M . Board Members Present : Supervisor Donald C . Makie Councilman Ralph Wilbur Councilman Gerald =Crance Town Justice Floyd Dorn Town Justice A . Francis Wright Also Present : Highway Superintendent Alfred Chaffee , Zoning Officer Gordon Roberts , and Moses Peter , Mrs . Joseph Short , Rick Dobson , Gary Vincent and Board Representative Miller . a. Supervisor Makie called the meeting to order . Minutes of the May meeting were approved with the following correction : Crane report on West Danby Water District was that in the Street and Blatchley housing development , anything over seven houses would need. 7 inch pipe in extending the water district and under seven houses - - 3 inch pipe . COMMUMICATIONS No Planning Board Minutes . 1 . From Commissioner of Health of Tompkins County re : Tenination of Existing Open Dumps . 2 . From Board of Representatives - Resolution # 118 To Clarify Appointments to County Sewer Agency and Term_) of Appointments . 3 . From Chamber of Commerce re : Removal of abandoned cars by Autosalvage . 4 . From County Highway Department - Copy of letter sent to Miss Adams re . mailbox. : 5 . Notes from Zoning Officer Roberts , May 1970 . 6 . From County Assessment Department . - Filing of Town Assessment Roll , Local Review Days , Meeting of the Local Assessment Review Board . 7 . Copies of letters regarding interior paint system deterioration of water tank . 8 . From Danby Community Council , Executive Committee asking that the Town Board repair roof and paint exterior of the Town Hall . PRIVILEGE OF FLOOR None from the Board . Moses Peter asked that the Board place on the agenda , the subject of beautification regarding the lack of care of the state right - of -way on Route 96B . As yet it has not been mowed and the state did assure the property owners when they acquired the right - if4'way that they were in a <position to maintain it . Some of the banks are not movable because of wahouts . It would be in the Town ' s interest to send a letter to the Department . of Transportation asking them by what criteria they establish priority for highway maintenance . Mrs . Short much in favor , also . Rick Dobson objected to all of Maycumber ' s cars around his residence on Route 9)6B , referring to it as a junkyard . '' Zoning Officer reminded if off the pavement , it is alright, but one wheel on the pavement Roberts will get a clarification of the law . COMMITTEE REPORTS Hiqhway - Chaffee reported doing some dust oiling on dirt roads and work on Erwin Projects --putting culverts in , removing stumps and hedges . Salesmen was in and said they had the parts in for the shovel but too busy to come right then , but do have the clutch shaft so can be run . Check received and given to Supervisor for damage to shovel amounting to $1 , 393 . 89 , Have done some sluicepipe work on Deputron Hollow Road . Wilbur added that from the conversation with meeting with Howard Stevenson , there has alFays been a problem with Town Board Minutes - June 8 , 1970 Sheet # 2 Highway ( continued ) Wilbur added that from the conversation in meeting with Howard Stevenson , Commissioner of Public Works , it is his understanding that if a town is drawing state aid on a road and someone builds a house , they can demand the road be fixed but in Lieberman ' s situation , we are not drawing any state aid- -do not consider that a :;town road . Only roads looked over at road tour were the drive by Lieberman ' s and Deputron Hollow road . Wright added that County official have looked over Grant Road which runs off of Hillview Road . West Danby Water District - Crance reported that a morning meeting which Compagni wanted with Town Board could not be scheduled . Needle valve on oil cup is still not working properly . Refunds for property owners in the water district on the agenda and a sordiscuss further -meeting with Compagni ; , Insurance - Wright - no report .. Refuse Collection &' iDisposal - Crance - no report . Youth .- Wright reported that he contacted Harold Bernhardt , Town Constable , who does police Jennings Pond as a community interest . Has not contacted Community Council or does not know how summer program is coming along . Zoning - Dorn - no report . Fire - Wilbur - no report . Crance added that he believes that there will be a public hearing regarding the sale of the old fire house plus where the money is - to go . Cemeteries - Dorn reported that he has talked with Ed Roberts regarding the BoytScouts doing some work as a community project . OLD BUSINESS VESS . Highway Superintendent ' s report - covered under Committee reports . Zoning Officer ' Report - Clerk read under Communications notes : Mr . Dobson is still in violation with his 3 trailers on lots on Brown Road and has been sent a violation notice dated 3 /20/70 , to remove on or before 4/30/70 . Trailer still remains . Roberts feels that since Mr . Dobson is applying for a Planned Development which would include this property in violation , he should , at this time , hold further processing until the Town Board hears the recommendation of the Planning Board and rules on Dobson ' s application . However , if proper information is not made to the Planning Board , within a reasonable time , other action will be taken . Brewster said he would take care of junk cars on his property . Two trailers on lots in the town--Yaple Road- -Mr . Hanson is fixing trailer and will move it and on Brown Road- - Maycumer is fixing to be resold . , Planning Board - Chairman absent . Discussion of the tax on the churches in the West Danby Water District : _ Wright receommended that a copy of the Supervisorts Monthly Report of the Water District be given to the Water Commissioners . Also , that the water commissione be advised by Makie , to review the water district budget , that /I§ up to them to make recommendations to the Town Board regarding water rates and advalorem tax ; NEW BUSINESS Road by the County Sanitary Landfill - An informal meeting with Commissioner of Public Works , Howard Stevenson revealed the suggestion that the County take over Hillview Road which is a Town Road and give to the Town , Bald Hill Road which is a County Road . This would put the town in an unfavorable position and not fair to the Town placing a burden on the Danby taxpayers as Bald Hill Road neecb rebuilding . Town Board is not interested in any road mileage swap ! Michigan Hollow Road has been posted . County Representative Miller reported that he told Stevenson at the Board of Representatives meeting all trucks should come off of route 96 and rebuild the 8/10 of a mile to the landfill . Chaffee estimated about $ 1 , 000 . 