HomeMy WebLinkAbout1970-02-16 1 TOWN OF DANBY TOWN BOARD MINUTES February 16 , 1970 • The regular meeting of the Town Board of the Town of Danby was held at the Danby Town Hall , Monday , February 16 , 1970 . Board Members Present : Supervisor Donald C . Makie Councilman Ralph Wilbur Councilman Gerald Crance Justice A . Francis Wright Justice Floyd Dorn Others Present : Roy Casteriine , Dick Blatchley , Don Street , Insurance Agent Bill Scott , Journal Reporter Fred Yahn and Dave Povey . Supervisor Makie called the meeting to order . Minutes of the meetings of January 9th with the Water Commissioners and Audit Meeting following , and the regular meeting of January 12th with the balance of the audit meeting were approved as submitted . COMMUNICATIONS There were no Planning Board Minutes . 1 . From the Tompking County Health Department re : Refuse Disposal Sites 2 . From City School District Transportation Department re : condition of lower end of Deputron Road . 3 . From Tompkins County Civil Defense re : Natural Disaster Conference February 25; 1970 4 . From Mrs: Emily Wiggins re : request light at Comfort Road . 5 . From N :Y . S . Department of Health re : chemical examination of est Danby Water Supply . PRIVILEGE OF FLOOR From the Board : Supervisor Makie praised Donald Burdick as a person always giving his assistance when something needs to to be done and willing to do . Justice Wright asked the discussion of insurance be placed on the agenda as there is an outstanding bill from 1969 . Also . the agreement with Finger Lakes Parks Commission which is near expiration regarding Jennings Pond . Thirdly , the rescinding of a motion made by Wright at the last meeting regarding putting up for bid the sale of the town snowblower . From Councilman Crance ->to put on the agenda under new businesss list of property owners in the Water District Councilman Wilbur asked that Deputron Road be put under . new business as a solution has been worked out . Also what are we going to do about a Town Attorney ? Makie said we do not have to have one to which Wilbur j replied that the need may be urgent at some time . Wilbur added that the bill for the new truck motor needs some negotiating . Question asked about chairmanship of planning board , and what transpired to cause a change . Mr . Maki attempted to clarify the situation . Joint meeting ended P lanning board called to order E dward and Clifford Hill plans and regulations for proposed trailer park on South Danby were submitted . After lengthy and detailed discussion the suggestion was made that the Hills revise their plans to include their entire project in the Planned Development District including all phases of development , rather than just the first 24 sites . Rick Dobson requested the board consider land he owns on Brown Road for development of a trailer park under a planned development district . The board requested he provide pertinent information relative articles of t he zoning ordinance . Map provided by Street and Blatchlay to the Town Board for proposal was tabled because of insufficient information . Meeting was adjourned at 11 : 15 PM Ikk (:))C I Ali • d Town Board Minutes - February 16 , 1970 Sheet #2 From the Public - Street and Blafchley will comment under West Danby Water District . COMMITTEE REPORTS Highway - Councilman Wilbur a new town highway employee making a five - man crew , Deputron Road and truck motor to be discussed under New Business . All snow plows are going again . Wilbur asked if we ever had a contract with the state or county highway department about what roads we plow and why . Question which arises is the portion of state highway which is in the Town of Ithaca . During the last big snow storm there were more problems with the people in the Town of Ithaca with the state highway than with the people in the Town of Danby and the state road . Wilbur feels that the Town of Danby taxpayers paying for this equipment should have the services from it . The answer Wilbur has received is that the Town of Ithaca does not plow any state highways . Roy Casterline , an employee of the Town of Ithaca , replied that the state does plow Route 392 in Forest Home Drive . Wilbur understands that there is a difference in what the county gets paid and what the county gives the town . It was resolved to have a meeting with the county . West Danby Water District - Councilman Crance stated going over the assessed property of the water district under New Business . Insurance - Wright reported a 1969 insurance bill from. Ithaca Agency totalling $ 3 , 556 . 00 and reviewing this with Bill Scott , find that $ 849. 