The regular meeting of the Town Board of the Town of Danby
was held at the Danby Town Hall , Monday , May 111, 1970 at 8 : 00 P . M .

Supervisor Makie called the meeting to orders Minutes of the
regular meeting in April were approved as submitted .

PRIVILEGE OF FLOOR
Mrs . Marvel Hatfield , President of the Community Council !e questions
which arose at the last meeting of the Danby Community Council
and asked for Town Board action :
Gravelling and fine stone needed fa' beach area at Jennings Pond .
Whose job is it to clean weeds out of pond .
Caretaker suggested driveway be oiled to the pond plus parking area .
There is not enough money in their budget for caretaker , who uses
own mower and gas .
Question whether the Council would gain anything by charging a fee
to enter the pond .
Would it be possible to have a counter across the road leading into
the . pond .
Many people do not like idea of charging members in the town each time
they enter the parkeethe 50 ¢ fee .
Possibly the town could issue stickerseefor $ 1 . 00 - ®to each taxpayer
and at the season charge the the nonresident ® ®then who is to
maintain this . If it comes back to the Communicty Council ,
would it be advisable to charge Fridays . Saturdays , and Sundays ,
for a certain fewe ... probably cost $ 8000 to $ 10 . 00 per day to
pay someone to collect the fees , and own opinion is that the
pond does not warrant this .

Would like more definite answers as duties of maintenance of the pond
for the summer as to caretaker and policing .
County Representative Jimmy Miller mentioned County takereover
of refuse disposal — site locations on edge of Danby in Town of Spencer ,
almost in Seneca County , Town of Enfield and West Dryden .
Wilbur asked if any provisions have been made for the County to
take over maintaining the Town of Danby road which is Hiliview Road
and will be extensively travelled to the Darby location .
Miller has not heard about this . Wilbur stated that Liguori
has been put on notice and also Howard Stevenson .
Mr . Miller will follow this through with Mr . Stevenson .

Representatives of the Baptist and Methodist churches in West
Danby - told the Town Board they would like consideration that they
do not have to pay the advalorem water tax which Was billed their
churches • in March ,

COMMITTEE REPORTS
Highway a Wilbur reported that the damaged shovel is covered by
insurance , but damaged more severely than first thought- ®
trouble getting some of the parts . In the meantime , have
lost the rented stonecrusher . Highway Department is working
o n the Erwin Roads— cleared the brush and trees on Bald
Hill Road and worked on Hill Road . Not an Erwin , they are
working on DePutron Road . There ha-s : been more vandalism
o n the power shovel , therefore thy; Highway Department . .
is in the process of putting a gate across the road going
into the gravel bank out by Bald Hi11 Road . There is a
new man working at the Highway Department making the force . -

W ater District ® Crance reported that Street and Blatchley developers •
will forego extending the water district „ The cost of a
six inch pipe to serve seven homes would be around $ 35 , 000
to X40 , 000 so will drill wells instead .
Insurance - Wright reported that he did not attend the Fire
Commissioners ' meeting , but was attended by Wilbur ,
and, received report that the Commissioners did . take
care of the Volunteer Firemen ' s Compensation Insurance .
Refuse Collection 8 - Disposal ® Crance reported that if Landstrom operates

II will be open on Saturdays from 7 : 30 a . m . until 3 : 00 P . m .
Wilbur reported that the present refuse site is receiving
old cars at the rate of three a week which is creating a
problem in that they are not pushed over the bank but •
left on top . This will make a tremendous a ,ibunt of work
to be done in closing the site and - fill that is needed .

Fire - Wilbur reported he had attended Fire Commissioner ' s meeting ,
with Attorney Williamson in attendance . To the best of
• Wilbur ' s . knowledge , the Fire Commissioners will assume the
compensation insurance bill .

Cemeteries a Dorn reported that Mr . Slights has started mowing the
three cemeteries that have been worked over . Dorn will
recommend a cemetery in the South Danby area to be
refurbished *

P lanning • Board a Chairman John Myers gave the report that he had three
sets of minute sc2 regularly scheduled meetings and
1 special meeting of the Planning Board , mostly
pertaining to trailer parks , but with insufficient
information and since most members of the Planning,
Board are relatively new members , would like to _joi
hold up on these minutes i At the last meeting , Mr
Hill asked if the Planning Board Would hold on any
action that might be taken until more definite
financial arrangements are made . Unfortunately ,
the Planning Board did not feel that they could act
o n what information they had , so did seek the advise
o f Mr . Liguori as the previous Planning Board recomo
mended in their minutes , and then asked the Hill ' s
to reconsider and to resubmit their proposal using

the recommendations of Mn Liguori which tie in
with the Danby Zoning Ordinance . Mr .
Myers does feel that the Planning Board does want
to establish some sort of by -laws where they do
know what their voting procedure will be . For .
their next meeting , they have on the agenda a
. proposal by Street & Blatchley for sate homes
to be built in West Danby . Also Mr . Dobson has
a proposal for developing a trailer park . Mr .
Myers was approached by a printing establishment
who wanted to find land for building . When did
III find the land , lack of water mains resulting in
the fire insurance rate very high . This would be
in Danby proper . Discussion on Conflict of
Interest among Planning Board members . . A member
would have to be disqualified in any. action on
own proposals . .
Resolution to repay - those who have paid taxes in the West Danby
Water District —above the amount which was due the. Town . .
Supervisor Makie reports we have enough money to cover this .
No one has the figures . Crance to work on getting figures . .