00 a month during the summer to grade and oil Hillview Road . Board in agreement for a. ,recommsndation from the Highway Committee to the County Board of Representatives on maintenance of Hillview Road . Miller to contact Howard Stevenson and Frank Liguori . Closing Dump Costs - Miller reported it will be up to the Health Committee to recommend something . There is a possiblity for sharing the costs with the towns . Wilbur recommended that the highway superintendent survey the situation at the dump and come up with an adequate estimate for closing such as cost of trucks , cost of hauling fill , bulldozing., dostiHof t:an.= aadequatet fence and sign , Makie to check on rodent control . Wright will contact Constable Harold Bernhardt to police closed dump for violators . Makie to write Sheriff ' s Department regarding dump being closed and to police area . Town Board Minutes - June 8 , 1970 . Sheet # 4 Town Stationery - Wright recommended that the Supervisor be authorized to purchase town stationery with an appropriate heading . Laberge Letter - Clerk read ]Otter regarding courtesies extended to Mr . Homeyer and Mr . Laberge during discussions of June 3 , 1970 relative to the development of Park and Recreational facilities to serve the Town of Danby , outlining , procedures in obtaining assistance . Also a resolution to be filled out should town follow through . Comments from Board : Wright : The further we go away from home to spend - our money , the less we get back-- bothered by total cost , not initial cost . Wilbur : Very reluctant to the piece of property in mind--tieing in with nothing more than a five - year license on a State Park„ If they took our license --where would ae be with the recreation area ? Votes no to the thought of bonding the Town of Danby for 40 years on a 5 -year revocable state license . Questions , alsolthe aOreage . Possibly land elsewhere in the Town , with more acreage -- something could be done with water situation , for swimming . Regarding West Danby Water area , there is need for recreational land . Crance : Agrees with Wilbur , feels land is needed in West Danby , but should go to the landowner first --possibly get two or three II/ options - -then ask engineer which is suitable . Dorn- - Should present this to the Planning Board and carried through right away . Not wait until July Town Board- for their answer . Wright : Agrees with Wilbur . Wilbur : Feels we need engineer ' s help on acquiring options for land--make recommendations on what land is good . Dorn to take tor-the Planning Board . Dorn has copy of Laberge letter . New Town Accounting Books - Supervisor stated with the new coding system adopted by the state , the present books are absolete , therefore asked to purchase new accounting books . Wright moved that the Supervisor be authorized to purchase new account books to carry out the duties as fiscal:': officer . Seconded by Dorn . 5 ayes , 0 noes , carried . Appeals Board Appointments - Two vacancies to be filled and one expiration June 30 , 1970 . W ilbur moved to appoint Doyle Webber to another term on the Board of Appeals expiring June 30 , 1975 , and to serve as chairman . S econded by Dorn . 5 ayes , 0 noes , carried. -, Wilb : moved to appoint Milton Todd a member of the Board of I. Appeals to fill the unexpired term of Reginald Nelson , to serve until June 30 , 1972 . Seconded by Crance . 5 ayes , 0 noes , carried . Wright moved to appoint Moses Peter a member of the Board of Appeals to fill the unexpired term of Mrs . Senja Radcliffe , to serve until June 30 , 1971 . Town Board Minutes - June 8 , 1970 Sheet r25 Planning Board Appointment expires June 30 , 1970 - Dorn to check with the Danby Planning Board for a recommendation . to fill the term which expires . Meeting to move on letter from Laberge - Scheduled for June 17th , 8 : 00 P . M . , Town Hall . To Hall Roof Repair and Painting Exterior - Board . in agreement to get estimates as fa' cost : , to base a budget - r% '-f are on . Wright will obtain an estimate . Makie will call Hush Barlow . Any other possible estimates; to be obtained . Zoning Officer ' s Recommendation in his report - Board in agreement to accept the Zoning Officer ' s recommendation regarding Dobson ' s violation with trailers on Brown Road . Beautification of State Highway - Wilbur recommended that Makie write to the District Engineer questioning the maintenance of the state right -of-way on Route 96B . Water District meeting with Compagni - Crance to set up a meeting with -Water Commissioners and Compagni regarding interior of water tank . Discussion of Building Permits - Wilbur questional the people who start building in the Town and do not obtain a building permit first . Zoning Officer said he had put an article in inJtheADanby , areatzatt Possibly a news item in the Ithaca Journal would help . There are provisions for a fine , which if imposed , would make persons get a building permit 11/ before starting to build , The Town Justice may write out a summons . General Fund Bills - Torn moved to pay General Fund Bills #50 through #59was listed on Warrant 6 totalling $ 375 . 85 . Seconded by Wilbur . 5 ayes , 0 noes , carried . Highway Fund Bills - Wilbur moved to pay Highway Fund Bills #46 through #52 as listed on Warrant 6 totalling $ 3 , 716 . 92 . Seconded by Wright . 5. • ayes , 0 noes , carried . There were no Water District Bills . Supervisor ' s Reports - Wilbur moved to accept the Supervisor ' s Reports . Seconded by Crance . 4 ayes , 0 noes , carried . Meeting adjourned at 11 : 15 P . M .
