TOWN BOARD MEETING The continuation of the Regular Meeting of the Town Board of the Town of Cortlandville, recessed from June 21, 2023, was held at the Raymond G. Thorpe Municipal Building, 3577 Terrace Road, Cortland, New York with Supervisor Williams presiding. Members present: Supervisor, Thomas A. Williams Councilman, Jeffrey D. Guido Councilman, Jay E. Cobb Councilman, David J. Donlick Councilman, Gregory K. Leach Town Clerk, Kristin E. Rocco-Petrella Others present: Deputy Town Clerk, Abigail Albro; Highway Superintendent, Larry Drach; Recreation Director, John McNerney; Town Residents: Robert Martin; Pamela Jenkins; News Reporter: Jacob Mack from the Cortland Standard; and News Reporter: Kevin Smith from Cortland Voice. Others present via Zoom video/telephone conference: Assistant to the Supervisor, Amanda Rainbow. Supervisor Williams called the continuation of the Regular Meeting to order, which was recessed on June 21, 2023. Councilman Guido made a motion, seconded by Councilman Cobb, to approve the Draft Town Board Minutes of May 3, 2023. All voting aye, the motion was carried. Councilman Guido made a motion, seconded by Councilman Cobb, to receive and file the Cortlandville Planning Board Minutes of May 30, 2023. All voting aye, the motion was carried. Councilman Guido made a motion, seconded by Councilman Cobb, to receive and file the Cortlandville Zoning Board of Appeals Minutes of May 30, 2023. All voting aye, the motion was carried. Supervisor Williams offered privilege of the floor to Robert Martin Town resident, Robert Martin commented on three items involving the Gutchess Lumber Sports Complex (GLSC). First, Mr. Martin commented that the ribbon cutting was held for GLSC Phase 2, however per the Management Agreement with PBR Tournaments the following items were not complete: food, beverage and other merchandise vendor facilities; restroom facilities; one or more buildings to host tournament operations/umpires; and maintenance facility. He commented on the operational aspects of the agreement in which he said that PBR will manage the scheduling and operation of all events associated with the baseball fields year-round. It was his understanding that Recreation Director McNerney continues to do the scheduling. Mr. Martin commented on the costs and financing of GLSC. He asked what PBR is paying the Town, referencing Exhibit D of the agreement which provided for a monthly payment of $18,166.66 to cover Phase 1 capital expenses. He asked about the actual costs of Phase 2, which he stated were about $4.5 million but estimated at $750,000 to $1 million. He asked what the labor and material costs for work done by the Highway Department are. Mr. Martin referenced the Town Board Minutes from November 9, 2022, which read, “Supervisor Williams noted that he has been working on the financial formulation for GLSC and planned to have a report to the Board soon regarding a plan for financing for the project.” He also asked the following questions: “What is the projected total cost for GLSC Phase 2?” and “What is the plan for financing this project?” Mr. Martin commented on the non-baseball facilities for use by the community, for which references are made in the Management Agreement and the new Community Hub project. The non-baseball facilities include a bocce ball court, volleyball courts, pickle ball courts, horseshoe pits, several walking/running trails. He stated, “so far, not much has been done. There is a steep coarse mulched trail downhill without any trail signs that connects to a Lime Hollow Trail. A bocce ball court with artificial turf has been fabricated. It has no amenities, like benches. The perimeter around has not been filled in and presents a trip hazard. Does Cortlandville have a bocce ball set for the public to use?” Mr. Martin provided photos of two bocce courts: 1. Cortlandville; 2. A “more professionally done court”. The final topic Mr. Martin commented on was the Community Hub at Cortlandville, which he stated was a “very costly ten-acre parking area”. He suggested that the project scope needs further definition and clarification. He mentioned that he went to GLSC this past Tuesday in which there were a number of games being played. He stated that parking was an issue. While the “overflow” was empty, cars were parked on the grass and “sticking out in the entrance driveway”; JUNE 28, 2023 TOWN BOARD MEETING PAGE 2 a possible concern for emergency vehicles if needed. He asked if the event being held was a PBR event and asked who manages the parking. Supervisor Williams thanked Mr. Martin for his