00 is Workmen ' s Compensation and $1 , 095 . 00 is the Firemen ' s Compensation ( Volunteer Firemen Benefit ) and bill was presented sometime last summer but not followed through . Bill Scott understood during the year from time to time thought was being approved but checksmece=lved were for other small items and it was late in the year before became obvious that this bill had not been presented before the board and was sent on the 11th of December but too late for the last regular meeting--apologized for any negilgence on his part on not following up each month to see that it was taken care of and knows it will not happen again--terms are not as generous anymore . HA Supervisor Makie stated he does not have last year ' s bills to check that this has not been paid nor can takeaction in committee reports , therefore cannot pay this until proven not paid . Refuse , Collection &:;:,Disposal - Crance reported , there is nothing-- been busy on water district business , Youth - Wright reported Jennings Pond License renewal on the agenda . Zoning & Planning - Dorn reported a meeting that was scheduled was cancelled . Makie has noted that the _Planning Board would like the Town Board to be thinking what / : they would like to have them do . 1. , . , a Town Board Minutes - February 16 , 1970 Sheet # 3 Fire - Councilman Wilbur stated that he had expected Clyde Carrier , Chairman of the Fire Commissioners to be present . Supervisor Makie reported receiving notices of interest received amounting to about $130 . 00 in two different accounts for the Danby Fire District made out to the Tmasxrer and does not know ;whether the supervisor should receive this money and pass back to the Fire District or even if they are allowed to invest savings accounts . Wilbur reported being aware of one but not two starting back in Leslie Stator ' s era-- saving $ 500 . 00 a year for a time when equipment had to be bought . As the administration changed and looking into this in Wilbur ' s era , it was not feasible business as actually taxing taxpayers , putting it in a savings account. , plus which in order to spring this money from an account you have to have a referendum to be done so it could not be used for emergencies therefore was ceased: Remembers one to be about $ 1 , 500 . 00 but has no idea about other account' Wilbur suggested sending these with Roy Casterline to get an =explanation from the Fire Commissioners on their meeting February 17 . Supervisor Makie commented on old firehouse -=The: Fire District makes a budget; then . lives within the budget like " we " do-- unless it goes out and raises/ funds . They don ' t come out with another tax -have set their budget --revenues and expenditures for the year The town could not budget to buy anything unless we made a tax anticipation note which we have certain limitations by lavC: Secondly ; this is town property anyway -- it belongs to the taxpayers: If we were to purchase this building at a price of more than a dollar; we would pay corresponding fees which would be a senseless waste of taxpayers ' money . If there is some endeavor that the Fire Commissioners have in mind that they need to raise money for;` they should do it through their normal channels . As they have already presented their budget and have the money raised in the amount of over $23, 000 . 00 , it cannot be imagined why they would need any sumrof thousands of dollars-= especially when costing a percentage to the taxpayers . Makie will not be quiet about this=. Wilbur stated that legally the Fire Commissioners cannot turn this building over to the Town of Danby for $1 . 004 The Fire Commissioners have to sell this to whoever it might be for fair , reasonable- - market value -- ' the same as when the town sells the lot the new fire house_ is on the town cannot give them the lot--has to be fair market valueko Makie says the town is not interested then . Also there has to be a referendum. Cemeteries - Justice reported quiet I ... 