Williams informed the Board that at the end of last week one of the main water pumps in the Walden Oaks PUD broke. Water/Sewer Superintendent Congdon made an emergency purchase of a pump for approximately $13,000 to resolve the problem. Supervisor Williams indicated that the invoice and purchase order would be provided to the Board at a future date. JULY 5, 2023 TOWN BOARD MEETING PAGE 3 Walking Trail at Town of Cortlandville - Terrace Road Property: Supervisor Williams presented a map of the Town of Cortlandville’s property on Terrace Road surrounding the Raymond G. Thorpe Municipal Building and Peter Alteri Municipal Garage, as prepared by former Water/Sewer Superintendent Alteri. The Board discussed the proposed trail several years ago; however, the plans were delayed with the disruption of the Covid-19 pandemic. Supervisor Williams asked the Board if there was still interest in moving forward with the plan. He explained that Highway Superintendent Drach was on board with the project; paving was almost complete for the 2023 season so his staff would have an opportunity to work on the project. Supervisor Williams stated that there would be little expense to the Town, and that suggested that in the future benches and a gazebo could be added. Councilman Guido indicated that several of his constituents would be happy to use the walking trail. The Board was in favor of proceeding with the walking trail as depicted on the proposed map provided by Supervisor Williams. No formal vote was taken. Councilman Guido made a motion, seconded by Councilman Leach, to receive and file correspondence from New York State Department of Environmental Conservation, dated June 27, 2023, regarding the Periodic Review Report Response Letter for the South Hill Dump in Cortlandville. All voting aye, the motion was carried. Councilman Cobb made a motion, seconded by Councilman Guido, to receive and file correspondence from Andrew Welch, Project Manager for RIC Development, LLC, dated June 1, 2023, responding to the thirteen items that were recommended by the Cortland County Planning Board regarding the application of Cortlandville PV, LLC for a five megawatt ground mounted large scale solar energy system for property located at 3023 Route 215, tax map # 97.02-01-25.000. All voting aye, the motion was carried. Attorney DelVecchio commented that the applicant, Cortlandville PV, LLC (RIC Energy) did a good job complying with the Town’s solar law and the Cortland County Planning Board recommendations. RESOLUTION #218 SCHEDULE PUBLIC HEARING FOR AN AQUIFER PROTECTION PERMIT APPLICATION SUBMITTED BY CORTLANDVILLE PV, LLC FOR JULY 19, 2023 AT 5:00 P.M. Motion by Councilman Leach Seconded by Councilman Guido VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, a Public Hearing is hereby scheduled for July 19, 2023 at 5:00 p.m. at the Raymond G. Thorpe Municipal Building, 3577 Terrace Road, Cortland, New York, concerning an Aquifer Protection Permit application submitted by Cortlandville PV, LLC, for the purpose of developing a five megawatt ground mounted large scale solar energy system, accessory access driveway, and security fencing encompassing approximately 33.0+/- acres, for property described as 3023 Route 215 in the Town of Cortlandville, tax map #106.00-03-13.000. Councilman Guido made a motion, seconded by Councilman Cobb, to receive and file correspondence from New York State Department of Environmental Conservation, dated May 16, 2023, regarding the Cortlandville Solar Jurisdictional Determination Request. All voting aye, the motion was carried. RESOLUTION #219 AUTHORIZE SALARY INCREASE FOR AMANDA K. RAINBOW, AIDE TO THE SUPERVISOR FROM $45,768.00 TO $55,658.00 EFFECTIVE JUNE 7, 2023 Motion by Councilman Cobb Seconded by Councilman Guido VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED JULY 5, 2023 TOWN BOARD MEETING PAGE 4 WHEREAS, per Town Board resolution #184 of 2023, adopted June 7, 2023, Amanda K. Rainbow was appointed as the Aide to the Supervisor to fill the vacant position, therefore BE IT RESOLVED, the Town Board hereby authorizes a salary increase for Amanda K. Rainbow, Aide to the Supervisor, from $45,768.00 to $55,658.00, effective June 7, 2023. RESOLUTION #220 RESOLUTION TO BE PAID DIRECTLY ALL OF TOWN’S SHARE OF COUNTY SALES TAX Motion by Councilman Cobb Seconded by Councilman Donlick VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED WHEREAS, New York Tax Law Section 1262 allows municipalities to apply a portion of their Sales Tax against the Property Taxes levied upon real property in that municipality, and WHEREAS, the Town of Cortlandville requests that the Cortland County Legislature apply $0.00 (zero dollars and zero cents) of Sales Tax to be utilized in the reduction of the County Tax levied against Real Property, with the amount requested in this resolution divided by 4 and that $0.00 quarterly amount be deducted from the County quarterly sales tax distribution as per agreements with the County related to Sales Tax Distribution, with any remaining funds available in Sales Tax payments paid to the Town of Cortlandville, and be it further RESOLVED, that pursuant to New York Tax Law Section 1262, this resolution shall be effective commencing with calendar year 2024, and be it further RESOLVED, that the Town of Cortlandville Town Clerk shall forward a Certified Copy of this Resolution to the Cortland County Treasurer and the Cortland County Real Property Tax Office by Registered or Certified Mail before September 1, 2023. RESOLUTION #221 AUTHORIZE EXPENDITURE OF AN ADDITIONAL $65.00 PER WEEK TO CASELLA WASTE MANAGEMENT TO PROVIDE AN EXTRA TRASH PICKUP PER WEEK AT THE GUTCHESS LUMBER SPORTS COMPLEX DURING THE MONTHS OF JUNE, JULY, AND AUGUST Motion by Councilman Guido Seconded by Councilman Cobb VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED WHEREAS, per Town Board Resolution #137 of 2023, adopted April 5, 2023, the Town Board awarded the bid for trash removal services to Casella Waste Management to provide services for the Town of Cortlandville, and WHEREAS, per Recreation Director McNerney and Highway Superintendent Drach, an additional trash pickup per week is necessary at the Gutchess Lumber Sports Complex during the months of June, July and August, therefore BE IT RESOLVED, the Town Board hereby authorizes the expenditure of an additional $65.00 per week to Casella Waste Management to provide an extra trash pickup per week at the Gutchess Lumber Sports Complex during the months of June, July and August. RESOLUTION #222 ACCEPT RESIGNATION FROM JULIE M. GROSS, REAL PROPERTY ASSISTANT FOR THE TOWN OF CORTLANDVILLE ASSESSOR’S OFFICE, EFFECTIVE JULY 19, 2023 Motion by Councilman Leach Seconded by Councilman Donlick VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED JULY 5, 2023 TOWN BOARD MEETING PAGE 5 BE IT RESOLVED, the Town Board does hereby accept the letter of resignation from Julie M. Gross as Real Property Assistant for the Assessor for the Town of Cortlandville, to be effective July 19, 2023, and it is further RESOLVED, the Town Board wishes Ms. Gross the best in her future endeavors, and it is further RESOLVED, the letter of resignation dated June 28, 2023 is hereby received and filed. Councilman Leach made a motion, seconded by Councilman Cobb, to receive and file correspondence from John Mendzef of 11 Grace Street, Cortland, dated June 28, 2023, regarding solar energy systems and other topics. All voting aye, the motion was carried. With no further business to be heard, Supervisor Williams adjourned the Regular meeting.
