HomeMy WebLinkAbout1970-07-13 TOWN OF DANBY TOWN BOARD MINUTES July 13 , 1970 The regular meeting of the Town Board of the Town of Danby was held at the Danby Town Hall , July 13 , 1970 , at 8 : 00 P . M . Board Members Present : Supervisor Donald C . Makie Councilman Ralph Wilbur Councilman Geral Crance Town Justice Floyd Dorn Town Justice A . Francis Wright Also present : Ernest Cole , E . James Miller , Eino Johanson and James Willard from Beech Hill Road , John Myers , Rick Dobson , residents from Brosn Road off Route 96B . Supervisor Makie called the meeting to order . Minutes of the June meeting were approved as submitted . COMMUNICATIONS 1 . Planning Board Minutes of February 11 , 1970 , March 24 , April 8 , and May 13 , 1970 . 2c Letter from Com . of Public Works Howard Stevenson that the State will not furnish forms for inventory of Highway' Tools and Equip- ment --town should prepare its own inventory . 3 . 1970 Chac ' es in Explosives Licensing Law . 4 . Notice from County Civil Defense re : emergency water supply equipment . 5 . Letter from Carl Foote , Sr . re rat control treatment . 6 . Resolution No . 152 from the County re : Authorizing the Exchange of Approach Roads in the Immediate Vicintiy of Sanitary Landfill Refuse Sites No . 1 and 3 . 7 . Memo from Commissioner of Health Robert Broad re : Closure of Disposal Sites . 8 . Memo from Commissioner of Health Robert Broad re : Closure of Unapproved Dumps , enclosing information concerning rat poisoning . 9 . Letter from Donald Ryan , Finger Lakes State Parks Commission , enclosing change sheet to be attached to revocable license dated July 12 , 1965 ; and continued use until April 1 , 1975 . PRIVILEGE OF FLOOR Ernest Cole who represents the Towns of Caroline and Danby on the County Water Agency , spoke on Agency collaborating former studies and come up with eventually , a proposal for water supply county wide -- either county-wide authority or regional authority , how to organize this and get it under way and how to finance it , Councilman Wilbur favors the West Danby Water District to be included in the water agency study . County Board Representative Miller stated that they met that day and if there are any questions , he will be glad to answer them . Eino Johanson from Beech Hill Road asked that their road be fixed up and gravelled . Residents from Brown Road protested Rick Dobson renaming his private road to Dobson Road . This is a private road , therefore does not come under town jurisdiction , and will have to be taken care of personally regarding the opposition . COMMITTEE REPORTS Highway - Wilbur reported that regarding the county resolution , has the information which Chaffee has recommended . ON AGENDA . Would like to investigate funds available for a new grader . ON AGENDA . Erwin Roads - Chaffee suggests not to program any Erwin Roads for 1972 . ( Already programmed for 1970 and 1971 ) .. Beginning in 1972 , the state will reimburse._a.t>c- the rate of of $ 18 , 000 . 00 per mile and there is the possibility that anything programmed will have to be completed at the present $ 9 , 000 . 00 state reimbursement per mile instead of $ 18 , 000 . 00 . Just finishing the 1969 Erwin Roads . • 1 Town Board Minutes - July 13 , 1970 Sheet #2 Highway report - continued Fisher Settlement Road - Gravel is all there , it is topped , only needs stabilizing and ditches shaped up and will be ready for an inspection . Deputron Hollow Road - Pipe is in , working on in spare time . Residents are happy with progress . Clsing of the Town Refuse - Chaffee has ordered a sign that dump is closed and directing people to new entrance to the sanitary landfill . Wilbur has suggested to Chaffeee that he keep close track of all the cost for covering , fencing , sign •for old dump in case at a later date might possibly be funds reimbursed retroactive . Also that some letters be writeen to possibly Assemblywoman Constance Cook and Congressman Howard Robison asking what towns do in this situation- -when the state says a dump will be closed- -where do these funds come from ? This should not come from the Highway Fund- - should be a General Fund expenditure but there is no available money . Water District - Crance reported tank has been painted inside and everything back in operation . Insurance - Wright had no . report . Makie asked Wright to check with Ithaca Agency as to whether the town has been presented with all the insurance bills for year 1970 . Refuse Disposal - Makie reported that he had on the agenda to discuss town cleanup . Youth - Wright reported that he attended the last meeting of the Community Council and very impressed with the way Mrs . Hatfield and Mrs . Oltz are handling the funds - -they are following the town ' s procedure . Wright did offer a challenge that more people become involved in the program . Zoning - Dorh asked that John Myers present this report under the Planning Board report . Fire - Wilbur reported that in talking with Chairman of the Fire Commissioners Clyde Carrier , it is believed that the referendum for the sale of the old fire house is held up pending a public hearing , but some doubt as to the majority of the public wanting a public hearing . ON AGENDA . Cemeteries - Dorn reported that Mr . Slights is doing a fine job . Will check into more cemeteries being uncovered . OLD BUSINESS Highway' - Chaffee absent . Zoning Officer absent but do have his monthly report . Planning . Board - Chairman John Myers reported that at their June meeting the following items were discussed : 1 . Planning Board voted not to accept the proposal from LaBerge for their assistance in acquiring recreation land because a specific dollar andoents costs were not given . 2 . Edward Hill is securing the assistance from an individual familiar with Mobile Park Development . 