0 OLD BUSINESS Highway Superintendent ' s Report - Chaffee absent , Planning Board - no report , have no chairman . Appeals Board - Chairman Webber absent . Procedure for dcstruwt-"ion ofAToWn Records - Makie quoted Town Law that a section on estimates which must be prepared for budgetary purposes filed with the Town Clerk , they must be kept on file for six years . Then, with authorization from the Town Board . Clerk does get each year I Town Board Minutes - February 16 , 1970 Sheet # Disposition of Records sheets telling the many town documents and the number of years to be kept -- some indefinitely . Then Town Board makes a resolution wishing to destroy these records and send this on to the Commissioner of Education in Albany • for their authorization . . Liability Insurance for Town Officials residences used for Town Business - justice Wright to report on this at next board meeting . NEW BUSINESS West Danby Water District - Blatchley & Street request :-for water . ,Councilman Crance introduced Blatchley and Street stating he has a blueprint of their lots in West Danby and that the quantity of homes which can be built depends on whether or not they can have water extended . Discussion of going from three inch line back to sir. The sixainchdi•ne . terminates ' at. the - Baptist . Cemetery changing to three inch line to the Sinn residence . By changing to six inch line would give the necessary fire protection for a number of houses . Wilbur stated that eventually the three inch line would have to be changed back to the cemetery if the quantity of homes did progress: About a thousand feet of .line . . is involved . Makie asked if the drilled wells for the two homes . that are there would be disconnected and put on the water system . Street could not say as the houses are already sold . So , could extend the district and receive - no more income or demands for service for 10 , 20 or 50 houses . There is no estimate what :cast: ,:tighfle . Same tax structure would have to be maintained meaning rest of district would have to pay for it immediately--this to come out in a public hearing; Makie has worked out preliminary details of possibly getting a substantial reduction in the ad valorem tax but not at liberty to divulge the details . Blatchley asked about possibility of town financing installation and then Blatchley and Street pay back at the rate of * 500 . 00 a year for ten years: Town is not allowed to engage in installment contracts; . ` Makie answered= and would be faced with same problem of not being able to secure funds , asking them to underwrite our loan . Wilbur wondered about classifying this as a special water district ( separate) and through taxes were taxed . Reference should be made to the Planning Board with respect to the establishment of a subdivision . A plot plan should be approved . Blatchley has gone to the state asking for an old state highway, which . has been abandoned for them to acquire but will have to come to town as it goes from state to town and back to developers . Makie outlined they must have preliminary plans with application to the Town Board who will refer this to the Planning Board . The Planning Board will approve , approve with modification or disapprove and report the decision to the Town Boards: Town Board will then have a public hearing and after that the Town Board will approve or disapprove . Councilman Wilbur made the motion that Supervisor Makie contact the engineer for figures of cost in extending the . Water . Dtstrict . .- with - the: understanding that he wil°1 ' be working for .Blate:hlek4and Street and any expenses incurred will accrue to them`: Seconded by Dorn. 5 ayes , 0 noes , carried . C 4 I ( Town Board Minutes - February 16 , 1970 Sheet # 5 West Danby Water District - Correction of Assessment Roll . Crance gave each board member a copy of the new assessment roll; asking to note property # 24-1-1 belonging to Edward Ashley who is assessed for the full valuation but actually has about ten acres within the district . From the original list prepared by the assessor and filed with the clerk there are ten rcels deleted and fifteen additions , making the total from 8490 ; 000 to $ 596 , 200 . This includes Ashley ' s . Makie figures Ashley ' s ten acres in the district is valued at 8200: 00: Crance recommends that this be taken off . Clerk questioned Crance as to where he got the column of full =value figures and he answered from the assessment roll in the county ; May 1969: These figures are wrong in some casest having sent out the tax bills and being familiar with ones that had their assessment raised or were paying taxes on an exemption which does not apply to special districts. Also one taxpayer was on list once but owns a second parcel. This resulted in going after the Clerk ' s assessment roll and going over each property in the Water District to correct the list which Crance has prepared . D: Methodist Church 7 , 060 17-1- 58 Vann , Lizzie 3, 320 18-1-16 Williams, Mary T . 