TOWN BOARD MEETING The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Peter Alteri Jr. Municipal Garage, 3587 Terrace Road, Cortland, New York with Supervisor Williams presiding. Members present: Supervisor, Thomas A. Williams Councilman, Jay E. Cobb Councilman, David J. Donlick Councilman, Jeffrey D. Guido Councilman, Gregory K. Leach Town Clerk, Kristin E. Rocco-Petrella Others present were: Town Attorney, John DelVecchio; Highway Sup’t. Larry Drach; Recreation Director, John McNerney; Deputy Town Clerk, Abigail Albro; News Reporter: Jacob Mack from the Cortland Standard. Others joining via Zoom video/telephone conference: Assistant to the Supervisor, Amanda Rainbow; and News Reporter, Eddie Velasquez from the Cortland Voice. Supervisor Williams called the Regular Meeting to order. Councilman Cobb made a motion, seconded by Councilman Donlick, to approve the Town Board Minutes of December 21, 2022 and December 28, 2022. All voting aye, the motion was carried. Supervisor Williams apprised the Board there were eight purchase orders submitted by Recreation Director McNerney for approval. All purchase orders were for accessory equipment for the Gutchess Lumber Sports Complex and were submitted to the Board previou sly for review. He explained that Recreation Director McNerney will be coming back to the Board in the future for two more items including the fence topper. RESOLUTION #37 AUTHORIZE SUPERVISOR TO SIGN PURCHASE ORDER #0204 TO STURDI STEEL FOR THE PURCHASE OF FOUR (4) FIVE-ROW SPECTATOR BLEACHERS FOR THE GUTCHESS LUMBER SPORTS COMPLEX – PHASE 2, IN AN AMOUNT NOT TO EXCEED $36,065.00 Motion by Councilman Guido Seconded by Councilman Donlick VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the Town Board does hereby authorize and direct the Supervisor to sign Purchase Order #0204, as submitted by Recreation Director McNerney, to be paid to Sturdi Steel for the purchase of four (4) five-row spectator bleachers for the Gutchess Lumber Sports Complex – Phase 2, in an amount not to exceed $36,065.00. Councilman Leach made a motion, seconded by Councilman Guido, to receive and file the following monthly and annual reports: 1. Town Clerk – December 2022; 2. Town Justice Mathey and Town Justice DeMarco – December 2022; 3. Cortland Community SPCA – December 2022; and 4. Code Enforcement Officer, Desiree Campbell – December 2022; 5. Code Enforcement Officer, Desiree Campbell – January-December 2022. All voting aye, the motion was carried. RESOLUTION #47 ACCEPT ANNUAL REPORT OF THE TOWN CLERK Motion by Councilman Cobb Seconded by Councilman Leach VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the Annual Report of the Town Clerk, as submitted by Town Clerk, Kristin E. Rocco-Petrella, RMC for the year 2022 is hereby accepted, and shall be received and filed. Under new business, Town Clerk Rocco-Petrella informed the Board that her office would be open for the purpose of tax collection on Saturday, January 28, 2023 from 9:00 a.m. to 12:00 p.m. Attorney DelVecchio reported: Proposed Local Law of 2023: Attorney DelVecchio mentioned that he provided the Board with a proposed local law to amend the zoning ordinance with regard to multi-family dwellings consisting of four or more units. He explained that the Town Code specifies that there must be two emergency means of egress/ingress for multi-family dwellings consisting of more than four units. The proposed local law would provide that two emergency means of ingress/egress would not be required as long as JANUARY 18, 2023 TOWN BOARD MEETING PAGE 5 the exception is clearly delineated in the NYS Fire Code, and that the Town Code Enforcement Office and Cortlandville Fire Commissioner approves of it. Attorney DelVecchio asked the Board to acknowledge receipt of the local law and to forward it to the Town and County Planning Boards for review. He also suggested that a public hearing could be scheduled for February 1, 2023. RESOLUTION #48 ACKNOWLEDGE RECEIPT OF A PROPOSED LOCAL LAW OF 2023, TITLED “A LOCAL LAW AMENDING THE TOWN OF CORTLANDVILLE’S CHAPTER 178-76 ZONING CONDITIONAL PERMIT ADDITIONAL SPECIFIC REQUIREMENTS”; FORWARD IT TO THE TOWN AND COUNTY PLANNING BOARDS FOR REVIEW AND RECOMMENDATIONS; AND SCHEDULE A PUBLIC HEARING FOR FEBRUARY 1, 2023 AT 5:00 P.M. Motion by Councilman Cobb Seconded by Councilman Leach VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the Town Board does hereby acknowledge receipt of a proposed Local Law of 2023, titled ““A Local Law Amending the Town of Cortlandville’s Chapter 178-76 Zoning Conditional Permit Additional Specific Requirements” as prepared by the Town Attorney, and it is further RESOLVED, the proposed Local Law shall be forwarded to the Town and County Planning Boards for their review and recommendations, and it is further RESOLVED, a public hearing shall be scheduled for February 1, 2023 at 5:00 p.m., or as soon