3r. Dobson proposal incomplete for any Planning Board action . `. Blatchley and Street proposal was voted and approved upon but that he resubmit drawings with boundaries more clearly defined . Makie asked Miller if he would find out what has to be filed for county' purposes . Appejls Board - Chairman absent . Closing of Town Dump - Town of Spencer is in agreemet with sharing costs of covering old dump . Chaffee told Makie he has put up a temporary fence while working and also temporary sign . Miller stated that the county is drawing up a resolution that any violators using the former dumps will be fined $500 . 00 . Town Board Minutes - July 13 , 1970 Sheet # 3 Closing of Dump - continued REOLUTION #11 CLOSING OLD DANY DUMP Councilman Wilbur moved that the old Danby Dump be officially closed on July 20 , 1970 . Seconded by Wright . 5 ayes , 0 noes , carried . Makie will write to the Sheriff of this resolution and to patrol the road . Recreation Area in West Danby- Makie feels that there is need for recreation land in West Danby Board in agreement , after much discussion , to . have the Planning Board concentrate on a site in West Danby for recreation . Gerald Crance to attend their meeting scheduled following Wednesday . NEW BUSINESS Adopt a Code of Ethics - Must be adopted by December :°31, 1970 and filed with the state comptroller . Each board member to study a lengthy bulletin on adopting a Code of Thies . Dorn received the copy . Appointment of a Budget Officer - Supervisor Makie stated that he will continue to serve as Budget Officer . Board in agreement . Town Cleanup of road approaching county landfill site - Makie asked the Board ' s reaction should the county expect the town to clean up the road approaching the sanitary landfill with some reimburse - ment . Board in agreement not to take on any more responsibility other than town roads and leave open for more cooperation and discussion . City of Ithaca Youth Program - Wright reported that a meeting he attended , there had been some talk that the people in the city wanting more money from the towns in running the youth programs - - they are not getting enough money from the United Fund . Board in agreement NOT TO PURSUE . Exchange of Roads with County - Wilbur reported that Chaffee recom- mends that the town exchange East Miller Road from Route 96B east to Nelson Road for all of Hillview Road including the southern end of Michigan Hollow to the County Line . RESOLUTION # 12 EXCHANGE OF ROADS WITH COUNTY Councilman Wilbur moved that the town exchange East Miller Road from Route 96B East to Nelson Road ( 1 . 86 miles ) for all of Hillview Road including the southern end of Michigan Hollow Road to the County Line ( 2 . 20 miles ) . Same roads to be changed back should sanitary landfill be terminated . Seconded by Councilman Crance Roll Call Vote : Supervisor Makie w aye Councilman Wilbur - aye Councilman Crance - aye Justice Wright - aye Justice Dorn a aye Town Clerk ' s Office - The need for a town clerk ' s office has become more pressing , but Makie 4ecided this needed q a committee and could not discussed now and to quote from tape , " pending the sale of the old fire house and your cnnections , Ralph , you would be the logicalflo be on it " . No mention of who is chairman ! Asked for a volunteer , which is Wright so supervisor said he would meet with Wilbur , Wright , and clerk ! New Adding Machine - Makie says new adding machine is badly needed , old one is adding wrong . Makie will look into purchase of an electric adding machine and call at least two board members . Town Board Minutes - Jury 13 , 1970 Sheet # 4 Planning Board Appointment - Dorn moved , that the Planning Board recommends the reappointment of Rick Dobson to the Planning Board . No second . Motion lost . Coundilman Crance said he would like to see someone from West Danby on the Planning Board . Tabled until the next meeting . Crance to look for membership from West Danby . Beech Hill Road - Wilbur to talk with Highway Superintendent Chaffee II/ about general repair of Beech Hill Road , widening and replacement of sluiceways , etc . Policy for Accepting Roads by the Town - Policy has been established that for the town to accept a road it must meet Erwin specifi - cations . A person may still have a Planned Development which could be approved and still not have a road that meet Erwin specifications . No reason to change this policy . Purchase of New Grader - Councilman Wilbur reported that Chaffee has asked that Town Board consider purchase of a new grader . This involves the following : a . Wilbur has looked at old grader and astonished at condition , very bad and has a lot of mileage . b . tandem type grader, nevi would cost approximately $ 32 , 000 . 00 . c . Some discussion of keeping old grader , but Wilbur feels to be of any good , needs four to five thousand dollars spent on it , then would only do for a year or two . d . Trade - in value approximately $ 6 , 000 . 00- -not a realistic figure because if one is bought outright , no problem to get 5% discount , possibly more . e . Method of financing : May buy the grader and not have to borrow the money until 1971 . The first payment will be in 1972 and this could be the repair money Meeting scheduled for July 20 , 1970 at the Highway Barns withe Highway Superintendent and salesman . Also try to discuss Erwin Roads for 1972 . Sale of Old Fire House — Wilbur moved that the clerk send a letter to the Fire Commissioners strongly favoring their holding a public hearing before any referendum on the sale of the old fire house . Seconded by Wright . 5 ayes , 0 noes , carried . General Fund Bills - Crance moved to pay General Fund Bills # 60 through #68 as listed on Warrant 7 totalling $ 744 . 40 . Seconded by Dorn . 5 ayes , 0 noes , carried . Highway Fund Bills - Wilbur moved to pay Highway Fund Bills # 53 through # 66 as listed on Warrant 7 totalling $ 2 , 718 . 38 . Seconded by Wright . 5 ayes , 0 noes , carried . Water District Bills - Wright moved to pay Water District Bills # 11 through # 12 as listed on Warrant 7 totalling $ 94 . 00 . Seconded by Dorn . 5 ayes , 0 noes , carried . Supervisor ' s Report - Wilbur moved to accept the Supervisor ' s Report . Seconded by Wright . 4 ayes , 0 noes , carried .