4 , 520 26-1-7 Maunula , Hans 15 , 590 Roll Call Vote : Makie - aye Wilbur - aye Crance - aye Wright - aye Dorn - aye 5 ayes , 0 noes , carried c a I Town Board Minutes - February 16 , 1970 Sheet # 6 Crance noted that by adding Huttenents name as it belongs a second time changes the figure of $ 596 , 200 to $ 597 , 280 At this time the assessment roll was checked against the list which Crance had prepare.d: making thirteen changes ( increases) in figures . Supervisor Makie stated what has happened is that in addition to the o nes that have not been taxed , the water district was figured on an incorrect roll, perhaps . The taxpayers paid the water taxes on their full assessment but the amount of money to be raised by taxes was figured on an incorrect roll making a higher tax rate for everybody and " they " just collected the tax rate and we figured out we needed * 8 , 950 . 00--that is what we got and $ 10 , 000 . 00 was collected , possibly . Supervisor Makie will write a letter to Assessment Director Thomas Payne and give the clerk a copy . . Resolution adopted to collect added taxes and corrected tax roll . Now have to pay back money to those properties outside the wa district , but since we do not have any money ., Supervisor Makie tabled this until next meeting . Crance asked - who will determine the amount of refund . Makie presumes using the tax and multiply out or ask Mr . Payne to submit the list of figures , then Supervisor will write out the checks from this special fund . At next meeting remove the people from the tax roll by resolution-- should have name ; property number and amount . Membership of Planning Board and Appeals Board Supervisor Makie stated that each member has a copy of the members of the Planning Board and Appeals Board and both boards are complete`. Board unanimously agreed to meet with the Planning Board at their next meeting to discuss the relationship between the Town Board and Planning Board . Makie will take the initiative o f calling the two boards but need for appointing a chairman at this time andahen work with him . Appointment of Planning Board Chairman Justice Wright moved to appoint John Myers as Chairman of the P lanning Board`« Seconded by Dorn . 5 ayes , 0 noes , carried . There is still a question on items of insurance listed . Bill Scott had already left . A meeting will have to be held with Bill Scott after Annual Resort an . ; . o . s = ve seen rece ve • rom former upery sor or ri h Wilbur emphatically questions the compensation insurance of $ 1 , 095 . 00 for firemen . It should be a-• Fire District budgetary item . We should have a list from our insurance agent of what insurance the = Town has . This is a 1969 insurance bill and have 1970 bill due now Town Board Minutes e_ February 16 , 1970 Sheet # 7 The 1970 insurance bill is $ 7 , 500 . 00 and 0 , 200 . 00 in the budget , and in the contingency fund there is $ 3 , 300 . 00 . Makie noted that the Board could withdraw the - resolution adopted at the January 1970 meeting transferring . monies to a contingency fund and a capital reserve fund-to the insurance budget . Another option is to take all the money out of the contingency fund which is $3 , 300 . 00 and the money has been received for the 1968 Youth Program amounting to $ 760 . 00--these could be put in the insurance fund or in a contingency fund and transfer`. W ilbur wants to see a complete run down showing exactly what there is for insurance ; what each costs , what is paid and what is owed'. Makie left this up to Wright to contact him to get together to prepare a debate --either give Wright the material to talk with S cott --or have a meeting=;` hopefully before the March meeting; Jennings Pond License Renewal Justice Wright has talked with Mr . Donald Ryan of the Finger Lakes Park Commission who suggested that each Board member take the time to go through the license which has been in effect . ( Each board member has a copy of the license ino-luding the chairman of the Community Council ) Mr . Ryan told Wright there is no problem on renewing it and his verbal discussion to him was an indication o f our intent: Should write them a letter asking for a renewal of the license along with any revisions that might come up . Wright noted on Page 3 #13 should be cognizant of stating " that the town ahall be solely responsible and answerable in damages for any and all accidents or injuries to person or propertvi including death ) and hereby covenants and agrees to hold harmless the Commission , the S tate of New York and their agents and employees from all claims , actions ; damages and costs of every nature and description arising out of or in any way connected with said use and occupation of the licensed premises: " In questioning " licensed premises ", Wilbur noted that . elsewherelin the contract reference is made to the red lines o n the map: ( This map - is attached to the license filed in Clerk ' s office ) . Wright