TOWN BOARD MEETING The Regular Meeting of the Town Board of the Town of Cortlandville was held at the Peter Alteri Jr. Municipal Garage, 3587 Terrace Road, Cortland, New York with Supervisor Williams presiding. Town resident, Pamela Jenkins made the following remarks with regard to the Comprehensive Plan Implementation Committee. Mr. Williams and Town Board members, My name is Pam Jenkins and I am here to ask you to reconsider the need to provide minutes for the Comprehensive Plan Implementation Committee. You provided minutes for that Committee up JANUARY 4, 2023 TOWN BOARD MEETING PAGE 3 through October 24, 2022, but none since. Your Resolution #343 of December 15, 2021 states that you created the CPIC to “accomplish the goals of the Comprehensive Plan adopted December 1, 2021…” You did not create that committee to advise you about what they thought about the Comprehensive Plan, or to design an alternate Comprehensive Plan…you tasked with them with performing a few necessary functions in the decision -making process. This conflicts with the resolution you passed on December 21, 2022 in which you claim that the CPIC is just an advisory committee, with no minutes necessary. I believe that the CPIC falls under under Town Law Section 272-a(2)(c) and OML-AO-3944. The Committee on Open Government wrote to me “If the Committee is a public body under OML, the Town cannot legislate away the requirements of the OML as it applies to the Committee, including the requirement to provide minutes.” So, merely passing a Resolution stating that you do not need to provide minutes does not actually make that requirement to provide minutes go away. So, please rescind the Resolution you passed in December 2022 where you claim that the CPIC is just an advisory committee not requiring minutes to be provided. Please provide the schedule for the upcoming meetings, agendas, and minutes and make a zoom link available so that the public can observe the meetings of the CPIC. This work is too important not to shine a little light on it, and taxpayers have a right to know how and if our Comprehensive Plan will be implemented. Also, regarding I-13, I requested (maybe too late today) a link to the salary schedule and requested that this document, of course, be posted (as all documents to be discussed are to be posted by NYS Law). Thank you, Pam Jenkins Councilman Guido made a motion, seconded by Councilman Cobb, to receive and file the following monthly reports: 1) Supervisor – November 2022; 2) Code Enforcement Officer, Kevin McMahon – December 2022; 3) Water/Sewer Department – December 2022; and 4) Cortland County Treasurer – January 2023. All voting aye, the motion was carried. Under new business Town Clerk Rocco-Petrella informed those in attendance that the 2023 Cortlandville Town/County tax bills and 4th Quarter Water/Sewer bills were mailed on December 30, 2022. Bills are due by January 31, 2023 without penalty. She had no other business to report. Attorney DelVecchio reported: Town Owned Street Light Fixtures: Attorney DelVecchio stated the Town now owns the street light fixtures in the Town and pays quarterly lease payments. He was recently contacted by a representative from National Grid who brought it to his attention that the Town is eligible to receive money back as a result of purchasing the lights. The Town would have to comply with the application process to receive the rebate. Attorney DelVecchio expected to hear back from National Grid within the next two weeks. Town Board reports: Councilman Leach asked for the status regarding the Highland Road speed limit reduction request. Highway Sup’t. Drach reported that the Highway Department conducted a speed limit study on Highland Road; the results showed that above 85% of traffic remained within the speed limit. The speed limit study was previously emailed to the Board for their review. Supervisor Williams and Councilman Leach had a brief discussion about whether a speed limit reduction had to go through the State or of the Town had the authority to reduce the speed limit due to new legislation. Attorney DelVecchio indicated he was looking into the matter. Supervisor Williams suggested after Attorney DelVecchio finishes his review of the new legislation that the Town invite the Highland Road neighborhood to a public meeting for open discission. Councilman Guido informed the Board that the Cortland County Redistricting Committee meeting was cancelled; no meeting would be held in January due to the Committee Members presenting to municipalities in the County. The next meeting would be held in February. JANUARY 4, 2023 TOWN BOARD MEETING PAGE 4 Supervisor Williams reported: Financial Advisor: Supervisor Williams reminded the Board that Richard Tupper has worked for the Town for the last year and a half as a Financial Advisor, both on the budget and as a general Financial Advisor. Last year, Mr. Tupper was paid $2,000 per month for the last six months of the year to help with the budget. Supervisor Williams stated that since Mr. Tupper is now working throughout the year to help with Gutchess Lumber Sports Complex and the budget, he suggested the Board authorize payment of $1,000 per month for the year 2023. RESOLUTION #04 AUTHORIZE HIRING RICHARD C. TUPPER AS A FINANCIAL ADVISOR TO THE TOWN OF CORTLANDVILLE FOR THE YEAR 2023 Motion by Councilman Cobb Seconded by Councilman Guido VOTES: AYE – Williams, Cobb, Guido, Leach NAY – 0 ABSENT – Donlick ADOPTED BE IT RESOLVED, the Town Board does hereby authorize and direct the Supervisor to hire Richard C. Tupper as a Financial Advisor to the Town of Cortlandville, effective January 1, 2023 through December 31, 2023, at a rate of $1,000.00 per month, with an option to renew his services. At this time in the meeting, the Board proceeded with new business items. RESOLUTION #05 AUTHORIZE SUPERVISOR TO SIGN THE AFFIDAVIT REGARDING THE TOWN’S 2021 COMMUNITY DEVELOPMENT BLOCK GRANT TOWN-WIDE HOUSING REHABILITATION PROGRAM (CDBG #287HR317-21) BETWEEN THE TOWN AND RONALD H. COVILLE AND BARBARA COVILLE Motion by Councilman Leach Seconded by Councilman Guido VOTES: AYE – Williams, Cobb, Guido, Leach NAY – 0 ABSENT – Donlick ADOPTED BE IT RESOLVED, the Town Board does hereby authorize the Supervisor to sign the Affidavit regarding the Town’s 2021 Community Development Block Grant (CDBG #287HR317-21) Town- Wide Housing Rehabilitation Program, between the Town of Cortlandville and Ronald H. Coville and Barbara Coville, 242 Sears Road, Cortland, New York regarding the extension of loan funds from the Town’s CDBG Program, for the total amount of $38,368.40. RESOLUTION #06 AUTHORIZE SUPERVISOR TO SIGN THE OWNER- OCCUPIED LOAN AGREEMENT BETWEEN THE TOWN AND RONALD H.