thereafter as the parties may be heard, at the Raymond G. Thorpe Municipal Building, 3577 Terrace Road, Cortland, New York, concerning the proposed Local Law of 2023. Councilman Leach made a motion, seconded by Councilman Guido, to receive and file the following letters regarding the audit of Town Department records for the year 2022 as required: - Letter from Councilman Cobb, dated January 17, 2023, regarding the audit of Town Highway Department and Town Water/Sewer Department records; - Letter from Councilman Guido, dated January 17, 2023, regarding the audit of Town Justice records; - Letter from Councilman Leach, dated January 17, 2023, regarding the audit of Town Clerk/Collector records; - Letter from Councilman Donlick, dated January 17, 2023, regarding the audit of Town Supervisor records. All voting aye, the motion was carried. Supervisor Williams reported: Little Libraries for the Town of Cortlandville: Supervisor Williams informed the Board he requested Highway Department employee and carpenter extraordinaire, Fred Walker to build two “little libraries” to be installed at Town Hall and the Highway Department. He pointed out the beautifully constructed libraries, which have separate sections for adult books versus children’s books. Town employees were tasked with submitting a design for how to decorate the libraries. Gutchess Lumber Sports Complex: Supervisor Williams apprised the Board that Recreation Director McNerney and a local representative from PBR have walked the new turf fields. The issues that existed prior to the snowfall have been resolved. With the exception of some punch list items left to complete, the turf installation was complete. JANUARY 18, 2023 TOWN BOARD MEETING PAGE 6 Proposed Key Fob System for Town Hall: Supervisor Williams informed the Board that the Cortlandville Fire Department (CVFD) is upgrading its electronic key system for their buildings; installing such a mechanism at the Town Hall has been a topic of discussion in the past. Supervisor Williams would be meeting with the same company being contracted by the CVFD to get more information on the possibility of installing a similar system at the Town Hall, and perhaps other municipal buildings. Executive Session: Supervisor Williams mentioned that an Executive Session was needed at the end of the Regular Meeting to discuss personnel and contracts. At this time in the meeting, the Board proceeded with new business items. RESOLUTION #49 ACKNOWLEDGE SUBMISSION OF THE ANNUAL PERFORMANCE REPORT OF ALL HOUSING ACTIVITIES FOR THE TOWN’S 2021 COMMUNITY DEVELOPMENT BLOCK GRANT TOWN-WIDE HOUSING REHABILITATION PROGRAM (CDBG #287HR317-21) Motion by Councilman Leach Seconded by Councilman Donlick VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the Town Board does hereby acknowledge submission of the Annual Performance Report of All Housing Activities for the Town’s 2021 Community Development Block Grant Town-Wide Housing Rehabilitation Program (CDBG #287HR317-21). RESOLUTION #52 REAPPOINT JOHN F. FINN AS CHAIRPERSON TO THE CORTLANDVILLE ZONING BOARD OF APPEALS Motion by Councilman Leach Seconded by Councilman Guido VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the Town Board does hereby reappoint John Finn of 618 Groton Road, Cortland, New York, as Chairperson to the Cortlandville Zoning Board of Appeals for a one-year term effective January 1, 2023 until December 31, 2023. There was a brief discussion regarding a proposed Local Law of 2023 presented by Attorney DelVecchio to amend the Town of Cortlandville’s Chapter 86 Fire Prevention and Building Code Administration. Attorney DelVecchio explained that the proposed local law would allow the Town to update the local code to align with New York State Code; it allows for any updates made by the State to be incorporated into the Town Code. If the Town Code is more restrictive, it would allow the Town to enforce the Town Code. The proposed local law would give the authority forever unless the Board changes the local law in the future. RESOLUTION #53 ACKNOWLEDGE RECEIPT OF A PROPOSED LOCAL LAW OF 2023, TITLED “A LOCAL LAW AMENDING THE TOWN OF CORTLANDVILLE’S CHAPTER 86 FIRE PREVENTION AND BUILDING CODE ADMINISTRATION”; FORWARD IT TO THE TOWN AND COUNTY PLANNING BOARDS FOR REVIEW AND RECOMMENDATIONS; AND SCHEDULE A PUBLIC HEARING FOR FEBRUARY 1, 2023 AT 5:00 P.M. RESOLUTION #55 AUTHORIZE TOWN EMPLOYEES TO ATTEND THE CORTLAND COUNTY SOIL AND WATER CONSERVATION DISTRICT TRAINING CLASS TO BE HELD ON FEBRUARY 23, 2023 Motion by Councilman Leach Seconded by Councilman Guido VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the Town Board does hereby authorize Town employees to attend the Cortland County Soil and Water Conservation District Training Class to be held on February 23, 2023 from 8:30 a.m. to 12:30 p.m. at the Grange Building, Cortland, New York, and it is further RESOLVED, correspondence