noted the expense of the insurance is the only cost o f this part of the youth program. Wilbur questioned the po..ssibil.it.y,. of the State Park Commission assuming all the caretaker expense . Wright moved that the Clerk write Mr . Ryan , tRegaional Park Manager, for a renewal of the Jennings Pond License for the use of Danby Youth requesting that caretaker services be resumed by the Parks Commission:` We will continue to provide lifeguard services and supervise all swimming activities or any other supervised activities instigated by the Danby Community Council. Request is made particularly in view of the fact that this park is avaiible to any and all peoplef Seconded by Dorn. 5 ayes , 0 noes , carried. Purchase of old Fire Hall - already discussed . Delinquent Dog List m Clerk not able to file as the list of dog owners not completed by the dog enumerator . Wright reported for a matter of rcord , the Board did appoint a dog enumerator but when he planned to do this work the weather was too bad; also changed jobs and thirdly; is down with pneumonia; ( Consequently? the enumerating is not done . It is noted that he is I doing the job`; but it is not completed . F Town Board Minutes • February 16; 1970 Sheet # 8 Dog List - continued Clerk reported that Albany has been notified of this delay as the delinquent dog list had to be filed with them on the 10th of February'. Supervisor Makie will contact Mr . Nelson : What the Planning Board should do - Due to the late hour , table this discussion until next month . Inventory for the Water District - Crance has one but not with him . Erwin Prolect completion dates and also will we apply for partial aid ? . Wilbur thinks this is the only way to do and was only found out last fall that could be done this way . Probably can have a mile soon Chaffee is behind on the Erwin roads . All this year has been spent finishing up the year before committments . Fishersettlement Road--the rough dirt work is done on the whole stretch and is less than half gravelled . Absolutely nothing done on the piece of Hill Road other than brush cut . Projecting these road projects is good because when we. • run out of the Erwin Aid in 1972 , we will have these in and still be able to collect the aid: Wilbur advised}: Makie asked if Wilbur could obtain a date from Chaffee as to when he might get partial aid and completion dates for financial planning: Makie will be finding out what will happen if we invest the money and have to draw back out ::<pr.ematurely . Community Council request - The Community Council asked Makie if the Youth Committee Chairman Crance and Makie would meet with the Community Council to explain the relationship of the Town Board and their feelings about the Council . Invitation extended to rest of Board which meets February 18th . Makie advised Crance of the needs of the West Danby people he could promote to the Council by his attendance . Makie feels the town board ' s feeling is one of financial support; as we see fit''. Wilbur added, financial support on a limited basis plus approval of their projects;` Budget Modification • Makie noted on sheets of paper attached to the Super^ isor;t s Reports , . the cash balances shows "red " in Item IV. Money has been received from tax collecting and also reimbursement from snowplowing from the county RESOLUTION #6 BUDGET MODIFICATION of ITEM IV HIGHWAY FUN D Wright moved to make a budget modification in Item IV of the Highway Fund to the extent of the difference in the snowplowing check which is $$ 3;,647; 29 raising this Item to $ 9 , 647. 29 . Considering our average i. payrolls; our expenses for machinery repairs , our expenses for notes that we owe , Makie feels that we could invest $ 7 , 000 . 00 - 0 Town Board Minutes - Bebruary 16 , 1970 Sheet #9 Investment of Town Funds - continued to be returned on June 1st and $ 15 , 000 . 00 to be returned on July 1st , $10 , 000 . 00 to be returned August 1st , and $ 10 , 000 . 00 I/ to be returned September 1st , 1970 assuming that Makie will receive soon about $22 , 000 . 00 in taxes that have not been all collected . Makie says it is his responsibility to invest . idle town funds --figures on the $ 7 , 000 . for three months would get in excess of $ 87 . 00 , on $ 15 , 000 . - $ 240 . + , $ 10 , 000 . - $ 208 . + and the last $10 , 000 . - $ 250 . 00 and this does not take into account receipt of any funds from Erwin Projects . From the General Fund , had figured on $ 10 , 000 . being invested but now with the advent of the insurance bill does not think Possibly $ 6 , 000 . 