comments. Councilman Cobb made a motion, seconded by Councilman Donlick to receive and file the following monthly reports: 1. Town Justice Mathey and Town Justice DeMarco – May 2023; 2. Fire & Safety Inspector, Desiree Campbell, CEO – May 2023; and 3. Cortland Community SPCA – May 2023 (Revised). All voting aye, the motion was carried. Town Board reports: Councilman Leach suggested the Town Board authorize the closure of Carroll Street for the duration of the Cortland County Jr. Fair, which would be held July 4-8, 2023. Supervisor Williams suggested the road be closed from the evening of July 3rd through July 9th. Councilman Leach would reach out to Mr. Bush with the Cortland County Jr. Fair Board to inform him of the road closure. Councilman Donlick mentioned that there were shows over the weekend as well. The extended closure of the road, if necessary, would be coordinated by Highway Superintendent Drach. RESOLUTION #209 AUTHORIZE “TEMPORARY CLOSURE” OF A SECTION OF FAIRGROUND DRIVE AND CARROLL STREET FOR THE 2023 CORTLAND COUNTY JR. FAIR Motion by Councilman Leach Seconded by Councilman Cobb VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED WHEREAS, a request was made by Councilman Leach to authorize a “Temporary Closure” of a section of Fairground Drive and Carroll Street during the 2023 Cortland County Jr. Fair, and WHEREAS, the temporary closure will not prohibit emergency vehicles access to Fairground Drive or Carroll Street, and WHEREAS, the Town Highway Superintendent has reviewed and approved the temporary closure, therefore BE IT RESOLVED, the Town Board does hereby authorize a “Temporary Closure” on a portion of Fairground Drive and Carroll Street, being the “corner” where the two roadways connect, from July 3, 2023 through July 9, 2023 for the 2023 Cortland County Jr. Fair, and it is further RESOLVED, signage for the temporary closure shall be provided by the Cortland County Fair Board. Councilman Donlick was pleased to announce that his daughters Annika and Elsie Donlick, along with their team members George Andrew Jr. and Gabrielle Taylor from Wayne County, attended the Holstein Dairy Knowledge Quiz Bowl held in Lexington, Kentucky at the National Holstein Convention and left the convention as the National Champions. The Board applauded the team for their performance and asked Councilman Donlick to invite the team to the August 16, 2023 meeting to be congratulated, which he stated he would do. Supervisor Williams reported: Town Board Meeting to be held at Living History Center: Supervisor Williams recalled that prior to 2020, the Town Board held meetings at different locations within the Town, such as the Blodgett Mills Independent Baptist Church, the McGraw Community Building, and at the Cortland County Jr. Fair. Councilman Leach reached out to the CNY Living History Center – Brockway Museum and secured the date of August 16, 2023 at 5:00 p.m. to hold a board meeting at the location. JUNE 28, 2023 TOWN BOARD MEETING PAGE 3 Electric Easement Needed for Electric Vehicle Charging Stations: Supervisor Williams requested authorization to execute an electric easement between the Town and Niagara Mohawk Power Corporation (National Grid) and Verizon New York, Inc. which was necessary in order to run the electric needed for the installation of the electric vehicle chargers at the Raymond G. Thorpe Municipal Building and at the Peter Alteri Municipal Garage. The easement was previously reviewed and approved by Attorney DelVecchio. Supervisor Williams explained the placement of the charging stations to those in attendance. RESOLUTION #210 AUTHORIZE SUPERVISOR TO EXECUTE ELECTRIC AND TELEPHONE EASEMENT AGREEMENT BETWEEN THE TOWN OF CORTLANDVILLE AND NIAGARA MOHAWK POWER CORPORATION (NATIONAL GRID) AND VERIZON NEW YORK, INC. FOR PROPERTY LOCATED AT 3577 TERRACE ROAD AND 3587 TERRACE ROAD Motion by Councilman Donlick Seconded by Councilman Leach VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the Town Board hereby authorizes and directs the Town Supervisor to execute the Electric and Telephone Easement Agreement between the Town of Cortlandville and Niagara Mohawk Power Corporation (National Grid) and Verizon New York Inc. for p roperty located at 3577 Terrace Road and 3587 Terrace Road (tax map #96.09-02-03.100), for the purpose of installing electric vehicle charging stations at the Raymond G. Thorpe Municipal Building and Peter Alteri Municipal Garage. RESOLUTION #211 AUTHORIZE SUPERVISOR TO SIGN THE AFFIDAVIT REGARDING THE TOWN’S 2021 COMMUNITY DEVELOPMENT BLOCK GRANT TOWN-WIDE HOUSING REHABILITATION PROGRAM (CDBG #287HR317-21) BETWEEN THE TOWN AND GEORGE R. MOWRY AND LORI L. MOWRY Motion by Councilman Leach Seconded by Councilman Cobb VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the Town Board does hereby authorize the Supervisor to sign the Affidavit regarding the Town’s 2021 Community Development Block Grant (CDBG #287HR317-21) Town- Wide Housing Rehabilitation Program, between the Town of Cortlandville and George R. Mowry and Lori L. Mowry, 3238 S. Cortland-Virgil Road, Cortland, New York regarding the extension of loan funds from the Town’s CDBG Program, for the total amount of $21,737.80. RESOLUTION #212 AUTHORIZE SUPERVISOR TO MAKE APPLICATION FOR FUNDING THROUGH CONGRESSIONALLY DIRECTED SPENDING REQUESTS TO THE OFFICE OF SENATOR CHUCK SHUMER AND CONGRESSMAN MARC MOLINARO IN THE AMOUNT OF $6,680,665.00 FOR THE “COMMUNITY HUB” AT CORTLANDVILLE – A 10-ACRE OARKING AREA AT THE GUTCHESS LUMBER SPORTS COMPLEX Motion by Councilman Cobb Seconded by Councilman Guido VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the Town Board hereby authorized and directs the Supervisor to make application for funding through Congressionally Directed Spending Requests to the offices of Senator Chuck Schumer, and Congressman Marc Molinaro in the amount of $6,680,665.00 for “The Community Hub” at Cortlandville. The project will consist of a multi-purpose ten-acre parking area adjacent to the Gutchess Lumber Sports Complex. JUNE 28, 2023 TOWN BOARD MEETING PAGE 4 Councilman Leach made a motion, seconded by Councilman Guido, to receive and file the Cortland County Planning Department Review and Recommendations, dated May 12, 2023, regarding the Aquifer Protection Permit application of Triple Cities Holdings, LLC for property located at 3772 US Route 11 in the Town of Cortlandville, tax map #97.02-01-25.000. All voting aye, the motion was carried. Councilman Leach made a motion, seconded by Councilman Cobb, to receive and file Cortland County Planning Board Resolution No. 23-14, dated May 17, 2023, regarding the Aquifer Protection Permit application of Triple Cities Holdings, LLC for property located at 3772 US Route 11 in the Town of Cortlandville, tax map #97.02-01-25.000. All voting aye, the motion was carried. Councilman Guido made a motion, seconded by Councilman Cobb, to receive and file the Cortland County Planning Department Review and Recommendations, dated May 12, 2023, regarding the Aquifer Protection Permit application of Cortlandville PV, LLC for property located at 3023 Route 215 in the Town of Cortlandville, tax map #106.00-03-13.100. All voting aye, the motion was carried. Councilman Guido made a motion, seconded by Councilman Donlick, to receive and file the Cortland County Planning Board Resolution No. 23-15, dated May 12, 2023, regarding the Aquifer Protection Permit application of Cortlandville PV, LLC for property located at 3023 Route 215 in the Town of Cortlandville, tax map #106.00-03-13.100. All voting aye, the motion was carried. Councilman Cobb made a motion, seconded by Councilman Guido, to receive and file correspondence from Cortland County Soil & Water Conservation District to Planning/Zoning Officer Bruce Weber, dated June 21, 2023, regarding its review of the proposed Cortland Chrysler Dodge Jeep, Inc. project for property located at 3878 Route 281 in the Town of Cortlandville. All voting aye, the motion was carried. RESOLUTION #213 ADOPT THE TOWN OF CORTLANDVILLE PARKS VENDING/FOOD TRUCK APPLICATION AND AUTHORIZE RECREATION DIRECTOR TO MANAGE THE APPLICATIONS Motion by Councilman Guido Seconded by Councilman Cobb VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the Town Board hereby adopts the Town of Cortlandville Parks Vending/Food Truck Application and authorizes Recreation Director, John McNerney, to manage the applications. Councilman Leach made a motion, seconded by Councilman Donlick, to receive and file correspondence from New York State Department of Taxation and Finance, dated June 14, 2023, regarding the Certificate of Final Special Franchise Full Values for the 2023 assessment roll. All voting aye, the motion was carried. RESOLUTION #214 ACKNOWLEDGE RECEIVING NOTICE OF PETITION FOR REVIEW OF ASSESSMENT Motion by Councilman Cobb Seconded by Councilman Guido VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the Town Board does hereby acknowledge, by receiving and filing, the Notice of Petition from BRE Rook SH Walden Place LLC, for property located at 839 Bennie Road in the Town of Cortlandville, tax map #105.00-02-03.000, regarding their current assessed valuation of real property.