IILabarge Letter offering assistance in planning recreation areas for
the Town- Supervisor Makie feels strongly that land should secured
for parks in Danby ( land adjacent to Jennings Pond ) and
an. area suitable in West Danby because if the projection
of the Water District is sop then land will be harder to
get . Suggests getting an outside recommendation .
Wright recommends asking for assistance .
Dorn to take this up with the Danby Planning Board .
Dorn has both copies of Laberge letter . .
Lieberman Letter - Board agreed any action to be taken after road tour -

• Voting Machine Custodians and Election Inspectors m .
Harry Hatfield will be the voting machine custodian in District I .
Carlton Hunt will be the voting machine custodian in District II .
lir, 1 ` election Inspectors serve for a two - year term , therefore those who
were appointed at the June 9 . 1969 Town Board meeting will serve
another year . Town Clerks were not aware of this change so will
. have to call the inspectors to find out if each will continue .
Compagni Lett & -Supervisor Makie received this letter requesting .
payment of balance of the final bill which had
been authorized to be paid in full at the December
1969 meeting . Only $ 39000000 was paid0 leaving the
$ 19233 . 14 .
Discussion - Compagniis guarantee runs out May 23 , 19700
There is an oil leak in the cup that oils the pump .
Tank is rusty inside .

in the Jennings Pond License whereby the
Town may charge the vehicular fee and
authorized the supervisor to sign the necesa
sary change sheets for the State Parks

Weeds in the Pond m Discussion on removing the weeds - a. ecannot be
taken care of real effectively unless pond
were to be drained- a - possibly a tractor and
old dump rake or angle iron on pick-up truck.°
Persons who like to use Jennings Pond might
. . take an interest in the weed problem * Use
. of more chlorine may be needed , or also
. muranic acid °
Dorn stated that the Conservation Department
has offered their services4

Parking Fee and Counter to Determine Number of Cars at Pond a
W ilbur stated that this is a decision for
t he Community Council to make and do as they
see fit , as it was dedided the Town could not
afford to put a man at the park for the hours
that would be involved * The youth , if wanting
. to do this at the rush times , should pursue
H this ° Also , if stickers are to be used for
the town people to purchase for 41 000 , do
not let outsiders in free because of no one
on the gateg
Resolved to send a letter to the Community
Council with following contents :
There i. 8 maintenance to be done at the pond
above duties of the caretaker * Some voluntary
help should be used , not only youth but parents
and community council members for work such
as repairing and painting lifeguard chairs *
We cannot run the program for them- ° has to be
generated within their group *
Duties of Policing a Wright reported that our Town Constable
voluntarily polices the area °
Mak ie asked Wright to coordinate this with
the Community Council and Constable to see
if this is adequate °
The community' youth program contains the youth budget and
Makie reported receiving it as approved for state aid * it spells
oxt what is budgeted and therefore to what extent money can be
pent - - over this will have to be by fund- raising *
Clerk does not have a copy of youth program which tells the
agreement before the community council and. the town *
Supervisor reported receiving 4760400 for the 1968 Youth
Program and has entered this under Cither Income *

Taxes the Churches c Supervisor Makie reported he will write to the
Attorney to see if we collect the advalorem
taxes on churches in the West Danby Water Distr at .
Discussion - Question made by representatives . _we can but
. do we have to collect ? It has to be taxed ..
Wilbur stated parsonages in the town have been
taxed a fire tax but not the churches . Also
there is an advaiorem tax on the fire house in
West Danby and also a $ 300 . 00 per year hydrant
charge and the whole town is paying this which
is not right ! Also Dowers the insurance rate
for the people in the District -- they are getting
an - advantage from what all the tax . ayers in
the town are paying . What has to be found out
do we have to charge them- - if there is a way
that we do not have to ChargeWilbur feels .
to go to West Danby and have a public hearing
to see what the opinion is of the entire
district , •
If the tax is levied and riot collected . then
we are short . In this case , this is an
additional tax -cis not on the present tax rolls .
Representatives from the churches stated about
20 families use the church in question . It is
' the. hope that the Water Commissioners recommend
to the Town Board , and to rewrite the water rates .
If the water rate was high enough , there world .

basis .

Other Business - Crance asked about the referendum for old fire house .
Makie answered the Fire Commissioners want the
Town Board referendum to be et the same time .
. Crance said the information received that Williamson
attorney for Fire Commissioners is drawing up one
right awayo
. kie said if they give us a date , then our lawyer
can also draw one up - - were obligated to coordinate
with them .
Wilbur reported that he had asked Williamson to keep
in contact with the town attorney Thaler .
Resolved to have a meeting just with Town . Board and
Fire . Commissioners again .