009 might be safe to invest . From the Water District Makie believes he could invest $ 7 , 000 . for six , eight or nine months and earn between $ 150 . and $ 155 . Possibly might make this in five $ 2 , 000 . 00 notes in the event that:. tae needed money , could take the $ 2 , 000 . out . Attorney advised that could not refinance because of the cost of holding .all . of the public . hearingOowever does feel we can possibly postpone the principal payment with FHA . If this is agreeable with the Board , Makie can go ahead without a formal authorization and does have an appointment for tomorrow after- noon to discuss this . Deputron Road - The bridge has been a. problem on the. Deputron Road making plowing impossible . Mr . Buchanan has requested the Candor School District to send a bus on this road to pick up the children resulting in the finding that he is paying Ithaca City School taxes and children being educated in Candor . Ithaca is running a station wagon on this road presently , but anticipating school buses going on this road , will have to put the tile in and do some work on the road . Wilbur }ass talked with Chaffee who has agreed this will be done . Application for Erwin Project is possible . . . now that there is a mail route and bus route . Should be ready for school next fall . Wilbur to contact Chaffee to apply for Erwin Project . Truck Motor - Wilbur reported the bill for truck motor is in for Board ' s audit but do not want the check released until approval from Chaffee . Cowpany has agresito make some settlement involving some credit plus some carburetor trouble which they have agreed to rebuild and send another . Civil Defense Meeting - Wright said maybe . Rescind motion for bidon ' Snowblower - Wright commented that day follow- last meeting when the motion was made to put the - snowblower up for competitive bidding , a local person who wanted to buy it offered Chaffee $ 700: 00 for it which was more than he expected to get for it . Upon Calling Wright , he was agreeable in selling to John Benjamin . Wright made the motion to rescind the motion which was passed at the last Town Board Meeting putting the snowblower up for bid . Seconded by Dorn-. 5 ayes , 0 noes , carried . 4, a IT) IITown Board Minutes - February 16 , 1970 Sheet # 10 Wilbur advised that the town does not repeat this practice again , if anything is sold, must have competitive bidding . Town Attorney - table until March meeting . Hydrants in Water District ( possible damage to ) - Councilman Wilbur advised that there are 2 fire hydrants - not sure the location of the third - that are located in the highway right -of-way , also water lines laid in the highway right -of- way . We should have a letter to the Water Commissioners and one on file, which should include all town board names , that the Town Highway Department or the Town accepts no responsibility for damage done to any of this property that is town right -of-way . Both fire hydrants are a prime suspect for a snowplow . Markers on them could be accidently removed . This can be done to the extent that the water district could be forced to carry some insurance: The two known locations are on corner of Brown Road and on the state road. Crane felt the one on Brown Road might be a hazardous location but the one on the state road is set back on a bank and the third is located by the old cemetery . Wilbur continued that on Hillview Road , the water line is laid in the road which is hazardous if digging a sluice pipe This is a matter of insurance and should be brought up with our insurance agent . Bills= General Fund Bills - Wright moved to pay General Fund Bills # 10 through #22 totalling $ 467 . 70 as listed on Warrant #27. Seconded by Makie . 5 ayes , 0 noes , carried . M . Members of the Fire District present : Clyde Carrier , Kenneth Colburn , Roy Casterline , George Clarkson and Paul Hoover . members of the Town Board present : Donald makie , Francis Wright , Ralph Wilbur and Gerald Crance . Clyde Carrier called the meeting to order at 7 : 46 P . M . and stated the purpose of the meeting was to discuss disposal of the old Danby Fire house . A discussion was held and the following motion was tendered : George Clarkson made a motion ( polling ) we take proper legal procedures to sell the old Danby Fire house to the Danby Town Board for the sum of $ 8000 . 00 and in turn pay the Danby Town Board the sum of $ 3000 . 00 for the old Danby School property . Seconded by Paul Hoover . The following polled votes : Francis Wright Aye Ralph Wilbur Aye Paul Hoover Aye George Clarkson Aye Roy Casterline Aye Kenneth Colburn Aye Gerald Crance Aye Donald makie Nay Clyde Carrier as Chairman did not vote . 7 Aye 1 Nay Carried .