from the Cortland County Soil and Water Conservation District, received January 9, 2023, is hereby received and filed. RESOLUTION #56 ACCEPT AUDIT REPORT OF THE FISCAL AFFAIRS OF THE TOWN OF CORTLANDVILLE FROM INSERO & CO. CPA’S, LLP FOR THE PERIOD ENDING DECEMBER 31, 2021 Motion by Councilman Leach Seconded by Councilman Donlick VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the Audit Report of the fiscal affairs of the Town of Cortlandville from Insero & Co. CPA’s, LLP for the period ending December 31, 2021 for the Town of Cortlandville is hereby accepted and shall be received and filed. Councilman Donlick made a motion, seconded by Councilman Leach, to receive and file correspondence from the Cortland County Legislature, dated January 5, 2023, regarding a public hearing to be held on January 19, 2023 at 4:00 p.m. the Cortland County Office Building, 60 Central Ave., Cortland, NY, regarding the Cortland County Landfill and Landfill policies. All voting aye, the motion was carried. RESOLUTION #57 ACKNOWLEDGE NOTIFICATION FROM THE STATE FOR FILING OF LOCAL LAW NO. 7 OF 2022 Motion by Councilman Leach Seconded by Councilman Cobb VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the New York State Department of State acknowledged receipt of Local Law No. 7 of 2022, “A Local Law Adopting the Town of Cortlandville’s Private Fire Hydrant Law in the Town of Cortlandville, New York”, to be effective December 22, 2022. RESOLUTION #59 ACKNOWLEDGE THE SUPERVISOR’S REQUEST FOR A 30- DAY EXTENSION FROM THE NYS COMPTROLLER’S OFFICE FOR FILING THE 2022 ANNUAL FINANCIAL REPORT (AUD) Motion by Councilman Cobb Seconded by Councilman Leach VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the Supervisor is hereby authorized to request an additional 30-day extension of time from the NYS Comptroller’s Office for filing the 2022 Annual Financial Report (AUD). RESOLUTION #60 AUTHORIZE THE CORTLAND CITY SCHOOL DISTRICT USE OF THE TOWN MEETING ROOM TO CONDUCT THEIR ANNUAL SCHOOL BOARD ELECTION ON MAY 16, 2023 Motion by Councilman Guido Seconded by Councilman Donlick VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the Town Board does hereby authorize the Cortland City School District use of the Town meeting room in the Raymond G. Thorpe Municipal Building, to conduct their annual Budget Vote and School Board Elections on Tuesday, May 16, 2023 from 11:30 a.m. to 9:30 p.m. With no further comments or discussion to be heard, Supervisor Williams requested the Board convene to an Executive Session to discuss personnel and contracts. Councilman Leach made a motion, seconded by Councilman Guido to recess the Regular Meeting to an Executive Session to discuss personnel and contracts. All voting aye, the motion was carried. All voting aye the motion was carried. The Executive Session was adjourned at 6:35 p.m. RESOLUTION #61 APPROVE EXTRA WORK AUTHORIZATION FROM CHA CONSULTING, INC. TO PROVIDE PROFESSIONAL ENGINEERING SERVICES FOR THE GUTCHESS LUMBER SPORTS COMPLEX PHASE 2, CONCESSION-RESTROOM BUILDING CONSTRUCTION CONTRACT DOCUMENTS Motion by Councilman Guido Seconded by Councilman Donlick VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the Town Board does hereby approve the Extra Work Authorization from CHA Consulting, Inc. (CHA Proposal No. X56314-R2) to provide professional engineering services for the Gutchess Lumber Sports Complex Phase 2, Concession-Restroom Building Construction Contract Documents, for the total cost of $68,700.00, and it is further JANUARY 18, 2023 TOWN BOARD MEETING PAGE 10 RESOLVED, the Supervisor is hereby authorized and directed to sign the Extra Work Authorization for the Concession-Restroom Building Construction Contract Documents. *** Note – Authorization was previously approved by TB Resolution #222 of 2022 (7/20/2022) RESOLUTION #62 AMEND SPONSORSHIP AGREEMENT BETWEEN THE GUTHRIE CLINIC AND THE TOWN OF CORTLANDVILLE TO SPONSOR THE GUTCHESS LUMBER SPORTS COMPLEX AND AUTHORIZE SUPERVISOR TO SIGN THE AMENDED AGREEMENT Motion by Councilman Cobb Seconded by Councilman Leach VOTES: AYE – Williams, Cobb, Donlick, Guido, Leach NAY – 0 ADOPTED BE IT RESOLVED, the Town Board does hereby amend the Sponsorship Agreement between the Guthrie Clinic and The Town of Cortlandville, adopted December 7, 2022 as Resolution #358 of 2022, to sponsor the Gutchess Lumber Sports Complex, and it is further RESOLVED, the amendment to the original agreement is specific to Schedule A, Paragraph 1, “Exclusivity in the Health Field” which shall read: “Excluded in the exclusivity are any services that The Guthrie Clinic does not provide to the Cortland (NY) Community. No other health care sponsor may be recognized as a sponsor unless agreed to in writing by both parties.”, and it is further RESOLVED, the Supervisor is hereby authorized and directed to sign the amended Sponsorship Agreement dated January 10, 2023.
